Contest Rules – FACEBOOK (the "Contest Rules")
The Contest is open only to residents of Canada (excluding Quebec) who are 18 years of age or older.
For the purposes of the Contest, the "Contest Group" consists of the Sponsor, together with its affiliates (including without limitation its parent, sister and subsidiary companies), the independent contest judge, retailers, franchisees, advertising and promotional agencies, suppliers of materials and services related to the Contest, and any other corporation, partnership, sole proprietorship or other legal entity directly involved in the Contest and their respective directors, officers and agents (collectively, the "Contest Group Entities").
Employees of the Contest Group Entities, members of the immediate family of such employees and any persons with whom such employees reside are not eligible to enter the Contest. For these Contest Rules, "immediate family” means mother, father, sister, brother, son, daughter, married or common law spouses, regardless of where they reside. Groups, clubs, organizations, businesses and commercial and non-commercial entities are not eligible to enter the Contest.
How to Enter
There are one hundred twenty (120) prizes to be won. Ten prizes will be awarded each day during the Contest Period. The number of prizes available to be won will be reduced as prizes are awarded pursuant to these Contest Rules.
Each prize consists of the following:
-December 4, 2017- Palmer’s Cocoa Butter Formula Swivel Stick. Approximate retail value of each prize is $6.50 CAD
-December 5, 2017- Palmer’s Cocoa Butter Formula Skin Therapy Oil Face. Approximate retail value of each prize is $11.50 CAD
- December 6, 2017- Palmer’s Cocoa Butter Formula Skin Therapy Cleansing Oil Face. Approximate retail value of each prize is $9.50 CAD
-December 7, 2017- Palmer’s Cocoa Butter Formula Lotion. Approximate retail value of each prize is $7.50 CAD
-December 8, 2017- Palmer’s Coconut Oil Formula Lotion. Approximate retail value of each prize is $5.50 CAD
-December 9, 2017- Palmer’s Coconut Oil Formula Body Cream. Approximate retail value of each prize is $7.50 CAD
-December 10, 2017- Palmer’s Coconut Oil Formula Body Oil. Approximate retail value of each prize is $5.50 CAD
-December 11, 2017- Palmer’s Cocoa Butter Formula Skin Therapy Oil. Approximate retail value of each prize is $11.00 CAD
-December 12, 2017- Palmer’s Cocoa Butter Formula Firming Lotion. Approximate retail value of each prize is $6.00 CAD
-December 13, 2017- Palmer’s Cocoa Butter Formula Facial Scrub. Approximate retail value of each prize is $6.00 CAD
-December 14, 2017- Palmer’s Cocoa Butter Formula Concentrated Cream. Approximate retail value of each prize is $7.50 CAD
-December 15, 2017- Palmer’s Cocoa Butter Formula products: Swivel Stick, Skin Therapy Oil Face, Skin Therapy Cleansing Oil Face, Body Lotion, Skin Therapy Oil, Firming Lotion, Facial Scrub and Concentrated Cream and Palmer’s Coconut Oil Formula products: Body Lotion, Body Cream and Body Oil. Approximate retail value of each prize is $84.00 CAD
The prize must be accepted as described in these Contest Rules and while it may be transferred by the winner to another person, it cannot be substituted for another prize, or exchanged in full or in part for cash, except in the Sponsor's discretion. The Sponsor reserves the right to substitute other of the Sponsor's products as all or a portion of the prize if the prize or a portion of it cannot be awarded as described. Any prize is “as is” without further warranty of any kind.
Random draws will be conducted daily during the Contest Period by an independent contest judge at MB Communications 3176 Pinemeadow Drive Burlington ON L7M 2Z6 from all eligible entries received at the time of the random draw (a “Random Draw”). Ten potential prize winners will be selected in each Random Draw.
Selected prize winners will be contacted regarding the prize by telephone or email (using the contact information provided on the Contest entry form) (the "Notification”).
Odds of winning in each Random Draw depend on the number of eligible entries received from the beginning of and throughout the Contest Period and application of any judging criteria.
To be declared a prize winner, the Entrant selected for the prize must first:
(a) reply to the Notification by telephone or email (as required) within five (5) days after the date of receipt of the Notification;
(b) correctly answer, unaided, a time-limited, mathematical skill-testing question, posed by telephone at a mutually convenient time to be arranged via telephone or email between the Entrant selected for the prize and the Sponsor or its representative;
(c) execute and return (either by mailing to the identified address or by scanning and returning via email to the identified email address) within 10 days of it being sent by the Sponsor or its representative, a Declaration of Compliance with Contest Rules and Liability Release (in a form satisfactory to the Sponsor) confirming understanding of, compliance with and acceptance of these Contest Rules and acceptance of the prize and a release of all liability, releasing the Contest Group Entities from any liability arising from or connected with the Contest or the awarding or accepting or use of a prize;
(d) execute and return (either by mailing to the identified address or by scanning and returning via email to the identified email address) within 10 days of it being sent by the Sponsor or its representative, a Publicity Release (in a form satisfactory to the Sponsor) consenting, without further compensation, to the Sponsor's use in perpetuity, in any form or media, of the Entrant's name, city and province/territory of residence, photograph, image, likeness, voice, any statements he/she may make regarding such Contest prize and/or Contest details or information for advertising and publicity of the Contest and the products and services of the Contest Group Entities.
By accepting a Contest prize, each winner authorizes each of the Sponsor and its respective designees to use in any related publicity the winner’s name, city and province/territory of residence, photograph, image, likeness, voice, and any statements he/she may make regarding such Contest prize and/or Contest details or information for advertising and promotional purposes worldwide in perpetuity, in any form or media including the Internet, without limitation and without additional compensation or consideration, permission or notification, unless prohibited by law.
The Contest Group Entities do not assume any responsibility for, and each Entrant releases the Contest Group Entities from, any and all claims, actions, damages, demands and liabilities of whatever nature or kind arising out of, or in connection with the Entrant's participation or attempted participation in the Contest, including, without limitation, the administration of the Contest, the selection and confirmation of winners, and the arranging, awarding and use of a prize.
Without limiting the generality of the foregoing, Contest Group Entities are not responsible for:
(a) lost, stolen, late, misdirected, incomplete, illegible, damaged, garbled or irregular entries, or for any entries not received or not processed for any reason, including any technical or human error. Such entries are void;
(b) any errors, omissions, incorrect or inaccurate information in these Contest Rules, other Contest-related materials, including without limitation, printing or advertising errors, failure of or problems with any other equipment or programming associated with or used in the Contest, including without limitation the website at www.facebook.com/PalmersCanada, howsoever caused; or,
(c) any failure of or problems with the Internet or FaceBook; problems or technical malfunction of any telephone network or lines, computer online systems, servers, access providers, computer equipment or software; failure, interruption or delay of any entry (including content download) or email to be transmitted or received or processed, including failure resulting from technical, human or other error or theft; technical problems or traffic congestion on the Internet or at any website or combination thereof, including injury or damage to an Entrant's computer or to any other individual's computer (or any information/data stored thereon) related to or resulting from participating in, or downloading any material, regarding the Contest or a prize; the security or privacy of information transmitted via computer networks or for breaches of privacy due to interference by third party computer "hackers” or otherwise; any communication not received for any reason, including without limitation due to an Entrant's email filter, email system, internet connection or telephone or voicemail services; and late, lost, misdirected, or unsuccessful efforts to notify a potential winner.
In the event of a dispute, all entries will be deemed to have been submitted by the authorized account holder of the e-mail address provided on the entry form.. "Authorized account holder” is defined as the person who is assigned the e-mail address by an Internet provider, online service provider, or other organization (e.g. business, educational institute, etc.) that is responsible for assigning e-mail addresses for the domain associated with the provided e-mail address. If the identity of an Entrant is disputed, the authorized account holder associated with the e-mail account at the time of entry will be deemed to be the Entrant. A selected Entrant may be required to provide proof that he/she is the authorized account holder of the e-mail address associated with the entry form for such selected Entrant name. The sole determinant of the time for the purposes of a valid online entry in this Contest will be the Contest server machine(s) operated by the Sponsor. Any dispute shall be governed by the laws of the province (other than the province of Quebec) in which the Entrant is resident at the time of entering the Contest, failing which the dispute shall be governed by the laws of the province of Ontario.
The Sponsor reserves the right, in its discretion, to disqualify any Entrant it finds to be tampering or attempting to tamper with the entry process or the operation of the Contest or otherwise acting in an unsportsman-like or disruptive manner, or with the intent to annoy, abuse, threaten or harass any other person. Entries that contain false information and/or are late, lost, stolen, falsified, illegible, damaged, misdirected, mutilated, garbled or incomplete, altered or otherwise irregular or entries that have been submitted using robotic, automated, programmed, or through illicit means, or that do not conform with or satisfy any or all of these Contest Rules, as determined in the Sponsors’ absolute discretion, will be judged null and void and disqualified. Proof of entry transmission shall not constitute proof of receipt. The Sponsor reserves the right to refuse any entry in its absolute discretion. Any attempt by an Entrant or any other individual to undermine the legitimate operation of this Contest may be in violation of criminal and/or civil laws. Should any such attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law.
In the event of any discrepancy or inconsistency between these Contest Rules and disclosures or other statements contained in any Contest related materials, including, without limitation, the Contest entry form, these Contest Rules shall prevail, govern and control.
By entering, the Entrants agree to comply with and abide by these Contest Rules and all decisions of the Sponsor and the independent Contest judge, which shall be final and binding in all matters relating to the Contest and the awarding of a prize. The Entrants who have not complied with these Contest Rules are subject to disqualification.
This Contest is void in Quebec and where prohibited by law and is subject to all applicable federal, provincial and municipal laws and regulations in Canada.
The Sponsor reserves the right to terminate, modify or suspend the Contest or amend the Contest Rules at any time and in any way, without prior notice including to any Entrant, for any reason whatsoever. Without limiting the foregoing, if for any reason the Contest is not capable of running as originally planned, for example as a result of tampering or infection by computer virus, the Sponsor reserves the right to terminate the Contest and conduct a random draw from all eligible entries received prior to the date of termination. All entries become the property of the Sponsor and will not be returned. No correspondence will be made with or entered into except with the Entrants.

Please read through this Privacy and Data Security Policy and be sure you are comfortable with how the Sponsor collects, uses, and may share your information. In general, except as provided elsewhere in the Contest Rules, or as specifically detailed in this Privacy and Data Security Policy, the Sponsor does not sell or transfer your personal information to third parties without telling you. General Information Received From You.
The Sponsor receives and stores information you enter on this Site or that you give the Sponsor in other ways. This includes information that can identify you, including your first and last name, telephone number, postal and e-mail addresses (such information that may identify you shall be referred to from this point on as "Personally Identifiable Information"). You can choose not to provide information to the Sponsor, but in general some information about you is required in order for you to enter the Site and participate in the Contest through this Site.
The Sponsor automatically collects some information about your computer when you visit the Site. For example, the Sponsor will collect your IP address, web browser software (such as Internet Explorer or Mozilla Firefox), and referring website. The Sponsor also may collect information about your online activity, such as products you have viewed and contests you have viewed and/or entered. One of the Sponsor’s goals in collecting this automatic information is to help customize your user experience.

How The Sponsor Uses Your Information:
To Communicate With You About Your Account and The Sponsor’s Services.
The Sponsor uses other information about you for the following general purposes: to manage your account, including processing contest information and winners and providing shipping notifications, to communicate with you in general; to respond to your questions and comments; to measure interest in and improve the Sponsor’s products, services, and our Site, to solicit information from you, to resolve disputes, or troubleshoot problems, to prevent potentially prohibited or illegal activities, to enforce these Contest Rules, and as otherwise described to you at the point of collection of your information.
To Communicate Special Offers/Promotions.
The Sponsor also would like to notify you about special offers and products or services that may be of interest to you. You will have an opportunity to opt in to those communications when you register for the Contest, and you can always opt out of receiving the Sponsor’s promotional communications later by selecting the option to opt out of further communications in replying to emails to you.
To Monitor and Maintain the Quality of The Sponsor’s Site and Service.
The Sponsor uses your IP address to help diagnose problems with the Site, to administer the Site, to monitor Site usage, and to gather broad demographic information. Your IP address is used to help identify you and to aid in your navigation through the Site as determined by your customization options, if any. The Sponsor also may aggregate your IP address with other information to create anonymous Ste statistics.
The Sponsor may share your information with the following entities:
· Shippers that ship any prizes that you may win from any contest which you enter at the Site. The Sponsor does not share your email address with shippers or fulfillment houses unless they need it to fulfill your prize or communicate with you about any prize, and the Sponsor restricts its use of this information to that purpose.
· Third-party vendors who provide services or functions on the Sponsor’s behalf in connection its Site, including, for example, fraud prevention services. These companies have access to Personally Identifiable Information needed to perform their functions but are not permitted to share or use the information for any other purpose.
The Sponsor also may share your information:
· In response to subpoenas, court orders or other legal process; to establish or exercise its legal rights; to defend against legal claims; or as otherwise required by law.
· When the Sponsor believes it is appropriate to investigate, prevent, or take action regarding illegal or suspected illegal activities; to protect and defend the rights, property, or safety of its Site, its customers, or other users; and in connection with enforcing the Contest Rules.
· In connection with a corporate transaction, such as a divestiture, merger, consolidation, or asset sale, or in the unlikely event of bankruptcy.
· The Sponsor also may share aggregate or anonymous information with third parties, including advertisers and investors. This information does not contain any Personally Identifiable Information and is used to develop content and services the Sponsor hopes you will find of interest.
Except as stated in its Contest Rules, the Sponsor does not sell to third parties information you have submitted to this Site that identifies you personally.

Data Security: How The Sponsor Protects Your Information:
While no website can guarantee security, the Sponsor has implemented administrative, technical, and physical security procedures to help protect the information you provide to it. For example, only authorized employees are permitted to access Personally Identifiable Information, and they may do so only for permitted business functions. In addition, the Sponsor uses industry standard Secure Socket Layer (“SSL”) encryption when collecting and transmitting your sensitive Personally Identifiable Information.
