ESO x QuakeCon® 2024 PVE Tournament Championship
The ESO x QuakeCon® 2024 PVE Tournament Championship (the “Competition”) is sponsored by Bethesda Softworks LLC, with an address of 1370 Piccard Drive, Rockville, Maryland 20850 USA (the “Sponsor”). For the purposes of the Competition, the participants are comprised of twelve (12) invited ESO players (each a “Participant”). By participating in the Competition, each Participant accepts and agrees to comply with and abide by these Official Rules and the decisions of Sponsor, which shall be final and binding in all respects.
Playoff Period: The Playoffs starts on August 27, 2024 at approximately 12:00pm Eastern Time and ends on August 28, 2024 at approximately 11:30pm Eastern Time. (the “Playoff Period”).
Competition Period: The Competition starts on August 9, 2024 at approximately 5:30pm Eastern Time (“ET”) and ends on August 9, 2024 at approximately 6:30pm ET (the “Competition Period”).
Eligibility: All Participants must be 18 years of age or older at the time of the Competition and have received an invitation to participate from Sponsor. All applicable federal, national, state, provincial, and local laws and regulations apply. Void where prohibited, restricted or taxed by law. Officers, directors and employees of Sponsor, and each of its respective parents, subsidiaries, affiliates, distributors, retailers, sales representatives, advertising and promotion agencies involved in the Competition (all such individuals and entities collectively referred to herein as the “Promotion Entities”), and the immediate family members and/or those residing in the same household of each are ineligible to win a prize. This Sweepstakes is void where prohibited.
Participation/How to Win: Teams that wish to participate in the Competition must apply through our website at https://woobox.com/puswca. All participants in each team must be in good standing, adhere to our game rules, and must not have been banned from the game previously. In the event that more than four (4) teams apply to participate in the playoffs, preference will be given toward those with a higher score on the Lucent Citadel leaderboards.
During the Playoff Period, four (4) pre-selected teams consisting of twelve (12) Participants each (the “Teams”) will be challenged to complete Veteran Lucent Citadel Trial live on www.twitch.tv/eigh1_puppies. Each round will require two (2) teams to compete against each other, with the highest score from each round moving on to compete during the Competition. Each participant from the Teams with the lowest scores will receive a Playoff Participant Prize (as described below). The two teams with the highest scores will move on to the Competition.
At the beginning of the Competition Period, the two (2) Teams will be challenged to complete The Elder Scrolls® Online: Gold Road Veteran Lucent Citadel Trial (the “Title Game”) live on the QuakeCon Twitch Stream at www.twitch.tv/Bethesda (the “Stream”). All bosses in the Title Game must be defeated. In the event a Participant gets disconnected, the Team may use a self-selected companion until the disconnected player logs back into the Stream. Each participant from the Team with the highest score will receive the Grand Prize (as described below). Each participant from the Team with the lowest score will receive a Runners Up Prize (as described below). Teams must complete the Trial in the Title Game before the Stream ends in order to receive a Prize.

The Prizes will be delivered only to verified winners and within ninety (90) days of the conclusion of the livestream. ARVs determined as of July 2024. Prices are subject to change; retailers may sell for less. Prizes must be accepted as awarded and may not be substituted, transferred or redeemed for cash or otherwise. Sponsor will not replace any lost or stolen prizes. Prizes pictured in point-of-sale, online, television and print advertising, promotional packaging, and other Competition materials are for illustrative purposes only. Actual prize(s) may vary from the prize(s) pictured. All details and other restrictions of the prize(s) not specified in these Official Rules will be determined by Sponsor in its sole discretion. Sponsor makes no representations or warranties with respect to any prize. The winner will be responsible for all taxes (federal, state, provincial and local) and all expenses not listed herein related to acceptance and use of the prize. Any person winning $600 or more worth of prizes from Sponsor in a calendar year will receive an IRS form 1099 after the end of the calendar year in which the prizes were awarded, and a copy of such form will be filed with the Internal Revenue Service (IRS).
Sponsor makes no warranties, and hereby disclaims any and all warranties, express or implied, concerning any prize furnished in connection with the Competition. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, SUCH PRIZES ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, AND SPONSOR HEREBY DISCLAIMS ALL SUCH WARRANTIES, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND/OR NON-INFRINGEMENT.
Participant Appearance Release: By participating in the Competition, each Participant hereby irrevocably grants the Sponsor and each of their respective licensees, successors and assigns, permission to stream, film, photograph and record the Participant’s performance in the Competition itself and in other Competition-related activities, including the Participant’s name, User Name, Team name and logo, avatar, gamertag or equivalent, voice, statements, likeness and other personal characteristics, information and so-called publicity rights as they appear therein (collectively, the “Appearance”) and the right, but not the obligation, to distribute, exploit or otherwise use such Appearance, in whole or in part, in any and all media, now known or, to the extent permitted by applicable law, hereafter devised, throughout the Universe in perpetuity, for any purpose, including but not limited to, advertising, marketing and promoting the Competition, the Sponsor, the Title Game, and future Competitions.
As between each Participant and Team, on the one hand, and Sponsor, on the other hand, the Appearance shall be deemed a work-made-for-hire for Sponsor prepared as a work specifically ordered and/or commissioned by Sponsor, and therefore, Sponsor shall be the author and exclusive copyright or related rights (including performers’ property rights) owner of the Appearance for all purposes throughout the Universe. If under applicable law the foregoing is not effective to place authorship and ownership thereof and all rights therein in Sponsor, then, within the limits provided by applicable law (if any), by way of assignment and transfer of present and future rights and otherwise, each Participant and Team hereby irrevocably grants, transfers, sells and assigns to Sponsor, all of the Participant’s right, title and interest in and to the Appearance throughout the universe in perpetuity. Each Participant and Team agrees to execute such further documents and to do such further acts as may be necessary to evidence, effect, perfect, register, or enforce Sponsor’s ownership of such rights.
Sponsor shall have the right, in their sole discretion, to edit, composite, morph, scan, dub, duplicate, fictionalize or otherwise alter the Appearance for any purpose which the Sponsor deems necessary or desirable. To the fullest extent possible under any applicable law, each Participant hereby irrevocably waives any and all so-called moral rights or “droit moral” rights (which shall include, without limitation, any similar or analogous rights under applicable laws of any country in the world including, without limitation, the so called right of paternity (droit a la paternite), right of integrity (droit au respect de l’oeuvre), right of withdrawal (droit de retrait or droit de repentir), right of publication (droit divulgation) and/or performers’ moral rights they may have in the Appearance, and agrees that they will make no claim of any kind against the Sponsor as a result of any of the uses described above, and irrevocably and unconditionally waives and releases the Sponsor from any and all claims, demands, and liabilities of any kind or nature whatsoever arising out of or in connection with such use including, without limitation, any and all claims, demands, or liabilities for invasion of privacy, infringement of the right of publicity, defamation (including libel, slander, and malicious falsehood), performers’ rights and any other personal and/or property rights. Each Participant expressly acknowledges that the Sponsor and other Participants will contribute to the Appearance and other works that will embody all or part of the Appearance. Accordingly, if under any applicable law, the above waiver or assignment by a Participant of “moral rights” or “droit moral” is not effective, then each such Participant agrees to exercise such rights in a manner which recognizes the contribution of and will not have a material adverse effect upon such other parties.
Sponsor shall have the right to freely license or assign its rights hereunder, in whole or in part, to any person or entity. Sponsor shall retain the rights granted in the Appearance even if the Participant is disqualified or fails to meet the eligibility requirements.
Personal Information: Sponsor and its authorized agents will collect, use, and disclose the personal information provided when entering the Competition and/or claim a prize for the purposes of administering the Competition and prize fulfillment. By entering the Competition, Participants consent to such collection, use, and disclosure of personal information.
Any personal information received as part of this Competition will be used by Sponsor, its affiliates and its advertising and marketing agencies involved in the Competition for the purpose of the administration of the Competition only. Sponsor’s privacy policy will apply to the Competition and to all information that Sponsor receives. Right To Void/Terminate/Suspend/Modify: Sponsor reserves the right to modify, extend, suspend, or terminate the Competition if it determines, in its sole discretion, that the Competition is technically impaired or corrupted or that fraud or technical problems, failures or malfunctions or other causes beyond Sponsor’s control have destroyed or severely undermined or to any degree impaired the integrity, administration, security, proper play and/or feasibility of the Competition as contemplated herein. In the event Sponsor is prevented from awarding prizes or continuing with the Competition as contemplated herein by any event beyond its control, including but not limited to fire, flood, natural or man-made epidemic of health or other means, pandemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal state or local government law, order, or regulation, public health crisis, order of any court or jurisdiction, or other cause not reasonably within Sponsor’s control (each a “Force Majeure” event or occurrence), then subject to any governmental approval which may be required, Sponsor shall have the right to modify, suspend, or terminate the Competition. Only the type and quantity of prizes described in these Official Rules will be awarded. These Official Rules cannot be modified or amended in any way except in a written document issued in accordance with law by a duly authorized representative of Sponsor. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision.
General Conditions: Winning a prize is contingent on fulfilling all the requirements set forth herein. All prize claims are subject to verification. Participants agree to abide by these Official Competition Rules. The Competition is subject to all applicable federal, state, provincial and local laws. Void where prohibited. Sponsor’s failure to enforce any term of these Official Competition Rules shall not constitute a waiver of that provision. The invalidity or unenforceability of any provision of these Official Competition Rules shall not affect the validity or enforceability of any other provision. If any provision of the Official Competition Rules is determined to be invalid or otherwise unenforceable, then the Official Competition Rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein. Should a winner make any false statement(s) in any document referenced above, the winner will be required to promptly return to Sponsor his/her prize, or the cash value thereof. Sponsor reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the Competition process, the operation of the Competition and/or Competition websites or apps, violates the Official Competition Rules, or acts with intent to annoy, abuse, threaten or harass any other person.
LIMITATIONS OF LIABILITY AND RELEASES: BY PARTICIPATING IN THE COMPETITION, PARTICIPANTS AGREE THAT THE SPONSOR HAS NO LIABILITY WHATSOEVER FOR, AND SHALL BE HELD HARMLESS AGAINST, ANY LIABILITY FOR ANY INJURIES, CLAIMS, LOSSES, DAMAGES, COSTS OR EXPENSES OF ANY KIND (INCLUDING WITHOUT LIMITATION DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES) TO PERSONS OR PROPERTY RESULTING FROM (A) ENTRY OR PARTICIPATION IN THIS COMPETITION, INCLUDING ACCESS TO AND USE OF THE COMPETITION WEBSITES, (B) ANY CLAIMS BASED ON PERSONALITY OR PRIVACY RIGHTS, DEFAMATION OR PRIZE DELIVERY, OR (C) THE ACCEPTANCE, POSSESSION, USE OR MISUSE OF ANY PRIZE. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, therefore such exclusions may not apply to you.
Governing Law: ALL ISSUES AND QUESTIONS CONCERNING THE CONSTRUCTION, VALIDITY, INTERPRETATION AND ENFORCEABILITY OF THESE OFFICIAL RULES OR THE RIGHTS AND OBLIGATIONS OF PARTICIPANTS OR SPONSOR IN CONNECTION WITH THE COMPETITION SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE INTERNAL LAWS OF THE STATE OF MARYLAND WITHOUT GIVING EFFECT TO ANY CHOICE OF LAW OF CONFLICT OF LAW RULES OR PROVISIONS THAT WOULD CAUSE THE APPLICATION OF ANY OTHER STATE’S LAWS.
ARBITRATION PROVISION: By participating in this Competition, each Participant agrees: (i) that any and all disputes the Participant may have with, or claims Participant may have against, the Sponsor relating to, arising out of or connected in any way with (a) the Competition, (b) the awarding or redemption of any prize, and/or (c) the determination of the scope or applicability of this agreement to arbitrate, will be resolved exclusively by final and binding arbitration administered by JAMS and conducted before a sole arbitrator in accordance with the rules of JAMS; (ii) this arbitration agreement is made pursuant to a transaction involving interstate commerce, and shall be governed by the Federal Arbitration Act (“FAA”), 9 U.S.C. §§ 1-16; (iii) the arbitration shall be held in Bethesda, Maryland; (iv) the arbitrator’s decision shall be controlled by the terms and conditions of these Official Rules and any of the other agreements referenced herein that the applicable Participant may have entered into in connection with the Competition; (v) the arbitrator shall apply Maryland law consistent with the FAA and applicable statutes of limitations, and shall honor claims of privilege recognized at law; (vi) there shall be no authority for any claims to be arbitrated on a class or representative basis, arbitration can decide only Participant’s and/or Sponsor’s individual claims; the arbitrator may not consolidate or join the claims of other persons or parties who may be similarly situated; (vii) the arbitrator shall not have the power to award punitive damages against the Participant or Sponsor; (viii) if the Participant is able to demonstrate that the costs of arbitration will be prohibitive as compared to the costs of litigation, Sponsor will pay as much of Participant’s filing and hearing fees in connection with the arbitration as the arbitrator deems necessary to prevent the arbitration from being cost-prohibitive; and (ix) with the exception of subpart (vi) above, if any part of this arbitration provision is deemed to be invalid, unenforceable or illegal, or otherwise conflicts with the rules of JAMS, then the balance of this arbitration provision shall remain in effect and shall be construed in accordance with its terms as if the invalid, unenforceable, illegal or conflicting provision were not contained herein. If, however, subpart (vi) is found to be invalid, unenforceable or illegal, then the entirety of this arbitration provision shall be null and void, and neither Participant nor Sponsor shall be entitled to arbitrate their dispute. By entering the Competition, each Participant releases Twitch completely from any liability with respect to the Competition. Any questions, comments or complaints regarding the Competition will be directed to the Sponsor and not Twitch.
