Il y a une limite d’une participation par personne pendant la totalité du concours. Toute personne qui participe ou tente de participer plus d’une fois au concours ou qui utilise une méthode de duplication robotisée, automatique, mécanique, électronique ou autre non autorisée aux termes du présent règlement sera considérée comme ayant fait une tentative de falsification ou de manipulation, ce qui entraînera automatiquement sa disqualification.

Aucune participation ne sera acceptée après la date d’échéance du concours pour quelques motifs que ce soit.

Les personnes résidant au Canada et ayant atteint l’âge légal dans leur province respective peuvent participer au concours.

Les individus employés par Mode Choc, ses agences de publicité, de promotion et de services contractés ainsi que les juges (faisant partie du concours) et tous les membres des familles immédiates ou les personnes vivant dans le même ménage que tous les individus mentionnés précédemment ne sont pas éligibles, et ce, en tout temps durant toute la période du concours.

Le 15 avril 2019, un tirage au sort sera réalisé parmi toutes les participations reçues par la responsable du concours au Mode Choc.

Il y aura un (1) seul gagnant qui devra avoir rempli le formulaire en bon et due forme.

Le gagnant sera contacté par courriel le 15 avril et aura deux jours pour réponder sans quoi, un autre gagnant sera tiré.

1.      PARTICIPATION

1.1. Anyone who wishes to participate in the contest must register online at www.modechoc.ca using the application form, and between March 28 to April 14

1.2. No purchase necessary;

1.3. Maximum of one entry per email address;

1.4. This contest is open to residents of Canada only, who have reached the age of majority in their province/territory of residence at the time of their participation in the contest.

1.5. Individuals employed by Mode Choc, its advertising or promotion agencies, affiliate companies, subsidiaries or judges (collectively ‘’Contest Parties’’) and members of their immediate family or people living in the same household are not eligible for the entire duration of the contest.

2.      ENTRIES FOR THE DRAW

2.1. For the purpose of this contest, ‘’receipt’’ of an Internet entry occurs when Mode Choc servers or third party contracted services’ servers record the entry information resulting from the entrant clicking the ‘’Submit’’ button and completing the form;

2.2. For purposes of this contest, a valid entry is determined by completing the forms through the Internet web pages which must be received between March 28 and April 14. Automated entries (using a robot, script, macro or other automated service) are not permitted;

2.3. Multiple entries will disqualify all entries submitted. All winners must meet the eligibility requirements set forth in these rules in order to qualify for the Prize. Mode Choc is not responsible for any failure of the website during the contest period, including any telephone problems or technical malfunction of any computer on-line systems, servers, access providers, computer equipment, software, failure of any e-mail or entry to be received on account of technical problems or traffic congestion on the internet or at the website, or any combination thereof including any injury or damage to an entrant's or any other person's computer related to or resulting from downloading any material related to the contest, all of which may affect a person's ability to participate in the contest. Entries with invalid email addresses will be disqualified.

2.4. By participating in this contest, entrants agree to release and hold harmless contest Parties from any and all liability whatsoever for any injuries, losses or damages of any kind arising from or in connection with, either directly or indirectly;

a)      The awarding, acceptance, receipt, possession, use and/or misuse of any prize awarded herein;

Or

b)      The participation in the contest or any prize related activities;

2.5. Mode Choc is not responsible for technical delay issues that may cause an expired contest to be printed on any advertising notification of the contest.

3.      THE PRIZE

3.1. One prize will be drawn and a maximum of 1 entry will be allowed per person. The Winner will receive a $500 gift card. Prize is not transferable to another person or exchangeable and has no cash value.

3.1.2 Conditions attached to the prize:

f) The Prize offered must be accepted as awarded and is not exchangeable, refundable, transferable or convertible into cash. In the event that the Prize is not accepted in accordance with its attached conditions, the Prize will be deemed to be forfeited.

j) Mode Choc disclaims all responsibility for damage or loss of a person or property related to the delivery and / or subsequent use of the awarded Prize. Mode Choc makes no guarantee concerning the appearance, safety or performance of any prize awarded.

4.      THE DRAW

4.1. Odds of winning: The actual odds of winning will depend upon the actual number of entries received for this contest;

4.2. The winner will be contacted by phone and / or email depending on the information provided. The designated person will have two (2) days from the first attempt of communication by the company to confirm his address in order to receive his/her prize. In the event that the winner is unreachable during these two days, Mode Choc gives itself the right to designate another winner.

4.3. Random drawing: There will be 1 prize: a $500 gift card. The Winner will be chosen by random draw from all eligible entries. The draw will take place at 2pm, Eastern Time. Subsequent draws may be needed if the Winner does not claim his/her prize by the deadline specified or is not eligible (article 2 and 3.1.2), at Mode Choc offices, located at 1055, av. du Pont Sud, #50, Alma, QC, G8B 2V7.

5.      CLAIMING THE PRIZE

5.1. The selected entrant will be contacted by phone and/or email between April 15 and 17 to confirm their acceptance of the Prize;

5.2. In case the Prize has not been claimed before April 17, Mode Choc will forfeit the entrant’s right to the Prize;

5.3. Before being declared a Winner, the selected entrant will be required to:

a) Accept the contest rules and acknowledge the right to publish the Winner’s picture, name and address, without compensation other than the prize offered;

b) Confirm to have reached the age of majority in their province/territory of residence

 

5.4. The Winner must contact Mode Choc by replying to the official email announcement.

5.5. Should a Winner make any false statement(s) in any document referenced above, the Winner will be required to promptly return his/her prize to Mode Choc. Any unclaimed prizes will be awarded in a random drawing to be held as necessary. In the event there is a dispute of the entrant's identity, the prize will be awarded to the established email account associated with the entry;

5.6. By participating, entrants agree to abide by and be bound by these General Rules and Regulations and by the decisions of the judges, which shall be final and binding with respect to all issues relating to this contest. It is your responsibility to ensure that you have complied with all of the conditions contained in the General Rules and Regulations. By participating in this contest, entrants agree to Mode Choc’s use of their personal information for direct marketing purposes

6.      APPLICABLE LAW

6.1. Quebec Residents: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.

7.      MISCELLANEOUS CONDITIONS

7.1. If, for any reason, the contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Mode Choc, Mode Choc reserves the right, at its sole discretion, and as permitted by law to cancel, terminate, modify or suspend the contest and select winners from among all eligible entries prior to the cancellation.
