1.     In these terms and conditions (“Terms and Conditions”), “we”, “our” or “us” means Camera House (The Promoter), a division of Raleru Limited (ABN 52 002 575 340) (“Raleru Limited”).Information on how to enter the Olympus & Camera House Photo Rally Competition Promotion “the Promotion” and prizes form part of these Terms and Conditions. Participation in the Promotion is deemed acceptance of these Terms and Conditions.

2.     Entry in the Olympus & Camera House Photo Rally Competition Promotion is open to Australian residents except for employees of Raleru Limited and Members (franchisees) of Raleru Limited including their families, agents and anyone else connected with the Olympus & Camera House Photo Rally Competition.

3.     Total Prize Pool values are up to $5696 (including GST). Three Category prizes are available, an Olympus OM-D E-M10 Mark II Single Lens Kit, each valued at $1199 (including GST). One major prize, for the overall winner is available, an Olympus OM-D E-M5 Mark II PRO Kit, valued at $2099 (including GST). Prize values are based upon the recommended retail prices at the time of printing (inclusive of GST). The Promoter accepts no responsibility for change in prize value between now and the ultimate prize redemption date.

4.     The winner for each Category, along with the Overall Prize Winner, will be judged by Camera House Head Office. Competition Winner’s Photos and names will be announced Monday 9th October by Camera House Head Office. The winners’ photo and names will be announced on http://www.camerahouse.com.au/photo-rally at 12pm Midday.

The three categories which form this competition are: Water, People & Travel.

Each category winner will be selected from within the respective category submissions. The Overall winner will be a photograph, which could have been submitted within any of the three categories, but is determined to be the best photograph of all submissions irrespective of its category.

5.     To enter the Promotion Eligible Entrants must, during the Promotional Period, submit a photograph taken by them to the “Olympus & Camera House Photo Rally Competition” on the Camera House website. Entrants can find the application via our Photo Rally page on the Camera House national website http://www.camerahouse.com.au/photo-rally) It is each entrant's responsibility to adhere to the requirements of the Terms and Conditions, the prevailing terms and conditions of the Promoter’s websites respectively and the Promoter will take no responsibility for any entry or photograph that has been uploaded incorrectly.

6.     The Olympus & Camera House Photo Rally Competition promotion commences at 12 midday Monday 4th September 2017 and closes 12 midnight Saturday 30th September 2017.

7.     Entrants can only enter a maximum of 2 photos per category; Water, People & Travel. The photograph entered must be a photo that depicts the associated category.

8.     The photos you submit must be a .jpg, .bmp, .tiff, .psd, .png, & .gif format no more than 4 MB in size.

9.     Entries will be judged by Camera House Head Office between Monday, October 2nd and Sunday, October 8th, 2017.

10.  Winners will be notified by telephone/email/ Facebook announcement. The Promoter reserves the right to publish the Winner’s name and photograph.

11.  If you win, you must claim your price within 21 days after we have notified you.  We will send your prize to you within 28 working days after you have claimed the prize.

12.  The judge’s decision is final and no correspondence will be entered into.

13.  All entrants acknowledge that the Promoter has the right to use the submitted photos for promotion on our social media platforms where the photographer will be appropriately acknowledged. If we intend to use photos anywhere else we will request an endorsement from the photographer.

14.  Each Eligible Entrant warrants to the Promoter that: (a) their photograph was taken by them and that it does not infringe the rights of any third party, including but not limited to, copyright, trademarks, trade secrets, privacy, publicity, personal or proprietary rights; and (b) he or she has obtained the consent of any recognisable person or persons who are the subject of photograph to submit the photograph and for it to be used as outlined in these terms and conditions. Each Eligible Entrant agrees to indemnify the Promoter against all costs and claims by third parties arising from their breach of these warranties. Eligible Entrants consent to any use of their entry which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth).

15.  Incomplete, indecipherable, or illegible entries will be deemed invalid. The Promoter reserves the right to disqualify contestants. Fraudulent activities will be monitored and will lead to exclusion.  The Promoter reserves the right to disqualify any entry where it reasonably suspects that such materials are prohibited by these Terms and Conditions, any relevant law, or are otherwise deemed inappropriate. This is at the Promoter's absolute discretion and discussions will not be entered into. Images that are considered unlawful or contain objectionable content, harassing, defamatory, abusive, threatening, harmful, obscene, profane, sexually oriented, racially offensive, contain nudity or otherwise objectionable will not be acceptable and deemed invalid.

16.  If the Prize (or part of the Prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the Prize (or that part of the Prize) with a prize to the equal value and/or specification.

17.  The Prize is not transferable or exchangeable and cannot be taken as cash.

18.  If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law to (a) disqualify any Eligible Entrant or voter; or (b) to modify, suspend, terminate or cancel the Promotion, as appropriate.

19.  Any cost associated with accessing the Promotional Website is the entrant's or voter's responsibility and is dependent on the Internet service provider used.

20.  The use of any automated entry software or any other mechanical or electronic means that allows an entrant or voter to automatically enter repeatedly is prohibited and will render all entries or votes submitted by that entrant or voter invalid. The Promoter reserves the right to determine this in its absolute discretion.

23.  Unfortunately, no data transmission over the Internet can be guaranteed as totally secure.  Whilst we endeavour to protect such information, we do not warrant and cannot ensure the security of any information which you transmit to us.  Accordingly any information which you transmit to us is transmitted at your own risk, however, once we receive your transmission, we will take reasonable steps to preserve the security of such information.

24.  The Terms and Conditions, and the use of the Site and any contents there of, are in all respects governed by and according to the laws of the State of New South Wales, Australia. By using the Site, you irrevocably agree to submit to the exclusive jurisdiction of the courts of New South Wales, Australia, for the resolution of any dispute of any kind whatsoever, including without limitation any dispute arising out of the interpretation or application of the Terms and Conditions, or your use of the Site or any material contained therein, or accessed thereby.
