WCL’S EMPIRE TODAY HOME FRESH CARPET SWEEPSTAKES
I. NAME OF SPONSOR(S)
“Windy City LIVE” and WLS Television, Inc. (Hereinafter collectively referred to as “Sponsor”).
II. ELIGIBILITY
Open only to legal residents of Illinois and Indiana; 21 years of age or older and must reside in and own their own residence in one of the following counties: in Illinois - Lake, McHenry, DeKalb, Kane DuPage, Cook, Kendall, Will Grundy, Kankakee, La Salle; in Indiana - Lake, Porter, La Porte, Newton, Jasper (“Empire Today Service Area”).
Any individuals (including but not limited to employees, consultants, independent contractors, and interns) who have, within the past six months, performed services for WLS Television, Inc., any organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the Sweepstakes or supplying the prize, and/or their respective parent, subsidiary, affiliated and successor companies, and immediate family and household members of such individuals, are not eligible to enter or play. "Immediate family members" shall mean parents, step-parents, children, step-children, siblings, step-siblings, or spouses. "Household members" shall mean people who share the same residence at least three months a year.
III. HOW AND WHEN TO ENTER
NO PURCHASE NECESSARY.
You may select one of the two following methods of entry:
Entrants must go to the Windy City LIVE web site (http://www.WindyCityLIVE.com), click on the “Promotions” graphic and scroll down to the “Empire Today” Sweepstakes information to click the official entry link. Entrants will be required to submit a first and last name, complete home address including house number, street name, city, state and zip code, contact phone number, a valid email address, and a photo of the room/floor Entrant wants replaced. Entrants will also be given the option to opt-in to be added to the “Empire Today” email list. Opting-in is not required to enter and will not improve your chances of winning.
Entrants must go to the Windy City LIVE Facebook page: (http://www.Facebook.com/WindyCityLIVE) and click the link within the “Empire Today” post on the page. Entrants will be required to submit a first and last name, complete home address including house number, street name, city, state and zip code, contact phone number, a valid email address, and a photo of the room/floor Entrant wants replaced. Entrants will also be given the option to opt-in to be added to the “Empire Today” email list. Opting-in is not required to enter and will not improve your chances of winning.
All submitted photos must meet “Photo Guidelines” defined as:
a) No individuals shall appear in the photo submission.
b) Photo must clearly show the floor in a single room of Entrant’s home.
c) Submissions must be in one of the following file formats: .gif, .jpg, .png, .bmp, .tig and the photo file size cannot exceed 50MB.
d) Entrants may not submit photos that have been digitally altered or otherwise enhanced in any way. The floor that appears in the submission must be the actual flooring inside Entrant’s home, which may be subject to confirmation by Sponsor prior to awarding any Prize.
e) Entrants must own all rights to the submitted photo.
f) No background artwork shall appear in submission unless it is the original work of the Entrant.
Entries remain the property of Sponsor and will not be returned or acknowledged.
Sweepstakes begins on July 9, 2018 at 1:00 PM Central Time (CT) and ends on July 21, 2018 at 6:00 AM CT (“Promotion Period”).
Limit one (1) entry per person regardless of method of entry (i.e., you cannot enter by both methods).
For Facebook entries, you understand that you are providing your information to Sponsor and not to Facebook, and that this Sweepstakes is in no way sponsored, endorsed, administered or associated with Facebook. Any questions, comments or complaints regarding this Sweepstakes should be directed to Sponsor, and not Facebook.
During the entry process, you may be asked to consent to receive promotional and marketing emails from ABC, ESPN and/or other members of the Walt Disney family of companies and/or prize suppliers. Consenting to receive promotional, marketing or reminder emails is optional, does not have to be agreed to in order to be eligible to enter the Sweepstakes and does not improve your chances of winning. In the event you do consent to receive these emails, the use of such emails shall be subject to ABC’s Privacy Policy, available at www.disneyprivacycenter.com. During the entry process, you may be asked to “like” Sponsor’s Facebook page. Consenting to “like” Sponsor’s Facebook page is optional and does not improve your chances of winning.
By clicking the check box next to the statement: “I have read and accept these Official Rules,” and the submit button, you signify that you have read and agree to these official rules and meet the eligibility requirements. If you do not check the box indicating your confirmation of and agreement to the above, then you will not be entered in the sweepstakes and cannot win a prize.
Sponsor can provide no technical support and accepts no responsibility for insuring the receipt or successful submission of your entry. Mass entries or entries generated by a script, macro or use of automated methods will be disqualified. Sponsor is not responsible for failed, partial or garbled computer transmissions, or for technical failures of any kind, including but not limited to electronic malfunction or damage of any network, hardware or software. If for any reason the Sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or other causes that corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes, Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Sweepstakes. No responsibility is assumed for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries; or any problems or technical malfunctions of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or electronic entry to be received on account of technical problems or traffic congestion on the Internet or at any Web-site, or any combination thereof, including any injury or damage to entrant’s or any other person’s computer related to or resulting from participation in or downloading any materials from this Sweepstakes. In the event of a dispute over an electronic entry, prize will be awarded to the owner of the e-mail account, not the name on the entry form. Except as otherwise contemplated by these Rules, and to the extent entrants may otherwise elect at the time of entry, information provided by you for these Sweepstakes is subject to Sponsor’s Privacy Policy located at https://disneyprivacycenter.com/privacy-policy-translations/english.
IV. HOW AND WHEN WINNERS WILL BE SELECTED AND NOTIFIED
One (1) Grand Prize Winner (“Winner”) will be selected at random on or about July 23, 2018, at 9:30 AM CT from all valid entries.
In the event winner is deemed ineligible, fails to comply with Sweepstakes procedures, or is not available to claim prize during specified dates, then an alternate winner will be selected at random, time permitting.
Winner will be notified by e-mail and/or phone on or about July 23, 2018 at 10:30 AM CT.
Limit one prize per winner for this Sweepstakes; People who have won any other prizes on station within 90 days of entry are not eligible to enter this Sweepstakes.
Odds of winning depend on number of valid entries received.
Final determination of winners are always conditional on verification of eligibility and compliance with all rules and procedures.
WINNER MUST RETURN ELIGIBILITY PAPERWORK NO LATER THAN 5:00 PM CT, WEDNESDAY, JULY 25, 2018. FAILURE TO DO SO WILL CAUSE WINNER TO FORFEIT PRIZE AND A NEW WINNER WILL BE SELECTED.
Winner must be available on a mutually agreeable date and time between July 26, 2018 and July 30, 2018 for Sponsor and Prize Supplier (defined below) to inspect the space in which the flooring will be installed.
Flooring must be installed between August 1, 2018 and August 3, 2018 at a mutually agreeable date and time, unless Prize Supplier dictates otherwise, and installation of the flooring will be videotaped for a future “Windy City LIVE” broadcast.
V. PRIZE(S)
Opting-in is not required to enter and will not improve your chances of winning.
GRAND PRIZE: One (1) flooring credit from Empire Today in the amount of up to five thousand dollars ($5000.00) for use towards the purchase of available and qualifying Home Fresh carpeting only in any single room in Winner’s home located in the Empire Today Service Area, subject to Empire Today terms and conditions pursuant to a product and services contract; ARV of Grand Prize: $5000.00 USD.
Prize must be used for Home Fresh carpeting only.
Prize will be awarded as a one-time Empire Today credit. Flooring credit must be used in one transaction and if the cost of flooring in such transaction is less than the credit amount won, Winner will NOT receive any remaining balance in cash. Flooring credit awarded in this Sweepstakes must be used for qualifying Empire Today products and services installed no later than August 3, 2018, unless Empire Today dictates otherwise, at a residence owned by the Winner within the Empire Today Service Area and subject to execution of a prize acceptance document from Empire Today and a contract with Empire Today for the applicable products and service, or the flooring credit will be forfeited. Flooring credit issued may not be combined with other offers and is not valid on prior purchases. All terms and conditions regarding the purchase to which the credit is applied will be subject to negotiation and Winner agrees to enter into an Empire Today sales contract.
If the actual value of the prize is less than stated approximate retail value, the difference will not be awarded.
All expenses not specifically provided for herein are the winner’s sole responsibility. Some restrictions may apply.
Federal, state and local taxes, if any, are the sole responsibility of the winner, who will receive an IRS Form 1099 reflecting the final actual value of any prize valued at $600 or more.
Empire Today is the “Prize Provider.” Sponsor and Administrator, and not Empire Today, are solely responsible for all aspects of the sweepstakes other than Empire Today’s products and services. Empire Today, and not Sponsor or Administrator, is solely responsible for Empire Today’s products and services
Winners are not entitled to exchange or transfer prizes or to obtain cash or other substitutes, but Sponsor in its sole discretion may substitute prizes of equal or greater value.
VI. RELEASES
By participating, entrants agree to be bound by these Rules and the decisions of the Sponsor, Judges and/or the Sweepstakes administrator, which shall be final in all respects.
By participating in this Sweepstakes and accepting any prize that they may win, entrants agree to release “Windy City LIVE,” WLS Television, Inc., their parent, subsidiary, affiliated and successor companies, advertising and promotion agencies and prize suppliers, and each of their respective officers, directors, agents, representatives and employees, as well as each of their respective successors, representatives and assigns, Empire Today and Facebook (collectively, the “Released Parties”) from any and all actions, claims, injury, loss or damage arising in any manner, directly or indirectly, from participation in this Sweepstakes and/or acceptance or use of the prize.
Winners agree that the Released Parties have not made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to any prize, including but not limited to its quality, mechanical condition or fitness for a particular purpose. Any and all warranties and/or guarantees on a prize, if any, are subject to the manufacturer’s terms and therefore winners agree to look solely to such manufacturers for any such warranty and/or guarantee.
Entrants authorize the Released Parties to use their name, voice, likeness, biographical data, city and state of residence and entry materials in programming or promotional material, worldwide in perpetuity, or on a winners’ list, if applicable, without further compensation unless prohibited by law. Sponsor is not obligated to use any of the above mentioned information or materials, but may do so and may edit such information or materials, at Sponsor’s sole discretion, without further obligation or compensation.
By submitting entry materials, entrants certify that such materials are original and created by entrant, that entrants have the necessary rights, permission and authority to submit such materials, and, if applicable, that entrants maintain a valid copyright in the materials. Entrants acknowledge that such materials may be included and/or discussed in a broadcast, that such discussion may include statements or opinions by the broadcast talent or others about the entrants, the entrants’ appearances and/or the materials, and that those statements and opinions may be considered surprising, humiliating, embarrassing, derogatory, defamatory or otherwise offensive or injurious to them. Entrants release the Released Parties from any actions, claims, injury, loss or damage allegedly caused, directly or indirectly, by any use of the materials and/or such statements or opinions made in connection with them during a broadcast.
To claim prize, winner must: (a) provide proof of age, identity and residency; and (b) sign and return affidavit of eligibility/compliance with Rules and publicity/liability release and indemnification all within the time period specified by Sponsor.
VII. MISCELLANEOUS; WINNERS’ LIST
Void where prohibited. All federal, state and local laws and regulations apply.
Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process and to cancel, terminate, modify and/or suspend the Sweepstakes in the event of tampering or other circumstances, including but not limited to acts of God or civil disturbance that render it impractical or impossible to complete or fulfill the Sweepstakes as originally planned.
List of winners and these Rules will be posted on WindyCityLIVE.com for at least 30 days after winner(s) are notified or announced.
