Official Rules

EVEN THOUGH THE PROGRAM IS HOSTED ON A FACEBOOK® PAGE, IT IS IN NO WAY SPONSORED, ENDORSED OR ADMINISTERED BY, OR ASSOCIATED WITH, FACEBOOK. FACEBOOK IS COMPLETELY RELEASED OF ALL LIABILITY BY EACH ENTRANT IN THIS PROGRAM.

1. DESCRIPTION:  NO PURCHASE NECESSARY TO ENTER OR WIN. The 2019 “Jersey Central Power & Light ‘Merry & Bright’ Holiday Lights Sweepstakes" ("Sweepstakes") begins on Monday, December 2, 2019, and will end on or about Friday, December 20, 2019 (“Sweepstakes Period”). Photos may be submitted beginning Monday, December 2, 2019, at 12:01 p.m. Eastern Time ("ET") until Friday, December 20, 2019, at 11:59 a.m. ET ("Submission Period"). Winners will be selected at random on or around December 6, 2019, December 13, 2019, and December 20, 2019.

The administrator and sponsor of this Sweepstakes is Jersey Central Power & Light (“Administrator”). 

2. ELIGIBILITY: This Sweepstakes is open only to legal residents of New Jersey who are physically located and residing therein, who are a current customer of a FirstEnergy operating company, and who are at least eighteen (18) years of age (each an “Entrant” or, collectively, “Entrants”). Administrator, employees, officers and directors of (collectively, the “Sweepstakes Entities”) and each of their respective parent companies, affiliates, divisions, subsidiaries, agents, representatives, promotion and advertising agencies, including but not limited to FirstEnergy Service Company, Jersey Central Power & Light, Ohio Edison Company, Pennsylvania Power Company, The Cleveland Electric Illuminating Company, The Toledo Edison Company, Pennsylvania Electric Company, The Potomac Edison Company, West Penn Power Company, Monongahela Power Company and Metropolitan Edison Company, together with the Immediate Family Members and/or those living in the same household of such persons (collectively, “Household Members”), are NOT eligible to participate in the Sweepstakes. For purposes of the Sweepstakes, “Household Members” shall mean spouses, parents, children, siblings and persons living at the same street address, either full or part time, whether or not they are legally related. Entries will not be acknowledged except as provided herein. Sweepstakes prize is non-transferable and cannot be substituted, sold or bartered. Void where prohibited by law. 

3.  HOW TO ENTER:  During the Submission Period, the Entrant must follow the steps below to receive one (1) entry into the Sweepstakes:

• Entrant must visit www.facebook.com/JCPandL (“Website”) and click on the “Merry & Bright” tab found in the left column of the page. Entrant may also click on the contest link in a Facebook post.
• Entrant must complete the entry form by providing his/her first and last name, mailing address, email address, daytime phone number and date of birth. Entrant must also verify that he or she is a current customer of a FirstEnergy operating company.
• Entrant must submit a photo or video of his or her home’s outdoor holiday lighting using the Sweepstakes application on the Jersey Central Power & Light Facebook page.
• Entrant must affirmatively accept the Official Rules.

ELIGIBLE ENTRANTS MUST SUBMIT THE REQUESTED ENTRY INFORMATION IN ACCORDANCE WITH THESE OFFICIAL RULES. NO OTHER METHOD OF SUBMISSION WILL BE ACCEPTED.  Limit one (1) entry per person, per household for the duration of the Submission Period. The maximum file size is 50 megabytes, and only mp3, mov, mp4, png, jpeg and jpg file types will be accepted. Entries must be received by Friday, December 20, 2019, at 11:59 a.m. ET.

Entries must include a photo or video of outdoor holiday lighting at Entrant’s own residence. Photos or videos of lights on another residence are not eligible. Photos or videos of indoor Christmas trees, mantels or other types of indoor lighting are not eligible. Entrants must submit their photo or video using the Sweepstakes application on Facebook, and must NOT submit a photo or video on the Jersey Central Power & Light Facebook wall, via private message, via email, or by any other method other than the Facebook application. Any photos or videos posted to the Jersey Central Power & Light Facebook wall will be removed and will not be eligible for consideration. NO audio entries will be accepted. “Liking” the Jersey Central Power & Light Facebook page does not automatically enter you into the Sweepstakes.

Only one (1) entry per household will be accepted; multiple entries for the same street address will be void. Entries that are incomplete or illegible, or that include an irrelevant or inappropriate photo, as determined for any reason by and in the sole discretion of the Sweepstakes Entities, are void and will not be accepted. Entries in excess of the limitation may result in disqualification of the Entrant. Participation in the Sweepstakes constitutes Entrant's understanding of and full and unconditional agreement to and acceptance of these Official Rules. Sponsor reserves the right to disqualify any Entrant that Sponsor determines to be in violation of any term contained in these Official Rules.

No third-party disclosures of customer information shall be made, nor will customer information be used for additional campaigns or promotions. Entrants also understand that they are providing their information and photos to Sweepstakes Administrators and not to Facebook, Inc. By submitting a photo or video, Entrant agrees to grant Sweepstakes Administrator royalty-free and unlimited use of the photo or video.

4.  ODDS OF WINNING:  Odds of winning depend on the number of eligible entries received during the Submission Period.

5. WINNER SELECTION AND NOTIFICATION: Three (3) winners will be selected at random by Sweepstakes Administrator from all eligible entries received to date on or around December 6, 2019, December 13, 2019, and December 20, 2019. Sweepstakes Winners will be notified on or around December 6, 2019, December 13, 2019, and December 20, 2019, at the email address or phone number associated with the entry.

Winner must respond via email within twenty-four (24) hours following contact from the Sweepstakes Administrators. Responses will not be accepted via phone, fax or physical mail. If Winner does not respond within the time period, is found to be ineligible, or if he or she has not complied with these Official Rules or declines the prize for any reason prior to award, such potential prize winner will be disqualified and an alternate Winner will be selected at random. This process will continue until a Winner has been verified.

Potential winners will be required to verify their address and to execute and return an affidavit of eligibility, a liability release and/or (where imposing such condition is legal) a publicity release, (collectively, the “Prize Claim Documents”) covering eligibility, liability, advertising and publicity issues. Prize will not be awarded until all such properly executed Prize Claim Documents are returned. Sponsor, in its sole discretion, will attempt to contact up to three (3) potential winners of a prize in accordance with the above procedure, after which the prize in question may go unawarded if it remains unclaimed. Sponsor reserves the right to disqualify anyone not fully complying with the Official Rules. Winners are solely responsible for all federal, state, local and/or other taxes, without limitation, including income taxes, and for any other fees or costs associated with the redemption of a prize. 

6. PRIZES:  Three (3) Winners will receive an Amazon® Gift Card in the amount of $100. Gift cards will be sent via email to recipients.

All prize details are at the sole discretion of the Sponsor. Winner cannot assign or transfer a prize to another person. Cash alternative is not permitted, except at the sole discretion of Sponsor. If a prize cannot be awarded due to circumstances beyond the control of Sponsor, a substitute prize of equal or greater retail value may be awarded. The value of the prize represents the Sponsor’s good faith determination of the maximum retail value thereof. No refunds or credit for changes are allowed. Other restrictions may apply. Prizes may not be redeemed, exchanged or otherwise substituted. PRIZES ARE NON-TRANSFERABLE.

6. ADDITIONAL CONDITIONS OF PARTICIPATION: 

 

Sweepstakes Entities’ Decisions. Decisions of Sweepstakes Entities with respect to this Sweepstakes shall be final in all regards. Sweepstakes Entities reserve the right, in their sole discretion, to change, alter and/or modify these rules at any time, including the substitution of a prize of equal or greater value. Such change, alteration and/or modification shall become effective upon the broadcast of the same by Sweepstakes Entities.

Rights of use. Sweepstakes Entities have the right to modify, use in perpetuity on any media, assign to any third parties and/or dispose of entries. Once submitted, entries and photos/videos become the sole property of the Sweepstakes Entities.

Promotional Use of Winner’s Identity. By participating in this Sweepstakes, you grant Sweepstakes Entities and their designees permission to use your name, picture, likeness, biographical information, statements, address (city and state) and/or voice in any manner for any marketing, advertising or promotions, whether telecast, published, or used in other medium (including but not limited to posting on the web), and to maintain such name, picture, likeness and/or voice in a database for future use, all without additional remuneration, all to the fullest extent permitted by law. 

Technical Problems. Neither Sweepstakes Entities nor their agents and representatives shall be responsible for:

· any technical difficulties including, but not limited to lost, late, misdirected or incomplete entries; garbled phone calls, limited calling, dropped lines, busy phone lines, computer error or any technical malfunctions of the telephone network, illegible or mutilated correspondence, inability to access Sweepstakes via the Internet due to hardware, software compatibility, server and/or any other condition;

· inability of the online portion of the Sweepstakes to run as originally planned, including but not limited to tampering or infection by computer virus. Sweepstakes Entities, at their sole discretion, reserve the right to cancel, modify, or suspend the Sweepstakes and conduct Winner selection from all salvageable eligible entries received.

Sweepstakes Cancellation/Suspension. Sweepstakes Administrator and Sponsor reserves the right, in their sole discretion, to cancel or suspend this Sweepstakes in the event Sweepstakes Administrators cannot preserve the security or proper administration of this Sweepstakes or for any reason in Sweepstakes Administrators’ sole and absolute discretion.

Trademarks. Any trademarks, tradenames, and/or tradestyles used in this Sweepstakes, including Amazon, Woobox and Facebook, are the sole property of the respective owners of such trademarks, tradenames, and/or tradestyles and are used herein solely for identification purposes. This Sweepstakes is in no way sponsored, endorsed, administered by or associated with Visa International Services Association, Woobox or Facebook Inc.

Legal Preemption. This Sweepstakes is subject to all applicable federal, state and local laws and to these Rules. This Sweepstakes is void where prohibited by law.

Acknowledgements. By participating, you agree:

• to be bound by these Official Rules and the decisions of the Sweepstakes Entities (or their designated representative), which are final and binding in all respects and to waive any right to claim ambiguity with the Official Rules;
• to waive any right to claim ambiguity with these Official Rules;
• to indemnify and hold harmless the Sponsor and the Sweepstakes Entities from any and all liability resulting or arising from the Sweepstakes;
• to indemnify and hold harmless Facebook Inc. from any and all liability resulting or arising from the Sweepstakes;
• to release all rights to bring a claim, action or proceeding against the Sweepstakes Entities related in any way to this Sweepstakes; 
• to release all rights to bring a claim, action, or proceeding against Facebook Inc. related in any way to this Sweepstakes;
• that the Sweepstakes Entities shall have no responsibility or liability in connection with disputes over procedures or with respect to use of any prizes (including property loss, damage, personal injury, or death); 
• that any person attempting to defraud or in any way tamper with this Sweepstakes will be ineligible for prizes and may be prosecuted to the full extent of the law; the Sweepstakes Entities reserve the right to seek damages for violations;
• that all expenses and use of the prizes not specifically mentioned herein are the sole responsibility of the Winners;
• that the Sponsor and Sweepstakes Entities are not responsible for multiple entries, entries that are entered by other than human means or by other mechanical means or for entries that are late (including delayed data transmissions), tampered with, illegible, mutilated, forged, mechanically duplicated, misdirected, incomplete, destroyed, lost, or entries otherwise not in compliance with these Official Rules and such entries may be disqualified;
• that in no event shall the Sweepstakes Entities be liable for any special, incidental or consequential damages associated with the Sweepstakes.

Disputes.  As condition of participating in this Sweepstakes, the Entrant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this Sweepstakes, shall be resolved individually, without resort to any form of class action, exclusively before a court located in New Jersey having jurisdiction. Further, in any such dispute, under no circumstances will Entrant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental or consequential damages, including attorneys’ fees, other than Entrants’ actual out-of-pocket expenses (i.e. costs associated with entering this Sweepstakes), and Entrant further waives all rights to have damages multiplied or increased.

Acknowledgement/Waiver/Indemnification/Release. The winner of any prize shall be required to execute an Acknowledgement, Waiver, Indemnification and Release prior to his or her receipt of such Prize.

Rules/Winners List. Official Rules will be posted at www.facebook.com/JCPandL during the Sweepstakes Period, and this link will be provided on promotional materials. After Winners are notified, Winners will be announced at www.facebook.com/JCPandL.
