OPEN TO LEGAL RESIDENTS OF THE UNITED STATES 18 YEARS OR OLDER. VOID WHERE PROHIBITED BY LAW. INTERNET ACCESS AND A VALID EMAIL ADDRESS ARE REQUIRED TO ENTER THE CONTEST. FRESHPET INC. (“Sponsor”) RESERVES THE RIGHT TO CANCEL THE SWEEPSTAKES AT ANY TIME. ALL SPONSOR DECISIONS ARE FINAL AND BINDING IN ALL MATTERS PERTAINING TO THIS SWEEPSTAKES. NO PURCHASE NECESSARY.
1. HOW TO ENTER: The Sweepstakes begins 10/24/2018 12:00 PM (EDT) and ends 10/31/2018 11:59 PM (PDT (the “Sweepstakes Period”). Participants will be required to submit a photo or video entry of the unique ways they show their love for their pet(s). To enter, submit a photo or video using the hashtag #TattooPawlor on social media sites Facebook, Twitter or Instagram. By providing your email address you are officially entering the Sweepstakes and you agree to these Official Rules. Sponsor is not responsible for any lost, late, undeliverable or undelivered entries. Limit one entry per person, validated by email address, Twitter username, Instagram username, or Facebook username.
2. SELECTION OF WINNERS: Ten grand-prize winner will be selected by the Freshpet team. Sponsor reserves the right to evaluate all entries and determine in its sole discretion if participants did not abide by the Official Rules. Those found to be in violation of the Official Rules, as deemed by Freshpet, are subject to disqualification from the Challenge. Prize descriptions are as follows: Ten (10) Grand-prize winners will receive: (1) One 2”x2” inch permanent black and gray tattoo done in a microrealistic portrait style of the winners’ cat and/or dog; completed by Sponsor selected tattoo artists at First Class Tattoo (located at 52 Canal St, New York, NY 10002) on November 10th, 2018 ($400 value). (1) One month of Freshpet refrigerated food ($50 value). Assorted branded swag and gear for dog or cat, as decided by winner ($30)
3. PRIZES: Prize winners will be notified via email or on respective social network on or before 11/5/2018. Sponsor not responsible for not technical errors in sending the winner’s notification. Winner will be responsible for expenses they may incur partaking and/or travelling to Freshpet x First Class Tattoos “Tattoo Pawlor” that are not listed in section 2 of this document; this includes, but is not limited to, transportation, boarding and tattoo upkeep expenses. Prizes are non-refundable and nontransferable. Sponsor reserves the right to substitute any prize with another prize of equal or greater value. Grand prize payment is subject to completion of valid W-9.
4. RELEASE: All entries submitted become property of the sponsor. By submitting an entry, entrants agree to release Sponsor from and against any and all costs, claims, or damages to persons or property due to participation in the Sweepstakes. All photo and video submissions become property of Sponsor and may be used in any form, including online, in PR, and in social media.

SUBMISSIONS
Any suggestions, ideas, notes, drawings, concepts, or other materials or information (collectively, the “Submissions”) submitted by you shall be the sole property of Freshpet. None of the Submissions shall be subject to any obligation of confidence on the part of Freshpet, and Freshpet and its affiliates shall not be liable for any use or disclosure of any Submissions in any manner. You hereby assign to Freshpet and Freshpet shall exclusively own, all right, title and interest in and to the Submissions and shall be entitled to unrestricted use of the Submissions for any purpose whatsoever, commercial or otherwise, without compensation to you. You warrant that you have the right to grant the foregoing assignment, and that the Submissions do not infringe on the rights of any third party. In addition, you warrant that all “moral rights” in those Submissions have been waived.
Notwithstanding the foregoing, you shall not submit or upload to, distribute through, or otherwise publish through Freshpet.net, Homestyleselect.com, Delifreshpet.com any content which is libelous, defamatory, obscene, pornographic, threatening, invasive of privacy or publicity rights, abusive, illegal, or otherwise objectionable that would constitute or encourage a criminal offense, violate the rights of any party, or that would otherwise give rise to liability or violate any law. Although Freshpet reserves the right to monitor or review the site and content posted by its users on such site, it does not assume the obligation or responsibility to do so.
You agree and acknowledge that Freshpet will fully cooperate with law enforcement authorities or court order requesting or directing Freshpet to disclose the identity of anyone posting or distributing such materials, or the identity of anyone otherwise violating these terms and conditions.
INDEMNITY
You agree to indemnify, defend and hold Freshpet its affiliates and licensors, and all of their respective directors, officers, managers, employees, agents and/or representatives harmless, from any against any claims, liability, losses, litigation, judgments, costs and expenses (including reasonable attorneys’ fees) arising out of or relating, directly or indirectly, to your breach of these terms and conditions.
OTHER
These terms and conditions shall be governed by and construed in accordance with the laws of the State of New Jersey. You agree that any action at law or in equity arising out of or relating to these terms shall be filed only in the state or federal courts located in Hudson County, New Jersey, and you consent to the personal jurisdiction of such courts for the purposes of litigating any such action. If any provision of these terms shall be unenforceable for any reason, then that provision shall be deemed severable from these terms and shall not affect the validity and enforceability of any remaining provisions. This is the entire agreement between us relating to the subject matter herein, and supersedes any prior agreement. This agreement incorporates by reference any other terms and conditions found on the site including, without limitation, terms relating to sweepstakes and promotions. This agreement shall not be modified except as provided herein.’
