Nourishing Neighbors Submission Rules
2020 OFFICIAL RULES
Eligibility: Submissions of stories, images and videos to the Nourishing Neighbors (“Program”) must be uploaded by an adult age 18 or older (“Participant”). Sponsor reserves the right to verify the foregoing. Uploading a Submission (as defined below) constitutes Participant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the drawing submission. Submissions are subject to all applicable federal, state, and local laws and regulations.
Sponsor/Administrator: Albertsons Companies, Inc. – 250 E. Parkcenter BLVD. Boise, ID 83706. The Program is in no way sponsored, endorsed or administered by, or associated with Instagram, Facebook or Twitter. Participant understands that they are providing their information to Sponsor and not to Instagram, Facebook or Twitter. Any questions, comments or complaints regarding this Program shall be directed to Sponsor and not Instagram, Twitter or Facebook.
How to Enter a Submission:
Visit https://woobox.com/bh5hdm to upload your image, video or freeform text submission. By uploading your Submission, you agree that your Submission conforms to the Guidelines as defined below (collectively, the “Guidelines and Restrictions”) and that Sponsor, in its sole discretion, may disqualify you if it believes that your Submission fails to conform to the Guidelines and Restrictions.
Release: By participating in the Program, Participant agrees to release and hold harmless Sponsor, Administrator, and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and each of their respective parent companies and each such company’s officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Program.
Publicity: Except where prohibited, participation in the Program constitutes each Participant’s consent to Sponsor’s and its agents’ use of Participant’s name, likeness, photograph, opinions, image and/or biographical information and statements for advertising, trade, publicity and promotional purposes without additional compensation, in perpetuity, in any media known and hereafter discovered, worldwide and on the internet and World Wide Web, without notice, review or approval by the winner and those acting under Sponsor’s authority.
General Conditions: Sponsor reserves the right to cancel and/or suspend any part of the Program, if any fraud, technical failures or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Program, as determined by Sponsor in its sole discretion. Any attempt by any person to deliberately undermine the legitimate operation of the Program may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
Submission Guidelines:Submission cannot: (a) contain photos or images of any person without their permission or include the last names, likenesses, or other identifying factors of any person, living or dead or contain any other form of personal identification, such as license plate numbers, e-mail addresses or street addresses; (b) be sexually explicit or suggestive, violent or derogatory of any ethnic, racial, gender, religious, professional or age group, profane or pornographic, contain or reference nudity or any materially dangerous activity; (c) promote alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing), any activities that may appear unsafe or dangerous, or any particular political agenda or message; (d) be obscene or offensive, endorse any form of hate or hate group; (e) contain or reference trademarks, logos (except Sponsor’s) or trade dress owned by others, or advertise or promote any brand or product (except Sponsor’s) of any kind, without permission; (f) contain copyrighted materials owned by others without permission; (g) or contain content plagiarized from other websites and/or publications.
By entering a Submission you warrant and represent that: (a) it has not been previously published; (b) it has not received previous awards; (c) it does not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity; (d) no personally identifiable information is depicted in the Submission; and (e) publication of the Submission via various media including Web posting and posting in social media, will not infringe on the rights of any third party. Entrant will indemnify and hold harmless Sponsor from any claims to the contrary. Any Submission that, in the sole opinion of Sponsor, is deemed to be inappropriate for publication or inclusion in the Program for any reason will be disqualified from the Program.
Entries submitted via your wireless mobile device (which may only be available via participating wireless carriers and is not required to enter the photo submission), may be subject to standard text messaging and/or data rates for each Submission or message sent or received from the handset according to the terms and conditions of the wireless carrier’s service agreement. Other charges may apply (such as normal airtime and carrier charges) and may appear on your mobile device bill or be deducted from your prepaid account balance. Wireless carriers' rate plans may vary, and you should contact your wireless carrier for more information on messaging rate plans and charges relating to your participation in this Program. Participation in this Program by mobile device means you understand you may receive additional messages by mobile device relating to this Program, including notifying you if you are the winner, which may be subject to charges pursuant to your carrier's rate plan. Text messaging may not be available from all mobile phone service carriers and handset models. Mobile device service may not be available in all areas. Check your mobile device’s capabilities for specific instructions.
Submissions may be edited during review process to protect identities.
Limitations of Liability: The Released Parties are not responsible for: (1) any incorrect or inaccurate information, associated with or utilized in the Program; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the submission process or the Program; (4) technical or human error which may occur in the administration of the Program; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Program.
Disputes: Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this photo submission shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for Idaho; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Program, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Program, shall be governed by, and construed in accordance with, the laws of the State of Idaho without giving effect to any choice of law or conflict of law rules (whether of the State of Idaho or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Idaho.
