PROMOTION OFFICIAL RULES
I. NAME OF SPONSOR(S)
“Windy City LIVE” and WLS Television, Inc., 190 N. State Street, Chicago, IL 60601 (Hereinafter collectively referred to as “Sponsor”).
II. PROMOTION PERIOD: Promotion will take place on May 18, 2018, beginning at 11:00AM Central Time and ending at 2:00PM Central Time or when all prizes have been awarded, whichever is sooner ("Promotion Period").
III. ELIGIBILITY
Promotion is open to legal residents of the United States, 18 years of age or older with a valid US driver license at time of entry, who are in attendance to accept prize at Gas Station during the Promotion Period.
By participating, Entrants agree to be bound by these Official Rules and the decisions of Sponsors which shall be final in all respects. By entering, Entrants agree to participating in a videotaped or live broadcast, in connection with the Promotion, which may be used by Sponsor in any and all media, now or hereafter, worldwide in perpetuity, without further obligation or compensation to the Entrants or any third party, except where prohibited by law.
Any individuals (including but not limited to employees, officers, directors, consultants, independent contractors, and interns) who have, within the past six months, performed services for WLS Television, Inc., Sponsor, or any organizations responsible for sponsoring, fulfilling, administering, advertising, promoting the Promotion or supplying the prizes, and each of their respective parent, subsidiary, related and affiliated companies, as well as persons involved in the production, and immediate family and household members of such individuals, are not eligible to enter or win. "Immediate family members" shall mean parents, step-parents, children, step-children, siblings, step-siblings, or spouses. "Household members" shall mean people who share the same residence at least three months a year, whether related or not. Potential Winner may be required to provide proof of eligibility prior to prize award. Subject to all applicable federal, state, local and municipal laws and regulations.
III. HOW AND WHEN TO ENTER
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILLNOT IMPROVE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED.
To enter: Entrants must comply with these Official Rules, and winning a prize is subject to availability and contingent upon fulfilling all requirements for Entry.
Entrant should Watch ABC 7 Eyewitness News, beginning at 11:00AM Central Time ("CT") during the Promotion Period for the secret location in the Chicago area, Shell gas station (“Gas Station”) revealed on-air during the broadcast. ABC 7 will announce instructions on-air for Entrants to follow. Entrants must fill out an Enter-For-A-Chance-To-Win sheet with their first and last name, city and state of residence, email address and telephone number (“Entry Sheets”). Entry Sheets must be (1) fully completed and (2) submitted to Sponsor within the Promotion Period. No other form of entry will be accepted. If Potential winner is ineligible or otherwise not in compliance with these official rules, then the Potential Winner may be disqualified and forfeits the prize. Sponsor’s computer shall be the official time clock for the Promotion.
Limit one (1) entry per person, per Automobile (“Vehicle”) per household during the Promotion Period, regardless of the number of vehicles the person may have.
Commercial Vehicles are not eligible. Sponsor can provide no support and accepts no responsibility for insuring the receipt or successful submission of your Entry. Mass Entries or Entries generated by use of automated methods, unauthorized, altered or fraudulent in nature will be disqualified. Sponsor is not responsible for lost, late, illegible, stolen, incomplete, invalid, unintelligible, or any alteration thereof, Entries or any administrative error, delay, interruption, defect, operation or disruption in the entry process, including traffic congestion, whether mechanical, human or electronic. Sponsor reserves the right, in its sole discretion to disqualify any individual who tampers or disables the entry process and to cancel, terminate, modify or suspend the promotion. All Entries will remain property of Sponsor, no entry will be returned.
Except as otherwise contemplated by these Rules, and to the extent Participants may otherwise elect at the time of Entry, information provided by you for these Promotion is subject to Sponsor’s privacy policy located at https://disneyprivacycenter.com/privacy-policy-translations/english (“Privacy Policy”).
IV. HOW PARTICPANTS WILL BE SELECTED AND NOTIFIED
During the Promotion Period, Participants will line-up, single file, in their Vehicles at the Gas Station as directed by Windy City LIVE staff or local police authorities.
Upon satisfaction of all rules and conditions a Winner may accept the prize.
Starting at 1:00PM CT, Windy City LIVE staff will direct Participants to available gasoline filling stations. Participants must pump their own gasoline into their Vehicles.
Promotion ends at 2:00PM CT May 18, 2018 or once two hundred (200) Vehicles have participated, whichever comes first. Once there are two hundred (200) entrants that have successfully participated, the Promotion will be over and no other prizes will be awarded.
At 2:00PM CT, upon the end of the Promotion Period, only Vehicles that have already legally entered Gas Station property via the authorized street entrance designated for Promotion will be allowed to participate. Any remaining Vehicles on the street will not be allowed to Participate.
A Windy City LIVE representative at Gas Station will make the final determination whether a Vehicle is on Gas Station property.
Odds of participating depend on the number of eligible entries and participating Vehicles present at gas station.
By entering in the Promotion, entrants fully and unconditionally agree to be bound by these rules, which will be final and binding in all matters relating to the Promotion. Final determination of participation is always conditional on verification of eligibility and compliance with all rules and procedures. In the event that a Winner is deemed ineligible, fails to comply with procedures, is not available to participate or claim the prize during specified time, or does not respond to Sponsors’ notification of winning, then prize will be forfeited and the potential Winner will be disqualified without compensation of any kind and the next Entrant will be selected to win the prize, time permitting, or Sponsors reserve the right to terminate the Promotion at their sole discretion.
V. PRIZE
Up to 200 winners will receive a Prize. Prize is One (1) Unleaded Gasoline Fill-Up up to Twenty-five dollars ($25); ARV of Prize: $25.00 US. Total ARV of all prizes combined: $5000. Sponsor will determine the grade of unleaded gasoline. No substitution or transfer allowed except, at Sponsor's sole discretion, a prize of equal or greater value may be substituted. Sponsor will not replace any lost, mutilated or stolen tickets, vouchers, certificates or prizes. Prize elements may not be separated. Prize cannot be used in conjunction with any other promotion or offer.
All expenses not specifically provided for herein are the Winners’ sole responsibility. Some restrictions may apply.
Federal, state and local taxes, if any, are the sole responsibility of the winner, who will receive an IRS Form 1099 reflecting the final actual value of any prize valued at $600 or more.
The Winners may be announced on-air on ABC7 and/or online on WindyCityLIVE.com and/or social media accounts, and/or Sponsors may make recordings of the Winners receiving the prize, which recordings may appear on-air on ABC7 and/or online on WindyCityLIVE.com and/or social media accounts, except where prohibited by law. Any announcement or appearance on-air or online is subject to availability. Sponsors are not responsible for cancellation or preemption of the Promotion or the Sponsor’s program or for other circumstances that make it impractical or impossible to fulfill this element of the prize. This element of the prize has no approximate retail value, and if it becomes impractical or impossible to fulfill this element, Sponsors’ only obligation will be to provide the remainder of the prize, if any. Prize elements may not be separated.
In the sole discretion of Sponsors, Entrants’ may be featured in videotaped and/or live broadcast segments on ABC7, including promotion thereof, or on Sponsor’s social media accounts, or may be used in connection with the marketing and advertising of the Promotion or Sponsor by any means or method whether now known or hereafter devised and in all media, including, but not limited to online or social media, worldwide in perpetuity, except where prohibited by law. If featured or used, Sponsors reserve the right to edit any submission materials in their sole discretion.
VI. RELEASES
By participating, Participants agree to be bound by these official rules and the decisions of the Sponsor, Judges and/or the Promotion administrator, which shall be final in all respects.
By participating in this Promotion and accepting any prize that they may win, Entrants agree to release, defend, indemnify, and hold harmless, Sponsor, WLS Television, Inc., its parent, subsidiary, affiliated and successor companies, advertising and promotion agencies and prize suppliers and/or promotional partners (including without limitation JPMorgan Chase Bank, N.A. and its affiliates’ and Fleishman-Hillard Inc.), and each of their respective officers, directors, agents, representatives and employees, as well as each of their respective successors, representatives and assigns, and Facebook (collectively, the “Released Parties”) f, from, but not limited to, any and all actions, complaints, claims, injuries, liabilities, fees (including reasonable attorney’s fees), royalties, costs, losses or damages arising in any manner, directly or indirectly, by whomever or wherever asserted, from a.) Entrants’ participation in the promotion, including without limitation any claims in the nature of personal injury, property damage, death, or claims in the nature of violation of rights of publicity or privacy b.) Sponsors’ exercise of the rights granted herein and/or c.) the acceptance, use or misuse of any prize or portion of any prize.
Participants authorize the Released Parties to use their name, voice, likeness, biographical data, city and state of residence and entry materials broadcast live and/or in recorded programming or promotional material, worldwide in perpetuity, or on a winner’s list, if applicable, without further compensation unless prohibited by law. Sponsor is not obligated to use any of the above mentioned information or materials, but may do so and may edit such information or materials, at Sponsor’s sole discretion, without further obligation or compensation.
Entrants acknowledge that any Entries and/or Materials may be included and/or discussed in a broadcast or online, that such inclusion or discussion may include statements or opinions by the broadcast talent or others about the Entrants, the Entrants’ appearances and/or the Entries/Materials, and that those statements and opinions may be considered surprising, humiliating, embarrassing, derogatory, defamatory or otherwise offensive or injurious to them, Sponsors’ employees, their studio or at-home audience and/or other third parties. Entrants release the Released Parties from any actions, claims, injury, loss or damage allegedly caused, directly or indirectly, by any use of the Entries/Materials and/or such statements or opinions made in connection with them during a broadcast or online.
To claim prize, (a) winner may be required to provide proof of eligibility (b) winner may be required to sign and return affidavit of eligibility/compliance with rules, publicity/liability release and indemnification, all within the time period specified by Sponsor.
VII. MISCELLANEOUS; WINNERS’ LIST
The parties waive all rights to trial in any action or proceeding instituted in connection with the Promotion or these rules. Any controversy or claim arising out of or relating to these rules and/or the Promotion shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. Any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted in the State of New York, City of New York. THESE OFFICIAL RULES AND THE INTERPRETATION OF ITS TERMS SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF NEW YORK WITHOUT REGARD TO ITS CONFLICTS OF LAWS RULES. For any matters which are not subject to arbitration as set forth in these rules and/or in connection with the entering of any judgment on an arbitration award in connection with these rules and/or the Promotion, the parties irrevocably submit and consent to the exclusive jurisdiction and venue of the state and federal courts located in or closest to the City of New York in the State of New York. The parties agree not to raise the defense of forum non conveniens.
Void where prohibited. All federal, state and local laws and regulations apply.
Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process and to cancel, terminate, modify and/or suspend the Promotion in the event of tampering or other circumstances, including but not limited to acts of God or civil disturbance that render it impractical or impossible to complete or fulfill the Promotion originally planned.
CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
IN NO EVENT WILL THE RELEASED PARTIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR PARTICIPATION IN THE PROMOTION, OR DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM ANY WEBSITES ASSOCIATED WITH THE PROMOTION. WITHOUT LIMITING THE FOREGOING, THIS PROMOTION AND ALL PRIZES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS.
