Summer of Country Racing Competition Terms and Conditions

On entering Country Racing Victoria’s Summer of Country Racing Competition (“the Competition”), you are agreeing to the following terms and conditions:

2.1   Prize List

3.1   Information on how to enter forms part of the terms of entry. Entry into the Competition is deemed acceptance of these conditions of entry.

3.2   This is a game of chance.

4.1   Subject to clause 4.3, entry is open to all residents of Victoria aged 18 years and over at the time of entry.  All entrants aged under the age of 18 must obtain permission from a legal guardian or parent aged 18 or over to enter on their behalf.

4.2   There is a limit of one (1) entry per person, with the exception of entries received on-course, which will count as two (2) entries.

4.3   Employees, contractors, and families of the Promoter (and its agencies) and any prize suppliers (and their agencies) associated with the Competition are not eligible to enter. This includes a spouse, de-facto spouse, parent, child, or sibling.

5.1   The Competition commences at 9:00am Thursday 26 December 2019 and closes at 11.59pm on Monday 27 January 2020. All entries must be received by the Promoter prior to the close of the Competition.

5.2   Entrants can enter the Competition one of two ways;

5.2.1     On-Course Entry: Through a colouring competition on-course at 34 events from Thursday 26 December until Monday 27 January 2020. These entries will count as two (2) entries. These dates and events are:

5.2.2     Online Entry: entrants may enter through the Promoter’s website and Facebook page through the Woobox program.

5.3        When submitting your entry, entrants over the age of 18 must provide their name, postcode, and email address.  In the event of a parent or guardian entering on behalf of an entrant under the age of 18, all of this information must be provided, along with the child’s age when entering.

5.4        Failure to comply with the above conditions or complete all fields required will deem the entry invalid and no correspondence will be entered into.

5.5        Entries must be received no later than 11:59pm on Monday 27 January 2020.

6.1        This is a game of chance and the major prize winner will be drawn randomly by the Promoter.

6.2        The Promoter’s decision is final in what constitutes the above and no correspondence will be entered into.

6.3        By entering the Competition, you take full responsibility of the originality of your entry and absolve the Promoter from any claim, dispute or legal action by any third parties.

7.1        Prize winners will be announced through the Promoter’s dedicated social networking sites including Facebook and Twitter on Friday 31 January 2020.

7.2        Successful entrants will be notified via email prior to the public release of the winners.

7.3        Any expenses incurred above the cost of the online prize voucher for a race day are the responsibility of the individual who makes the booking.

7.4        The online vouchers can only be used in one transaction for one event.

7.5        The online vouchers are valid for 12 months upon issue.

7.6        No element of any prize is transferable, and no element of any prize can be redeemed for cash.

7.7        Winners of the prize should seek independent financial advice about any tax implications that may arise from the prize winnings.

7.8        The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of these rights.

7.9        In participating in the competition, the winners agree to participate and co-operate as required in all editorial activities relating to the Competition, including but not limited to being interviewed, filmed and photographed, and having their name published on the Promoter’s website and social media pages.

7.10      The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages to the entrant. Entrants should direct any request to opt out, access, update or correct information to the Promoter. All entries become the property of the Promoter.

7.11      If any prize is unclaimed or forfeited another selection process will take place (subject to directions from a regulatory authority).

7.12      The Promoter’s decision is final at every stage of the Competition and no correspondence will be

entered into.

8.1        In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to government legislation.

8.2        The Promoter is not responsible for lost, interrupted communications or unavailable server or other connections, failed telephone, mid-delivery or computer transmissions or other errors of any kind, whether human, mechanical or electronic.

8.3        If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

8.4        The Promoter reserves the right to verify the validity of entries and to disqualify any entry of any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms & Conditions of Entry or who has, in the opinion of Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter. The Promoter reserves the right to disqualify a winner if the Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause.

8.5        Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantee, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity) ; whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by the winner or entrant; or (f) use of the prize.

8.6        The Promoter is not responsible for any liability for incidents at prize events.

8.7        This Competition is no way sponsored, endorsed or administered by, or associated with Facebook. You are providing your information to Promoter and not to Facebook. The information provided will be used for database purposes.

8.8        Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (‘Non-Excludable Guarantees’). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence) for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Competition.
