OFFICIAL RULES FOR SPARKLIGHT “DREAM BIGGER” PROMOTION

NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.

Entry Period: March 1, 2022 through March 21, 2022

Agreement to Official Rules: Participation in the Cable One, Inc. d/b/a Sparklight (“Sparklight”) “Dream Bigger” Promotion (the “Promotion”) constitutes entrant’s full and unconditional agreement to and acceptance of these Official Rules and the decisions of Cable One, Inc., 210 E. Earll Drive, Phoenix, AZ 85012 (the “Sponsor”), which are final and binding. Winning a prize is contingent upon fulfilling all requirements set forth herein.

Eligibility: To qualify for the drawing to win a charitable donation, organizations must be located within, or provide services within, a Sparklight service area. The Promotion is open only to K-12 schools or K-12 Organizations in the United States that are served by a Sparklight system (“Qualified Organizations”). Entries may be submitted on behalf of the Qualified Organization by administration, instructors, volunteers, parents, students or community members as long as they are approved by the Qualified Organization. The Promotion is void where prohibited or restricted by law.

How to Win: To be entered into the drawing for a $3,000 charitable donation, entrants must upload a photo of the school group, club or organization. Photo entry must be accompanied by a written entry of 300 words or less describing how the funding will be spent and how the community/students will benefit. The Qualifying Organization name, city and state must be included in the entry. Five (5) organizations will be selected to each receive a $3,000 donation to be used to fund a student tech project or club. Ten (10) finalists will be selected by Sparklight in its sole discretion and announced on March 24, 2022. The winners will be determined by public voting online via the contest platform (sparklight.com/contest) to be held March 24, 2022 through March 31, 2022. The winning schools and/or organizations will be notified the week of April 4, 2022. Finalists will be notified by March 24, 2022 and must provide an Internal Revenue Service Form W-9 (Request for Taxpayer Identification Number and Certification) by March 31, 2022 in order to be eligible for the prize.

Limit: There is a limit of one (1) entry per Qualifying Organization.  Promotion winners agree to provide their email address and telephone numbers for Sponsor’s use in contacting the winners and for use in future marketing and promotional campaigns. 

Promotion Prizes: Grand Prize = $3,000 donation to a K-12 school or 501(c)(3) youth organization. School or organization must serve a community where Sparklight does business; 501(c)(3) nonprofit organization must be in good standing with the IRS.

Conditions/Use Rights: By accepting the prize, winner consents to the use of the winner’s name and likeness via all forms of media now known or hereafter devised worldwide, in perpetuity, without notice, attribution, or compensation (other than the specific prizes described herein) to winner, its successors or assigns, or any other entity, except where prohibited by law.

Privacy:  Each winner authorizes Sponsor to collect, use, process, transfer, and store all data provided by winner, including without limitation, personal data in the United States or any location(s) throughout the world that Sponsor deems necessary and with such party(ies) as Sponsor deems appropriate, for purposes of administration of the Promotion. All information submitted to Sponsor as part of this Promotion will be treated in accordance with Sponsor’s privacy policy, available at: https://www.sparklight.com/legal/privacy-policy. Personal information will be used only to: (a) provide information about the Promotion; (b) contact and publicize winners; and/or (c) to send additional information to the winner during or after the Entry Period.

Release and Limitations on Liability:  Each winner agrees to release from any liability and hold harmless all directors, officers, and employees of Sponsor and its respective subsidiaries, affiliates, sales representatives, distributors, licensees, agents, advertising and Promotion agencies (the “Released Parties”) from and against any claim or cause of action arising out of or relating to participation in the Promotion, or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Promotion; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) lost, late, misdirected, incorrect, garbled, or incompletely received entries; (d) errors in the administration of the Promotion; (e) injury or damage to winner, third persons, or property that may be caused, directly or indirectly, in whole or in part, from winner’s participation in the Promotion or acceptance, receipt, use, or misuse of any prize; and (f) any claims based on publicity rights, defamation, or invasion of privacy. Sponsor is not responsible if any prize cannot be awarded due to travel cancellations, delays, or interruptions due to acts of God, acts of war, natural disasters, weather, or acts of terrorism.

DISPUTES: THE PROMOTION IS GOVERNED BY, AND WILL BE CONSTRUED IN ACCORDANCE WITH, THE LAWS OF THE STATE OF ARIZONA, AND THE FORUM AND VENUE FOR ANY DISPUTE SHALL BE IN THE COUNTY OF MARICOPA, ARIZONA. IF THE CONTROVERSY OR CLAIM IS NOT OTHERWISE RESOLVED THROUGH DIRECT DISCUSSIONS OR MEDIATION, IT SHALL THEN BE RESOLVED BY FINAL AND BINDING ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION (AAA) IN ACCORDANCE WITH ITS STREAMLINED ARBITRATION RULES AND PROCEDURES OR SUBSEQUENT VERSIONS THEREOF.

Miscellaneous: The decisions of Sponsor are final with respect to all aspects of this Promotion. In the event that the operation, security, or administration of the Promotion is impaired in any way for any reason, including, but not limited to fraud, virus, or other technical problems, or any condition caused by events beyond the reasonable control of Sponsor that may cause the Promotion to be disrupted or corrupted, Sponsor may, in its sole discretion, either:  (a) suspend the Promotion to address the impairment and then resume the Promotion in a manner that best conforms to the spirit of these Official Rules; or (b) award the prize from among the non-suspect, eligible entries received up to the time of the impairment. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process and/or the operation of the Promotion, to be acting in violation of these Official Rules or any applicable laws relating to the Promotion, or to be acting in an unsportsmanlike or disruptive manner, and to resolve all disputes in its sole discretion. The Sponsor may disqualify any entrant(s), during or after the Entry Period, if (a) any such entrant harms or publicly disparages the Sponsor during or after the Promotion Entry Period, (b) Sponsor learns of the entrant’s previous, current, or planned future immoral, illegal, or inappropriate acts, (c) any such entrant provides false information about the Promotion to the Sponsor or the public; (d) any such entrant uses the Sponsor’s trademarks or otherwise inappropriately associates the entrant with Sponsor; or (e) if any such entrant does not obtain the Sponsor’s prior written approval before providing interviews or public comment related to the Promotion.
