SWEEPSTAKES
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES. A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCES OF WINNING. THIS SWEEPSTAKES IS INTENDED FOR PLAY IN THE UNITED STATES ONLY AND WILL BE GOVERNED BY U.S. LAW. DO NOT ENTER IF YOU ARE NOT ELIGIBLE AND LOCATED IN THE UNITED STATES AT THE TIME OF ENTRY. BY SUBMITTING AN ENTRY, YOU AGREE TO BE BOUND BY THESE OFFICIAL RULES.
1. Sweepstakes Period: The NATURESWEET TOMATO HERO SWEEPSTAKES (the “Sweepstakes”) begins at 12:00:00 PM Eastern Time (“ET”) on November 23, 2020 and ends at 11:59:59 AM ET on January 19, 2021 with 2 weekly entry periods as listed below in Table 1. Administrator’s computer is the official time keeping device for this Sweepstakes. Entrants will be reviewed for eligibility. Two (2) WEEKLY winners from all entries within that entry period (See Table 1 below). One (1) GRAND PRIZE winner will be randomly selected from the CUMULATIVE entries at the close of the sweepstakes.

2. Eligibility: The Sweepstakes is open only to legal residents of the fifty (50) United States and the District of Columbia who are eighteen (18) years of age or older and who have reached the age of majority in their jurisdiction of residence at the time of entry. Void outside the fifty (50) United States and the District of Columbia and where prohibited. Officers, directors and employees of NatureSweet (“Sponsor”), (collectively, the “Sweepstakes Parties”), and their respective parents, subsidiaries, representatives, contractors, consultants, mandatories, affiliated companies, franchisees, advertising and promotional agencies, legal counsel, website providers, web masters, persons engaged in the development, production or distribution of materials for this Sweepstakes, and their immediate family members (parent, child, sibling, and spouse of each) and/or persons living in the same household as such officers, directors, and employees (whether related or not) are not eligible to enter or win a prize in this Sweepstakes. Entry into this Sweepstakes constitutes entrant's full and unconditional agreement to these Official Rules and to Sponsor’s and/or Administrator’s decisions, which are final and binding in all matters related to the Sweepstakes. Winning a prize is contingent upon fulfilling all requirements set forth herein.
Go to www.NatureSweet.com/Promotions to take the Tomato Hero Quiz. You must provide all required information on the entry form to be eligible to enter, including without limitation first and last name, email address, and your agreement to provide a license to Sponsor to use your entry (as further described below). Once you have completed these steps, you will automatically be entered with one (1) entry into the Sweepstakes.
The person who submits the Entry will be considered the entrant (“Entrant”). Submission of erroneous or incomplete information will void the submitted Entry. Limit one (1) Entry per person, per household, per e-mail address for the duration of the Sweepstakes Period, regardless of method of entry. Bonus entry is offered for opting in to receive NatureSweet’s newsletter on www.NatureSweet.com/Promotions. Entrants may not register with multiple e-mail addresses nor may Entrants use any other device or artifice to register multiple times or as multiple registrants. If multiple Entries are received in excess of the stated limitation from any person or household on any day during the Sweepstakes Period, only the first such Entry received from such person, household that day will be eligible for entry. Entries will not be acknowledged or returned. Online entrants must have a valid e-mail address. Those who do not follow all of the instructions, provide the required information in their registration form, or abide by these Official Rules or other instructions of Sponsor may be disqualified. Each online Entry submission must be manually key stroked and manually entered by the individual Entrant; automated and/or repetitive electronic submission of Entries (including but not limited to Entries made using any script, macro, bot or Sweepstakes service) may be disqualified. No mechanical reproductions or facsimiles of mail-in entries will be accepted, and all such entries will be void. Normal Internet access, phone, and usage charges imposed by your online or phone service may apply. Should multiple users of the same e-mail account enter the Sweepstakes and a dispute thereafter arise regarding the identity of the Entrant, the authorized account holder of said e-mail account at the time of entry will be considered the Entrant. “Authorized account holder” is defined as the natural person who is assigned an e-mail address by an Internet access provider, on-line service provider, or other organization which is responsible for assigning e-mail addresses or the domain associated with the submitted e-mail address.
Entry Notes: Entries made on another’s behalf by any individuals or other entities, including but not limited to, commercial sweepstakes/contest subscription notification and/or entering services, will be declared invalid and disqualified for this Sweepstakes. Tampering with the Entry process or the operation of the Sweepstakes is prohibited, and any Entries deemed by Sponsor, at its sole discretion, to have been submitted in this manner will be void. In the event a dispute regarding the identity of the individual who actually submitted an entry cannot be resolved to Sponsor’s satisfaction, the affected Entry will be deemed ineligible. Sponsor is not responsible for problems downloading or uploading any Sweepstakes-related information to or from the web site or for any other technical malfunctions of electronic equipment, computer on-line systems, servers, or providers, computer hardware or software failures, phone lines, failure of any electronic mail entry to be received by Sponsor on account of technical problems, traffic, congestion on the internet or the web site, or any other technical problems related to web site entries including telecommunication miscommunication or failure, and failed, lost, delayed, incomplete, garbled or misdirected communications which may limit an entrant’s ability to participate in this Sweepstakes.
4. Determination of Winners:
All eligible Entries received during each Entry Period will be selected by random drawing to determine the NatureSweet Weekly Prize Winners for the applicable Entry Period, subject to verification of eligibility and compliance with these Official Rules. The Grand Prize winners will be selected by random draw from all of the eligible CUMULATIVE entries from the Sweepstakes Period, subject to verification of eligibility and compliance with these Official Rules.
One (1) randomly drawn Entrant from each Entry Period will be declared the potential weekly prize winner for the applicable Entry Period. A total of two (2) weekly prize winners will be selected throughout the Sweepstakes Period. A total of one (1) potential Grand Prize Winner will be chosen on or about January 25, 2021 from the CUMULATIVE Entrant pool during the Sweepstakes Period. The odds of winning are based on the number of eligible Entries received.
Potential Weekly Prize Winners and the Grand Prize Winner will be notified via email. Potential Weekly Prize Winners and the Grand Prize Winner may be required to execute and return an affidavit of eligibility and a liability release and, where legal, a publicity release (“Affidavit/Release”) within thirty (30) days of date of issuance of those documents in order to claim his/her prize. If any winner notification sent to a potential Weekly Prize Winners or Grand Prize Winners is undeliverable, if a potential Weekly Prize Winner or Grand Prize Winner fails to respond to the message notifying him/her that he/she is a potential winner within five (5) business days, if a potential Weekly Prize Winner or Grand Prize Winner fails to sign and return the Affidavit/Release or any other required documents within the required time period (if applicable), if a potential Weekly Prize Winner or Grand Prize Winner does not comply with these Official Rules, or if a potential Weekly Prize Winner or Grand Prize Winner is disqualified for any reason, the weekly prize or Grand Prize may be forfeited and awarded to the another randomly drawn eligible Entry from the same Entry Period or Sweepstakes Period, whichever is relevant. Only two (2) alternate drawings will be held, after which any remaining prizes will remain un-awarded. If a winner is at least eighteen (18) years old but still considered a minor in his/her state of residence, Sponsor may, at its discretion, award the prize in the name of his/her parent or legal guardian who will be responsible for fulfilling all requirements imposed on winners set forth herein.
ALL POTENTIAL WEEKLY PRIZE WINNERS AND GRAND PRIZE WINNER ARE SUBJECT TO VERIFICATION BY SPONSOR AND/OR ADMINISTRATOR, WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE SWEEPSTAKES. AN ENTRANT IS NOT A WINNER OF ANY PRIZE UNLESS AND UNTIL ENTRANT’S ELIGIBILITY HAS BEEN VERIFIED AND ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE.

License and Publicity Release: EXCEPT WHERE PROHIBITED BY LAW, PARTICIPATION IN THE SWEEPSTAKES CONSTITUTES EACH ENTRANT’S GRANT TO SPONSOR (WHICH GRANT SHALL BE CONFIRMED IN WRITING AS CONDITION OF WINNING THIS SWEEPSTAKES), ITS PARENT, SUBSIDIARIES, AFFILIATES, RETAILERS, DISTRIBUTORS, ADVERTISING AND PROMOTION AGENCIES, SUPPLIERS, AND THOSE ACTING PURSUANT TO ITS AUTHORITY, THE RIGHT AND PERMISSION TO PRINT, PUBLISH, BROADCAST, AND USE, WORLDWIDE IN ANY MEDIA NOW KNOWN OR HEREAFTER DEVELOPED, INCLUDING BUT NOT LIMITED TO THE WORLD WIDE WEB, AT ANY TIME OR TIMES, ENTRANT’S NAME, PORTRAIT, PICTURE, VOICE, LIKENESS, OPINIONS AND BIOGRAPHICAL INFORMATION (INCLUDING BUT NOT LIMITED TO HOMETOWN AND STATE) FOR ADVERTISING, TRADE, AND PROMOTIONAL PURPOSES (INCLUDING THE ANNOUNCEMENT OF HIS OR HER NAME ON TELEVISION OR RADIO BROADCAST) WITHOUT ADDITIONAL CONSIDERATION, COMPENSATION, PERMISSION, OR NOTIFICATION. 9. Nature of Relationship/Waiver of Equitable Relief: Each Entrant understands and acknowledges that Sponsor has wide access to ideas, designs, and other materials, and that new ideas are constantly being submitted to it or being developed by their own employees. Each Entrant also acknowledges that many ideas may be competitive with, similar or identical to the Submission and/or each other in theme, idea, format or other respects. Each Entrant acknowledges and agrees that such Entrant will not be entitled to any compensation as a result of Sponsor's use of any such similar or identical material. Each Entrant acknowledges and agrees that the Sponsor does not now and shall not have in the future any duty or liability, direct or indirect, vicarious, contributory, or otherwise, with respect to the infringement or protection of the copyright in and to the Submission. Finally, each Entrant acknowledges that, with respect to any claim by Entrant relating to or arising out of Sponsor actual or alleged exploitation or use of any Submission or other material submitted in connection with the Sweepstakes, the damage, if any, thereby caused to the applicable Entrant will not be irreparable or otherwise sufficient to entitle such Entrant to seek injunctive or other equitable relief or in any way enjoin the production, distribution, exhibition or other exploitation of the Submission or any material based on or allegedly based on the Submission, and the Entrant's rights and remedies in any such event shall be strictly limited to the right to recover damages, if any, in an action at law.
10. Disputes/Choice of Law: You and the Sponsor waive all rights to trial in any action or proceeding instituted in connection with these Official Rules or the Sweepstakes. Any controversy or claim arising out of or relating to these Official Rules or the Sweepstakes shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. Any such controversy or claim shall be arbitrated on an individual basis and shall not be consolidated in any arbitration with any claim or controversy of any other party. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the Entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Texas in the United States, without giving effect to any choice of law or conflict of laws rules (whether of the State of Texas or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Texas.
