Human vs Machine Image Contest! Feb 20 2023 - Feb 26 2023

 

  1. The promoter of this Competition is Digital Imaging Express trading as digiDIRECT, New South Wales, Australia.
  2. Competition entry is open to Australian residents. Entrants under 18 years of age must have the consent of their parent or guardian to enter. Employees of the Promoter or any person associated with the Competition or any organisation or individual associated with the provision of the prize(s) are not eligible to enter.
  3. Each entry must be entered in accordance with these Terms and Conditions. By entering the Competition, you agree to be bound by these Terms and Conditions. The Promoter reserves the right to refuse to award any prize to any entrant who fails to comply with these Terms and Conditions. All relevant instructions on the Promoter's website form part of these Terms and Conditions.
  4. Competition entry is free.
  5. The Competition can be entered via digiDirect's PhotoComp module
  6. Each entry must include an image fitting the entry details and the requested identity and contact information.
  7. By submitting an image to this competition, you grant the Promoter and its licensees a non-exclusive license to use of said image.
  8. Without limiting the rights granted to the Promoter under point 7, you specifically agree that point 7 grants to the Promoter the non-exclusive right throughout the world to communicate the image in whole or in part to the public on any media platform and you grant to the Promoter all associated rights necessary to exercise the above rights.
  9. Entries can be either photographs shot by a human (editing is allowed), or completely AI-generated images.
  10. Entrants are allowed to submit multiple entries.
  11. The winning image will be selected by the panel of expert judges advertised on the contest description page, with the judges not knowing whether the entry is a photograph or AI creation.
  12. The judging panel of digiDirect's weekly photo competition will collate a shortlist of 20 finalists for judging by the panel of expert judges.
  13. Chance plays no part in determining the prize winners.
  14. The Winner will receive an online voucher for $1000 usable at www.digidirect.com.au (not applicable in store). This voucher will be valid for 12 months past the date it is provided to the winner.
  15. This prize cannot be redeemed for cash.
  16. You warrant that:
    1. all details provided with your entry are true and accurate
    2. you have all necessary rights and licenses to grant the rights set out in these Terms and Conditions
    3. the Image is an original work
    4. you are the copyright owner or authorised licensor of all copyright works and subject matter comprised in the image
    5. the exercise of the rights granted to the Promoter in these Terms and Conditions will not infringe the rights of any third parties; you will indemnify the Promoter against any loss or damage resulting from any breach of these warranties
  17. You acknowledge that the Promoter is under no obligation to exercise any of the rights granted to it by these Terms and Conditions.
  18. The decision of the Promoter and its panel of judges is final and no correspondence will be entered into. The name of the prize winner will be announced on the digiDirect social media pages. Please allow at least 28 days from the date of notification for the delivery of the prize.
  19. In the event that the prize winner cannot be contacted, the Promoter will retain the prize for three (3) months from the date of the judges' decision. If any prize is not claimed within three (3) months of the date of the judges' decision, the judges may determine another winner for the unclaimed prize. A winner of any unclaimed prize will be the prize winner for the purpose of these Terms and Conditions.
  20. If there is any event that prevents or hinders the running of the Competition or the Promoter's ability to deliver the prize to the prize winner, the Promoter may, at its discretion, cancel the Competition and recommence it at another time under the same conditions or select another winner.
  21. The Promoter is not responsible for any incorrect or inaccurate information, or for any of the equipment or programming associated with or utilised in this Competition, or for any technical error that may occur in the course of the administration of this Competition. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of entries.
  22. To the full extent permitted by the law, the Promoter will not be liable for any injury, damages, expenses, or loss whatsoever (whether direct or inconsequential) to persons or property as a result of any person entering into the Competition or accepting or using any prize, including without limitation non-receipt of any prize or damage to any prize in transit.
