Official Rules:
Jokari Holiday Recipe Contest
NO PURCHASE OR PAYMENT IS NECESSARY TO ENTER. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING. ODDS OF WINNING ARE DEPENDENT UPON THE NUMBER OF QUALIFIED ENTRIES.
1. Eligibility
The Jokari Holiday Giveaway (the"Giveaway") is open only to legal residents of the fifty (50) UnitedStates (and the District of Columbia), who are at least eighteen (18) years old at the time of entry. In order to enter the Giveaway or receive the prize, you must fully comply with the Official Rules and, by entering, you represent and warrant that you agree to be bound by these Official Rules.
2. Timing
Giveaway begins November 22, 2018, at 7:00 a.m. Eastern Time and ends December 31st, 2018 at 11:59 p.m. Eastern Time ("Giveaway EntryPeriod").
3. How to Enter
During the Giveaway Entry Period, you may enter by completing the online entry form by providing your name and email address, a recipe and your own photo of the recipe. Entrants may only use one email address to enter the Giveaway. One entry per person and only one entry per email address. You are not permitted to share the same email address with another entrant. Any attempt by any entrant to obtain more than one entry by using multiple/different email addresses, identities, registrations and logins, or by any other methods, will be void and will result in disqualification of your entries and you. Use of any automated system to enter is prohibited and will result in disqualification. Jokari is not responsible for lost, late, incomplete, invalid, unintelligible or misdirected entries, all of which will be ineligible to win a prize. In the event of a dispute as to any entrant, the authorized account holder of the email address used to enter will be deemed to be the entrant. The "authorized account holder" is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. In the event of a dispute, an entrant will be responsible for providing proof of being the authorized account holder. The sufficiency of proof is entirely within the discretion of Jokari/US, Inc.
4. Winner Determination
At the conclusion of the Giveaway period, three entrants will be selected as the winners according to the three (3) highest vote counts for their photo submissions and will be contacted via the email provided at the time of entry. To collect the prize, the winning entrants must provide a mailing address within the United States to where the prize will be shipped.
5. Prizes
Three (3) prizes will be awarded. One grand prize winner will receive a Jokari Prize package valued at minimum $150. One second place winner will receive a Jokari Prize package valued at a minimum of $100. One third prize winner will receive a Jokari Prize package valued at a minimum of $50. No cash equivalent for the prizes. The prize is non-transferable and no substitution will be made except as provided herein at the Jokari's sole discretion. Jokari reserves the right to substitute any listed prize for one of equal or greater value for any reason.
6. Entry Conditions and Release
Each entrant agrees to: (a) comply with and be bound by theseOfficial Rules and the decisions of Jokari which are binding and final in allmatters relating to this Giveaway; (b) defend, indemnify, release and holdharmless Jokari and any other person and organization responsible forsponsoring, fulfilling, administering, advertising or promoting the Giveaway,and all of their respective past and present owners, officers, directors,employees, agents and representatives (collectively, the "ReleasedParties") from and against any and all claims, expenses, and liability,including but not limited to negligence and damages of any kind to persons andproperty, including but not limited to invasion of privacy (underappropriation, intrusion, public disclosure of private facts, false light inthe public eye or other legal theory), defamation, slander, libel, violation ofright of publicity, infringement of trademark, copyright or other intellectualproperty rights, property damage, or death or personal injury arising out of orrelating to a participant's entry, creation of an entry or submission of anentry, participation in the Giveaway, acceptance, possession, attendance at,defect in, delivery of, inability to use, use or misuse of prize and/or thebroadcast, exploitation or use of entry. Winners acknowledge that ALL PRIZES ARE AWARDED AS-IS WITHOUT WARRANTY OF ANY KIND, INCLUDING WARRANTY OF MERCHANTABILITY.
7. Publicity
Except where prohibited or restricted by law, winners' acceptance of prize constitutes the winner's agreement and consent for Jokariand any of its designees to use and/or publish winner's full name, city and state of residence, photographs or other likenesses, pictures, portraits,video, voice, testimonials, biographical information (in whole or in part),and/or statements made by winner regarding the Giveaway or Jokari, worldwide and in perpetuity for any and all purposes, including, but not limited to,advertising, trade and/or promotion on behalf of Jokari, in any and all forms of media, now known or hereafter devised, including, but not limited to, print,TV, radio, electronic, cable, or World Wide Web, without further limitation,restriction, compensation, notice, review, or approval.
8. General Conditions
Sponsor reserves the right to cancel, suspend and/or modify the giveaway, or any part of it, if any fraud, technical failures or any other factor beyond Jokari's control impairs the integrity or proper functioning of the Giveaway, as determined by Jokari in its sole discretion. Jokari reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the registration process or the operation of the Giveaway or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Giveaway may be a violation of criminal and civil law, and, should such an attempt be made, Jokari reserves the right to seek damages from any such person to the fullest extent permitted by law. Jokari's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
9. Limitations of Liability
The Released Parties are not responsible for: (a) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Giveaway; (b) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (c) unauthorized human intervention in any part of the entry process or the Giveaway; (d) technical or human error in the administration of the Giveaway or the processing of registrations; or (e) any injury or damage to persons or property which may be caused, directly or indirectly,in whole or in part, from entrant's participation in the Giveaway or receipt or use or misuse of any prize. If for any reason an entrant's registration is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant's sole remedy is another entry in the Giveaway. No more than the stated number of each prize will be awarded.
10. Disputes
Entrant agrees that: (a) any and all disputes, claims, and causes of action arising out of or connected with this Giveaway, or any prizes awarded, shall be resolved individually, without resort to any form of representative or class action; (b) any and all disputes, claims and causes of action arising out of or connected with this Giveaway, or any prizes awarded,shall be resolved exclusively by the United States District Court located in Dallas, Texas or the appropriate local Texas state court having jurisdiction over Carrollton, Texas, where Jokari’s headquarters is located; (c) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Giveaway, but in no event attorneys' fees; and (d) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental and consequential damages and any other damages, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Jokari in connection with the Giveaway, shall be governed by, and construed in accordance with, the laws of the State of Texas, without giving effect to any choice of law or conflict of law rules (whether of the State ofTexas or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Texas.
