OFFICIAL SWEEPSTAKES RULES AND REGULATIONS
WHO CAN ENTER
This Sweepstakes is open to all Healthcare Workers who have been directly responsible for keeping us safe and have been nominated through the elmonterv.com/contest page to Woobox app to participate as entrants in the Sweepstakes. Entrants must reside in the continental Unites States. Examples of included Healthcare Workers are: doctors, nurses, technicians, medical researchers, hospital workers, assistants, and pharmacists who are legal residents of the USA and who have reached twenty one (21) years of age on the date that he or she is nominated to participate in this Sweepstakes. Employees of El Monte RV, Road Bear RV or any thl affiliate (the “Sponsor”), or Woobox (“Data Processor”) their subsidiaries and affiliated companies and each of their respective directors, officers, employees, agents, representatives, attorneys, advertising or promotional agencies, members of their immediate families and persons with whom any of the foregoing are domiciled are not eligible to participate in this Sweepstakes.

This Sweepstakes is being promoted and administered by Sponsor.
SWEEPSTAKES PERIOD:
The Sweepstakes starts on October 21, 2020 (“Start Date”) and closes on December 13, 2020 at 11:59pm PST (“Close Date”). The period in which the Sweepstakes are open to entrants is referred to as the “Sweepstakes Period”.
HOW TO ENTER: NO PURCHASE NECESSARY.
All Healthcare Workers that have been nominated and received by Woobox during the Sweepstakes Period to participate in the Sweepstakes will be entered. Completion of other actions are not necessary to enter and will not increase your chances of winning the Sweepstakes. Only one entry per person, regardless of entry method. Neither WOOBOX, the Sweepstakes Administrator nor Sponsor shall be responsible for lost, late, damaged, illegible, stolen, misdirected, misidentified, postage due or incomplete entries, for any problems or technical or mechanical malfunction of any telephone systems, computer on-line systems, servers, access providers, computer equipment, software, failure of any entry to be received by Woobox on account of technical problems or traffic congestion on the Internet or at any website, or inaccurate entry information, whether caused by equipment, programming used in this Sweepstakes, human processing or otherwise, or any combination thereof. Entries become the property of Sponsor and will not be returned.

Official Nominate a Healthcare Hero Rules for Voters
THANK YOU FOR YOUR INTEREST IN NOMINATE A HEALTHCARE HERO. VOTING IN NOMINATE A HEALTHCARE HERO IS GOVERNED BY THE VOTING RULES SET FORTH BELOW. BY REGISTERING TO VOTE, YOU AGREE TO BE LEGALLY BOUND BY THESE TERMS AND CONDITIONS. IF YOU DO NOT AGREE TO THE TERMS AND CONDITIONS BELOW, DO NOT REGISTER TO VOTE.
1. ELIGIBILITY: Voting is open only to those individuals who are at least 13 years of age at the time of casting a Vote and who sign up as a Voter in advance of casting a Vote as required below (collectively, “Voters”). Nominate a Healthcare Hero is void where prohibited by law. All federal, state and local laws and regulations apply.
2. SIGNING UP: In order to sign up as a Voter and be eligible to cast a Vote, you must first either (a) register an e-mail address with El Monte RV www.elmonterv.com/contest
3. SPECIFIC RULES FOR VOTERS: The following rules apply to Voting on a Nominate a Healthcare Hero entry (“Entry”) in Nominate a Healthcare Hero:
Votes must be cast online at www.elmonterv.com/contest, mobile browser, iPhone application, or Android application. In order to vote online, you must first sign up to vote as described above.
During the preliminary round that closes on December 13, 2020 at 11:59 p.m. PST, you may vote once per IP address per day.
Votes sent outside of the designated voting dates and times will not be counted.
By voting for a Nominate a Healthcare Hero Entry, you agree to these Official Voting Rules (“Rules”).
4. ADDITIONAL RULES: Sponsor may disqualify any Vote or Voter if, in its sole discretion, it determines that the Vote was cast in exchange for compensation or other consideration or is otherwise contrary to the spirit of the competition. Sponsor may prohibit a Voter from participating in Nominate a Healthcare Hero if, in its sole discretion, it determines that said Voter is attempting to undermine the legitimate operation of Nominate a Healthcare Hero by cheating, hacking, deception, or other unfair participation or voting practices or intending to annoy, abuse, threaten, or harass any other entrants or Sponsor representatives. Sponsor is not responsible for typographical or other errors in the offer or administration of Nominate a Healthcare Hero, including but not limited to errors in the advertising, Rules, selection and announcement of the winner, and distribution of the prizes. Sponsor reserves the right to terminate or amend Nominate a Healthcare Hero, in whole or in part, at any time without notice, if any factor, including without limitation virus, bugs, or non-authorized human intervention, interferes with its conduct as contemplated by these official rules. Sponsor decisions are final on all matters relating to Nominate a Healthcare Hero and the subject matter of these rules. By voting in Healthcare Hero, the Voter agrees that Sponsor and its respective affiliates, agents, directors, officers, and employees have no liability whatsoever for any injuries, losses, or damages of any kind relating to or arising from Nominate a Healthcare Hero or resulting from the Voter’s participation in Nominate a Healthcare Hero, including any claim or loss that may occur during the winner’s travel in related to Nominate a Healthcare Hero. The Voter agrees to defend, indemnify, and hold harmless Sponsor and its affiliates, agents, directors, officers, and employees from and against any and all liability, claims, suits, actions, losses, and expenses, including costs and attorney fees relating to or arising out of any claim or demand of any kind or nature which any person or party may make against Sponsor based upon or arising out of the Voter’s actions or the Voter’s participation in Nominate a Healthcare Hero, or any other claim or demand relating to Nominate a Healthcare Hero. CAUTION: ANY ATTEMPT BY A VOTER TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF NOMINATE A HEALTHCARE HERO MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND, SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH VOTER TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION. PRIZE:
Sweepstakes: One (1) prize of a seven (7) day El Monte RV Vacation Rental consisting of one (1) RV motorhome based on availability provided by El Monte RV will be awarded to the first one (1) entry selected by the entrant receiving the most votes from among all eligible entries as winner. The prize will be issued by email. Prizes are non-transferable and non-assignable. No substitution of prizes are permitted except by the Sweepstakes Administrator. All prizes will be awarded. The odds of winning are dependent upon the number of eligible entries received.
WINNER NOTIFICATION:
Selected entrant(s) will be notified by email, mail or phone within forty-eight (48) hours of the close of contest. Selected entrants will be required to acknowledge by phone, via email or in writing his or her receipt of notification of eligibility for prize, and sign an affidavit and return it to the Sweepstakes Administrator within ten (10) business days of the date on which it is sent to selected entrant for signing. If no response is received by the Sweepstakes Administrator within ten (10) business days of notification, the prize will be forfeited and may be awarded to an alternate winner who has received the next highest amount of votes selected from the remaining eligible entries.
GENERAL:
Neither Woobox nor Sponsor are responsible for any costs associated with claiming any prize. Winners are solely responsible for the reporting and payment of any and all taxes, insurance, travel to and from the El Monte RV location fees and costs, if any, that may result in claiming a prize in this Sweepstakes.
Winner may make no substitution or transfer of prize. Travel time must be completed concurrently. All federal, state and local taxes and insurance are the sole responsibility of Winner. All federal state and local regulations apply. Return on any prize notification will result in disqualification and an alternate may be selected. Type and size of RV based on availability and shall be determined solely by Sponsor. Sponsor reserves the right to substitute prize of equal or greater value. By participation in this Sweepstakes entrants agree to be bound by the official rules and the decision of the judges. Contest period is November 9, 2020 to December 13, 2020. Entrant must have a valid driver’s license at time of entry. Winner must be over 21 years of age. By participating in this contest, entrants agree to their image and likeness being used for marketing and advertising purposes without compensation except as prohibited by law. All security deposit, damages, fuel costs, campsite fees, flights, transport/transfers to and from the airports, tolls, extra hire items, travel insurance, security deposit and personal expenditure are not included in the prize and must be paid for by the winner. Renter must provide a binder for Primary Third-Party Liability Insurance up to state statutory limits applicable to the rental vehicle. Primary Third-Party Liability Insurance may be available for purchase for those who do not wish to use their own insurance as primary or who do not have sufficient insurance for rental vehicle. Cost for insurance to be paid for by winner. Subject to availability at the time of booking, El Monte RV will confirm the motorhome model once the winner has chosen their collection date and location. The standard T&Cs and Travel Restrictions of hiring an El Monte RV motorhome apply. Transportation to and from El Monte RV rental location is solely the responsibility of the winner. Please note that these may change at any time without notice.
Entries in any way tampered with, forged, mutilated, incomplete, illegible, photocopied or mechanically reproduced, or submitted by or through fraudulent means, may be disqualified, in the sole discretion of the Sweepstakes Administrator. This includes any entry that does not comply with these Sweepstakes Rules in any respect.
Decisions of the Sweepstakes Administrator are final on all matters of fact, interpretation, eligibility, procedure and fulfillment in respect to this Sweepstakes. The Sweepstakes Administrator reserves the right at any time to withdraw this Sweepstakes or to modify, amend, or supplement these rules, in its sole discretion, subject to applicable law.
The winners agree to abide by and be bound by these Official Rules.
Any personal data collected during an individual’s participation in the Sweepstakes, will be collected and used by Woobox and Sponsor and their agents for the purposes of the proper administration and fulfillment of the Sweepstakes as described in these Official Rules and will not be shared with any third party except as required by law, or to conform with legal process or to protect or defend the legal rights or property of Woobox or Sponsor, their subsidiaries and affiliated companies and each of their respective directors, officers, employees, agents, representatives, advertising, promotion, and fulfillment agencies, and legal advisors are not responsible for and shall not be liable for: (i) telephone, electronic, hardware or software program, network, Internet, or computer malfunctions, failures, or difficulties of any kind; (ii) failed, incomplete, garbled, or delayed computer transmissions; (iii) any condition caused by events beyond the control of Woobox and/or Sponsor that may cause this Sweepstakes to be disrupted or corrupted; (iv) any injuries, losses, or damages of any kind arising in connection with or as a result of the prize, or acceptance, possession, or use of the prize, or from participation in this Sweepstakes; or (v) any printing or typographical errors in any materials associated with this Sweepstakes. Sponsor reserve the right, in their discretion, to suspend or cancel this Sweepstakes at any time if a computer virus, bug, tampering, unauthorized intervention, or other technical problem of any sort corrupts the administration, security, or proper play of this Sweepstakes. Sponsor also reserve the right to disqualify, in their sole discretion, any person tampering with the entry process, the operation of the Web site, or who is otherwise in violation of these Official Rules. Any attempt to damage or undermine the legitimate operation of the Sweepstakes is a violation of criminal and civil laws. Should such an attempt be made, Sponsor reserve the right to prosecute violators to the fullest extent allowable by law.
By participating in this Sweepstakes, each participant agrees to release and hold Woobox, Sponsor, their subsidiaries and affiliated companies and each of their respective owners, shareholders, directors, officers, employees, agents, representatives, advertising, promotion, and fulfillment agencies, and legal advisors, harmless from any and all losses, damages, rights, claims and actions of any kind in connection with this Sweepstakes or resulting from acceptance, possession, or use of any prize, including without limitation, personal injury, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy.
Except where prohibited, participants agree that (1) any and all disputes, claims or causes of action arising out or connected with the Sweepstakes or any prizes awarded shall be resolved individually, without resort to any form of class action; (2) any and all claims, judgments and awards shall be limited to actual out of pocket costs incurred in participation but in no event attorney’s fees; and (3) under no circumstances will a participant be entitled to obtain awards for and participants hereby waive all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket costs, and any and all rights to have damages multiplied or otherwise increased. Except where prohibited, all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules and the decisions of Woobox and Sponsor in connection with the Sweepstakes, shall be governed by and construed in accordance with the laws of the State of California, without regard for conflict of laws doctrine.
Should any term or provision of this paragraph or any other rule herein be concluded to be void, unenforceable or contrary to applicable law as provided herein, such term or provision shall, but only to the extent necessary to bring the rule within the requirements of such law, be deemed to be severed from the other terms and conditions; and the remainder of these Official Rules shall be given effect as if it had not included the severed item.
