Terms & Conditions (FINAL SGC APP)
1. Information on how to enter and prizes form part of these conditions.By participating, entrants agree to be bound by these conditions. Entries mustcomply with these conditions to be valid.
2. Entry is open to permanent residents of Australia, aged 18 years orolder only. (“EligibleEntrant”) Employees of the Promoter and theirassociated agencies and companies and their immediate families are ineligibleto enter.
3.To enter the competition and registereither;
4. The promotion commences at00:01am (AEST) on 21/05/15 and closes at 11.59pm (AEDST) on 31/12/15. (Promotional Period).
MAJOR/MINOR PRIZE DRAWS
5. There will be 1 X Major Prize Draw, and 11 X Minor Prize Draws. All validentries received within the promotional period outlined above will be enteredinto the Major & Minor Prize Draws.
6. The Major and Minor Prize Draws will takeplace on and 15/01/16 at 11.59am (AEDST) at 18/ 137-145 Rooks Road Nunawading, VIC 3131, Australia.
7. The first valid entry drawn will win the following Major prize:
1 x Cub Camper Kamparoo Brumby Camper Top of therange off roader with independent suspension, of road electric brakes, Fridgebox with stainless steel storage drawers, deep cycle battery pack, galvanisedchassis, stainless steel kitchen unit and a deluxe awning with a front wall.Australian steel, Australian canvas, Australian designed and Australianmade. Inclusive of all on road costs and dealer delivery valued at RRP$28,990.00 AUD (Winner to arrange delivery of prize from the winners nearestCub Camper dealer).
8. Total maximum value of Major prize is valued at RRP $28,990.00 AUD All taxes (excluding GST) which may be payable as a consequence ofreceiving a prize are the sole responsibility of the winner.
9. The next 11 valid entries drawn will win the following 11Minor prizes: (In drawn order)
Firstvalid entry drawn will win a $2,000 Camec Gift Voucher, valued at RRP $2,000.00AUD (Total $2,000.00 AUD)
Thenext 10 valid entries drawn will each win a $250 Discovery Holiday Parks GiftVoucher, valued at RRP $250.00 AUD each. (Total $2,500.00 AUD)
10. Total Maximum value of Minor Prizes is $4,500.00 AUD.
BONUS PRIZE DRAW (ONLINE ENTRIESONLY)
11. All competition entrants who registered and entered into the competitionvia the online/website at www.whatsupdownunder.com.au during the promotionalperiod will receive (1) one entry into the Bonus Prize Draw per person/peremail address per day only.
12. There will be 7 Bonus Prize Draws intotal. All valid entries received within the promotional period as set out inClause 4 via the online/website entry method, will be entered into the Bonus PrizeDraw.
13. The Bonus Prize Draws will take place at the same time and place as theMajor Draw on the following dates; 11.59am(AEST) on 26/06/15, 11.59am (AEST) on 31/07/15, 11.59am (AEST) on 28/08/15, 11.59am(AEST) on 25/09/15, 11.59am (AEDST) on 30/10/15, 11.59am (AEDST) on 27/11/15and 11.59am (AEDST) on 15/01/16..
14. The first eligible entry drawn during on the Draw Date as stipulated abovewill each win a Camec RV Media Package valued at $1,182.90 RRP consistingof 1 x RVMedia 32” Full HD TV (Part Number 042702) RRP $699.00;1x RVMedia Blu-Ray & DVD Player (Part number 042494) RRP $399.00;1x RVMedia VESA Conversion Kit (Part Number 043042) RRP $14.95 and 1x RVMedia LCD Triple Arm TV Mount Bracket (Part number 041131) RRP$69.95;
15. Total Value of Monthly Prize Pool is $8,280.30 AUD.
16. Total Promotional Prize Pool Is $41,770.30AUD.
17. Incomplete,indecipherable or illegible entries will be deemed invalid.
18. The Promoter reserves the right to request verification of age,identity, residential address of winners at the nominated prize deliveryaddress and/or proof of entry and other information relevant to entry into orparticipation in this promotion. Verification is at the Promoter’s discretion,whose decision is final. The Promoter reserves the right to disqualify anyindividual who is involved in any way with interfering or tampering with theconduct of the promotion.
19. The winner of the Major and Minors prizes will be notified by telephoneand in writing within two (2) working days of the draw and the names of theprize winner will be published in The Australian on 22/01/16. Prizes will be delivered within 28days from the prize draw or any other period mutuallyagreed between the Prize winner(s) and the Promoter.
20. The winners of the Bonus Monthly Prize Draws will be notified bytelephone and in writing within two (2) working days of each draw and the namesof the prize winners will be published in The Australian on the followingdates: Bonus Draw (1) on 03/07/15, Bonusdraw (2) on 07/08/15, Bonus Draw (3) on 04/09/15, Bonus Draw (4) on 02/10/15, BonusDraw (5) on 06/11/15, Bonus Draw (6) on 04/12/15 and Bonus Draw (7) on 22/01/16.Prizes will bedelivered within 28 days from the prize draw or anyother period mutually agreed between the Prize winner(s) and the Promoter.
21. Prizes are not transferable and are not redeemable for cash. ThePromoter’s decision is final and binding - no correspondence will be enteredinto. The Promoter accepts no responsibility for late, lost or misdirectedentries or other communications. Entries will be deemed void if forged, manipulatedor tampered with in any way.
22. If necessary, the promoter may conduct an unclaimed prize draw at thesame time and place as the original Major draw on the 18/04/16 (being at least 3 monthsafter the date of the Major Prize Draw) inorder to distribute any unclaimed prizes. All non-winning entries will beincluded in the unclaimed prize draw. In the event of any winners in theunclaimed prize draw, the winners will be notified by phone and in writingwithin two (2) working days of the draw and their names published in TheAustralian on 25/04/16.
23. In the event that any prize becomes unavailable for reasons beyond thePromoter’s control, the Promoter may substitute a prize of equal or greatervalue, subject to any written directions from the various lottery authorities.
24. Prize values are correct at time of printing but no responsibility isaccepted for any variation in the value of any prizes.
25. The Promoter accepts noresponsibility for late, lost or misdirected entries or other communications.All entries are deemed to be received at the time of receipt in the Promotionaldatabase and not time of transmission by the Entrant. Email is not a guaranteeddelivery communication tool. The Promoter assumes noresponsibility for any failure to receive an entry or for inaccurateinformation or for any loss, damage or injury as a result of technical ortelecommunications problems, including security breaches. If such problemsarise, then the Promoter may (where necessary with the approval of the relevantlottery authority) modify the promotion. Except for any liability which cannotbe excluded by law, including the Non-Excludable Guarantees, the Promoter andits associated companies are not responsible for and excludes all liability(including negligence), for any personal injury or any loss or damage(including loss of opportunity) whether direct, indirect, special orconsequential, arising in any way out of:
(a) any problems or technicalmalfunction (whether or not under the Promoter’s control) of any telephonenetwork or lines, computer online systems, servers, or providers, computerequipment, software, technical problems or traffic congestion on any computersystem or at any website, or any combination thereof, including (but notlimited to) any injury or damage to participants or any other person’s propertyrelated to or resulting from participation in this Promotion;
(b) any incorrect or inaccurate information,either caused by users or by any of the equipment or programming associatedwith or utilised in connection with this Promotion, or by any technical errorthat may occur in the course of this Promotion;
(c) any error, omission, interruption,deletion, defect, delay in operation or transmission, communications linefailure, theft or destruction or third part interference or unauthorised accessto or alteration of entries or entrants details;
(d) any entry or prize claim that is late,lost, altered, damaged or misdirected (whether or not after their receipt bythe Promoter);
(e) anyvariation in prize value to that stated in these Terms and Conditions;
(f) any tax liability incurred by a winneror entrant (independent financial advice should be sought); or
(g) use ofa prize.
26. The Promoter is not liable for any loss or damagewhatsoever which is suffered, including but not limited to indirect orconsequential loss, or for personal injury suffered or sustained during thecourse of accepting or using the prize, except for any liability which cannotbe excluded by law.
27. Details from entries will be collected and used for the purposes ofconducting this promotion (which may include disclosure to third parties forthe purpose of processing and conducting the promotion) and for promotionalpurposes surrounding this promotion. By entering this promotion entrantsconsent to the use of their information as described and agree that thePromoter may use this information, or disclose it to other organisations thatmay use it, in any media for future promotional purposes without any furtherreference or payment to the entrant. Entrants may access, change and/or updatetheir personal information and obtain a copy of the Promoter’s privacy policyby contacting the Promoter c/o (03) 9872 5780 during office hours.

To the extent permittedby law, the Promoter, its employees, and agents shall not be liable for anyclaims, damages, injuries, costs, and expenses suffered, sustained or incurred(including but not limited to indirect or consequential loss) as a result of,or arising out of, or in any way connected with this competition and/or itsprizes or any act or omission (whether negligent or not) of the Promoter, itsemployees and agents.
