ELIGIBILITY: This Sweepstakes is open to legal residents of the United States and the District of Columbia who were 21 years of age or older as of 7/31/2017. Employees of Sponsor, Idaho Potato Commissioners, and agencies, agents and employees of the State of Idaho and all other service agencies involved with design, execution or fulfillment of this Contest, and members of the immediate families (defined for these purposes as parents, children, siblings, and spouse) or households (whether related or not) of any of the above are NOT eligible to enter or participate in any manner.
PROMOTION PERIOD: The Promotion begins at 6:00 a.m.. Eastern Time ("ET") on July 31, 2017 and ends at 11:59 p.m. ET on August 4, 2017 (the "Promotion Period").
HOW TO ENTER: During the Promotion Period, go to https://www.facebook.com/famousidahopotatoes (“Facebook page”) and click on the link “Giveaways” to locate the “FAMOUS IDAHO® POTATOES TOTAL ECLIPSE GIVEAWAY.” Follow the on-screen directions, complete all required registration fields and submit to enter. (“Online Entry”). Entrants must complete all required information. LIMIT ONE (1) ENTRY PER PERSON/E-MAIL ADDRESS PER DAY. LIMIT FIVE (5) BONUS ENTRIES PER PERSON/E-MAIL ADDRESS PER DAY.
GRAND PRIZE DRAWING: On 8/7/17 a random drawing will be conducted from among all eligible entries received during the entire Promotion Period.
PRIZES, APPROXIMATE RETAIL VALUE (“ARV”) & ODDS: A total of five (5) prizes will be awarded: A t-shirt, a pair of eclipse glasses and a 15-lb. bag of fresh Idaho® potatoes. Total ARV of prize is $50. No substitution or transfer of prizes is permitted except at Sponsor’s sole discretion. If a prize, or any portion thereof, cannot be awarded for any reason, Sponsor reserves the right to substitute a prize of equal or greater value. All federal, state and local taxes, and all other costs associated with acceptance or use of the prizes, are the sole responsibility of the winner. Arrangements for delivery of prize will be performed after winner validation. Odds of winning any prize depend on the number of entries received. Winners will be notified by email. Unclaimed prize will not be awarded.
GENERAL TERMS & CONDITIONS: The potential Winner will be notified by email and due to the timeliness of the promotion, the potential winner must respond within 24 hours of receipt of notification or prize will be forfeited and an alternate potential winner will be selected on the basis of the criteria stated above. The following documents will be forwarded to the potential Winner via email: An affidavit of eligibility, liability release and publicity release. The return of any prize/prize notification as undeliverable or failure to return any documents in a timely manner may result in disqualification and an alternate winner may be chosen. By participating, participants agree to release, discharge and hold harmless Sponsor from and against any and all liability or damages associated with this Promotion or acceptance, use or misuse of any prize received in this Promotion. Sponsor is not responsible for any typographical or other error in the printing of the offer or administration of the Promotion. Acceptance of prize constitutes permission for the Sponsor and its agencies to use winners’ names and likenesses for purposes of advertising and publicity without further compensation, unless prohibited by law. By participating in this Promotion, participants agree to be bound by the Official Rules and decisions of the Sponsor, which shall be final in all matters relating to the Promotion. In the event of a dispute regarding the identity of the person submitting an entry, entries will be declared made by the person's name submitted at time of entry. Sponsor reserves the right to disqualify any individual who tampers with the Promotion or Website or acts in a disruptive manner. This Promotion is offered only in the United States and is governed by the laws of the State of Idaho. By entering, entrants irrevocably consent to the sole and exclusive jurisdiction of the courts of the State of Idaho located in the county of Ada for any action, suit or proceeding arising out of or relating to this Promotion.
LIMITATIONS OF LIABILITY: In the event of a dispute regarding the identity of an entrant, the corresponding entry will be deemed to be made by the authorized account holder of the email account from which the entry was submitted. Neither Sponsor nor its agencies are responsible for lost, interrupted or unavailable satellite, network, server, Internet Service Provider (ISP), Website or other connections availability, accessibility or traffic congestion, or miscommunications, or failed computer, network, telephone, satellite, or cable hardware, software or lines, or technical failure, or jumbled, scrambled, delayed, or misdirected transmissions, or computer hardware or software malfunctions, failures or difficulties, or other errors of any kind whether human, mechanical, electronic or network, or the incorrect or inaccurate capture of entry or other information or the failure to capture, or loss of, any such information.
Neither Sponsor nor its agencies are responsible for any incorrect or inaccurate information, whether caused by Website users, or by any equipment or programming associated with or utilized in this Contest and assume no responsibility for any error, omission, interruption, deletion, defect, or delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or tampering with or hacking of Website. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds may be tampering with the entry process or operation of this Contest or Website, or may be acting in violation of the terms of the Website, or may be acting in a non-sportsmanlike or disruptive manner, or with intent to threaten, abuse, or harass any other person. Any attempt to deliberately damage any Website or undermine the legitimate operation of this Contest may be unlawful and subject to legal action by Sponsor or its agents.

WAIVER: By participating in this Promotion, participant waives all rights to claim actual punitive, incidental and consequential damages, attorneys’ fees or any other damages from sponsor.
