Rules and Regulations
NO PURCHASE NECESSARY TO ENTER OR WIN. A purchase will not improve the chances of winning. #FirstAmBankInspireGood Giveaway (the “Contest”) runs Jan. 15, 2021, through Feb. 12, 2021 ("Contest Entry Period"). By participating in the Contest, each entrant unconditionally accepts and agrees to comply with and abide by these terms and rules (“Official Rules”) and the decisions of First American Bank (“FAB”), which shall be final and binding in all respects. FAB is responsible for the overall administration of the Contest.
TERMS
A. ELIGIBILITY: Contest open to legal U.S. residents residing in the continental United States who are 18 years of age and older as of Jan. 15, 2021. Employees of FAB and members of the immediate family are not eligible to participate and win.
B. HOW TO ENTER: Entries must be received between Jan. 15, 2021, at 8:30 a.m. Central Time (“CT”) and Feb. 12, 2021, at 11:59 a.m. CT. To enter the Contest, (a) visit facebook.com/FirstAmBank and follow the links and instructions (Entrant will need to have a valid Facebook account in order to enter. Entrants can open a Facebook account for free at www.facebook.com. Entrant’s profile must be set to public in order to enter and be registered in giveaway); (b) visit instagram.com/FirstAmBank and follow the links and instructions (Entrant will need to have a valid Instagram account in order to enter. Entrants can open an Instagram account for free at www.instagram.com. Entrant’s profile must be set to public in order to enter and be registered in giveaway); (c) visit twitter.com/FirstAmBank and follow the links and instructions (Entrant will need to have a valid Twitter account in order to enter. Entrants can open a Twitter account for free at www.twitter.com. Entrant’s profile must be set to public in order to enter and be registered in giveaway); (d) visit http://woobox.com/o9xg6g and follow the instructions; or (e) visit any First American branch location and complete an entry form (must be done through drive-through or by making an appointment). Limit one (1) personal entry per eligible person per day during the Contest Entry Period regardless of entrant having more than one email address or social media account. Entries submitted may not be acknowledged or returned. Proof of submission of an entry shall not be deemed proof of receipt by the Contest administrator. Online entrants are subject to all notices posted online including but not limited to FAB’s Privacy Policy. Use of Woobox as a means of entry will be subject to Woobox’s privacy policy and terms of service. By participating in the Contest, entrant understands that he or she is providing his or her information to FAB and not Woobox. Further, entrant specifically agrees to release Woobox from any and all liability associated with this Contest. The Contest is in no way sponsored, endorsed or administered by, or associated with Woobox.
C. THE PRIZE: FAB will award one (1) prize of one (1) Yeti mug and one (1) $250 donation to a local food bank or homeless shelter to four (4) contest entrants. The Prize has an approximate retail value of $269. There will be no cash compensation. The value of the Prize represents FAB’s good faith determination. That determination is final and binding and cannot be appealed. Restrictions, conditions, and limitations may apply. FAB will not replace any lost or stolen prize items. All federal, state, local and other taxes are the sole responsibility of the applicable winner.
D. WINNER SELECTION: Four (4) winners will be selected in a weekly random drawing from among all eligible entries received throughout the Contest Entry Period. The random drawings for the Contest will be conducted on Jan. 22, 2021, Jan. 29, 2021, Feb. 5, 2021, and Feb. 12, 2021. The random drawing will be conducted by FAB; all decisions are final. Odds of winning will depend on the number of eligible entries received (example: 1/500 chance of winning if there are 500 entries). The winners will be notified within two (2) business days of the random drawing. If the winner entered via social media, they will be notified via that platform. If the winner entered through Woobox or a branch, they will be notified by phone or email. Any winner notification not responded to within 48 hours or returned as undeliverable may result in Prize forfeiture and an alternate winner shall be selected. If a potential winner is ineligible to win the Prize because of age or other material misrepresentation, does not comply with the acceptance requirements above or is otherwise in violation of these Official Rules, then such winner will be disqualified and an alternate winner may be selected from the remaining eligible entrants. No substitution or transfer of the Prize is permitted except by FAB.
No more than the stated number of prizes specified in these Official Rules will be awarded. The Yeti will be mailed and the donation made within six to eight weeks of claiming the Prize. The winner will forfeit the Prize if not claimed within 48 hours of responding to the notification. FAB is not responsible for the safe arrival of the Prize.
E. GENERAL CONDITIONS: Entrants found tampering with or abusing any aspect of this Contest, as solely determined by FAB, will be disqualified. If disqualified for any abuse, FAB reserves the right to terminate entrant's eligibility to participate in the Contest. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be in violation of criminal and civil law, and, should such an attempt be made, FAB reserves the right to seek damages from any such person to the fullest extent permitted by law. FAB’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. FAB reserves the right to terminate, cancel, suspend and/or modify the Contest if any fraud, virus or other technical problem corrupts the administration, security, or proper play of the Contest, as determined by FAB in its sole discretion.
By entering the Contest and/or accepting the Prize, all entrants/prize winners agree to: (a) be bound by these Official Rules; (b) release FAB and its affiliates, subsidiaries, shareholders, directors, officers and employees from all liability, claims, action, or proceedings relating to the Contest and from injuries or damages arising in connection with or relating to participation in the Contest, or use or misuse of the Prize; (c) their name being used in any form of media without additional compensation, notification, permission or approval and (d) waive any right to claim ambiguity in the Contest or these Official Rules. By accepting the Prize, winner further acknowledges that FAB has not made, nor is in any manner responsible or liable for, any warranty, representation or guarantee, express or implied in fact or in law, relative to the Prize or prize supplier or to any portion thereof, including but not limited to its quality, merchantability, mechanical condition, or fitness for a particular purpose including, without limitation, use of any equipment associated with the Prize. FAB reserves the right to modify these Official Rules for clarification purposes without materially affecting the terms and conditions of the Contest, to void suspect entries and/or cancel, terminate or suspend any portion of this Contest should any non-authorized human intervention or other causes beyond the control of FAB corrupt or impair the administration, security, fairness or proper play of the Contest and, in any such event, at its discretion, select a winner from eligible, non-suspect entries received during the Contest Entry Period.
F. DISPUTES: Except where prohibited, all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and FAB in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the United States and the State of Illinois.
G. Arbitration Provision: Both entrant and FAB agree that any dispute arising under or relating in any way to the Contest or these Official Rules (a “Claim”) will be resolved by binding arbitration as discussed below, and not through litigation in any court (except for matters in small claims court). Both entrant and FAB agree not to proceed on any Claim in arbitration as a class claim or class action or other comparable representative proceeding.
The party filing a Claim in arbitration must contact JAMS, Inc. (“JAMS”) as the arbitration administrator. Any arbitration of a Claim will take place in accordance with the rules applicable to the Claim (the “Rules”) that JAMS has in effect at the time the arbitration claim is filed. The Rules are available at the JAMS website: http://www.jamsadr.com/rules-clauses. Any decision rendered in such arbitration proceeding will be final and binding on both entrant and FAB.
