ENTRY SUBMISSIONS FOR SPOOKLEY’S DARE TO BE SQUARE PRIZE GIVEAWAY - Official Terms and Conditions 

1.  No Purchase Necessary to Submit. Void Where Prohibited.

2.  Eligibility: Open to all social media users who are at least 13 years old and reside in the United States. Entrants under the age of 18 require the permission of their parent/guardian before entering.

Employees or contractors of HOLIDAY HILL ENTERPRISES, LLC (“Sponsor”) and their immediate family members (spouse, parent, child, sibling, grandparent, and spouse or “step” of each) and those living in the same household of each such person are not eligible to submit.

By submitting an entry, entrants confirm that they meet the eligibility requirements above and will be legally bound by these terms and conditions (“Terms”). It will be Sponsor’s sole decision as to whether any eligibility requirement has or has not been met and may require evidence or confirmation from entrants.

3.  How to Submit: To submit an entry, entrants must complete the entry form hosted at http://www.spookley.com/giveaway. There is no fee required to submit an entry. 

The entry must not, in the sole discretion of the Sponsor:

• be discriminatory (based on race, sex, religion, natural origin, physical disability, sexual orientation, age, or any other factor), illegal, offensive, threatening, defamatory or harassing or contain obscene, provocative, defamatory, sexually explicit, or otherwise objectionable or inappropriate content;
• incorporate or prominently display any third-party brands or trademarks (other than that of the Sponsor); or
• infringe any third-party rights, including copyright, or have been copied.

Entrants should avoid including their name or any other personal information in any files submitted to Sponsor through the entry.  Only one entry per person is permitted.

Sponsor assumes no responsibility for lost, late, delayed, damaged, incomplete, illegible, unintelligible, inaccurate, misdirected or non-compliant submission.

4.  Selection of Files to be Used:  Photos, videos, or other files selected will be at the sole discretion of the Sponsor.

5.  Prizes. The prizes are only those prizes laid out on the contest entry page: http://www.spookley.com/giveaway.  Winners will be selected in a random drawing from among all eligible entries received. 

6.  Conditions of Participation:  By submitting an entry,  the entrant agrees to release and hold Sponsor and its respective affiliates, subsidiaries, advertising, promotion and fulfillment agencies, legal advisors, or other parties in any way involved in the development, production, or distribution of the request for submissions, their respective agents, subsidiaries, affiliates, directors, officers, consultants, employees and representatives, harmless from any and all losses, damages, rights, claims and actions in any kind in connection with the submission. 

Sponsor has a legitimate reason for processing personal information relating to entrants. Upon submitting their entries, entrants will directly provide personal information to Sponsor for the purpose of carrying out the submission rules.   Sponsor will process such personal information on the basis that is has a legitimate interest in doing so, which does not override the rights and freedoms of the entrant.  Entrant also acknowledges that Sponsor will transfer, process and store his or her personal information globally, including in the United States, in accordance with all applicable privacy laws (including the General Data Protection Regulation) in order to perform its obligations under these contest rules.

7.  License: By submitting an entry, all entrants grant an irrevocable, perpetual, worldwide non-exclusive license to Sponsor to reproduce, distribute, display and create derivative works of the entries (along with a name credit) in connection with the contest and promotion of the contest, in any media now or hereafter known. Entrants consent to the Sponsor doing or omitting to do any act that would otherwise infringe the entrant's "moral rights" in their entries. Display or publication of any entry on Sponsor’s website does not indicate the entrant will be selected to win a prize. Sponsor will not be required to pay any additional consideration or seek any additional approval in connection with such use. Additionally, any further publicity required of a winner by Sponsor shall be conducted at the winner’s sole discretion.

8.  Governing Law:   The laws of the United States govern these Terms. This is without prejudice to any laws that may apply in entrant’s country of residence, which apply to entrant’s participation hereof.
