Rules and Regulations

Important:  Please read these rules before entering this sweepstakes (the "Sweepstakes"). By participating in this Sweepstakes, you agree to be bound by these Official Rules and represent that you satisfy all of the eligibility requirements below. 

Eligibility: Sweepstakes is open only to legal residents of the United States of America who are at least eighteen (18) years of age or older. Employees and directors of Ferrellgas, L.P., and its affiliates, and any advertising or promotion agencies or contractors, who are under contract or have performed work on behalf of Ferrellgas, L.P. during (or during the period six months prior to) the Promotion Period, and the immediate families (parent, child, sibling and spouse of each) and members of the same household of each of the above, are not eligible. Void where prohibited by law. All applicable federal, state and local laws and regulations apply. By participating, Entrants agree to abide by all terms of these Official Rules and to the decision of the Administrator and waive any right to claim ambiguity in the Sweepstakes or these Official Rules.

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR

WIN. A PURCHASE DOES NOT INCREASE YOUR CHANCES OF WINNING.

The Sweepstakes begins December 21, 2018 at 12:00 a.m. Eastern Standard Time (EST) and ends March 19, 2019 at 11:59 p.m. EST (the “Promotion Period”).

Entry: You may enter by making a public post with a photo on Facebook, Instagram or Twitter tagging with hashtag #BlueWinterCue in the copy during the Sweepstakes Period. By publicly posting your photo on Facebook, Instagram or Twitter tagging with hashtag #BlueWinterCue or by submitting photo to Sweepstakes, Entrant represents that Entrant has all necessary rights to grant a license to the Administrator to publish and reuse Entrant’s photos and/or posts for any purpose without compensation and that Entrant hereby grants such license together with right to use Entrants name and the image of anyone or anything appearing in the photos. No other method of entry is permitted. No mechanically reproduced or automatically generated entries are permitted. Incomplete, illegible or garbled entries will be disqualified. There will be no verification or receipts of entries. If you enter using a mobile device, standard data charges may apply from your carrier. There is no limit of entries per person during the Sweepstakes Period.

As sponsors, Blue Rhino, and Ferrellgas, L.P may display all Submissions on both Blue Rhino and Ferrellgas social media platforms. By uploading your Submission, you agree that your Submission conforms to the Submission Guidelines and Content Restrictions listed below (collectively, the “Guidelines and Restrictions”) and that Blue Rhino, in its sole discretion, may remove your Submission and disqualify you from the Sweepstakes if it believes, in its sole discretion, that your Submission fails to conform to the Guidelines and Restrictions.  By uploading your Submission, in addition to rights granted below, you: (a) grant to sponsors Blue Rhino and Ferrellgas, L.P. all rights necessary to display your Submission on Blue Rhino and Ferrellgas, L.P websites and any social media pages; (b) hereby waive any so-called moral (e.g., creative rights) in your Submission; (c) represent and warrant that you have the right to grant the rights granted in these Official Rules; and (d) represent and warrant that your Submission and its use as contemplated in these Official Rules does not and will not violate, misappropriate, or infringe upon any law or regulation or the rights of any third party, including any copyright, trademark, or any rights of publicity or privacy, or any other intellectual property or proprietary rights.

 

Submission Guidelines:

a.    The Submission must tag the hashtag #BlueWinterCue;

b.    The Submission must be a digital photo;

c.     The Submission must be entrant's original creation and owned one hundred percent (100%) by the entrant;

d.    The Submission must not disparage Sponsor, Administrator or any other person or party;

e.    The Submission cannot have been submitted previously in a promotion of any kind or exhibited or displayed publicly through any means; and

f.      The Submission must demonstrate one of the following sweepstakes themes: Grilling, Winter Grilling, or Food Preparation.

Content Restrictions:

a.    The Submission must not contain material that violates, misappropriates, or infringes upon any law or regulation or the rights of any third party, including any copyright, trademark, or any rights of publicity or privacy, or any other intellectual property or proprietary rights;

b.    The Submission must not disparage any person or entity;

c.     The Submission must not contain material that is inappropriate, indecent, obscene hateful, tortious, and/or defamatory;

d.    The Submission must not contain material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age; and

e.    The Submission must not contain material that is unlawful, in violation of or contrary to the laws or regulations in any jurisdiction where Submission is created.

For All Submissions:  You may submit unlimited Submissions during the Sweepstakes Period.  Submissions received from any person or email address in excess of the stated limit, whether through multiple or different Facebook accounts or other applicable accounts or means, will be void.  Entrant must have signed permission from all individuals (parents/legal guardian of children, if featured and if not your own) that appear in the Submission to use their name and image in the Submission and to grant the rights set forth herein.  If requested by sponsors Blue Rhino and Ferrellgas, L.P entrant must be able to provide such permissions in a form acceptable to Sponsors.  By uploading a Submission, entrant grants to Blue Rhino and Ferrellgas, L.P. (and Sponsors’ licensees and assigns) a royalty-free, irrevocable, perpetual, assignable and non-exclusive license to use, reproduce, modify, publish, create derivative works from, and display such Submissions in whole or in part, and otherwise exploit the Submission in all media now known or hereafter devised, throughout the universe, in any way Blue Rhino and Ferrellgas, L.P. sees fit including, but not limited to, entertainment, instruction/education, promotional, advertising and/or marketing or trade association purposes.  In connection with all rights granted herein, Blue Rhino and Ferrellgas, L.P. (and Sponsors’ licensees and assigns) shall also have the irrevocable right to incorporate Submissions, in whole or in part, into other works, in any form, media or technology now known or hereafter developed.  If necessary, entrant will sign any necessary documentation that may be required for Blue Rhino and Ferrellgas, L.P or its designees to make use of the non-exclusive rights entrant is granting to use the Submission.  Proof of submission will not be deemed proof of receipt by Sponsors.

• Compliance: Potential winners are subject to verification of eligibility and compliance with these Official Rules. Announcement and instructions for the Prize will be sent by private message to the potential Prize winner’s Facebook, Twitter or Instagram account or email, including requesting the potential winner to provide his/her complete first and last name (no initials), email address, physical mailing address, telephone number and date of birth. Once the potential winner’s initial information is received, Administrator will send voucher for Prize in the mail within approximately twenty-four (24) hours. Potential winner has forty-eight (48) hours to respond to the Administrator’s email with the requested information or the Prize may, at Sponsor’s sole discretion, be forfeited. All federal, state and local taxes imposed on the acceptance of a Prize are solely the responsibility of each winner. Administrator will attempt to notify each potential winner as set forth above, but Administrator and Sponsor are not responsible for any undelivered direct messages, emails or other attempts at contact, including, without limitation, emails that are not received because of a winner’s privacy or spam filter settings which can divert any Sweepstakes email, including any winner notification email, to a spam or junk folder. The right to receive a Prize is non-assignable, non-transferable, and no Prize substitution or exchange will be allowed, except by Sponsor, who reserves the right to substitute a Prize of equal or greater value. Any and all other costs and expenses not expressly stated herein are the sole responsibility of the winner. CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO PROSECUTE ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. By accepting a prize, winners agree to release and hold Ferrellgas, L.P., and its divisions, subsidiaries, affiliates, directors, officers, employees, sales representatives, contractors, and advertising and promotion agencies harmless from any and all liability for any injuries, losses or damages of any kind caused by their participation or resulting from acceptance, possession, use, or misuse of any prize. • Privacy Policy: Any personal identifiable information collected during an Entrant’s participation in this Sweepstakes will be collected by Sponsor or its agent and used by Sponsor, its affiliates, agents, and marketers for the sole purpose of the proper administration and fulfillment of the Sweepstakes as described in these Official Rules, in accordance with Sponsor’s Website Privacy Policy at https://bluerhino.com/privacy-policy. Please note, Sponsor’s Website Privacy Policy follows its parent company, Ferrellgas Partners, L.P.’s Privacy Policy.
