The Community First Contest (“Contest”)
Official Rules

1.    ELIGIBILITY: To be eligible to nominate or vote in this Contest, an individual must be eighteen (18) years of age or older as of July 7, 2017. To be entered, the eligible local nonprofit organization (“Nonprofit”) must be a registered 501(c)(3) organization headquartered in or serve any of the counties in the following specified areas (each an “Area”): (1) Nebraska Area: Nebraska – Box Butte, Buffalo, Butler, Dawes, Dodge, Douglas, Gage, Hall, Lancaster, Lincoln, Madison, Platte, Sarpy and Scotts Bluff; Iowa – Mills and Pottawattamie, and South Dakota – Beadle, Davison, Sanborn and Yankton; (2) Colorado Area: Colorado – Adams, Boulder, Broomfield, Jefferson, Larimer, and Weld; Illinois Area: (3) Illinois Area – Boone, DeKalb, Kane, Kendall and McHenry; and (4) Kansas Area: Kansas – Johnson. By participating in the Contest, you, as a Nominator (as defined in Section 3), Nonprofit, or voter, agree to be bound by these Official Rules and the decisions of Sponsor. The Contest is subject to all applicable federal, state, and local laws, rules and regulations. Void where prohibited or restricted by law, rule or regulation. The grand prize winner of the 2016 Community First Contest is not eligible to win a prize in this Contest.

2.    CONTEST PERIOD: The Contest begins at 12:00 a.m. Central Time (“CT”) on July 7, 2017 and ends at 11:59:59 p.m. CT on September 19, 2017.

3.    HOW TO NOMINATE: To nominate a Nonprofit in the Contest, the individual (“Nominator”) must click on the Woobox link in the post or website banner regarding the Contest and provide the information requested, including information on the Nonprofit. The period to nominate a Nonprofit begins at 12:00 a.m. CT on July 7, 2017 and ends at 11:59:59 p.m. CT on July 31, 2017 (“Nomination Period”). Limit one (1) entry per Nominator name/email address per day during the Nomination Period (regardless of whether a person has more than one (1) email address or more than one (1) person uses the same email address). Multiple entries per Nominator name/email address per day are prohibited and will void all entries by that Nominator during the Nomination Period.

The name of the Nominator registered via the Woobox site must be the authorized account holder of the associated email address, otherwise, the entry may be deemed void. In the event of a discrepancy in the identity of the Nominator, the entry will be declared made by the authorized account holder of the email address at the time of entry, and the Nominator may be required to provide identification sufficient to show that he/she is the authorized account holder of said email address.

Proof of submitting an entry does not constitute proof of delivery or entry. Each entry submission must be manually key stroked and manually entered by the individual Nominator; automated and/or repetitive electronic submission of entries (including but not limited to entries made using any script, macro, bot or service) will be disqualified and transmission from these or related email or IP address may be blocked, at Sponsor’s sole discretion.

4.    JUDGING: There will be two (2) rounds of judging for each Area.

A.    First Round of Judging: Between July 31, 2017 and August 11, 2017, all Nonprofits nominated for an Area during the Nomination Period will be judged by Sponsor based on the following criteria (each 1/4):

(1)    Mission and purpose of Nonprofit;
(2)    Community need;
(3)    Community impact; and
(4)    Leadership, history, reputation of Nonprofit.

The ten (10) Nonprofits for each Area with the highest average scores from the first round will be contacted by Sponsor, and will be required to provide additional information between August 14, 2017 and August 21, 2017 in order to move on to the second round for an Area. Sponsor reserves the right to choose fewer than ten (10) finalists for an Area if, in Sponsor’s sole discretion, an insufficient number of eligible and/or qualified entries are received.

B.    Second Round of Judging: Between 12:00 a.m. CT on August 28, 2017 and 11:59:59 p.m. CT on September 8, 2017 (“Voting Period”), the public can vote on the finalists selected during the first round of judging for each Area by clicking on the on the Woobox link in the post or website banner regarding the Contest. By submitting a vote, each voter agrees to consider the information regarding the Nonprofit finalists for an Area provided on the voting page and use the following criteria in placing his/her vote: (1) mission and purpose of the Nonprofit for the Area; (2) community need; and (3) community impact.

Limit one (1) vote per person/email address per day during the Voting Period (regardless of whether a person has more than one (1) email address or more than one (1) person uses the same email address). Multiple entries per person/email address per day are prohibited and will void all votes by that person/email address during the Voting Period. The two (2) finalists with the highest average scores will win prizes.

5.    CONSUMER DISCLOSURE; PRIZE DESCRIPTION: The Nonprofit finalist with the highest number of votes from the second round of judging for each Area will receive the grand prize of $10,000. The Nonprofit finalist with the second highest number of votes from the second round of judging for each Area will receive a prize of $2,500. (Total Approximate Retail Value of all prizes is $50,000). No substitution, or transfer of prizes permitted except at the sole discretion of Sponsor, who reserves the right to substitute a prize (or portion thereof) with one of comparable or greater value, at its sole discretion. Limit one (1) prize per Nonprofit, no matter if the Nonprofit is nominated in more than one (1) Area.

6.    WINNER NOTIFICATION: Potential Nonprofit winners will be notified by Sponsor approximately one (1) day after being selected. Winners may be required to complete and sign an Affidavit of Eligibility, Publicity and Liability Release, and IRS form W-9, which must be returned within five (5) days via Federal Express (“FedEx”) via overnight courier. Sponsor will furnish a prepaid FedEx overnight courier envelope to the winner. If the prize notification is undeliverable, the winner does not reply to Sponsor within twenty-four (24) hours after receive of notification of winning a prize, winner fails to return the signed and notarized Affidavit within the specified time period, or in the event of noncompliance with these Official Rules, the prize will be forfeited and awarded to an alternate winner. By entering the Contest, Nominators and Nonprofits grant Sponsor and its designees permission to use, reproduce, encode, store, copy, transmit, publish, post, broadcast, display, publicly perform, adapt, edit, exhibit and/or otherwise use or reuse without limitation Nominators’ and Nonprofits’ name, city and state; image and/or likeness (including any photographs and videos); and any information provided for the Contest for advertising, promotional and other purposes, worldwide and in perpetuity, in any and all forms of media, now known or hereafter devised (including and without limitation, the Internet) without additional compensation, except where prohibited by law.

7.    LIMITATION OF LIABILITY: By participating in the Contest, Nominators, Nonprofits, and voters agree to release, indemnify and hold harmless Sponsor, Facebook, Twitter, Woobox, prize suppliers, and advertising and promotion agencies, and each of their respective parent, subsidiary and affiliated companies, shareholders, officers, directors, agents, representatives, and employees (collectively “Releasees”) from and against any injuries, losses, damages, claims, actions and any liability of any kind resulting from or arising from participation in the Contest or acceptance, possession, use, misuse or non-use of the prizes that may be awarded. This Contest and these Official Rules shall be interpreted in accordance with the laws of the State of Nebraska without regard to its principles of conflicts of law and jurisdiction and venue shall be solely within the State of Nebraska. Releasees are not responsible for technical, computer, mechanical, printing, typographical, human or other errors relating to or in connection with the Contest, including, without limitation, errors which may occur in connection with the administration of the Contest, the processing of entries, the announcement of the prizes, the Official Rules, or in any Contest related advertising or materials; or for stolen, lost, late, misdirected, damaged, incomplete, inaccurate, undelivered, delayed or illegible entries or postage due entries or mail; or for electronic, computer, or telephonic malfunction or error, fail to enter into the processing system, or are processed, reported, or transmitted late or incorrectly or are lost for any reason including computer, telephone, paper transfer, or human or other error. If in Sponsor’s opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Contest, or if computer viruses, bugs, unauthorized intervention, fraud, or technical difficulties or failures compromise or corrupt or affect the administration, integrity, security, fairness, or proper conduct of the Contest, Sponsor at its sole discretion reserves the right to disqualify any individual who tampers with the entry process and/or void any entries submitted fraudulently, to modify or suspend the Contest, or to terminate the Contest and conduct a random drawing to award the prize using all eligible non-suspect entries received as of the termination date. As a condition of entering the Contest, Nominators, Nonprofits and voters agree that: a) under no circumstances will they be permitted to obtain awards for, and hereby waive all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses; b) all causes of action arising out of or connected with this Contest or the prize awarded, shall be resolved individually, without resort to any form of class action; and c) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred and in no event shall Nominators, Nonprofits or voters be entitled to receive attorneys’ fees or other legal costs. Sponsor reserves the right to modify prize award procedures.

8.    PERSONAL INFORMATION: Information collected from Nominators, Nonprofits and voters will be maintained by Sponsor in accordance with applicable federal and state consumer privacy laws, rules and regulations. Sponsor will collect information from Nominators and Nonprofits solely for the purpose of the prize drawing and to notify winners. Sponsor will not share this information with any third party, except as necessary for the administration of the Contest.

10. NO AFFILIATION WITH FACEBOOK OR TWITTER: The Contest is in no way sponsored, endorsed or administered by, or associated with Facebook or Twitter.
