ELIGIBILITY: The Sweepstakes is open only to legal residents of the 50 United States and the District of Columbia (excluding Puerto Rico and all United States territories and possessions) (collectively referred to herein as "states"), who are eighteen (18) years of age or older (except in the case of legal residents of certain states where the legal age of majority is greater than eighteen (18) years of age, such legal age of majority) at the time of entry. To be eligible for the Grand Prize, the driver must meet the minimum age, driver’s license, and insurance requirements in the “Grand Prize Conditions” section below. Employees, officers, and directors (and their immediate family members such as spouse, parent, child, sibling and their respective spouses, regardless of where they reside and members of the same household, whether or not related) of Toyo Tire U.S.A. Corp. (“Sponsor”), GBL Public Relations (“Administrator”) and each of their respective parents, affiliated companies, subsidiaries, licensees, distributors, dealers, retailers, printers, advertising and promotion agencies, and any and all other companies associated with the Sweepstakes are not eligible to participate or win the Monthly Prizes or the Grand Prize (defined below). The Sweepstakes is subject to all applicable federal, state, and local laws, rules and regulations. Void where prohibited or restricted by law, rule or regulation.
ENTRY PERIOD; HOW TO ENTER: The Sweepstakes begins at 11:00 AM Eastern Time (“ET”) on December 1, 2020 and ends at 5:59 PM ET on May 31, 2021 (“Entry Period”). You may enter the Sweepstakes in one (1) of the two (2) following ways: via online entry form or by mail. No other methods of entry will be accepted.
ENTRY LIMIT; ENTRY CONDITIONS: Regardless of entry method, there is a limit of one (1) entry per eligible person, per day during the Entry Period. Any attempt by you to obtain more than one (1) entry per day by using multiple/different email addresses, identities, registrations and logins, or any other methods will void your entries and you will be disqualified. You must enter each month to be eligible to win during that month.
If it is discovered that an entrant has registered or attempted to register using multiple physical addresses, e-mail addresses, telephone numbers, multiple identities, IP addresses, use of proxy servers, or any other method of unauthorized entry, all in Sponsor’s and/or Administrator’s sole and absolute discretion, all of that entrant’s entries will be declared null and void, entrant will be disqualified from the Sweepstakes and any prize that entrant might have been entitled to receive will not be awarded to him/her. Entries that are late, lost, illegible, duplicated, mechanically reproduced, contain false information, damaged, misdirected, mutilated, garbled or incomplete, altered or otherwise irregular, in the sole discretion of Sponsor and/or Administrator; or that have been submitted or generated using robotic, programmed, script, or any other automated means, or illicit means; or that do not conform with or satisfy any or all of the conditions set out in the Official Rules, as determined by Sponsor and/or Administrator in its sole and absolute discretion, may be judged void and disqualified.
MONTHLY PRIZES RANDOM DRAWING: The potential Monthly Winners of the Sweepstakes will be selected by random drawing on or about January 22, 2021; February 22, 2021; March 22, 2021; April 22, 2021; May 22, 2021; and June 22, 2021, from among all eligible entries received during the previous month. Subject to verification of eligibility and compliance with the terms of these Official Rules, the potential Monthly Winners will be declared the official Monthly Winner of the Sweepstakes (the “Monthly Winner”). The decisions of Sponsor and/or Administrator are final and binding on all matters relating to this Sweepstakes and the determination of a Monthly Winner. Odds of winning depend on the total number of eligible entries received during the applicable month. Winners of previous months’ Monthly Prize drawings during the Sweepstakes are not eligible to win more than one (1) Monthly Prize.
GRAND PRIZE RANDOM DRAWING: The potential Grand Prize winner of the Sweepstakes will be selected by random drawing on or about June 22, 2021, from among all eligible entries received during the course of this Sweepstakes. Subject to verification of eligibility and compliance with the terms of these Official Rules, the potential Grand Prize winner will be declared the official Grand Prize winner of the Sweepstakes (the “Grand Prize Winner”). The decisions of Sponsor and/or Administrator are final and binding on all matters relating to this Sweepstakes and the determination of the Grand Prize Winner. Odds of winning depend on the total number of eligible entries received.
MONTHLY PRIZES: One (1) Monthly Prize will be awarded, each month, within the six months of the promotion. The six (6) Monthly Winners will each receive a $500 dollar gift card (collectively, the “Monthly Prize”). Approximate Retail Value (“ARV”) of each Monthly Prize: $500. Total ARV for all Monthly Prizes: $3,000.
GRAND PRIZE: One (1) Grand Prize will be awarded. To be eligible for the Grand Prize, the driver must meet the minimum age, driver’s license, and insurance requirements (see the “Grand Prize Conditions” section farther below for details. The Grand Prize Winner will receive the following prizes: An overlanding trip from Pacific Overlander (“Pacific Overlander”) for up to four (4) individuals to the Grand Canyon National Park sometime between August 1, 2021 and October 31, 2021 (as chosen in the Sponsor’s sole discretion); Airfare for up to four (4) individuals to McCarran International Airport (LAS) from another airport in the 50 United States (as determined by the Sponsor in its sole discretion); Accommodations for up to four (4) individuals through Pacific Overlander, including an off-road vehicle equipped with sleeping arrangements, a guided tour, and all meals provided by the guide, for up to four (4) days and three (3) nights, in the Grand Canyon National Park; A $500 dollar gift card (collectively, the “Grand Prize” or “Experience”). ARV of the Grand Prize is up to $7,500; Actual value may vary depending on Grand Prize Winner’s city of departure and any difference in value will not be awarded. Only if travel is determined to be unsafe by local, state, and/or government entities, will a non-transferable voucher be offered to use at a later date instead.
Total ARV of all Monthly Prizes and the Grand Prize is $10,500.
MONTHLY PRIZES CONDITIONS: All Monthly Prizes details shall be determined in the sole and absolute discretion of Sponsor. The Winner is fully responsible for any and all applicable federal, state, and local taxes (including income and withholding taxes). No transfer, substitution or cash equivalent for the Monthly Prizes is allowed. Sponsor reserves the right to substitute the Monthly Prizes (or any portion thereof) with a prize of comparable or greater value at its sole and absolute discretion.
GIFT CARDS: The Gift Cards are subject to terms, conditions and policies specified by the gift card issuer. Such terms and conditions may include any or all of the following, as well as others: gift cards may not be redeemable for cash, or used for payment on accounts, or used for the payment of prior purchases; cards are non-refundable; purchases and amounts spent or deducted from a gift card balance may be non-refundable; gift cards may expire on a designated date; and gift cards may be redeemable only by legal residents of the United States. Use of a Gift Card constitutes acceptance of the gift card issuer’s terms, conditions and policies, and as such, each winner of a Gift Card should carefully read the terms, conditions and policies either enclosed in the gift card packaging materials or provided electronically in the case of any electronic gift card as well as described on the website URL listed on the back of the gift card or provided electronically in the case of any electronic gift card. Each Winner should also safeguard the Gift Card as he/she would any other valuable item and treat it the same as cash. The Gift Card is useable up to its balance only.
GRAND PRIZE CONDITIONS: In order to be eligible to accept and receive the Grand Prize, the driver in the Winner’s party must (i) be at least twenty-one (21) years of age with a valid driver’s license and insurance, OR (ii) at least twenty-five (25) years of age with a valid driver’s license and eligible for provided insurance through Pacific Overlander who is facilitating the vehicles. The grand prize cannot be accepted unless the driver can meet the minimum age, driver’s license, and insurance requirements. All Grand Prize details, including, without limitation, the exact nature and duration of the Experience, shall be determined in the sole and absolute discretion of Sponsor. The Winner is fully responsible for any and all applicable federal, state, and local taxes (including income and withholding taxes). No transfer, substitution or cash equivalent for the Grand Prize is allowed, except at Sponsor’s sole discretion or if travel is determined to be unsafe by local, state, and/or government entities. Sponsor, in its sole discretion, reserves the right to provide ground transportation in lieu of air transportation if Winner resides close enough to Las Vegas, NV as determined by Sponsor at its sole discretion for the Experience (and no additional compensation or substitution will be awarded for difference in prize value). The Grand Prize is non-transferable and non-assignable, with no cash redemptions except at Sponsor’s sole and absolute discretion. Sponsor reserves the right to substitute the Grand Prize (or any portion thereof) with a prize of comparable or greater value at its sole and absolute discretion. The Winner and his/her travel companion must travel together on such dates as are specified by Sponsor and on the same travel itinerary. If Winner cannot travel on such dates, then he/she may be disqualified and an alternate entrant may be selected as a potential winner via a random drawing, if time permits, from among all remaining eligible entries. All travel arrangements must be made by Sponsor’s agent. Winner and his/her guest are responsible for obtaining all required travel documents, including passports and visas (if applicable) prior to travel and must have no impediment to entering the United States. Winner and his/her guest agree to comply with all applicable regulations in connection with the Grand Prize. Released Parties (defined below) will not be responsible for weather conditions, pandemics or epidemics, Acts of God, acts of terrorism, civil disturbances, work stoppage or any other natural disaster outside their control that may cause the cancellation of the Experience.
TRAVEL CONDITIONS: Travel arrangements must be made through the Sponsor or its agent, and any changes after booking are permitted only in Sponsor’s sole and absolute discretion. All other expenses not specifically mentioned herein, including but not limited to taxes, lodging, travel, meals, beverages, alcoholic beverages, parking, gratuities, transportation and other costs and expenses incurred are the responsibility of the Grand Prize Winner and guests are solely the responsibility of the prize winner and guests. If a prize includes airfare, the prize solely includes coach air transportation for each individual recipient from an airport nearest the prize recipient’s home to an airport closest to the event. All details of the prize not specified herein shall be determined solely by Sponsor. Travelers under the age of 18 (except in the case of legal residents of certain states where the legal age of majority is greater than eighteen (18) years of age, such legal age of majority) must be accompanied by such person’s parent or legal guardian and must be above the age of eight (8).
AIRLINE CONDITIONS: Sponsor is not liable for any expenses incurred as a consequence of any governmental agency-related and/or flight cancellation/delay or other events that may result in the cancellation/delay of a trip, including weather conditions, acts of God, an act of terrorism, civil disturbance, epidemics, natural disasters or any other reason. Sponsor will have no responsibility if any flight or event is cancelled or rescheduled. Grand Prize Winner and his/her guest(s) agree to comply with all applicable airport, airline, and travel regulations in connection with the Grand Prize. All other expenses relating to acceptance of the Grand Prize not explicitly stated herein, including but not limited to taxes, lodging, travel, meals, beverages, alcoholic beverages, parking, gratuities, transportation to and from airports and other costs and expenses incurred by use of the Grand Prize are responsibility of the winner and, if applicable, guests. No substitutions or cash equivalents will be allowed, except at the sole discretion of Sponsor, who reserves the right to award prize of comparable value. All details of the prize not specified herein shall be determined solely by Sponsor.

MONTHLY PRIZES AND GRAND PRIZE NOTIFICATION: The potential Monthly Winners and Grand Prize winner will be notified at the email address, postal address and/or telephone number (in the sole discretion of Sponsor and/or Administrator) provided at the time of entry (the "Prize Notification"). In the event that any potential winners do not respond to any such Prize Notification within three (3) days of the date of issuance or declines the Prize for any reason, a disqualification will result, the Prize will be forfeited and, at Sponsor’s sole discretion and time permitting, an alternate potential winner may be randomly selected from among all remaining eligible entries.
MONTHLY AND GRAND PRIZE IDENTIFICATION: The potential Monthly Prize and Grand Prize winners will be required to submit his/her valid social security number and/or other identification to Sponsor and/or Administrator and will be required to execute, have notarized and return an Affidavit of Eligibility and Release of Liability and Publicity, unless prohibited by law, within five (5) days of the date of issuance. Failure to submit any identification required by Sponsor and/or Administrator or to return the required documents within the specified time period, non-compliance with these Official Rules or the return of the Monthly and/or Grand Prize (or any portion thereof) or Monthly and/or Grand Prize Notification as undeliverable may result in disqualification and Monthly and/or Grand Prize forfeiture and, at Sponsor’s sole discretion and time permitting, may cause an alternate potential winner to be randomly selected from among all remaining eligible entries.
WAIVER OF LIABILITY/PUBLICITY RELEASE: By participating in the Sweepstakes and submitting an entry, each entrant agrees to (a) be bound by these Official Rules, including all entry requirements, and (b) waive, release and hold harmless Sponsor, Administrator, Facebook, Inc. (“Facebook”), Twitter, Inc. (“Twitter”) and each of their respective parents, affiliated companies, subsidiaries, officers, directors, employees, agents, licensees, distributors, dealers, retailers, printers, representatives and advertising and promotion agencies, and any and all other companies associated with the Sweepstakes, and all of their respective officers, directors, employees, agents and representatives (collectively, “Released Parties”) for any and all claims arising out of any injury, damage or loss that may occur, directly or indirectly, in whole or in part, from the participation in the Sweepstakes or from the receipt or use of the Monthly Prizes and Grand Prize (or any portion thereof) or any travel or activity related to the receipt or use of the Monthly Prizes and Grand Prize (or any portion thereof), including without limitation, any personal injury, death or damage to persons or property.
You further understand and agree that all rights under Section 1542 of the Civil Code of California ("Section 1542") and any similar law of any state or territory of the United States that may be applicable with respect to the foregoing release are hereby expressly and forever waived. You acknowledge that Section 1542 provides that: A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH, IF KNOWN BY HIM OR HER MUST HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR. The releases hereunder are intended to apply to all claims not known or suspected to exist with the intent of waiving the effect of laws requiring the intent to release future unknown claims.
By entering this Sweepstakes, each entrant gives his/her express permission to be contacted by Sponsor, by telephone, email and/or postal mail for Sweepstakes purposes. Winners, by acceptance of the Monthly Prizes and Grand Prize, grants to Sponsor, Administrator, and each of their respective designees the right to publicize each Winner’s name, address (city and state/territory of residence), photograph, voice, statements and/or other likeness and prize information for advertising, promotional, trade and/or any other purpose in any media or format now known or hereafter devised, throughout the world, in perpetuity, without limitation and without further compensation, consideration, permission or notification, unless prohibited by law.
GENERAL CONDITIONS: Released Parties are not responsible for stolen, late, incomplete, illegible, inaccurate, misdirected, lost, misrouted, scrambled, damaged, delayed, undelivered, mutilated, postage-due or garbled entries, transmissions, email or mail; or for lost, interrupted or unavailable network, cable, satellite, server, Internet Service Provider (ISP), wireless network, website, or other connections including those through and/or by any website, availability or accessibility or miscommunications or failed computer, satellite, telephone, cable or wireless transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties; wireless service congestion; failures or malfunctions of phones, phone lines or telephone systems, wireless towers or cellular tower equipment; any error, omission, interruption, defect or delay in wireless or other transmission, processing, or communication; non-delivery; misdirected, blocked, or delayed email notifications; printing, typographical or other errors appearing within these Official Rules, in any Sweepstakes-related advertisements or other materials; or any other errors, problems or difficulties of any kind whether human, mechanical, electronic, network, computer, telephone, wireless service, mail, typographical, printing or otherwise relating to or in connection with the Sweepstakes, including, without limitation, errors or difficulties which may occur in connection with the administration of the Sweepstakes, the processing of entries, the announcement of the Monthly Prizes and Grand Prize or in any Sweepstakes-related materials, or the cancellation or postponement of the Experience. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by website users, tampering, hacking, or by any equipment or programming associated with or utilized in the Sweepstakes. Released Parties are not responsible for injury or damage to entrants’ or to any other person's computer and/or wireless device related to or resulting from participating in this Sweepstakes or downloading materials from or use of the website. Sponsor and/or Administrator shall have the sole right to disqualify any entrant for violation of these Official Rules or any applicable laws relating to the Sweepstakes, and to resolve all disputes in its sole discretion. Released Parties (a) make no warranty, guaranty or representation of any kind concerning the Monthly Prizes or Grand Prize (or any portion thereof), and (b) disclaim any implied warranty. Sponsor’s and/or Administrator’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
Sponsor reserves the right, in their sole discretion, to cancel or suspend the Sweepstakes (or any portion thereof) should virus, bugs, unauthorized human intervention, epidemics, or other causes corrupt administration, security, fairness, integrity or proper operation of the Sweepstakes (or any portion thereof). In the event of cancellation, Sponsor may elect to identify the Winners and award the Monthly Prizes or Grand Prize by way of random drawing from among all non-suspect, eligible entries received up to the time of such cancellation. Sponsor also reserves the right, in their sole discretion, to modify these Official Rules for clarification purposes without materially affecting the terms and conditions of the Sweepstakes.
CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE ASSOCIATED WITH THIS SWEEPSTAKES OR UNDERMINE THE CONTENT OR LEGITIMATE OPERATION OF THIS SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR WILL DISQUALIFY ANY ENTRANT RESPONSIBLE FOR THE ATTEMPT, AND SPONSOR, AND THEIR RESPECTIVE AGENTS RESERVE THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS’ FEES) AND OTHER REMEDIES FROM ANY PERSON OR PERSONS RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.
Entries generated by a script, macro or other mechanical or automated means will be disqualified. In the event of dispute as to the identity or eligibility of any potential winners based on an email address, the winning entry/entries will be declared made by the Authorized Account Holder of the email address submitted at the time of entry provided he/she is eligible according to these Official Rules. The “Authorized Account Holder” is defined as the natural person to whom the applicable Internet service provider or other organization (such as a business or educational institution) has assigned the email address for the domain associated with the submitted email address.
As a condition of entering this Sweepstakes, each entrant agrees that (i) any and all disputes, claims, controversies or causes of action arising out of or relating to this Sweepstakes, or any prizes awarded (each, a "Claim"), shall be (1) arbitrated on an individual basis only, and shall not be consolidated or joined with or in any arbitration or other proceeding involving a Claim of any other party, and (2) settled by binding arbitration in Orange County, California before a single arbitrator appointed by the American Arbitration Association in accordance with its then governing rules and procedures, and judgment on the award rendered by the arbitrator may be entered by any court having jurisdiction thereof; and (ii) under no circumstance will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental, consequential or any other damages, other than for actual out-of-pocket expenses. These Official Rules shall be governed by and construed and interpreted in accordance with the laws of the State of California, U.S.A, applicable to contracts entered into and performed exclusively in that State.
