1.Sponsor
Kitchen Stuff Plus’ “Summer Patio Giveaway” is sponsored by Kitchen Stuff Plus Inc. This Contest is in no way sponsored, administered, endorsed by or associated with, WooboxLLC., Instagram LLC. or Facebook Inc. Any questions, comments or complaints must be directed to the Sponsor, and not to, Woobox LLC., Instagram LLC. or Facebook Inc.
2. Eligibility
To enter, you must be a citizen or permanent legal resident of Canada who resides in Ontario and is at least 18 years of age. The contest is not valid in any location outside of Ontario. The following are not eligible to enter to win: Kitchen Stuff Plus Inc. and their affiliates and each of their respective employees, shareholders, directors, officers, members, successors and agents, and each of their respective parent companies, divisions, subsidiaries, retailers, affiliates, promotion and advertising agencies, and any others engaged in the development, productions or distribution of promotional materials or prizes for this promotion (collectively, the “Released Parties”), and members of their immediate family (spouse, mother, father, sister, brother, ward, daughter or son and their respective spouses, regardless of where they reside) and persons living in the same household of Released Parties.
3. Contest Period
The Contest begins on Tuesday May 1, 2018 at 3:00pm EST and ends on Thursday May 31, 2018 at 11:59pm EST (the “Contest Period”) after which time the Contest will be closed and no further entries shall be accepted.
4. How to Enter
There are (3) methods of entry for this contest. Entrants are allowed (1) entry per method during the Contest Period, for a total of (3) entries.
Method #1: Instagram
Entrants must have an Instagram account to participate in this campaign. An account can be opened for free at http://instagram.com.By entering this contest, entrants agree to abide by Instagram policies that can be found at https://instagram.com/about/legal/terms/.
To participate, entrants must “follow” the Kitchen Stuff Plus handle http://instagram.com/kspstuff, if they are not already following the account. Next, entrants must like a post identified as a contesting post from the Summer Patio Giveaway and comment on the post by tagging three friends and using the hashtag #kspsummergiveaway. Entrants are allowed (1) entry through Instagram during the campaign period.
Method #2: Facebook:
Entrants must have a Facebook account to participate in this campaign. An account can be opened for free at http://facebook.com.By entering this contest, entrants agree to abide by Facebook policies that can be found at http://facebook.com/policies.
To participate, entrants must enter through Kitchen Stuff Plus ’Facebook page contest application, found at http://facebook.com/kitchenstuffplus,using hashtag #kspsummergiveaway. Entrants are allowed (1) entry through Facebook during the campaign period.
Method #3: Kitchen Stuff Plus Contest Page
To participate through Kitchen Stuff Plus Contest page participants are asked to fill out an online ballot form at www.kitchenstuffplus.com/contests. Entrants are allowed (1) entry through the website during the campaign period.
5.Winner Selection
(1) Grand Prize Winner, (1) Second Place Winner, and (1) Third Place Winner will be selected at random from entries collected during the Contest Period.
Odds of winning depend on the number of eligible entries received. Prize awards are subject to verification of eligibility and compliance with these Official Rules. Potential winners must be at least 18 years of age, a Canadian citizen or permanent resident and reside in Ontario. This contest is not valid anywhere outside of Ontario. Prize must be picked up in an agreed upon Kitchen Stuff Plus store location.
6. Winner Notification
Potential Prize Winners will be notified through a message via Kitchen Stuff Plus’ Facebook, Instagram or email should it be provided. Each winner will be given instructions on how to claim his/her prize. If a selected entrant cannot be contacted within (7) business days from the draw date, the prize will be forfeited and another selected entrant will be drawn. Winner must also confirm eligibility. Failure to do so will result in a forfeit of the prize, with Kitchen Stuff Plus Inc. having no further obligations to such potential winner. If the prize is returned as undeliverable, or winner is not in compliance with these Official Rules, the prize will be forfeited and at Kitchen Stuff Plus Inc.’s discretion another potential winner selected by random.
To claim a prize and to be declared a winner, the selected entrant will be required to:
Failure to complete the declaration of release form will result in the prize being forfeited and another entrant may be drawn. If a selected entrant does not reply within seven (7) business days from the date they were first contacted, or if they do not comply with the rules and regulations, the prize will be forfeited, and another entrant maybe drawn.

No substitution, transfer, or cash equivalent of a prize is permitted except by Sponsor, who reserves the right to substitute a prize with one of equal or comparable or greater value, at its sole discretion, or in the event a prize becomes unavailable for any reason. Prize is awarded “as is.” All federal, provincial and local taxes on the prizes are the sole responsibility of prize winners. All prizes must be claimed in-store.
8.Indemnification by Entrant
By entering the Contest, entrant releases and holds Releasees, Instagram LLC., Woobox LLC. and Facebook Inc., harmless from any and all liability for any injuries, loss or damage of any kind to the entrant or any other person, including personal injury, death, or property damage, resulting in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of any prize, participation in the Contest, any breach of these Contest Rules, or in any prize-related activity. The entrant agrees to fully indemnify Releasees, Instagram LLC., Woobox LLC. and Facebook Inc., from all claims by third parties relating to the Contest, including without limitation any claims of infringement of rights to copyright, privacy and/or personality.
9.Limitation of Liability
By participating each entrant agrees and by accepting a prize, winners agree: (a) to abide by these Official Rules, which govern all communications regarding the Promotion, and all rules and guidelines provided by Facebook which can be found at http://facebook.com, by Woobox which can be found at https://woobox.com/terms and by Instagram which can be found at http://instagram.com.
The Sponsor assumes no responsibility or liability for lost, late, unintelligible/illegible, falsified, damaged, misdirected or incomplete entries, notifications, responses, replies or any Confirmation and Release, or for any computer, online, software, telephone, hardware or technical malfunctions that may occur, including but not limited to malfunctions that may affect the transmission or non-transmission of an entry. The Sponsor is not responsible for any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with or utilized in the Contest or by any technical or human error which may occur in the administration of the Contest. The Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Sponsor is not responsible for any problems, failures or technical malfunction of any telephone network or lines, computer online systems, servers, providers, computer equipment, software, e- mail, players, or browsers, on account of technical problems or traffic congestion on the Internet, at any website, or on account of any combination of the foregoing. The Sponsor is not responsible for any injury or damage to entrant or to any computer related to or resulting from participating in this Contest. Entrant assumes liability for injuries caused or claimed to be caused by participating in the Contest, or by the acceptance, possession, use of, or failure to receive any Prize. The Sponsor assumes no responsibility or liability in the event that the Contest cannot be conducted as planned for any reason, including those reasons beyond the control of the Sponsor, such as infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or corruption of the administration, security, fairness, integrity or proper conduct of this Contest.
Decisions of Sponsor which shall be final in all respects relating to this Promotion; (b) to release, discharge and hold harmless the Released Parties, from any and all injuries, liability, losses and damages of any kind to persons, including death, or property resulting, in whole or in part, directly or indirectly, from entrant’s participation in the Promotion or the acceptance, possession, use or misuse of any awarded prize; (c) to the use of his/her name, answer (or portions of the Answer), image and/or likeness for programming, advertising, publicity and promotion purposes in any and all media, now or hereafter known, worldwide and on the Internet, and in perpetuity by Sponsor and its designees, without compensation (unless prohibited bylaw) or additional consents from entrant or any third party and without prior notice, approval or inspection, and to execute specific consent to such use if asked to do so; and (d) winner assumes all liability for any injury or damage caused, or claimed to be caused by participation in this Promotion or use or redemption of any prize.
10.Conduct
By participating in the Contest, each entrant agrees to be bound by (i) the Contest Rules, which will be posted and made available at www.kitchenstuffplus.com/contests; and (ii) the terms and conditions of any third-party site, to the extent applicable, including without limitation, Facebook, Instagram and Twitter. Entrant further agrees to be bound by the decisions of the Sponsor, which shall be final and binding in all respects.
Kitchen Stuff Plus reserves the right at its sole discretion to disqualify any individual from the Contest and to ban the individual from any future contest that it finds or believes to be tampering with the entry process or the operation of the Contest or Contest Website, to be acting in violation of the Official Rules or in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Any attempt by an entrant or any other person to deliberately damage any website or undermine the legitimate operation of the contest is a violation of criminal and civil laws and should such an attempt be made, sponsor reserves the right to seek damages from any such person to the fullest extent permitted bylaw.
11.Privacy/Use of Personal Information
By participating in the Contest, entrant: (i) grants to the Sponsor the right to use his/her name, username, mailing address, telephone number, and e-mail address (“Personal Information”) for the purpose of administering the Contest, including but not limited to contacting and announcing the Winner; (ii) grants to the Sponsor the right to use his/her Personal Information for publicity and promotional purposes, in whole or in part, in any and all media now known or hereafter devised, without further compensation unless prohibited by law; and (iii) acknowledges that the Sponsor may disclose his/her Personal Information to third-party agents and service providers of the Sponsor in connection with any of the activities listed in (i) and (ii) above.
Kitchen Stuff Plus is collecting personal data about entrants for the sole purpose of administering this Contest. No further informational or marketing communications will be received by the entrant unless the entrant requested to receive further communications. 12.Intellectual Property
All intellectual property, including but not limited to trade-marks, trade names, logos, designs, promotional materials, web pages, source code, drawings, illustrations, slogans and representations are owned by the Sponsor and/or its affiliates. All rights are reserved.
13.Law
These are the official Contest Rules. The Contest is subject to applicable federal, provincial and municipal laws and regulations. The Contest Rules are subject to change without notice to comply with any applicable federal, provincial and municipal laws or the policy of any other entity having jurisdiction over the Sponsor. All issues and questions concerning the construction, validity, interpretation and enforceability of the Contest Rules or the rights and obligations as between the entrant and the Sponsor in connection with the Contest shall be governed by and construed in accordance with the laws of the province of Ontario including procedural provisions without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction’s laws.
14.Language Discrepancy
In the event of any discrepancy or inconsistency between the terms and conditions of the Contest Rules and disclosures or other statements contained in any Contest- related materials, including but not limited to the Contest entry form, or point of sale, television, print or online advertising, the terms and conditions of the Contest Rules shall prevail, govern and control.
15.Internet & Mobile
Sponsor is not responsible for electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions or limitations of any kind, or inaccurate transmissions of or failure to receive entry information by Sponsor or presenter on account of technical problems or traffic congestion on the Internet, at any Website, or via the mobile phone or any combination thereof. If for any reason the Internet or mobile phone portion of the program is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt of affect the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes. Sponsor reserves the right to select winners from eligible entries received as of the termination date. Sponsor further reserves the right to disqualify any individual who tampers with the entry process. Sponsor may prohibit an entrant from participating in the Sweepstakes if it determines that said entrant is attempting to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception or other unfair playing practices or intending to abuse, threaten or harass other entrants. Caution: Any attempt by a participant to deliberately damage any Web site or undermine the legitimate operation of the Sweepstakes is a violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek damages from any such participant to the fullest extent of the law.
