The Official Rules to enter the Lionel Trains LLC "Lionel Holiday Giveaway” THIS CONTEST IS OPEN ONLY TO INDIVIDUALS WHO ARE 18 YEARS OF AGE OR OLDER AT TIME OF ENTRY. NO PURCHASE NECESSARY TO ENTER OR CLAIM PRIZE.
1. ELIGIBILITY: Lionel Holiday Giveaway is, subject to the terms contained herein, open to legal residents of the United States, 18 years of age or older at time of entry. Officers, directors, employees and agents, and their immediate family members, of Lionel LLC (Sponsor and Contest Administer) are void from participation. The Giveaway is governed by U.S. law, is subject to all applicable federal, state and local laws and regulations, and is void where prohibited. By entering the Giveaway, each participant represents and warrants to the Sponsor and Contest Administer that he or she meets all of the eligibility standards set forth herein. The Sponsor and Contest Administer may reject any entry at any time if it determines or suspects, in its sole and absolute discretion that a participant may not be eligible or may otherwise be in violation of the Giveaway rules.
2. HOW TO ENTER: To enter the Giveaway, go to the official Facebook or Instagram page of Lionel Trains and follow the Rules to Enter provided, beginning on November 6^th, 2019. The Giveaway will conclude at 8:00AM EST on November 22^nd, 2019.
3. SELECTION OF WINNERS: The Contest Administer will determine the contest winner on November 22^nd, 2019; the Winner will be determined at random and Contest Administer will notify Winner by email via the email address used to enter. If Contest Administrator, using commercially reasonable efforts, is unable to contact a potential winner within five (5) business days from the first contact attempt, or if a potential winner has not, or does not comply with these Official Rules, then such person shall be disqualified and an alternate winner may be selected in accordance with these Official Rules as determined in Contest Administrator’s sole discretion. Except for notifying a winner by email, Contest Administrator has no obligation to contact a winner by United States mail or telephone, or to deliver a message by voicemail/answering machine, or otherwise. By accepting Prize, the Winner consents that the Sponsor may use the Winner's names, photographs, or other likenesses, the Winner’s hometown and biographical information, statements concerning the Giveaway entry or the Sponsor’s products without compensation for purposes of advertising, promotion, and merchandising, and grant all rights to edit or modify and to publish and copyright it.
4. RELEASE OF LIABILITY. By accepting Prize, the Winners agree to hold Contest Administer, the Sponsor and Contest Administer, and their respective affiliates, including Rail Events and Warner Bros. Inc, and each of their respective shareholders, directors, officers, employees, members, successors, agents and assigns (collectively, the “Released Parties”) harmless against any and all claims and liability arising out of the promotion or use of the Prize. Furthermore, the Winner assumes all liability for any injury or damage caused, or claimed to be caused, by participating in this Giveaway or using the Prize. By participating in this Giveaway, entrants agree to abide by and be bound by these Official Rules, and understand that the Giveaway results are final in all respects. By participating in this Giveaway, entrants agree to hold the Released Parties harmless against any and all claims and liability arising out of Prize. Entrant is responsible for all online charges incurred by Internet Service Provider. Any questions regarding the determination of the winner will be decided in the sole discretion of the Sponsor and Contest Administer or the Contest Administer, whose decisions are final and binding in all matters relating to this Giveaway.
5. PRIZE: The Winners will receive a prize package consisting of one THE POLAR EXPRESS™ Ready-To-Play Set by Lionel and tickets for a family of 4 to THE POLAR EXPRESS™ Train Ride by Rail Events. The 4 tickets for the The Polar Express Train Ride are for the train ride only; travel expenses and all other expenses not incurred. The 4 tickets can only be used at one of the two locations hosting The Polar Express Train Ride by Rail Events; Fillmore & Western Railway in Fillmore, CA on December 4^th, 2019 from 4:00pm-9:00pm PT and Southern California Railway Museum in Perris, CA on December 5^th, 2019 from 4:00pm-9:00pm PT. Prizes are non-transferable and cannot be substituted by the Winner. The Sponsor and Contest Administer may substitute a prize of equal or greater value in its sole discretion. The Winner is solely responsible for all federal, state and local taxes associated with the acceptance of the prize. Unclaimed or rejected prizes will not be awarded. Odds of winning depend on the number of entries received.
6. REDEEMING PRIZES: The Contest Administer will notify the Winner on the day that the winner are selected. Once the Winner has been successfully contacted, the Contest Administer will post an announcement on the Sponsor’s Facebook and Instagram pages to announce each winner. The Winner and information provided by the Winner is subject to verification at the sole discretion of the Sponsor and Contest Administer. Unless otherwise agreed by the Sponsor and Contest Administer, Winner will receive their prize via FedEx, United Parcel Service or other overnight service within three to four weeks of winner announcement. The Released Parties are responsible for lost, late, stolen, misdirected, delayed or damaged prizes. The tickets for a family of 4 to The Polar Express Train Ride by Rail Events must be used on or before 12/31/2019. 7. GENERAL: All federal, state and local laws apply to this Contest. By participating, entrants agree (i) to be bound by these Giveaway rules, including all eligibility requirements, and (ii) to be bound by the decisions of the Sponsor and Contest Administer, which are final and binding in all matters relating to the Giveaway. The Released Parties are not responsible for: (i) lost, late, misdirected, damaged, garbled or illegible entries; (ii) error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by the Sponsor and Contest Administer on account of technical problems or traffic congestion on the Internet or at any web site or any combination thereof; or (iii) any injury or damage to entrant’s or any other person’s computer related to or resulting from participating in the Giveaway. The Sponsor and Contest Administer reserve the right to permanently disqualify any person from this Giveaway it believes has violated these Giveaway rules. By accepting a prize or participating in this Giveaway, the Winner and/or any participant irrevocably consents to the use of his/her name, likeness, image, voice, performance (in connection with interviews and other recordings), biographical information, comments, feedback, suggestions, writings, ideas and statements relating to the Giveaway or the Sponsor and Contest Administer, without further compensation, in all world-wide marketing, promotion, and publicity carried out in perpetuity by the Sponsor or Contest Administer in connection with this Giveaway. The Sponsor and Contest Administer reserve the right to terminate, cancel, suspend and/or modify the Giveaway if any fraud, virus or other problem corrupts the administration, security, or proper play of the Giveaway, as determined by the Sponsor and Contest Administer in its sole discretion. If Giveaway is terminated before the end date/time, the Sponsor or Contest Administer will determine the winner from all eligible entries received as of the termination date/time. If any such malfunction, error, disruption or similar damage occurs and impairs the administration, security, fairness, integrity or proper play of the Giveaway, the Sponsor and Contest Administer may, in their sole discretion, suspend or terminate the Giveaway by posting a notice on their website and/or social media pages.
8. DISCLAIMERS: Under no circumstances, including negligence or intentional acts or omissions, shall the Released Parties be liable for any direct, indirect, incidental, special or consequential damages, including without limitation, property damage, personal injury and/or death, resulting from participation in the Giveaway or acceptance, use or misuse of any prize. Notwithstanding the foregoing, in the event that the preceding release is determined by a court of competent jurisdiction to be invalid or void for any reason, the entrant agrees that, by entering the Giveaway, (a) any and all disputes, claims, and causes of action arising out of or in connection with the Giveaway, or any prizes awarded, shall be resolved individually without resort to any form of class action; (b) any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Giveaway, but in no event attorney’s fees; and (c) under no circumstances will any entrant, including the Winner, be permitted to obtain any award for, and entrant hereby waives all rights to claim, punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out-of-pocket expenses. Entrants hereby acknowledge that the Sponsor and Contest Administer have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied (including, but not limited to warranties of any kind concerning the appearance, safety or performance of any prize), in fact or in law, relative to any prize. Each winner shall bear all risk of loss or damage to his/her prize after it has been delivered to such winner via FedEx, United Parcel Service, or any other shipping agent.
