Official Rules & Regulations:

GENERAL RULES: No Purchase Necessary. A Purchase Will Not Increase Your Chance to Win. Your chances of winning without making a purchase are the same as the chances of someone who purchases something. It is illegal to give any advantage to buyers in this competition. Entrants agree to abide by the terms of these official rules and by the decisions of Sponsor, which are final and binding on all matters pertaining to this KTA Super Stores event. Non-compliance within this time period may result in disqualification and selection of an alternate winner. Return of any prize notification as undeliverable may result in disqualification and selection of an alternate winner. Entrants further grant to Sponsor the right to use and publish name and photo submission in print, and in any other media in connection with KTA Super Stores.

 

WHAT TO ENTER: KTA Super Stores prides itself on being a locally owned and operated Hawai‘i Island business. We want to share Hawai‘i Island with our customers, by featuring photos of our island on our Gift Cards. What is Hawai‘i Island to you? Everyone experiences Hawai‘i differently, so show us through your lens, your favorite parts of Hawai‘i Island.

 

SUBMISSIONS: The Photo Contest begins on Thursday, July 1, 2021 at 12am HST and will end on Saturday, July 31, 2021 at 11:59pm HST (the "Entry Period"). Entries submitted before or after the Entry Period will not be eligible. Sponsor’s computer is the official time-keeping device for the Photo Contest. All photo submissions must be an original and taken by the entrant. One entry per e-mail for the duration of the contest. Photos must be taken on Hawai‘i Island. To ensure eligibility for the contest, please submit files no larger than 2MB at the time of entry. All photographs should accurately reflect the subject matter and the scene as it appeared. Photos that have been digitally altered beyond standard optimization (removal of dust, cropping, reasonable adjustments to exposure, color and contrast, etc.) will be disqualified. Photo submissions must be in portrait orientation, images at least 5 inches wide by 7 inches tall, 300 dpi. Entries may originate in any format — including, but not limited to digital files, digital prints, color transparencies, color prints, or black and white prints — so long as they are submitted electronically in a .tiff, .pdf, .jpg, or.png form. Multiple exposures that have been combined to produce a single "High Dynamic Range" image are acceptable.

 

Previously published material for which non-exclusive rights were granted may be entered as long as you still maintain the right to grant us a license. You must be able to disclose when and where the photo appeared previously to KTA Super Stores upon request.

 

If you choose to include people in your submission, you are responsible for obtaining the necessary releases from the individuals depicted, and must be able to provide copies of those releases to The KTA Super Stores upon request.

 

The following submissions are ineligible: Images of captive animals photographed in zoos and commercial game farms. Photos that violate or infringe upon another person's rights, including but not limited to copyright and photographs of persons without the necessary consent required by law in your jurisdiction. KTA Super Stores reserves the right to require entrants to submit evidence of the subject’s legal consent to be photographed for the submitted photograph, which may include a signed waiver from the subject. NOTE: Waiver requirements vary by jurisdiction, and the entrant is responsible for obtaining a legally enforceable waiver from any photographed subject. Photos that contain sexually explicit, nude, obscene, violent or other objectionable or inappropriate content. Images that involve the willful harassment of wildlife, or damage to the environment by the photographer. Images that involve putting any individual or animal in danger.

 

KTA Super Stores shall determine entry eligibility in its sole and absolute discretion. Submissions may be watermarked if desired, but the watermark should be inconspicuous enough to not interfere with the judging of the photo. A watermarked photo might not be honored by the competition (at the judges’ sole discretion) if the photographer is unable or unavailable to provide a pristine, watermark-free version of the image when asked. Images will be judged on originality, technical excellence, composition, overall impact and artistic merit.

 

HOW TO ENTER:  All images must be submitted though our photo submission website: ktasuperstores.com/promotions, including all required fields, including name, email and other information about your photo submission. You can select an image directly from your computer desktop. Digital images that are sent via mail or email will not be accepted.

 

You may enter 1 photo entry per email, you may not use an agency or automated system to enter. Sponsor reserves the right to reject any additional entries or entries that do not comply with these Official Rules. By entering, you indicate your unconditional agreement to, and acceptance of, these Official Rules and Sponsor’s decisions, which are final and binding. You cannot win a prize unless you comply with all requirements in these Official Rules.

 

Entrants may be asked to supplement their submission (such as with a paragraph about their photo or the highest resolution version of their photo) anytime on or after July 31, 2021.  

 

VOTING: The Public vote for the top ten entries begins on Sunday, August 1, 2021 at 12am HST and will end on Sunday, August 8, 2021 at 11:59pm HST (the "Voting Period"). Votes submitted before or after the Voting Period will not be eligible. Sponsor’s computer is the official time-keeping device for the Photo Contest. The public may vote for as many submissions as they’d like, but they can only cast one vote for one single submission. Voting is limited to one submittion or per IP Address. This restricts users from voting from one IP Address more than once. IP Addresses are typically the same in offices, schools, hospitals, a single home, etc. Keep in mind, if one person votes on an IP Address in a building/home, then another person will not be able to cast a vote if they’re using the same network.

 

JUDGING:  The top ten photos will be selected by public voting. Those 10 semi-finalist entries will then be judged on originality, composition, overall impact, artistic merit and subject matter. Judging will be conducted by a panel of KTA Super Stores employees. All potential winners will be revealed online on August 9, 2021. All judging decisions are final. Please do not contact us about the status of entries or judging. KTA Super Stores will notify the winners via the contact information provided at the time of entry.

 

PRIZE: Three (3) winners will receive a $100 KTA Super Stores Gift Card, and their photo entry will be printed on a limited amount of KTA Super Stores Gift Cards scheduled to be available for public purchase in December 2021 while supplies last.  

 

Seven (7) Semi-Finalists will receive a $10 KTA Super Stores Gift Card.

 

Acceptance of a prize constitutes permission for Sponsor to use winner’s name, photos and likeness for advertising and promotional purposes without additional compensation unless prohibited by law. No substitution or transfer of prize by winner permitted, except that Sponsor reserves the right to substitute a prize of equal or greater value in the event that the advertised prize is unavailable. All applicable income taxes are the sole responsibility of winner. By entering, entrants and their respective parents or legal guardians release, discharge and hold harmless Sponsor, its subsidiaries, affiliates, directors, officers, employees, and agents from any and all liability or any injuries, loss, or damage of any kind arising from or in connection with this competition or any prize won. By participating in this promotion, entrants and their respective parents or legal guardians agree to be bound by these Official Rules and the judges’ decisions, which are final. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in these competition materials and the terms and conditions of these Official Rules, the Official Rules shall prevail, govern and control. All material submitted becomes the sole property of Sponsor and will not be returned. Sponsor is not responsible for any typographical or other error in the printing of the offer or in the announcement of the prize. Except otherwise stated in these Official Rules, KTA Super Stores Terms and Conditions apply to the prize.

 

ELIGIBILITY: This event is open to all Hawai‘i Island photographers. Void where prohibited by law. All federal, state, and local laws and regulations apply to these contests/promotions. If you cannot or will not comply with these Official Rules, you should not participate in the event.

 

By submitting an entry to the Photo Contest, entrants certify that their participation in this Photo Contest is not illegal or in violation of any law, regulation, treaty or administrative act, and that the laws of their governing jurisdiction of residence at the time of entry do not prohibit or restrict the receipt of any Prize under this Photo Contest.

 

KTA Super Stores reserves the right to reject any entry if, in KTA Super Stores’s sole discretion, the laws of an applicable jurisdiction, including but not limited to the entrant’s jurisdiction of residence at the time of entry, would prohibit or limit KTA Super Stores from proceeding with the Contest as intended or the consideration or awarding of any Prize would impose additional administrative, tax, operational, or legal burdens on KTA Super Stores.

 

By entering this contest, you agree to be bound by these Official Rules and to waive any right to claim any ambiguity or error in these Official Rules or the event itself. You also agree to be bound by all decisions of the Sponsor or its designees, whose decisions are final and binding. By entering the contest, you agree to release the Contest Entities, KTA Super Stores from all responsibility or liability for damages, losses or injuries of any kind resulting from participation in the Contest or any prize-related activities, if any, or any awarding, possession, use and/or misuse of prize(s), if any, awarded herein. This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook, Instagram or Twitter. You are providing your information to KTA Super Stores.

 

There is no cash alternative to the prize. Nor can the prize be transferred or redeemed for cash or refund. Odds of winning depend upon the votes received within the voting period. The Semi-Finalists and Grand Prize winners will be required to sign a waiver and release form in order to receive their prize.  

 

YOUR RIGHTS: You will retain all rights to any photograph you submit -- including ownership if applicable. If you submit a photograph to enter the Photo Contest, you grant KTA Super Stores a permanent royalty-free, nonexclusive right to:

 

Display the photograph on any KTA Super Stores operated website. Allow third-parties to share the photograph on social media. Use the photograph on the Internet and in Social Media in support of our mission. Use the photograph in KTA Super Stores’s internal and external communications materials including but not limited to web sites and web publications, fact sheets, fund raising publications, advertising, multimedia, presentation and membership services, annual report and Nature Conservancy magazine. Provide your photograph to other individuals and organizations for KTA Super Stores-related use in news stories, newsletters, reports, slide shows, displays, web pages, videos, membership premiums, and the like use, in connection with KTA Super Stores Gift Cards, your name and other publications. Retain a digital copy of your photograph that will be archived in the KTA Super Stores photo library and accessible to KTA Super Stores staff via the KTA Super Stores internal online photo archive. KTA Super Stores will endeavor to credit all photographs with the caption "Person's Name" when the full name is available.

 

PRIVACY: We are committed to the privacy of your information. We do not, and will not, distribute, disclose or sell any of your personal information to third parties, other than as required by law or as necessary to process a payment. You are providing your information to KTA Super Stores and not to Facebook.
