KTVB AND THE IDAHO TRANSPORTATION DEPARTMENT OFFICE OF HIGHWAY SAFETY SHIFT VIDEO CHALLENGE OFFICIAL RULES

NO PURCHASE NECESSARY TO ENTER OR TO WIN. A PURCHASE WILL NOT INCREASE YOUR ODDS OF WINNING. SUBJECT TO APPLICABLE FEDERAL, STATE, LOCAL AND MUNICIPAL LAWS AND REGULATIONS. VOID WHERE PROHIBITED.

Eligibility. Subject to the additional restrictions below, the KTVB and Idaho Transportation Department Office of Highway Safety Shift  Student Video Contest (the "Contest") is open to students currently enrolled in a private or public high school within the State of Idaho.

Sponsor. The Contest is conducted by KTVB and Idaho Transportation Department Office of Highway Safety (together "Sponsor").

Message. Each video entry must demonstrate the choices that young drivers make to Shift towards engaged driving by using positive messages and modeling good behavior behind the wheel of the car. 

VIDEO ENTRIES MUST NOT DEPICT THE DRIVER USING AN ELECTRONIC DEVICE OR BEING DISTRACTED IN ANY OTHER MANNER WHILE OPPERATING A MOTOR VEHICLE. ALL OCCUPANTS IN A MOVING VEHICLE MUST BE WEARING SEAT BELTS.   

How to Enter. The Contest will begin at 9:00 a.m. (M.T.) on Thursday, March 14, 2019 and end at 11:59:00 p.m. (M.T.) on Wednesday May 15, 2019 (the "Contest Entry Period"). To enter, upload a video to YouTube of your Shift engaged driving video public service announcement lasting exactly 30 seconds. Complete the online entry form available at Shift-Idaho.org, including the name of the student or students who produced the video, high school name/address/main telephone number, school district and YouTube, Vimeo or Instagram link to your video by the entry deadline stated above. Each video submission must be an authentic, original video produced by entrant(s) identified on the accompanying entry form and entrant(s) must own the copyright in the video submitted or have the appropriate rights to submit the video.  Sponsor reserves the right to reject any video that Sponsor, in its sole discretion, deems obscene, offensive, inappropriate, objectionable, or in bad taste, or that infringes on any third party’s intellectual property rights.  Your computer must accept cookies, or any successor or similar technology, which may be used for the purpose of entry tracking. Ad blocking software on your computer needs to be disabled so that it doesn't interfere with processing your entry.

Maximum of one (1) entry per person or group.  Multiple entries by means of software generated or other automated processes will be disregarded.  Sponsor will not verify receipt of entries. Entries become property of Sponsor and will not be returned. Incomplete and multiple entries are void. Sponsor is not responsible for incomplete, lost, late, misdirected, incomplete, incomprehensible, illegible, or damaged entries.

Eligible Video Submissions will be displayed, in Sponsor's sole discretion, on KTVB.com and the KTVB Facebook page. The video submissions must meet the following criteria:

(1)   Video must be deemed family friendly, in the sole discretion of Sponsor.
(a) Video must have been taken by students currently enrolled in an Idaho public or private   high school, who have all rights to transmit and license it.
(b) Video must not depict the driver using any electronic device in a moving vehicle.

(2)   Video must show all vehicle occupants wearing seat belts whether the vehicle is moving or stationary.

(3)   Video must not violate trademark, copyright, privacy or any other rights of any other person. (Please note that royalty-free music is available at YouTube.com/audiolibrary.)

(4)   By entering, the entrant grants permission to and for the Sponsor to receive and display the video for the purposes of the Contest.

(5) The entrant certifies that any individuals of any age shown in the video furnished have been informed that the video has been entered in a Contest and have no objection to entrant's submission and Sponsor's display and posting of the video.

(6) Videos may not contain expressions of hate, abuse, offensive images or conduct, obscenity or pornography or any material that could give rise to any civil or criminal liability under applicable law or regulations.

(7) The video submitted does not contain software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software on KTVB.com or any other website.

(8) By uploading a video, the entrant agrees to indemnify Sponsors, their affiliates, directors, officers and employees and hold them harmless from any and all claims and expenses, including attorneys' fees, arising from use of the video and/or the failure to comply with these rules.

Winner Selection. Videos will be available for public voting May 15 - 21, 2019. The video that receives the most votes will win first place, the video that receives the second most votes will win second place and the video that receives the third most votes will win third place. In the event of a tie, entries with the same number of votes will share the same ranking i.e. there may be multiple first, second or third prize winners. The high school of the winning finalists will be notified by phone, email, and/or mail no later than Thursday, May 23, 2019. Finalist may be required to sign and return appropriate forms and/or documentation, including an Affidavit of Eligibility, a Liability Release and/or where legally permissible a Publicity Release as directed by Sponsor. Failure to sign and return such forms within the requisite timeframe could result in disqualification.

Prizes and Odds. The Overall Winners of First (1), Second (2), and Third (3) place, will be broadcast on KTVB stations and KTVB Digital throughout the 100 Deadliest Days, from May through September 2019. All of the winners will be invited to KTVB news programs to be interviewed about their video.

Winner Notification and Acceptance. The Winners will be notified on or about Thursday, May 23, 2019 at the email address or telephone number providers on winner’s entry form. Sponsor will call during regular business hours and will leave no messages. Failure to reach winners by phone after three (3) attempts, return of email notification as undeliverable, or failure of winner to respond to email notification may result in disqualification of winner, forfeiture of his or her interest in all prizes, and selection of a substitute winner from among all remaining eligible finalists. No substitutions allowed by winner. Prizes are not redeemable for cash. Winners are solely responsible for reporting and payment of any taxes on prizes. Except where prohibited, acceptance of any prize constitutes each winner's consent to the publication of images from the student video in any media for any commercial or promotional purpose, without limitation the Internet, or further compensation. Prizes not won and claimed by eligible winners in accordance with these Official Rules will not be awarded and will remain the property of Sponsor.

Participation. By participating, the entrants agree to be bound by these Official Rules and the decisions of Sponsor. Sponsor reserves the right to disqualify persons found tampering with or otherwise abusing any aspect of this Contest as solely determined by Sponsor. In the event the Contest is compromised by a virus, non-authorized human intervention, tampering or other causes beyond the reasonable control of Sponsor which corrupts or impairs the administration, security, fairness or proper operation of the Contest, Sponsor reserves the right in its sole discretion to suspend, modify or terminate the Contest. Should the Contest be terminated prior to the stated expiration date, Sponsor reserves the right to award prizes based on the entries received before the termination date. Sponsors will not be responsible for incomplete, lost, late, misdirected or illegible entries, poor quality videos, or for failure to receive entries or votes or other electronic communications due to transmission failures or technical failures of any kind, including, without limitation, malfunctioning of any network, hardware or software, whether originating with sender or Sponsor. The authorized account holder of the e-mail address submitted at time of entry will be considered the entrant. An "authorized account holder" shall mean the natural person assigned to such email account by the Internet Service Provider (ISP), online service provider, or other organization responsible for assigning email addresses for the domain associated with such email account. A potential winner may be requested to provide proof that in the event of a dispute, all online entries will be deemed to have been submitted by the owner of the ISP account from which they were sent. For these purposes, an ISP account holder shall mean the natural person assigned to such ISP account by the Internet access provider, online service provider or other organization responsible for assigning ISP addresses for the domain associated with such ISP account. Any questions regarding the number of entries, or votes submitted or the owner of an ISP account shall be determined by Sponsor in its sole discretion. By participating in this Contest, each participant agrees to fully release, forever discharge and hold harmless Sponsor (KTVB and the Idaho Transportation Department, including the Office of Highway Safety), TEGNA Inc., and Facebook from and against all claims, costs, liabilities, losses, injuries and damages arising out of the promotion, including but not limited to, any claims for personal injury, death, or damage to or loss of property or any other harm arising out of participant's participation in the promotion, the receipt, use or misuse of any prize, or any travel or activity that is related to the promotion or any prize. This Contest is in no way sponsored, endorsed or administered by, or associated with Facebook.

Copyright. By entering the Contest, each entrant grants to Sponsor a royalty-free limited license to publish, print, edit or otherwise use the submitted entry, in whole or in part, for any purpose and in any manner or media (including, without limitation, the Internet) throughout the world without compensation.

Construction. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.

Sponsor. The KTVB and the Idaho Transportation Department Office of Highway Safety Shift Student Video Contest is sponsored by KTVB and the Idaho Transportation Department Office of Highway Safety. The decisions of Sponsor and the Contest judges regarding the selection of winners and all other aspects of the Contest shall be final and binding in all respects. Sponsor will not be responsible for typographical, printing or other inadvertent errors in these Official Rules or in other materials relating to the Contest.
