Official Rules of the NFM Holly Jolly Giveaways 2024

PRELIMINARY INFORMATION: NO PURCHASE NECESSARY. A purchase will not improve your chances of winning. Void where prohibited. Entries (as defined below) for the NFM Holly Jolly Giveaways 2023 (the “Event”) can be submitted from Friday, December 1, 2024 at 8:00 AM CST until Friday, December 15, 2024 at 11:59 PM CST (“Entry Period”). Odds of winning depend upon the number of eligible Entries (as defined below) received. This contest and prizes are subject to all applicable federal, state, and local laws. 

ELIGIBILITY: Open only to permanent, legal residents of Nebraska, Iowa, Kansas, Missouri, Texas, Oklahoma, Louisiana, Minnesota, Arkansas, South Dakota, Illinois, Colorado and Alabama, age eighteen (18) (or nineteen (19) where applicable) years or older, who have an active Facebook account at the time of entry. All federal, state and local laws and regulations apply. Employees of Nebraska Furniture Mart, Inc. or its subsidiaries (collectively “NFM”), sales representatives who sell to NFM, marketing affiliates and partners of NFM, distributors to NFM, advertising and promotion agencies that work with NFM, and any other entity involved in the development, administration, promotion, or implementation of the Event are not eligible to enter or win the Event. Entrants who have won a prize from NFM within the last 60 days are ineligible to enter.   

ENTRY: You may enter the Event during the Entry Period by visiting https://www.facebook.com/nfmfans (the “Website”) and posting a comment on the daily post by NFM, beginning on Friday, December 1, 2024 and continuing daily through the end of the Entry Period. Each submission is an “Entry” and each individual submitting an Entry is an “Entrant”. Multiple Entries by the same individual will count as one (1) Entry. The number of times a single name is entered will not increase the likelihood of being selected as a Winner (as defined below).  

Illegible, incomplete, garbled, unintelligible, reproduced, copied, printed and/or late entries are ineligible. All Entries become the property of NFM and will not be acknowledged. Only Entries submitted to the Website before the end of the Entry Period will be eligible. NFM’s determination for all matters related to this Event shall be final. Entry constitutes permission (except where prohibited by law) to use entrant’s name, city, state, likeness, image, and/or submitted story for purposes of advertising, promotion, and publicity in any and all media now or hereafter known, throughout the world in perpetuity, without additional compensation, notification, permission, or approval.   

WINNER SELECTION AND NOTIFICATION: After the close of each day during the Entry Period, a daily Winner (“Daily Winner”) will be selected by representatives of NFM from all eligible Entries received during that day. Following the selection, NFM will attempt to notify the selected Daily Winner by contacting them through the Facebook account that they submitted an entry from. Once contacted, the selected Daily Winner will have a reasonable time, as determined in NFM’s sole discretion, to contact back NFM as designated in the message. If a selected Daily Winner fails to reach NFM within the time set by NFM, the Entrant will be determined ineligible for the Prize and NFM will, time permitting, select another eligible entry from the remaining entries and award the Prize to the winner(s) so selected (the “Alternate Selection”). All rules listed in regard to eligibility will remain in effect for the Alternate Selection. Each Daily Winner will be required to sign an affidavit of eligibility, release of liability, and, except where prohibited, publicity release (collectively, “Eligibility Documents”), which will be in a form supplied by NFM prior to claiming the Prize. A person who refuses to execute the Eligibility Documents will be deemed ineligible to claim the Prize. NFM may share Entrant’s name and contact information as necessary to administer the Event.  

PRIZE: There will be a total of 15 prizes (each a “Prize”) awarded.  The Daily Winners who complete and submit the Eligibility Documents will each be a prize winner (“Winner”) and will receive the Prize they entered to win.  All applicable local, state, and federal taxes are the sole responsibility of the Winner. NFM will furnish an Internal Revenue Service Form 1099 to Winner for the value of the Prize for the year in which the Prize was won. Each Winner must pick up their Prize from the NFM store location nearest to them within 14 calendar days of being notified of winning or arrange for shipping with an NFM representative. After the 14 calendar days have passed, the Prize will be forfeited.  All shipping costs are the sole responsibility of the Winner. 

All details of the Prize will be determined by NFM in its sole discretion. NFM reserves the right to substitute a Prize (or portion thereof) with a similar prize (or prize element) of comparable or greater value. All taxes and other expenses, costs, or fees associated with the acceptance and/or use of the Prize are the sole responsibility of the Winner. A Prize cannot be transferred by a Winner or redeemed for cash and is valid only for use at an NFM store or on nfm.com, with no substitution of a Prize by Winner.  

NFM shall have the right, but not the obligation, to make any deductions and withholdings that NFM deems necessary or desirable under applicable federal, state and local tax laws, rules, regulations, codes or ordinances. NFM shall have no responsibility or liability for any element of the Prize due to reasons beyond NFM’s control and is not responsible or liable for any expenses incurred as a consequence thereof.  

CONDITIONS: By entering, each Entrant agrees for themselves and for their heirs, executors, and administrators (a) to release and hold harmless NFM, NFM’s affiliates, and each of their respective officers, directors, and employees (collectively, “Released Parties”) from any liability, illness, injury, death, loss, litigation, or damage that may occur, directly or indirectly, whether caused by negligence or not, from such Entrant’s participation in the Event and/or his/her acceptance, possession, use, or misuse of Prize or any portion thereof (including any travel related thereto); (b) to indemnify Released Parties from any and all liability resulting or arising from the Event and to hereby acknowledge that Released Parties have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to Prize, including express warranties provided exclusively by prize supplier that are sent along with Prize; (c) if selected as a Winner, to the posting of such Winner’s name on the Website and the use by Released Parties of such name, voice, image, and/or likeness for publicity, promotional, and advertising purposes in any and all media now or hereafter known, throughout the world in perpetuity, without additional compensation, notification, permission, or approval, and, upon request, to the giving of consent, in writing, to such use; and (d) to be bound by these Official Rules and to waive any right to claim any ambiguity or error therein or in the Event itself, and to be bound by all decisions of NFM, which are binding and final. Failure to comply with these conditions may result in disqualification from the Event at NFM’s sole discretion.  

ADDITIONAL TERMS: NFM reserves the right to permanently disqualify from any promotion, including the Event, any person it believes, in its sole discretion, has intentionally violated these Official Rules. Any attempt to deliberately damage the Event or the operation thereof is unlawful and subject to legal action by NFM, which may seek damages to the fullest extent permitted by law. The failure of NFM to comply with any provision of these Official Rules due to an act of God, hurricane, war, fire, riot, pandemic, earthquake, terrorism, act of public enemies, actions of governmental authorities outside of the control of NFM (excepting compliance with applicable codes and regulations), or other “force majeure” event will not be considered a breach of these Official Rules. Released Parties assume no responsibility for any injury or damage to entrants’ or to any other person’s computer relating to or resulting from entering or downloading materials or software in connection with the Event. Released Parties are not responsible for telecommunications, network, electronic, technical, or computer failures of any kind; for inaccurate transcription of entry information; for errors in any promotional or marketing materials or in these Official Rules; for any human or electronic error; or for Entries that are stolen, misdirected, garbled, delayed, lost, late, damaged, or returned. NFM reserves the right to cancel, modify, or suspend the Event Name or any element thereof (including, without limitation, these Official Rules) without notice in any manner and for any reason (including, without limitation, in the event of any unanticipated occurrence that is not fully addressed in these Official Rules).  In the event of cancellation, modification, or suspension, NFM reserves the right to select Winners in a random drawing from among all eligible, non-suspect Entries received prior to the time of the event warranting such cancellation, modification, or suspension.  Notice of such cancellation, modification, or suspension will be posted on the Website.  NFM may prohibit any entrant from participating in the Event, if such entrant shows a disregard for these Official Rules; acts with an intent to annoy, abuse, threaten, or harass any other entrant, NFM, or NFM’s agents or representatives; or behaves in any other disruptive manner (as determined by NFM in its sole discretion).  NFM reserves the right to modify these rules for clarification purposes without materially affecting the terms and conditions of the Event.  

ARBITRATION/CHOICE OF LAW: Except where prohibited, participants in the Event agree that: (1) any and all disputes, claims, and causes of action arising out of or connected with this Event, or any prizes awarded, or the administration of the Event or the determination of the Winner, shall be resolved individually, without resort to any form of class action, and exclusively by arbitration, to take place in the State of Nebraska, pursuant to the Rules of the American Arbitration Association, then effective, (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Event but in no event attorneys’ fees; and (3) under no circumstances will a participant be permitted to obtain awards for and participants hereby waive all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. Except where prohibited, all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of participant(s) and NFM in connection with the Event, shall be governed by, and construed in accordance with, the laws of the State of Nebraska, without regard to conflicts of law doctrine.  

WINNER ANNOUNCEMENT: NFM will announce a winner each day, beginning on December 2, 2024 until December 16, 2024, when the last winner will be announced.
