What Fills Your Cup Contest Official Rules

CONTEST ENTRY PERIOD
The Stella Rosa® Fill your Cup Contest begins at 12:00 am PST on June 1, 2022, and ends at 11:59 pm PST on July 31, 2022 (the “The Contest Period”).
ELIGIBILITY
The contest is open to legal residents of the United States, who are age 21 or older at the time of entry. The contest is subject to all applicable federal, state, and local laws and regulations.
OUR MISSION
We are committed to elevating the LGBTQ community, and spreading love and acceptance both within and beyond our brand. This year, we are proud partners of GLAAD. GLAAD rewrites the script for LGBTQ acceptance by ensuring fair, accurate, and inclusive representations of the LGBTQ community in media and entertainment. We will be donating $75,000 to this amazing organization to continue creating a world where everyone can live the life they love this Pride, and always.
HOW TO ENTER
Entries that are incomplete or do not adhere to the rules or specifications may be disqualified at the sole discretion of the Sponsor.
Online Contestants are subject to all notices posted online including but not limited to the Sponsor’s Privacy Policy.
Limit: You may only enter once. Therefore, only one (1) entry per person or email address during the Contest Entry Period. You may not enter more times than indicated by using multiple email addresses, identities, or devices to circumvent the rules; this will automatically disqualify you as a contestant.
PRIZES
*If alcohol shipping restrictions apply to your state, you’ll receive the equal dollar amount of the wine in additional merchandise.
WINNER SELECTION, NOTIFICATION, AND VERIFICATION
All eligible Entries received during the Contest Entry Period will be reviewed by a panel of judges selected by the Sponsor by or around the last week the contest is running, who shall use the criteria set forth below for each entry to determine potential winners. The eligible Entries will be graded based on the following pre-determined set of criteria:
For each Entry, each prompt answer will be scored based on the Judging Criteria above. The Contestant receiving the highest score from among all eligible entries received will be deemed a potential winner. In the unlikely event of a tie, the tied Entry with the highest score in Criterion C (Relevance to Pride and your personal connection) will be deemed that Entry Period’s potential winner. If additional tiebreakers are needed, the same tie-breaking mechanism will be used; however, instead of the highest score in Criterion C, determining the potential winner from among the tied entries, the highest scores in each of Criteria b, in sequence (to the extent needed) will determine the potential winner. If additional tie-breakers are still needed, the tied Entries will be judged by a separate panel of judges to be determined by the Sponsor using the judging process as outlined above. All decisions made by Sponsor with respect to the judging and award of the prizes are final and binding upon all Contestants.
The winner will be notified by the email they submitted in their entry, and they will have 24 hours to respond back to Stella Rosa® acknowledging communication and claiming their prize. The winner may be contacted via phone with one last chance to claim their prize by the number they provided in the form. If they don’t respond to the email after the 24-hour confirmation period. The winner may be asked to fill out a Publicity Release form, as well as any other forms as required by Stella Rosa®. Noncompliance with any of the above will result in disqualification and an alternate winner may be selected. An alternate winner will be chosen if a prize notification or prize is returned as undeliverable, or if a winner is found to be ineligible or not in compliance with these rules.
ORIGINAL CONTENT; OWNERSHIP
By entering, entrants warrant that to the best of their knowledge: (1) their entry is an original idea; (2) they are authorized by the owner of the design to enter the design in the Contest; and that (3) the design does not infringe the intellectual property rights of any third party. Submitted materials may not contain any third-party created content (such as third-party logos or other trademarks, copyrighted material, or material that is subject to other third-party proprietary rights including but not limited to music, images, videos, software etc.), without the written authorization or license from the content owner.
RELEASE; ARBITRATION
As a condition of entering the contest, you agree that (1) under no circumstances will you be permitted to obtain awards for, and you hereby waive all rights to claim punitive, incidental, consequential or any other damages, and any claims, judgments or awards shall be limited to actual out-of-pocket expenses; (2) all causes of action arising out of or connected with this contest, or any prizes awarded, shall be resolved individually via mediation or arbitration, without resort to any form class action; and (3) in no event will you be entitled to receive attorneys’ fees. BY ENTERING THE CONTEST YOU AGREE TO RELEASE, DISCHARGE AND HOLD HARMLESS CONTEST PARTIES AND THE RESPECTIVE OFFICERS, DIRECTORS, AND AGENTS OF EACH, FROM ANY AND ALL LIABILITY FOR ANY INJURY, LOSS, OR DAMAGE OF ANY KIND TO PERSONS, INCLUDING DEATH, AND PROPERTY, WHETHER DIRECT OR INDIRECT, WHICH MAY BE DUE TO OR ARISE OUT OF PARTICIPATION IN THE CONTEST OR ANY PORTION THEREOF, OR THE ACCEPTANCE, USE/MISUSE OR POSSESSION OF PRIZES, OR ANY PRIZE-RELATED TRAVEL OR ACTIVITY. YOU WAIVE ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
CHOICE OF LAW AND JURISDICTION
Except where prohibited, all issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of entrants or winners, Sponsor, and administrator in connection with this contest, shall be governed by, and construed in accordance with, the laws of the State of California, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of California or any other jurisdiction), which might otherwise cause the application of the laws of any jurisdiction other than the State of California. Any action seeking legal or equitable relief arising out of or relating to the contest or these Official Rules shall be brought only in the courts of the State of California. You hereby irrevocably consent to the personal jurisdiction of said courts and waive any claim of forum non-convenience or lack of personal jurisdiction they may have.
OWNERSHIP AND LICENSE
All entry materials become the property of the Sponsor and will not be acknowledged or returned. The copyright in any Submission shall remain the property of the entrant, but entry into this contest constitutes entrant’s irrevocable and perpetual permission and consent, without further compensation, with or without attribution, to use, reproduce, print, publish, transmit, distribute, sell, perform, adapt, enhance, or display such Submission, and the entrant’s name and/or likeness, for any purpose, including but not limited to editorial, advertising, trade, commercial, and publicity purposes by the Sponsor and/or others authorized by the Sponsor, in any and all media now in existence or hereinafter created, throughout the world, for the duration of the copyright in the Submission. Sponsor and/or others authorized by the Sponsor shall have the right to edit, adapt, and modify the Submission.
CONDITIONS
By entering this contest, the entrant agrees to be solely responsible for and shall hold Stella Rosa wines and its agents harmless, in the event entrants fail to comply with Stella Rosa’s Official Rules and Privacy Policy. Stella Rosa wines is not liable for any malfunctions or failures of any computer internet system, servers or providers, computer equipment, software, failure of any email on account of technical problems or traffic congestion on the internet, or any combination thereof, including any injury or damage to entrant’s or any other person’s computer, mobile or any other device and/or its contents related to or resulting from participation or downloading/uploading any materials related to this contest, or other technical difficulties or failures or errors of any kind.
Stella Rosa reserves the right to terminate or modify the contest at any time for any reason. In such a circumstance, all winners will be selected based on entries received to date of termination. Stella Rosa also reserves the right to modify this contest in the event an insufficient number of entries are received and/or an insufficient number of entries meet the minimum judging criteria.
