1. Eligibility: The Ultimate Luxury Spa Giveaway is open only to those who sign up at the giveaway page located at https://woobox.com/rx5y6u and who are 18 as of the date of entry. The giveaway is only open to legal residents of the United States and is void where prohibited by law. Employees of Spavia Day Spa (the “Sponsor”), their respective affiliates, subsidiaries, advertising and promotion agencies, suppliers and their immediate family members and/or those living in the same household of each are not eligible to participate in the giveaway. The Ultimate Luxury Spa Giveaway is subject to all applicable federal, state and local laws and regulations. Void where prohibited.

3. Agreement to Rules: By participating, you agree to be fully unconditionally bound by these Rules, and you represent and warrant that you meet the eligibility requirements set forth herein. In addition, you agree to accept the decisions of Spavia Day Spa, as final and binding as it relates to the content.
4. Giveaway Period: Entries will be accepted online starting on April 7, 2024 and ending May 12, 2024. All online entries must be received by May 12, 2024 11:59PM EST.
5. How to Enter: The Ultimate Luxury Spa Giveaway must be entered by submitting an entry using the online form provided on this site, located at https://woobox.com/rx5y6u. The entry must fulfill all giveaway requirements, as specified, to be eligible to win a prize. Entries that are not complete or do not adhere to the rules or specifications may be disqualified at the sole discretion of Spavia Day Spa. You may enter only once and you must fill in the information requested. You may not enter more times than indicated by using multiple email addresses, identities or devices in an attempt to circumvent the rules. If you use fraudulent methods or otherwise attempt to circumvent the rules your submission may be removed from eligibility at the sole discretion of Spavia Day Spa. All entries must be received by the end dates and times above to be eligible. There is no cost to enter. Entries generated by script, macro or other automated means or practices, or by any means which subvert the entry process will be void. Joint entries are not accepted. By participating in the Giveaway, you are confirming that you have read and agree to comply with these Rules and all other Giveaway requirements. Unfollowing the Spavia Day Spa Instagram and your local Spavia during the Giveaway Entry Period will affect your eligibility in the Giveaway or opportunity to win. Entrants are responsible for having full and ongoing access to their email account. Internet and data charges apply and are the responsibility of the Entrant. In the event you are selected as the Winner, you must be willing to have your name and your nominee’s name and state/province/territory/country published on the Promoter’s Facebook page, Instagram, Twitter or other publication.

Any and all prize related expenses, including without limitation any and all federal, state, and/or local taxes shall be the sole responsibility of the winner. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by winners is permitted. Acceptance of prize constitutes permission for Spavia Day Spa to use winner's name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law.
7. Odds: The odds of winning depend on the number of eligible entries received.
8. Winner selection and notification: Winners of the giveaway will be selected in a random drawing under the supervision of the Sponsor. Winners will be notified via email to the address or phone to the number they provided in the giveaway, within five (5) days following the winner selection. You will be expected to collect the prize from your local Spavia. Therefore, if you live far from the location, you may need to forfeit receipt. Spavia Day Spa shall have no liability for a winner's failure to receive notices due to winners' spam, junk e-mail or other security settings or for winners' provision of incorrect or otherwise non-functioning contact information. If the selected winner cannot be contacted, is ineligible, fails to claim the prize within 72 hours from the time award notification was sent, or fails to timely return a completed and executed declaration and releases as required, prize may be forfeited and an alternate winner selected.
The receipt by winner of the prize offered in this giveaway is conditioned upon compliance with any and all federal and state laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY ANY WINNER (AT SPONSOR'S SOLE DISCRETION) WILL RESULT IN SUCH WINNER'S DISQUALIFICATION AS WINNER OF THE GIVEAWAY AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.

Rights Granted by you: By entering this content you understand that Spavia Day Spa, anyone acting on behalf of Spavia Day Spa, or its respective licensees, successors and assigns will have the right, where permitted by law, without any further notice, review or consent to print, publish, broadcast, distribute, and use, worldwide in any media now known or hereafter in perpetuity and throughout the World, your entry, including, without limitation, the entry and winner's name, portrait, picture, voice, likeness, image or statements about The Ultimate Luxury Spa Giveaway, and biographical information as news, publicity or information and for trade, advertising, public relations and promotional purposes without any further compensation.

Terms: Spavia Day Spa reserves the right, in its sole discretion to cancel, terminate, modify or suspend The Ultimate Luxury Spa Giveaway should (in its sole discretion) a virus, bugs, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the giveaway. In such case, Spavia Day Spa may select the recipients from all eligible entries received prior to and/or after (if appropriate) the action taken by Spavia Day Spa. Spavia Day Spa reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of The Ultimate Luxury Spa Giveaway or website or violates these Terms & Conditions.
Spavia Day Spa has the right, in its sole discretion, to maintain the integrity of The Ultimate Luxury Spa Giveaway, to void entries for any reason, including, but not limited to; multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by giveaway rules; or the use of bots, macros or scripts or other technical means for entering.
Any attempt by an entrant to deliberately damage any web site or undermine the legitimate operation of the giveaway may be a violation of criminal and civil laws and should such an attempt be made, Spavia Day Spa reserves the right to seek damages from any such person to the fullest extent permitted by law.

Limitation of Liability: By entering you agree to release and hold harmless Spavia Day Spa and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such entrant's participation in The Ultimate Luxury Spa Giveaway and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof, (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; (v) electronic or human error which may occur in the administration of the Promotion or the processing of entries.
12. Disputes: THIS GIVEAWAY IS GOVERNED BY THE LAWS OF THE UNITED STATES, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this giveaway, participant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this giveaway, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Colorado having jurisdiction. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys' fees, other than participant's actual out-of-pocket expenses (i.e. costs associated with entering The Ultimate Luxury Spa Giveaway), and participant further waives all rights to have damages multiplied or increased.

14. Indemnification: Each Entrant agrees to: (a) comply with and be bound by these Rules and the decisions of Promoter which are binding and final in all matters relating to this giveaway; (b) defend, indemnify, release and hold harmless Promoter and its respective parent(s), subsidiaries, and affiliated companies, celebrities, and any other person and organization responsible for sponsoring, fulfilling, administering, advertising or promoting The Ultimate Luxury Spa Giveaway, and all of their respective past and present officers, directors, employees, agents and representatives (collectively, the “Released Parties”) from and against any and all claims, expenses, and liability, including but not limited to (i) breach of the representations and warranties hereunder, (ii) negligence and damages of any kind to persons and property arising out of or relating to a participant’s entry, creation of an entry or submission of an entry, participation in the giveaway, acceptance, possession, attendance at, defect in, delivery of, inability to use, use or misuse of prizes (including any travel or activity related thereto) and/or the use of entry information as specified hereunder. Winner acknowledges that all prizes are awarded as-is without warranty of any kind.
15. Photo Usage Agreement
By participating in this promotion, you grant Spavia Day Spa (hereinafter referred to as "the Promoter") the irrevocable right and permission to use photographs and/or video recordings of you on Spavia Day Spa and affiliated entities' marketing platforms, including but not limited to social media channels (Instagram, Facebook, LinkedIn, Twitter), websites, and in public relations efforts. You understand and agree that these materials will become the property of the Promoter and will not be returned. You hereby authorize the Promoter to edit, alter, copy, exhibit, publish, or distribute these photos for any lawful purpose. Moreover, you waive any right to inspect or approve the finished product, including written or electronic copy, wherein your likeness appears. Additionally, you waive any right to royalties or other compensation arising from or related to the use of the photo. You also agree to release and hold harmless the Promoter, its officers, employees, and any third parties involved in the creation or publication of marketing materials, from and against any claims, damages, or liability arising from or related to the use of the photos as described above.
16. Winners List: To obtain a copy of the winner's name or a copy of these Official Rules, mail your request along with a stamped, self-addressed envelope to: Spavia Day Spa 6312 S Fiddlers Green Circle, Suite 140E Greenwood Village CO, 80111. Requests must be received no later than May 31, 2024.
17. Releases: By participating in The Ultimate Luxury Spa Giveaway, you agree to release Promoter, and any other organizations affiliated with the sponsorship, fulfillment, administration, prize support, advertisement or promotion of the giveaway and each of their respective parents, agents, affiliates, subsidiaries, advertising and promotion agencies, and prize suppliers, and each of their respective officers, directors, agents, representatives and employees, as well as each of their respective successors, representatives and assigns (collectively, the “Released Parties”) from any and all actions, claims, injury, loss or damage arising in any manner, in whole or in part, directly or indirectly, from participation in the giveaway and/or acceptance, use or misuse of any prize (or portion thereof).
