Lord Mayor’s Green Heart Photography competition entry terms and conditions

1. Information on how to enter the competition forms part of the competition conditions.

2. Competition entry is deemed acceptance of these competition terms and conditions.

3. Prizes: There are a total of five prizes to be won for this competition, awarded as follows:

Overall winner prize: total value $1099

One Tangalooma Getaway Package for two adults and two children valued at up to $599 including:

Major prizes: total value $395 each

One of three Tangalooma Classic Day Cruise Package for two adults and two children valued at up to $395 each including:

Minor prizes: total value $100 each

One of three Ted’s Camera store vouchers will be provided to the first runner-up of each category. Vouchers will be either emailed or posted to winners, pending written confirmation of their preferred collection method.

School participation prizes:

One of each primary and secondary school with the greatest number of students who submit elidable entries will receive an image gallery printing package. Image gallery printing package details:

Prizes are not exchangeable or transferable, unless deemed so by the prize provider, and cannot be redeemed for cash. Any additional expenses incurred by the prize winner, other than those outlined in these competition conditions, are the responsibility of the prize winner. The prize itself is subject to the specific terms and conditions of the prize providers.

The prize must be redeemed by the prize winner, unless the prize winner is under 18 years of age, in which case the prize winner’s parent or guardian is required to redeem the prize on the prizewinner’s behalf.

4. The competition period: The competition opens for entries at 12.01am on Friday 8 September 2017 and closes at 11:59pm on Sunday 8 October 2017.

5. How to enter:

Entries must be received:

(a) via the Facebook competition application at facebook.com/BrisbaneCityCouncil,

(b) with all Entrant Registration fields (completed via 5.(a) above) fully and legibly completed and submitted by or on behalf of each entrant to the Promoter. There is no limit to the number of students each school invite to participate in the competition.

(c) by no later than 11:59pm on 8 October 2017

(d) with the file named: entrant-name_title-of-work (e.g. John-Smith_my-Brisbane) and be dated

(e) Entrants may be required to submit their entry on CD/DVD with a higher resolution version for reproduction/exhibition purposes if requested.

6. Eligibility:

(a)  General: to be eligible to register for and enter this competition, a person must:

(b)  Primary and secondary school categories: To be eligible a person must:

Primary and secondary school students are eligible to enter both the school age category and the open category.

7. Competition judging: Entries will be shortlisted to 30 entries by a judging panel made up of Council’s officers at Brisbane City Council, Brisbane Square offices between 9 October 2017 and 13 October 2017. Eligible entries will be judged on merit in accordance with the following criteria:

(a) originality;

(b) creativity;

(c) photo content;

(d) ability to showcase Brisbane and Brisbane’s natural environment; and

(e) interpretation of the theme ‘keeping Brisbane clean, green and sustainable’.

From the 30 shortlisted entries, one major prize winner, three category prize winners and three category runners’ up will be determined through a public vote via Council’s Facebook page between 12:00am 14 October 2017 and 11:59pm 24 October 2017.

In the event of a tie a judging panel of Council Officers will have the final vote to determine one winner.

The winners of school participation prize will be the top primary and top secondary school with the greatest number of eligible student entrants.

8. Winner notification: All prize winner will be announced at the exhibition opening night event at the QPAC Melbourne Street Green, Melbourne Street, South Bank, Brisbane by an officer of the Promoter on Friday 27 October, 6:00pm – 8:00pm, and notified by email/telephone on 30 October 2017 by a Council officer. If the winner does not claim the prize within 30 days of the notification date, the Promoter may re-decide the prizewinner until a contactable winner has been located and the prize is claimed.

9. Exhibition: An online gallery will display a selection of approved images. All finalist images will form part of the 2017 Lord Mayor’s Green Heart Photography Competition Council Flicker gallery and may be used in social media and marketing as per Item 11.

All finalist images will be printed and appear as part of a roving gallery exhibition at selected Brisbane sites from 26 October 2017 until 2 February 2018. Entrants whose images are selected for the exhibition will be notified by phone or email by 20 October 2017.

Council reserves the right to refuse display of any entry deemed unsuitable for public exhibition. This includes material that contains swearing, nudity, racist, sexist or political comment, political satire or political criticism or may otherwise be potentially embarrassing to Council.

10. No Liability of Promoter: The Promoter accepts no responsibility whatsoever for late, misplaced, lost or ineligible entries. The Promoter makes no representations or warranties as to the quality, suitability or merchantability of the prize.  To the extent permitted by law, the Promoter is not liable for any loss or damage whatsoever which is suffered (including but not limited to direct or consequential loss) or for any personal injury sustained in connection with the entry into the competition or acceptance or use of the prizes.  This paragraph is not intended to exclude any liability which cannot be excluded under Australian consumer protection laws.  Any such liability is limited to the resupply of the subject prize.

11. Important – Copyright and Privacy Consent:  By entering into the competition, the nominated entrant:

(a) grants to the Promoter (and agents or contractors acting on behalf of the Promoter) the non-exclusive irrevocable free-of-charge right to use, reproduce, modify, adapt, edit, record, video, take images and photographs of, and publish and communicate to the public; and

(b) consents to their name (in whole or in part) being acknowledged as the author of:

- the entrant’s responses to the entry form questions and accompanying photograph/s, in any media and within any material relating to or arising out of the Promoter’s Green Heart program or other Council program including for promotional, marketing and publicity purposes relating to the Promoter’s Green Heart program or other Council programs.  The nominated entrant acknowledges and accepts that the Promoter (and agents and contractors acting on behalf of the Promoter) are not obliged to use the nominated entrant’s submitted photograph/s in Green Heart Photography Competition and/or their name on any such materials or in any media.

(c) By entering this competition, the entrant confirms that they are the owner of all copyright

in the photograph/s submitted and that all persons appearing in the photograph/s have consented to the entrant submitting the photograph/s as part of this competition, including the Promoter’s right to use the photograph/s in accordance with clause 10.

(d) If for any reason, Council in its sole discretion decides not to accept a photograph submitted as part of this competition, the entry will be excluded and the entrant is not eligible to be awarded a prize. Photographs that are considered unlawful, harassing, defamatory, abusive, threatening, harmful, and obscene or otherwise contain objectionable or inappropriate content will be deemed invalid and will be rejected. Council’s decision is final and no correspondence will be entered into.

12. Force Majeure:  If for any reason this competition is not capable of running as planned (including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter), which corrupts or affects the administration, security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right, in its sole discretion, to take any action that may be available, and to cancel, terminate, modify or suspend the competition. The Promoter reserves the right in its sole discretion to disqualify all entries from any individual who tampers with, or benefits from tampering with, the entry process which as a result corrupts or affects the administration, security, fairness, integrity or proper conduct of the competition.

13. In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders its determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strikes; the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions.

14. Council reserves the right to modify these terms and conditions at any time and to cancel or amend the competition at any time without notice or further recourse to the entrants.

15. This competition is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants accept that they are providing their information to Brisbane City Council and not to Facebook. Entrants and participants in this competition release Facebook and its associated companies from all liability arising from this competition.

16. This promotion is powered by Woobox. Woobox does not sponsor, administer or endorse this competition. Participants must read and agree to Woobox’s Terms and Conditions of Use and Privacy Policy before entering or participating in this competition.
