Rules & Regulations 

These are the official rules and regulations (“Official Rules”) for The Rooms video/audio submission campaign (the “campaign”). By making a submission, the submitter (as hereinafter defined) agrees to be bound by these regulations.

Content of submissions should reflect, reference, and/or be relevant to the culture, heritage, and history of Newfoundland and Labrador. In making a submission, the submitter agrees to the submission being used indefinitely in promotion by The Idea Factory, agency of record for The Rooms and The Rooms Corporation of Newfoundland and Labrador.

In making a submission, the submitter confirms that the submission is an original work, no part of which is plagiarized. No copyright materials (songs, images, etc.) or material protected by other intellectual property rights may be used without proper permission from the owner. The submitter also warrants that he/she/it has the permission of and has obtained a release from anyone whose likeness, in whole or in part, is captured in the video/audio for use in this campaign. The Idea Factory and The Rooms Corporation of Newfoundland and Labrador may request a copy of such permission and release for any video/audio in which a person is recognizable. Any liability for copyright infringement or violations of privacy resulting from a video/audio are the sole responsibility of the submitter and the submitter agrees to release and indemnify The Idea Factory and The Rooms Corporation of Newfoundland and Labrador from any claims, actions or proceedings related to The Idea Factory or The Rooms Corporation of Newfoundland and Labrador’s use of the video/audio.

Every submission will be reviewed by The Idea Factory and will be posted/used at the discretion of The Idea Factory and The Rooms Corporation of Newfoundland and Labrador. A submission (or anything related to it) must not contain anything that (i) infringes on, misappropriates or violates a third party’s patent, copyright, trademark, trade secret, moral rights or other intellectual property rights, or rights of publicity or privacy; (ii) violates, or encourages any conduct that would violate, any applicable law or regulation or would give rise to civil or legal liability; (iii) is fraudulent, false, misleading, or deceptive; (iv) is defamatory, obscene, pornographic, vulgar, or offensive; (v) promotes discrimination, bigotry, racism, hatred, harassment or harm against any individual or group (which include, but are not limited to, race, sex, creed, national origin, religious affiliation, marital status, sexual orientation, gender identity, or language); (vi) is violent or threatening or promotes violence or actions that are threatening to any other person; (vii) promotes illegal or harmful activities or substances; (vii) contains information or materials embodying the names, images, likeness, voices, or other indicia identifying any third party person (living or dead), such as personal names, email addresses or street addresses, including, without limitation, those of celebrities and/or other public or private figures, living or dead; (ix) uses the brand names, trade names, or trade-marks of any third party; or (x) in The Idea Factory's sole discretion, does at least one of the following: insults, attacks, harasses, bullies, threatens, demeans or impersonates others; contains “hate speech”, whether directed at an individual or group, based on membership within certain categories, targets minors or promotes products or services that are illegal for use by minors in their jurisdiction, or that are deemed unsafe or inappropriate; contains adult content, including foul language, nudity, depictions of people in explicit or suggestive positions, or activities that are overly suggestive or sexually provocative; contains content that is shocking, sensational or disrespectful, or portrays excessive violence; is otherwise obscene, offensive, or inappropriate; or links to or promotes a webpage; or otherwise makes available any unsolicited or unauthorized advertising, “commercial pitch,” contest materials, junk mail, spam, pyramid schemes, or any other form of solicitation. 

By submitting a video/audio, the submitter warrants and consents that he/she/it is the owner of the work, holds its copyright, and grants The Idea Factory and The Rooms Corporation of Newfoundland and Labrador a royalty-free, worldwide, perpetual and non-exclusive license to display, distribute, and reproduce the work, in whole or in part, in any media now existing or subsequently developed for any purpose of The Idea Factory or The Rooms Corporation of Newfoundland and Labrador, including future promotional purposes by The Idea Factory or The Rooms Corporation of Newfoundland and Labrador. The submitter acknowledges that there will be no payment or usage fees from The Idea Factory or The Rooms Corporation of Newfoundland and Labrador for the use of the video/audio in any way.

The submitter’s personal information is being collected by The Rooms Corporation of Newfoundland and Labrador under the authority of the Access to Information and Protection of Privacy Act, 2015 and is subject to the provisions of the Act. The submitter’s consent for disclosure for the above purposes is given under section 68 (1)(b)of that Act.

The submitter warrants that he/she is at least 19 years of age, and that he/she read the Offical Rules before submitting a video/audio recording and that he/she fully understands the contents.
