THE LEGACY CO-OP GONE FISHING GIVEAWAY CONTEST
OFFICIAL CONTEST RULES AND REGULATIONS (“RULES”)
NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. THIS CONTEST IS SUBJECT TO ALL APPLICABLE FEDERAL, PROVINCIAL/TERRITORIAL AND MUNICIPAL LAWS AND REGULATIONS AND IS VOID WHERE PROHIBITED BY LAW. PARTICIPATION IN THIS CONTEST CONSTITUTES FULL AND UNCONDITIONAL AGREEMENT WITH AND ACCEPTANCE OF THESE RULES.
1. CONTEST PERIOD: The Legacy Co-op GONE FISHING GIVEAWAY Contest (the “Contest”) begins on February 22, 2021, at 12:00:01 a.m. SK time and ends on March 4, 2021, at 11:59:59 p.m. SK time (the “Contest Period”).
2. ELIGIBILITY: The Contest is only open to legal residents of Saskatchewan, Manitoba, who are the age of majority or older in their province or territory of residence at the time of entry. Employees, representatives or agents (and those with whom such persons are domiciled, whether related or not) of Legacy Co-op, Federated Co-operatives Limited (“FCL”), and each of their respective parent companies, governors, subsidiaries, affiliates, directors, officers, shareholders, board members and agents (altogether the “Released Parties”) are not eligible to enter. Any individual who meets the above-noted eligibility requirements will be referred to as an “Eligible Entrant”.
3. HOW TO ENTER: NO PURCHASE NECESSARY. Visit the contest link at https://bit.ly/LegacyGoneFishing to complete the form and submit it. OR Enter through The Rock call in.
4. ENTRY LIMIT: One (1) bonus entry will be submitted when the contest is shared. Entrants are limited to one (1) per email address.
5. VERIFICATION: All Entries are subject to verification at any time and for any reason. Legacy Co-op reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to Legacy Co-op – including, without limitation, government-issued photo identification): (i) for the purposes of verifying an individual’s eligibility to participate in this Contest; (ii) for the purposes of verifying the eligibility and/or legitimacy of any Entry and/or other information entered (or purportedly entered) for the purposes of this Contest; and/or (iii) for any other reason Legacy Co-op deems necessary, in its sole and absolute discretion, for the purposes of administering this Contest in accordance with these Rules. Failure to provide such proof to the complete satisfaction of Legacy Co-op within the timeline specified may result in disqualification in the sole and absolute discretion of Legacy Co-op. The sole determinant of the time for the purposes of this Contest will be the Administrator’s Official Clock.
6. THE PRIZE: There will be one (1) Prize available to be won, consisting of a portable Fishing Shack and $100 Gift Card (with an approximate retail value (“ARV”) of three hundred and fifty dollars ($350 CDN) (the “Prize”). Without limiting the generality of the foregoing, the following general conditions apply to the Prize: (i) Prize must be accepted as awarded and is not transferable, assignable or convertible to cash (except as may be specifically permitted by Legacy Co-op in its sole and absolute discretion); (ii) no substitutions except at Legacy Co-op's option; (iii) Legacy Co-op reserves the right at any time to substitute the Prize or a component thereof for any reason with a prize or prize component(s) of equal or greater value, including, without limitation, but solely at Legacy Co-op's sole discretion, a cash award; (iv) colour and other specifics of the Prize will be at the sole and absolute discretion of Legacy Co-op and subject to availability; (v) manufacturer’s standard warranty applies to the Prize; (vi) Prize will be available for pickup at the Legacy Co-op Yorkton Agro Centre, and the winner will be required to present adequate personal identification (in a form acceptable to Legacy Co-op – including, without limitation, government issued photo identification); (vii) confirmed Prize winner is solely responsible for all expenses that are not included in the Prize description above, including additional accessories and any costs associated with: (a) any upgrade package(s); and or (b) taking delivery of the Prize. The Prize will only be awarded to the Eligible Entrant whose verifiable full name and valid e-mail address appear on the Entry Form.
7. WINNER SELECTION PROCESS: On March 5, 2021 (the “Draw Date”), in Yorkton, Sk, one (1) Eligible Entrants will be selected by random draw from among all eligible Entries submitted and received in accordance with these Rules. The odds of winning depend on the number of eligible Entries submitted and received in accordance with these Rules.
8. WINNER NOTIFICATION PROCESS: Legacy Co-op or its designated representative will make a minimum of three (3) attempts to contact the selected Eligible Entrant within five (5) business days of the Draw Date. If the selected Eligible Entrant cannot be contacted within five (5) business days of the Draw Date, or if there is a return of any notification as undeliverable; then he/she may, in the sole and absolute discretion of Legacy Co-op, be disqualified (and, if disqualified, will forfeit all rights to the Prize) and Legacy Co-op reserves the right, in its sole and absolute discretion, with time permitting, to randomly select an alternate Eligible Entrant from among the remaining eligible Entries submitted and received in accordance with these Rules (in which case the foregoing provisions of this section shall apply to such newly selected Eligible Entrant). A Release form must be completed by the Eligible Entrant.
9. WINNER CONFIRMATION PROCESS: BEFORE BEING DECLARED THE CONFIRMED PRIZE WINNER, the selected Eligible Entrant will be required to: (a) correctly answer a mathematical skill-testing question without mechanical or other aid (which may, in the sole and absolute discretion of Legacy Co-op, be administered online, by email or other electronic means, by telephone, or in the Declaration and Liability Release with (where lawful) a Publicity release in a form acceptable to Legacy Co-op (the “Release Form”); and (b) sign and return, within ten (10) business days of notification, the Release Form, which (among other things): (i) confirms compliance with these Rules; (ii) acknowledges acceptance of the Prize (as awarded); (iii) releases the Released Parties from any and all liability in connection with this Contest, his/her participation therein and/or the awarding and use/misuse of the Prize or any portion thereof; and (iv) agrees to the publication, reproduction and/or other use of his/her name, address, voice, statements about the Contest and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by or on behalf of the Sponsor in any manner or medium whatsoever, including print, broadcast or the Internet. Upon satisfaction of these conditions, the Eligible Entrant will be declared a winner of the Contest. If the selected Eligible Entrant: (a) fails to correctly answer the skill-testing question; (b) fails to return the properly executed Contest documents outlined above within the specified time; (c) cannot accept (or is unwilling to accept) the Prize (as awarded) for any reason; and/or (d) is determined to be in violation of these Rules (all as determined by the Sponsor in its sole and absolute discretion); then he/she will be disqualified (and will forfeit all rights to the Prize) and the Sponsor reserves the right, in its sole and absolute discretion, with time permitting, to randomly select an alternate Eligible Entrant from among the remaining eligible Entries submitted and received in accordance with these Rules (in which case the foregoing provisions of this section shall apply to such newly selected Eligible Entrant).
10. LIMITATION OF LIABILITY/RELEASE: By participating in the Contest, and as a condition of acceptance of the Prize, you, your heirs, executors, administrators, successors and assigns, release and forever discharge and hold harmless Legacy Co-op, Federated Co- operatives Limited and retail co-operatives and each of their respective direct and indirect parent companies, affiliates, subsidiaries, successors, assigns, agents, advisors, franchisees, shareholders, boards members, representatives, their advertising, promotion and fulfillment agencies, employees, officers, directors, agents and representatives (collectively, the “Released Parties”), from and against any and all losses, damages (including, without limitation, direct, indirect, incidental, consequential or punitive damages), rights, claims, actions, causes of action, personal injury, property damage or death, including without limitation all costs and liabilities of any kind including legal fees on a substantial indemnity scale, hereinafter called “Claims” and including without limitation any Claims arising from any act of negligence of the Released Parties, that you now have, or may hereafter have against the Released Parties directly or indirectly resulting or arising from: (i) participation in the Contest, or the awarding, acceptance, possession, use or misuse or enjoyment of any Prize, and where applicable, traveling to, preparing for, or participating in, any Contest-related or Prize-related event or activity; or (ii) the publicity rights granted to Legacy Co-op. You specifically acknowledge that you understand that there may be serious risks of bodily injury, death, or property damage associated with the acceptance, possession, use and/or misuse of the Prize and attendance at any event or participation in certain Prize-related activities, and you voluntarily assume these risks. Legacy Co-op will not be responsible for late, lost, illegible, incomplete, falsified or destroyed entries and all such entries are void. Legacy Co-op do not assume any responsibility for incorrect or inaccurate capture of entry information, technical malfunctions, human or technical error, printing errors, or lost entries. You also agree to indemnify, defend, and hold harmless the Released Parties from any and all Claims in respect to the foregoing.
11. GENERAL CONDITIONS: All Entries become the property of Legacy Co-op. This Contest is subject to all applicable federal, provincial and municipal laws. The decisions of Legacy Co-op with respect to all aspects of this Contest are final and binding on all entrants without right of appeal, including, without limitation, any decisions regarding the eligibility/disqualification of Entries and/or entrants. By participating in this Contest, you are agreeing to be legally bound by the terms and conditions of these Rules.
