Official Rules
1. ENTRY: Submit a nomination for your favorite Oncology Nurse via third-party application, Woobox. To nominate a nurse, provide full name, contact information, job title and a short description of why you think they should be recognized as Extended Stay America’s Favorite Oncology Nurse. No purchase necessary to enter or win. A purchase will not improve your chances of winning.
Three finalists will be randomly selected from all received nominees. Individuals will be able to vote for their favorite of the three finalists and the finalist with the most votes at the end of the voting period will be named Extended Stay America’s Favorite Oncology Nurse for 2017. The winning nurse must be a nurse in the oncology field and must be available to attend Extended Stay America’s 3rd Annual Survivor’s event in Charleston, South Carolina on Sunday, June 25, 2017.
2. PRIZE DESCRIPTION: One (1) winner will be named Extended Stay America’s Favorite Oncology Nurse for 2017. The winner and one (1) guest will be provided airfare to Charleston, South Carolina where they will be presented with the award. The winner will receive a free (2) night stay at Extended Stay America to attend the event, along with $300 spending money. Winner is not entitled to exchange or transfer prize or to obtain cash or other substitutes in whole or in part. Approximate prize value: $1,600.
The two (2) other finalists will each receive:

Each of the individuals who nominated the three finalists will also receive an Extended Stay America Hope bear. Approximate value per Hope bear: $10
All awards are subject to federal, state, and local income taxes and will be grossed up for tax purposes. Incidental expenses and all other costs and expenses which are not specifically listed as part of a prize in these Official Rules and which may be associated with claiming and using the Sweepstakes prize are solely the responsibility of the prize winner and his/her guests. Actual value of trip prizes depends upon the city of departure, time of travel, any airfare fluctuations and on current market conditions at time of prize fulfillment, and any difference between the stated ARV and the actual value if any, will not be awarded. If any part of an event is unable to take place as planned, for any reason, including but not limited to, cancellation, scheduling conflicts or an event of force majeure, the remaining components of the prize will be awarded and Sponsor’s obligation to the winner will be fulfilled, and no other additional compensation will be provided. Trip is subject to air/hotel availability and confirmation of reservations and certain travel restrictions. Airline and flight times to be selected by Sponsor at its sole discretion. One or more stopovers may be required on air transportation. Winner and guests must travel together at the same time on the same itinerary. All travel arrangements must be made through Sponsor’s agent on a carrier of Sponsor’s choice. Once trip dates have been booked, no change, extension or substitution of trip dates is permitted, except at Sponsor's sole discretion. No extension or change of trip dates permitted. Sponsor will not replace any lost or stolen tickets, travel vouchers, certificates or similar items once they are in a winner's possession, or in the possession of a winner's guest. If a winner lives within 100 miles of prize destination city, the air transportation portion of the prize will not be awarded and ground transportation will be substituted and no additional compensation will be provided. Winner and guests must possess valid ID and are solely responsible for obtaining all necessary and required travel documents in order to travel. Sponsor shall not be responsible for any cancellations, delays, diversions or substitution or any act or omissions whatsoever by the air carriers, or any other persons providing any of these services and accommodations to winner and winner’s guests including any results thereof such as changes in services or accommodations necessitated by same. Sponsor shall not be liable for any loss or damage to baggage. All airline tickets issued in conjunction with a prize are not eligible for frequent flyer miles. Prize components cannot be used in conjunction with any other promotion or offer, and no portion may be separated except at Sponsor's sole discretion. The prize restrictions/conditions stated herein are not all-inclusive and may be subject to additional restrictions/conditions, which may be stated in the affidavit and release and/or prize travel documents.
3. ELIGIBILITY: This contest is open only to legal U.S. residents (including the District of Columbia), 18 years of age or older. Void where prohibited by law. Contestants residing in those areas where the contest is void may participate in the contest but may not win any prizes. Employees, directors and officers, and their immediate families (spouse, parents, children, siblings, and their respective spouses), and their respective household members (whether related or not), of ESA Management, LLC (referred to hereafter as (“Sponsor” or “Extended Stay America”), and each of their affiliates, subsidiaries, and divisions are not eligible to win.
4. NOMINATION TIMING: Extended Stay America will begin accepting nominations after 12:00 Noon EST on Monday, May 8, 2017. Nominations will be accepted through 11:59PM EST on Sunday, May 14, 2017.
5. FINALISTS NOTIFICATION TIMING: Extended Stay America will be contacting finalists between Monday, May 15, 2017 and Tuesday, May 16, 2017 to notify them that they’ve been selected as a finalist and to obtain their permission to use their name during the finalist voting period and future promotion of this award. Extended Stay America will also be requesting a photo from each finalist to be used in the finalist voting period and future promotion of this award. Each finalist will be asked to sign an image release form at this time.
5. VOTING TIMING: Extended Stay America will announce the three finalists on Facebook, Twitter and LinkedIn around 12:00 Noon EST on Tuesday, May 16, 2017 and will remain open until 11:59PM EST on Sunday, May 28, 2017.
6. HOW TO NOMINATE A NURSE: Extended Stay America will be posting “Favorite Oncology Nurse Award” posts on Facebook, Twitter and LinkedIn on Monday, May 8, 2017. To nominate, click the link in the post. The link will bring you to Woobox, a third-party application which will be used to accept nominations. Individuals are to provide the full name, contact information, job title and a short description of the Oncology Nurse they wish to nominate. Individuals will also have the option to provide a short video of themselves explaining why their nominee deserves to be selected as Extended Stay America’s Favorite Oncology Nurse Award.
7. IMAGE/VIDEO USAGE: Individuals who provide a video nomination submission give Extended Stay America permission to use the video footage in future marketing efforts and promotion of the Favorite Oncology Nurse Award.
Extended Stay America will request a photo from each of the three selected finalists, to be used during the voting process and in social media posts. Each finalist will be provided with an image release form. Signing the image release form gives Extended Stay America permission to use the submitted photos in future marketing efforts and promotion of the Favorite Oncology Nurse Award.
8. WINNER SELECTION: Three finalists will be randomly selected from all received nominees. Extended Stay America will contact each selected finalist to confirm finalist information, including job title. (Finalists must be a nurse in the oncology field.) The finalist that receives the most votes during the finalist voting period will be selected as Extended Stay America’s Favorite Oncology Nurse Award.
9. WINNER NOTIFICATION: A winner will be announced on Facebook, Twitter and LinkedIn on Monday, May 29, 2017. Extended Stay America will provide the winner with further instructions for claiming his/her prize at this time. The winner must follow the provided instructions to claim his/her prize within seven days of being notified. Inability to contact a winner within seven days may result in disqualification and selection of an alternate winner.
10. BY ENTERTING THE AWARD PROCESS, participants release and hold harmless Sponsor, Twitter, Facebook, LinkedIn, and their respective parent companies, subsidiaries, affiliates, directors, officers, employees, and agents from any and all liability for any injuries, loss, or damage of any kind arising from or in connection with this award or any prize won, including any injuries, loss or damage of any kind arising from or in connection with participation in the award process. Incidental expenses and all other costs and expenses which are not specifically listed as part of a prize in these Official Rules and which may be associated with the award are solely the responsibility of the respective prize winner. All awards are subject to federal, state, and local income taxes and will be grossed up for tax purposes.
11. NOMINEE/FINALIST PERSONAL INFORMATION: Information collected about nominees will not be shared publicly. By entering this award, entrants are providing their information to Extended Stay America and not to Twitter, Facebook. Woobox or LinkedIn. The three selected finalists will be contacted by Extended Stay America, at which time Extended Stay America will request permission to use each finalist’s name and image during the finalist voting process and further promotion of the award.
12. NOT ENDORSED BY TWITTER/FACEBOOK/LINKEDIN/ Woobox: By participating in this contest, you acknowledge that this contest is in no way sponsored, endorsed or administered by, or associated with, Twitter, Facebook, Woobox or LinkedIn, and release Twitter, Facebook, Woobox and LinkedIn from any and all liability arising from or related to this contest. The information you are providing for this contest is being provided to Extended Stay America and not to Twitter, Facebook, Woobox or LinkedIn, and will be used to notify you if you have won.
13. CONDUCT: All contest participants agree to be bound by these Official Rules. Extended Stay America in its sole discretion reserves the right to disqualify any person it finds to be tampering with the entry process, the operation of its web site or is otherwise in violation of these rules.
14. LIMITATIONS OF LIABILITY: Extended Stay America is not responsible for late, lost or misdirected email or for any computer, online, telephone or technical malfunctions that may occur. If for any reason, the contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort, Extended Stay America may cancel, terminate, modify or suspend the contest. Entrants further agree to release Extended Stay America from any liability resulting from, or related to participation in the contest.
By participating in this award process, entrants agree to release and hold harmless the Extended Stay America, as well as each of their respective officers, directors, employees, agents and representatives and each of their respective successors, representatives and assignees, as well as Twitter, Facebook and LinkedIn from any and all actions, claims, injury, loss or damage arising in any manner, directly or indirectly, from participation in this award and/or acceptance, receipt, possession or use/misuse of any prize. By entering, entrants also authorize the Extended Stay America and its designees to use their name, voice, likeness, photograph, prize information (if applicable), biographical data and city and state of residence in programming, advertising and/or promotional material without compensation to the extent permitted by law.
Extended Stay America is not responsible for failed, partial or garbled computer transmissions, for technical failures of any kind affecting the award in any manner, including but not limited to electronic malfunction or damage of any network, hardware or software. The foregoing also includes any malfunction/error/failure deemed by Extended Stay America in its sole discretion to impact the availability or accessibility of submissions by entrants or the transmission or receipt of winner notifications. If for any reason the award is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud or technical failures beyond Extended Stay America’s control that corrupt or affect the administration, security, fairness, integrity or proper conduct of the award (including entries or otherwise), Extended Stay America reserves the right, in its sole discretion, to disqualify any individual, whether or not the individual is a participant in the award, who tampers with the entry process and to terminate, modify or suspend the award. In such event, Sponsor reserves the right to conduct the award and select prize winners for affected Award Period by means of a random drawing from among all eligible entries received prior to and/or after (as appropriate) the action taken by Extended Stay America for affected Award Period or otherwise in a manner which is fair, appropriate and consistent with these Official Rules as determined by Extended Stay America in its sole discretion. No responsibility is assumed for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or loss, destruction or unauthorized access to, or alteration of, entries; or any problems or technical malfunctions of any telephone network or lines, computer online systems, servers, providers, computer equipment or software, or failure of any email or electronic entry or participation to be received due to technical problems or traffic congestion on the Internet or at any website/platform, or any combination thereof, including any injury or damage to any person's computer or wireless mobile device related to or resulting from participation in or downloading any materials from this award. People entering the award, as well as nominees/finalists, further agree not to knowingly damage or cause interruption of the award and/or prevent others from participating in the award.
14. DISPUTES: To the fullest extent permitted by law, entrant agrees that: (1) Any and all disputes, claims and causes of action arising out of or connected with this award or the awarding of prizes shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Western District of North Carolina or an appropriate North Carolina State Court; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this award, but in no event attorneys' fees; (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of the entrant and Sponsor in connection with the award shall be governed by and construed in accordance with the laws of the State of North Carolina, without giving effect to any choice of law or conflict of law rules (whether of the State of North Carolina or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of North Carolina.
