The Wish Upon a Stella Rosa Contest Official Rules

PURPOSE: We are Stellabrating YOU, our fans by giving back and granting your wishes, while also giving back to some amazing charities, all at once. Let us know your wish (up to a $500 value) for your chance to have it come true AND select one of the preselected charities to receive a match donation of $500!
ELIGIBILITY: The Contest is open to legal residents of the United States, who are age 21 or older at the time of entry. Employees of Riboli Family Wine Estates (the "Sponsor”) and their subsidiaries, affiliates, advertising and promotion agencies and marketing/prize providers (collectively, “Promotion Entities”), their distributors and retailers, alcohol beverage licensees (i.e., alcohol beverage suppliers, importers, wholesalers, distributors and retailers) and the immediate family members of, and/or those living in the same household of each, are not eligible to enter. The contest is subject to all applicable federal, state and local laws and regulations.
CONTEST ENTRY PERIOD: The Wish Upon a Stella Rosa Contest, (the “Contest”) begins at 12:00:01 AM Pacific Time (“PT”) on November 1st, 2020 and ends at 11:59:59 PM PT on December 31, 2020 (the "Contest Entry Period"). There is $15,00 in prizes to be awarded and distributed between winners each month. We will reach out to the winners via email at the end of each month, beginning November 24 and ending on 1/1/21.

AGREEMENT TO RULES: By participating, the Contestant (“Contestant” or “You”) agree to be fully and unconditionally bound by these Rules, and You represent and warrant that You meet the eligibility requirements. In addition, You agree to accept the decisions of the Sponsor’s Contest Committee as final and binding as it relates to the content of this Contest.
HOW TO ENTER: To enter, visit (the “Website”), complete the entry form in its entirety by:
1. Providing your first name, last name, email address, zip code, phone number and date of birth; 2. Provide one (1) short essay not to exceed 1,000 characters describing what you would wish for that could be fulfilled with up to a $500 value (the “Wish”);
3. Provide a short essay not to exceed 1,000 characters describing why you deserve to have one of your wishes granted (the “Essay”);
4. Scroll down to read about each charity to help you make your decision, then vote for your favorite charity.
5. Check the box to agree to these Official Rules and submit (the “Entry”). The entry must fulfill all Contest requirements, as specified, to be eligible to win.
6. Entries that are incomplete or do not adhere to the rules or specifications may be disqualified at the sole discretion of the Sponsor.
7. Online Contestants are subject to all notices posted online including but not limited to the Sponsor’s Privacy Policy. Limit: You may only enter once. Therefore, only one (1) entry per person or email address during the Contest Entry Period. You may not enter more times than indicated by using multiple email addresses, identities, or devices in an attempt to circumvent the rules; this will automatically disqualify you as a contestant. ENTRY REQUIREMENTS & CONDITIONS: All Entries must comply with the following minimum guidelines to be eligible: á Entry cannot contain content that is irrelevant to the purpose of the Contest. á Once an Entry has been submitted, it cannot be modified or deleted by the Contestant. á Each submitted Wish and Essay must be original (plagiarism results in automatic disqualification). á Entry cannot be profane, pornographic, sexually explicit or suggestive. á Entry cannot be violent or promote firearms/weapons. á Entry cannot promote illegal drugs, tobacco or the consumption or abuse of alcohol. á Entry cannot defame, misrepresent or contain disparaging remarks about people, brands, products or companies. á Entry cannot contain content that defaces or depicts any person, brand, product or company in a negative or inappropriate manner. á Entry cannot be obscene or offensive, endorse any form of hate or hate group or be derogatory to any ethic, racial, gender, religious, professional or age group. á Entry cannot reference or contain materials embodying copyrighted images, names, likenesses or other indicia identifying any brand, products, company or person, living or dead, without permission. á Entry cannot communicate messages or images inconsistent with the positive images and/or goodwill to which Sponsor wishes to associate. á Entry cannot depict illegal activity and cannot itself be in violation of any law. á Entry cannot in any way reference persons or organizations without written permission from any person or organization whose name or likeness is used. á Entry may not include reference to a known celebrity, famous or well-known person or any image or reference which violates the right of privacy or publicity of any person. By submitting an Entry, You understand and grant Sponsors an irrevocable, perpetual, non-exclusive worldwide license to use his/her Entry, Wish, Essay, name, hometown and likeness on the Sponsor’s various websites and social media sites and in advertising and/or promotional activities worldwide without compensation, permission or notification. Sponsor’s reserves the right in its sole and absolute discretion to alter, change or modify any Entry, which includes an Essay. By submitting an Entry, Contestant warrants and represents that: (a) Entry, Wish and Essay does not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other legal or moral rights of any person or entity; (b) Contestant owns all rights to the Entry, including without limitation, copyrights; and (c) Contestant will indemnify and hold harmless the Sponsor and related entities, agents and assigns from any claims and damages (including reasonable attorneys' fees) arising from or relating to the breach or alleged breach of your representations and warranties herein, the Entry, or Contestant’s conduct in creating the Entry, the acceptance or use of any prize or otherwise in connection with this Promotion.
INDEMNITY By entering this contest, You represent and warrant that your entry is an original work of authorship, and does not violate any third party’s proprietary or intellectual property rights. If your entry infringes upon the intellectual property right of another, You will be disqualified at the sole discretion of the Sponsor. If the content of your entry is claimed to constitute infringement of any proprietary or intellectual proprietary rights of any third party, the Contestant shall, at your sole expense, defend or settle against such claims. You shall indemnify, defend, and hold harmless Sponsors from and against any suit, proceeding, claims, liability, loss, damage, costs or expense, which Sponsor Claims may incur, suffer, or be required to pay arising out of such infringement or suspected infringement of any third party’s right. Terms & Conditions: Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Campaign should virus, bug, non-authorized human intervention, fraud, or other cause beyond Sponsor’s control corrupt or affect the administration, security, fairness, or proper conduct of the Campaign. In such case, Sponsors may select the Winner from all eligible entries received prior to and/or after (if appropriate) the action taken by Sponsors. Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Campaign or website or violates these Terms & Conditions. Sponsor has the right, in its sole discretion, to maintain the integrity of the Campaign, to void votes for any reason, including, but not limited to: multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by Campaign rules; or the use of bots, macros, scripts, or other technical means for entering. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Campaign may be a violation of criminal and civil laws. Should such attempt be made, Sponsor reserves the right to seek damages to the fullest extent permitted by law. ANY VIOLATION OF THESE OFFICIAL RULES BY WINNER (AT SPONSOR’S SOLE DISCRETION) WILL RESULT IN WINNER’S DISQUALIFICATION AS WINNER OF THE CAMPAIGN, AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.
PRIZES/APPROXIMATE RETAIL VALUE (“ARV”): Wish Prizes: There are up to ____ Wish Prizes available to be won. The Wish Prize includes a prize package of items, services, donation or other components (the “Wish Package”) that will fulfill the Wish winner’s wish, as interpreted and determined by Sponsor in its sole discretion. Winner will not be given a choice of prizes and may not change the Big Wish Prize as offered. Maximum ARV of each Wish Prize: Up to a $500 value. Total ARV of all prizes available to be won: $______.
JUDGING AND WINNER DETERMINATION: All eligible Entries received during the Contest Entry Period will be reviewed by a panel of judges selected by the Sponsor by or around the last week of each month the contest is running, who shall use the criteria set forth below for each Wish and Essay to determine potential prize winners. The eligible Entries will be graded based on the following pre-determined set of criteria:
1. Wish Judging Criteria: o How will the Wish impact/improve the recipient’s life: 20% o Originality/Creativity of Wish: 20% o How Realistic the Wish is in relation to the maximum ARV for the corresponding Wish prize: 10%
2. Essay Judging Criteria: Emotional Draw of Reason provided in Essay:
30% for Connection to Theme: 20% For each Entry, each Wish will be scored based on the Wish Judging Criteria and the Essay will be scored based on the Essay Judging Criteria above. An Entry’s Wish, will each receive a separate total score based on the total of the Wish Judging Criteria score and the Essay Judging Criteria score for that Entry. The Contestant receiving the highest score from among all eligible Wishes received will be deemed a potential Wish Prize winner. In the unlikely event of a tie, the tied Entry with the highest score in Criterion A (Relevance to Theme) will be deemed that Entry Period’s potential winner. If additional tiebreakers are needed, the same tie-breaking mechanism will be used; however, instead of the highest score in Criterion 1.a determining the potential winner from among the tied entries, the highest scores in each of Criteria 1.b through 2.b, in sequence (to the extent needed) will determine the potential winner. If additional tie-breakers are still needed, the tied Entries will be judged by a separate panel of judges to be determined by the Sponsor using the judging process as outlined above. All decisions made by Sponsor with respect to the judging and award of the prizes are final and binding upon all Contestants. WINNER NOTIFICATION: The first round of potential winners will be notified via email on or around November 30, 2020 & the first week of January 2021. Potential winners will be required to confirm his/her mailing address and agreeing to accept the Wish Package as offered within 48 hours via return email. Make sure to check your spam folder that week. If you don't confirm the win via email within 48 hours, we may call you to give you one more chance to claim your prize. There will be no liability for winner’s failure to receive notices due to spam, junk e-mail or other security settings or for winner’s provision of incorrect or otherwise non-functioning contact information. Notification will include the Wish Package as determined by Sponsor to fulfill the wish the potential winner has won. Noncompliance may result in disqualification and an alternate winner may be selected. Prize will be awarded within approximately 45 days after the winner is verified. If a prize notification or prize is returned as undeliverable, it will result in disqualification, and the prize may be awarded to the Contestant with the next-highest score for such prize. If Releases are returned as undeliverable or if the selected winner cannot accept or receive the prize for any reason, or he/she is not in compliance with these Official Rules, the prize will be forfeited and the prize may be awarded to the Contestant with the next-highest score for such prize.
PRIZE CONDITIONS: Prizes are not redeemable for cash. Prizes are non-assignable or transferable. No substitution is permitted except if a prize is unavailable, in which case a prize of equal or greater value will be awarded. No cash in lieu of prizes and no exchange or substitution of prizes, except at the sole discretion of the Sponsor. Any other incidental expenses on prize not specified herein are the winner’s sole responsibility. The winner is responsible for all federal, state, local and income taxes associated with winning the prize. Except where prohibited by law, entry and acceptance of prize constitute permission to use winner's name, prize won, hometown, likeness, videotape, photographs, and statements for purposes of advertising, promotion and publicity (including online posting) in any and all media now or hereafter known throughout the world in perpetuity, without additional compensation, notification or permission. Prizes are awarded “as is” with no warranty or guarantee, either express or implied by Sponsor. Winners acknowledge that the Sponsor and all other businesses affiliated with this Contest and their agents do not make, nor are in any manner responsible for any warranty, representations, expressed or implied, in fact, or in law, relative to the quality, conditions, fitness or merchantability of any aspect of the prize being offered, except that each merchandise prize shall be subject to its manufacturer’s standard warranty (if any). Once the prize has been delivered to the winner’s provided address, the prize is considered awarded. Prepaid Gift cards are not redeemable for cash and will not be replaced if lost or stolen. Prepaid Gift card usage is subject to the issuing company’s complete terms and conditions, including expiration dates. GENERAL: Although subsequent attempts to enter may be received, only the first complete entry received from a particular Contestant will be eligible; subsequent attempts by the same person to enter, including entries submitted with an alternate email address, will be disqualified. Participating Contestants agree to these Official Rules and the decisions of the Sponsor and the Administrator, and release the Sponsor, the Administrator, and their affiliated companies, and all other businesses involved in this Contest, as well as the employees, officers, directors, and agents of each (the “Released Parties”), from all claims and liability relating to their participation in the promotion, and the acceptance and use/misuse of the prize offered. Winner assumes all liability for any injury or damage caused or claimed to be caused, by participation in this Contest or use/misuse or redemption of the prize. Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the Contest or in the announcement of the prize. In the event of a dispute over the identity of an Contestant, the entry will be deemed submitted by the "Authorized Account Holder" of the e-mail address submitted at the time of entry. Authorized Account Holder means the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Sponsor may ask any Contestant or potential winner to provide Sponsor with proof, to Sponsor’s satisfaction, that such party is the authorized account holder of the email address associated with the entry. Entry materials/data that have been tampered with or altered, or mass entries or entries generated by a script, macro or use of automated devices are void. The Released Parties are not responsible for: (i) lost, late, misdirected, damaged or illegible entries; or (ii) error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by Sponsor on account of technical problems or traffic congestion on the Internet or at any web site or any combination thereof; or (iii) any injury or damage to Contestant's or any other person's computer related to or resulting from participating in the Contest. By participating in the Contest, you (i) agree to be bound by these official rules, including all eligibility requirements, and (ii) agree to be bound by the decisions of the Sponsor and the Administrator, which are final and binding in all matters relating to the Contest. Failure to comply with these official rules may result in disqualification from the Contest. Sponsor reserves the right to: (i) permanently disqualify from any Contest it sponsors any person it believes has intentionally violated these official rules; and (ii) withdraw a method of entry if it becomes technically corrupted (including if a computer virus or system malfunction inalterably impairs its ability to conduct the Contest). If for any reason this Contest is not capable of running as planned due to an infection by a computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, the Sponsor reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Contest, at which time, Sponsor will determine winners from among all eligible entries received at the time of the Contest termination.
LEGAL WARNING: ANY ATTEMPT BY AN INDIVIDUAL, WHETHER OR NOT AN CONTESTANT, TO DAMAGE, DESTROY, TAMPER OR VANDALIZE THIS WEB SITE OR INTERFERE WITH THE OPERATION OF THE CONTEST, IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND DILIGENTLY PURSUE ALL REMEDIES AGAINST ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
GOVERNING LAW AND LIMITATION OF LIABILITY: All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules or the rights and obligations of Contestants, Sponsor or the Released Parties in connection with the Contest will be governed by and construed in accordance with the internal laws of the State of California, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other laws.
BY ENTERING THE CONTEST, CONTESTANT AGREES THAT TO THE EXTENT PERMITTED BY APPLICABLE LAW: (A) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE CONTEST, OR ANY PRIZE AWARDED, WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (B) ANY AND ALL CLAIMS, JUDGMENTS, AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT-OF-POCKET COSTS INCURRED (IF ANY) NOT TO EXCEED TEN DOLLARS ($10.00), BUT IN NO EVENT WILL ATTORNEYS’ FEES BE AWARDED OR RECOVERABLE; (C) UNDER NO CIRCUMSTANCES WILL ANY CONTESTANT BE PERMITTED TO OBTAIN ANY AWARD FOR, AND CONTESTANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES, LOST PROFITS AND/OR ANY OTHER DAMAGES, OTHER THAN ACTUAL OUT OF POCKET EXPENSES NOT TO EXCEED TEN DOLLARS ($10.00), AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED, AND (D) CONTESTANTS’ REMEDIES ARE LIMITED TO A CLAIM FOR MONEY DAMAGES (IF ANY) AND CONTESTANT IRREVOCABLY WAIVES ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY, SO THE ABOVE MAY NOT APPLY TO YOU. DISPUTES: ALL DISPUTES WILL BE RESOLVED SOLELY BY BINDING ARBITRATION AND CONTESTANTS WAIVE THE ABILITY TO BRING CLAIMS IN A CLASS ACTION FORMAT. The parties hereto each agree to finally settle all disputes only through arbitration; provided, however, the Released Parties shall be entitled to seek injunctive or equitable relief in the state and federal courts in Los Angeles County, California and any other court with jurisdiction over the parties. In arbitration, there is no judge or jury and review is limited. The arbitrator’s decision and award is final and binding, with limited exceptions, and judgment on the award may be entered in any court with jurisdiction. The parties agree that, except as set forth above, any claim, suit, action or proceeding arising out of or relating to this Contest shall be resolved solely by binding arbitration before a sole arbitrator under the streamlined Arbitration Rules Procedures of JAMS Inc. (“JAMS”) or any successor to JAMS. In the event JAMS is unwilling or unable to set a hearing date within fourteen (14) days of the filing of a “Demand for Arbitration”, then either party can elect to have the arbitration administered by the American Arbitration Association (“AAA”) or any other mutually agreeable arbitration administration service. If an in-person hearing is required, then it will take place in Los Angeles County, California. The federal or state law that applies to these Official Rules will also apply during the arbitration. Disputes will be arbitrated only on an individual basis and will not be consolidated with any other proceedings that involve any claims or controversy of another party, including any class actions; provided, however, if for any reason any court or arbitrator holds that this restriction is unconscionable or unenforceable, then the agreement to arbitrate doesn’t apply and the dispute must be brought in a court of competent jurisdiction in Los Angeles County, California. The sponsor agrees to pay the administrative and arbitrator’s fees in order to conduct the arbitration (but specifically excluding any travel or other costs of Contestant to attend the arbitration hearing). Either party may, notwithstanding this provision, bring qualifying claims in small claims court. PRIVACY: Personal information collected from Contestants is subject to the Sponsor’s Privacy Policy, which can be found at https://stellarosawines.com/legal/.
