“WIN A TRIP TO THE YUKON, CANADA” PRIZE DRAW PROMOTION

TERMS AND CONDITIONS

 

Eligibility Criteria

 

1. Entry is only open to Australian residents aged 21 years or over who are available to take the Major Prize (as outlined in clauses 11-15) if drawn as the Major Prize winner.  

 

2. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

3. Promotion commences on 13/03/2023 and final entries close at 6:00pm AEDST on 23/04/2023 (“Promotional Period”).

 

4. To enter, individuals must complete the following steps during the Promotional Period (“Initial Entry”):

a) visit www.paddypallin.com and follow the prompts to the promotional entry page;

b) input the requested details (including their full name, valid mobile number, state and postcode, and a valid email address);

c) agree to the Terms and Conditions and Privacy Policy by ticking the relevant tick box;

d) agree to receive communications of marketing nature from the Promoter by ticking the relevant tick box; and

e) submit the fully completed entry form.  

 

5. Incomplete or indecipherable entries will be deemed invalid.

 

Draw & Winner Notification

 

6. The draw (“Draw”) will take place at Paddy Pallin, Unit C2, 3-29 Birnie Avenue Lidcombe, New South Wales   2141 Australia on 24 April 2023 at 11:00 AEST. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn.

 

Winners will be notified by telephone and email within two (2) business days of the draw, and the Major Prize winner’s name will also be published online at www.facebook.com/paddypallin and https://www.instagram.com/paddy_pallin/ from 24/04/2023.  

 

7. The draw for unclaimed prize will take place on 22/05/2023 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners, if any will be notified by telephone and email within two (2) business days of the draw. If the Major Prize is awarded, the Major Prize winner’s name will also be published online at www.facebook.com/paddypallin and https://www.instagram.com/paddy_pallin/ from 22/05/2023.

 

 

Major Prize

 

8. The first valid entry in the Draw will win a Yukon Tourism Trip voucher valued at AU$12,000 that entitles the user to book an adventure holiday and flights to the Yukon through travel fulfillment partner Adventure World (Major Prize) plus $1000 travel luggage from Osprey Australia. The voucher is only valid for travel to the Yukon, staying at least 4 nights, and includes at least 2 tourism experiences. Some blackout periods may apply. To be valid the voucher must be used in one purchase, any leftover denomination will not be carried onto other trips/ bookings. The voucher cannot be used in conjunction with any other offer by Adventure World Travel Group. The voucher is valid for a trip booked directly with Adventure World Travel Group by 29th February 2024 with confirmed travel dates before the 24th of March 2025. The winner may add any number of companions to the booked trip up to the value of $12,000, if the total of the booking goes over $12,000 the winner will need to make up the difference in value. The voucher is valid only on trips that have met minimum numbers.

 

9. Major Prize must be booked directly with Adventure World by 29th February 2024 with confirmed travel dates before the 24th of March 2025. Spending money, additional meals, taxes, insurance, passports, visas, vaccinations, transport to and from departure point, accommodation or other expenses in transit to Yukon or for stopovers on the way to the Yukon, items of a personal nature, in-room charges, and all other ancillary costs are not included. The winner and his/her companion are responsible for ensuring that they have valid passports, and any requisite visas, vaccinations, and travel documentation. The winner and his/her companion must depart from and return to the same departure point and travel together. Itinerary to be determined by the Promoter in agreement with the winner but in the event that agreement cannot be reached, the Promoter reserves the right to determine the itinerary.  Prize is subject to the standard terms and conditions of individual prize and service providers. The winner may be required to present their credit card at time of accommodation check in. Prize goods are not refundable due to change of mind and cannot be exchanged for a line of credit.

 

10. In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend or modify a prize, subject to any written directions from a relevant regulatory authority.

 

General

 

11. Information on how to enter and the prize form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

 

12. The Promoter’s decision is final and no correspondence will be entered into.

 

13. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.

 

14. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

 

15. If for any reason a winner does not take the prize by the time stipulated by the Promoter, then the prize will be forfeited.  

 

16. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

 

17. Total prize pool value is up to AU$13,000

 

18. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.

 

19. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

 

20. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

 

21. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.  

 

22. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia or any statutory consumer guarantees as provided under consumer protection laws in New Zealand or any other applicable jurisdiction (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

 

23. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorized access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) taking/use of and/or participation in a prize.

 

24. As a condition of accepting the Major Prize, the Major Prize winner (and his/her companion) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.  

 

25. Entry and continued participation in the promotion via Facebook and Instagram is dependent on entrants following and acting in accordance with the Facebook Statement of Rights and Responsibilities (which can be viewed at www.facebook.com/terms.php) and the Instagram Terms of Service (which can be viewed at: https://help.instagram.com/581066165581870) respectively.  

 

26. This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook or Instagram. Entrants understand that they are providing their information to the Promoter and not to Facebook or Instagram. The information an entrant provides will only be used for the purposes outlined in these Terms and Conditions. Any questions, comments or complaints about this promotion must be directed to the Promoter and not to Facebook or Instagram. Facebook and Instagram will not be liable for any loss or damage or personal injury which is suffered or sustained by an entrant, as a result of participating in the promotion (including taking/use of a prize), except for any liability which cannot be excluded by law.

 

27. The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to the following third parties; service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. In entering this competition, you are acknowledging that the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. At any time, the entrant may opt out, access, update or correct their PI. All entries become the property of the Promoter. The Promoter will not disclose Australian entrant’s PI to any entity outside of Australia.  

 

28. The laws of Australia apply to this promotion to the exclusion of any other law.  Entrants submit to the exclusive jurisdiction of the courts of Australia.
