OFFICIAL RULES
NO PURCHASE OR ENROLLMENT NECESSARY. The #HeatUpTheHolidays (the “Promotion”) is open to legal residents of the forty-eight (48) contiguous United States and District of Columbia (excluding Washington) who are of legal age of majority in their state of residence (18 (except Alabama and Nebraska residents must be at least 19 and Mississippi must be at least 21)). Employees (and their immediate families: parent, child, spouse or sibling and their respective spouses, regardless of where they reside and those living in their same households, whether or not related) of HomeServe USA Corp. (“Sponsor” or “HomeServe”), and its respective parents, affiliates, and subsidiaries and participating vendors/agencies are not eligible to enter or win. By participating, entrants agree to be bound by these Official Rules and the decisions of Sponsor, which are binding and final on matters relating to this Promotion. Promotion is subject to all applicable federal, state and local laws. Void in Alaska, Hawaii, and where prohibited or restricted by law, rule or regulation.
HOW TO ENTER: The Promotion begins at 3:00pm Eastern Standard Time (“EST”) on December 20, 2021 and ends at 11:59pm EST on January 6, 2022 (“Promotion Period”). During the Promotion Period, there are four ways to enter – one Entry via Facebook, one Entry via Twitter, one Entry via Instagram and one via email. Limit one (1) Entry via Facebook per person, one (1) Entry via Twitter per person, one (1) Entry via Instagram per person and one (1) Entry via email address per person, a total of four (4) Entries (collectively, “Entry” or “Entries”). You may also get Referral Entries as described below.
1. Facebook Entry Method- Visit http://www.facebook.com/homeserveusa (“Facebook Page”) and click on the “Like” tab (if you are not already a fan of HomeServe’s Facebook Page). To enter, find a HomeServe #HeatUpTheHolidays post on the Facebook Page (“Facebook Post”), comment on the Facebook Post and include in your comment the hashtags “#HeatUpTheHolidays” and #SweepsEntry during the Promotion Period.
2. Twitter Entry Method- Visit twitter.com/homeserveusa (“Twitter Page”) and click on the “Follow” tab (if you do not already follow HomeServe’s tweets). To enter, find a HomeServe #HeatUpTheHolidays tweet (“Tweet”) on the Twitter Page, reply to the Tweet during the Promotion Period and include in your reply the hashtags “#HeatUpTheHolidays” and #SweepsEntry.
3. Instagram Entry Method - Visit instagram.com/homeserve_usa (“Instagram Page”) and click on the “Follow” tab (if you do not already follow HomeServe’s Instagram). To enter, find a HomeServe #HeatUpTheHolidays Post (“Instagram Post”) on the Instagram Page, add a comment to the Instagram Post during the Promotion Period and include the hashtags “#HeatUpTheHolidays” and #SweepsEntry.
4. Email Entry Method - Visit https://bit.ly/HeatUpTheHoliday (“Woobox Page”) and enter the Promotion as instructed on-screen.
REFERRAL ENTRIES: Get your unique link (“Unique Link”) when you provide your email address at the Woobox Page. Share your Unique Link with a friend and if that friend enters the Promotion, you get one (1) additional Entries. Limit 3 Referral Entries per person per email address.
LIMITS: There is a limit of 7 total Entries per person for the Promotion Period.
ALL ENTRIES: The Facebook Page, the Twitter Page, the Instagram Page and Blog Site are collectively referred to herein as the “Website.” Entries made via Facebook, Twitter, Instagram, Email and/or through Referrals are collectively referred to as the “Entries.” Entries generated by script, macro or other automated means or by any means which subvert the Entry process are void. Anyone found to use multiple Website accounts to enter the Promotion will be ineligible. All Entries become the property of Sponsor. “Liking” or “following” the HomeServe social media pages are optional, and not required for valid Promotion Entry.
DRAWING/NOTIFICATION/REQUIREMENTS: Potential Winners will be selected in a random drawing held on or about January 10th, 2022 from all eligible Entries received (“Winner”). Odds of winning depend on the number of eligible Entries received. Potential Winner will be notified by direct message via Twitter, Facebook, Instagram or Email (whichever Website the winning Entry was made) and may be required to execute and return an affidavit of eligibility, a liability release and, where lawful, a publicity release within five (5) calendar days of date of issuance. If such documents are not returned within the specified time period or a potential Winner is not in compliance with these rules, Prize will be forfeited and, at Sponsor’s discretion, an alternate Winner may be selected at random from the remaining eligible Entries.
PRIZE: One (1) Grand Prize: • One (1) Brand New Hot Water Heater Replacement, Replacement Services, plus $700 to cover a portion of the taxes to be paid on the Prize (“Prize”). APPROXIMATE RETAIL VALUE OF TOTAL PRIZES: $2700. PRIZE CONDITIONS: The hot water heater replacement can be either gas or electric and will be determined on site by Sponsor. Hot water heater can be up to 50 gallons in size. The hot water heater replacement is subject to certain terms and conditions as specified by the issuer. Prize is awarded “as is” with no warranty or guarantee, either express or implied by Sponsor. Winner may not substitute, assign or transfer a Prize or redeem Prize for cash, but Sponsor reserves the right, at its sole discretion, to substitute a Prize (or portion thereof) with one of comparable or greater value. Winner is responsible for all applicable federal, state and local taxes, if any, as well as any other costs and expenses associated with Prize acceptance and use not specified herein as being provided. All Prize details are at Sponsor’s sole discretion.
Prize exclusions include: Tankless hot water heaters and hot water heaters over 50 gallons.
PRIZE FULFILLMENT:
Once an Entry has been selected and acknowledged as the Winner of The Promotion, Sponsor will reach out to get additional details from the Winner to schedule Prize delivery. Prize must be delivered and accepted by the Winner before February, 28th, 2022.
If there is no HomeServe contractor able to fulfill the Prize, Sponsor will fufill Prize delivery through a local contractor of our choosing. Should a local contractor be unable to fulfill the Prize, Sponsor will award the Winner with a VISA gift card valued at the Prize value of $2700.
GENERAL CONDITIONS: Released Parties (as defined below) are not responsible for lost Entries or direct messages, unavailable network/server/ISP/Website/other connection, miscommunications, failed computer/hardware/software/satellite/telephone/cable, or other errors/difficulties in connection with the Promotion. Released Parties are also not responsible for injury or damage to a computer relating to this Promotion. Persons who tamper with any aspect of the Promotion or Website or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified. Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Promotion should any portion of the Promotion be, in Sponsor’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of Entries, or for any other reason in Sponsor’s sole discretion. If terminated, Sponsor will select the potential Winner via a random drawing from all eligible, non-suspect Entries received prior to action taken or as otherwise deemed fair and appropriate by Sponsor. If there is a dispute as to the identity of an entrant, the Prize will be awarded to the authorized account holder of the email address associated with the Website account holder and s/he must comply with these Official Rules. Entrants agree to resolve disputes related to this Promotion by arbitration or in small claims court, without resort to class action or jury trial. If any provision(s) of these Official Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.
Entrants shall not submit content that is unlawful, defamatory, obscene, infringes of the intellectual property, privacy or publicity rights of other, is offensive, harassing or has the purpose or effect of creating an intimidating or hostile environment, uses obscenity, personal insults or other offensive language, in any way promotes unsafe activities that could lead to an unsafe situation involving the company's consumers or other individuals.
Content in the Entries may not violate any third party's copyrights or trademark rights and the Entry content should not mention or depict any individuals that have not granted express permission to be featured. By submitting an Entry, you, the Entrant, represent and warrant that you have all necessary rights and permissions to submit and post the Entry content.
LIMITATIONS OF LIABILITY: Neither Sponsor, Facebook, Twitter, Instagram nor any of its respective parents, affiliates, subsidiaries or participating vendors/agencies or any of their respective officers, directors, employees, representatives and agents (collectively, “Released Parties”) will have any liability whatsoever for, and shall be held harmless by entrants against, any liability, for any injuries, losses or damages of any kind, to persons, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any Prize or participation in this Promotion.
GRANT OF PUBLICITY: Winner, by acceptance of a Prize, except where legally prohibited, grants permission for Sponsor and its designees to use his/her name, address (city and state), photograph, quotes, voice and/or other likeness and Prize information for Sponsor’s advertising, trade and promotional purposes without further compensation, in all media now known or hereafter discovered, worldwide in perpetuity, without notice or review or approval.
WINNER’S LIST: For the name of the Winner, available after January 13th, 2022 send a self-addressed envelope to: HomeServe USA 601 Merritt 7 Norwalk, CT 06851 ATTN: Social Media Department with your request for the name of the Winner in the HomeServe #HeatUpTheHolidays Sweepstakes, to be received by January 31st, 2022.
ENTRANT INFORMATION: Entrants understand that they are providing their information to Sponsor and not to Facebook, Twitter or Instagram. The information Entrants provide will be collected in accordance with Sponsor’s privacy policy available at https://www.homeserveusa.com/sc/Legal/Privacy-Policy.
