NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING. This is not a game of chance. VOID WHERE PROHIBITED BY LAW.

 

By entering the Get Hitched at Helzberg Contest (the “Contest”) you agree to abide by all terms and conditions referenced in these Official Rules.

 

1. ELIGIBILITY: This Contest is open only to legal U.S. residents physically residing in one of the fifty (50) United States or the District of Columbia at time of entry who are 18 years of age or older and the age of majority in their state of residence at the time of entry, who are engaged to be married or are ready to propose marriage to their significant other (their “Significant Other”). Employees of Helzberg’s Diamond Shops, LLC (“Sponsor” or “Helzberg”), FleishmanHillard Inc. (“FleishmanHillard”), GMR Marketing LLC (“GMR” or “Administrator”), and/or any promotion or other vendor agency involved in this Contest (and any other person engaged to work on this Contest) and any agents acting for, or on behalf of, the above entities, their respective parent, subsidiary and related companies, officers, directors, affiliates and service providers (collectively, the “Released Parties”) and the household and immediate family members (defined for the purposes of this Contest as a parent, spouse, child, and sibling) of such employees are NOT eligible to enter or win. Contest is subject to all federal, state, and local laws and regulations. Void where prohibited or restricted by law.

 

2. TIMING: This Contest begins at 7:00 a.m. Central Time (“CT”) on July 10, 2022 and ends at 11:59 p.m. CT on August 29, 2022 (“Contest Period”).

 

3. HOW TO ENTER: To enter the Contest (individually, an “Entry”, collectively, “Entries”), you must follow the instructions below to share why you want to win the Get Hitched at Helzberg Contest:

 

a. Visit https://woobox.com/c4ev9u (the “Website”) during the Contest Period.

b. Follow the on-screen instructions to register including inputting your first name and last name; email address; daytime phone number and city and state of residence; verify your relationship status by selecting the applicable option in the Relationship Status drop-down menu.  

c. Tell us in the English language why you want to win the Get Hitched at Helzberg Contest in an original essay (your “Story”) of no more than 300 words and in accordance with the criteria set forth in these Official Rules. NOTE: only the first 300 words of your Story will be considered as part of your Entry and any words in excess of the 300 word limit will not be judged.

d. Check the designated box to accept these Official Rules and click “Enter Now”.

 

Your Story and registration information shall be referred to collectively as your “Entry.”

 

Entry Limit: Limit one (1) Entry per person and per email address during the Contest Period. Entries received from any person in excess of stated limitations or otherwise not in compliance with the foregoing will be void and those involved in such Entries will be disqualified.

 

4. ADDITIONAL CRITERIA FOR ENTRY:  Your Entry must be your original creation in the English language, must not have been previously published in whole or in part, and must explain the reason you want to get hitched at Helzberg. Entry must be consistent with the Sponsor’s brand reputation in the marketplace and must be suitable for audiences of all ages.  The judges/Sponsor may disqualify any Entry that contains any of the following: Entries that include copyrighted, trademarked, patented or previously published material, proprietary and/or brand names; Entries that defame or invade the rights or privacy of any person, living or deceased, or otherwise infringe upon any third party’s personal, proprietary or intellectual rights; Entries that include recognizable commercial products (e.g., clothing, toys, food) and/or their trademarks, brands, logos; unauthorized trademarks and copyrighted material (e.g., music, celebrity references, etc.); Entries that include or involve any of the following: music, obscenity, crude, vulgar or offensive statements, depictions, language and/or symbols; gang or hate group signs or symbols; violence, explicit sexual activity; nudity; Illegal drug or alcohol use; license plates, phone numbers, personal addresses (physical or email or otherwise); website or web page links; derogatory characterizations of any ethnic, racial, sexual or religious groups or references that may tend to humiliate other people (publicly or otherwise), any assault or threatening of others; trespass or the violation of other people’s rights or property; Illegal (e.g., discriminatory, harassing) or inappropriate activity, behavior or conduct (e.g., inflicting emotional distress); Entries containing prohibited content or otherwise in violation of these Official Rules, or containing any other content, materials and/or   that are or could be considered infringing of third party intellectual property rights, inappropriate, unsuitable or offensive, as determined by Sponsor in its sole discretion; Entries that exceed specified length or size limits; and Entries that do not meet the stated criteria above, or Entries that (in the Sponsor’s sole discretion) may technically meet the stated criteria but do not reflect the intent and the spirit of the provisions related to participation. Judges’/Sponsor’s discretion in reviewing Entries for such elements is final and non-appealable. 

 

The use of automated devices to enter this Contest is prohibited. Sponsor assumes no responsibility for lost, late, or misdirected Entries or any computer, online, telephone, or technical malfunctions that may occur. Any attempt by any person to submit more than the stated number of Entries by using multiple/different accounts or any other methods will void that person’s Entry and that person will be disqualified. Sponsor makes the final determination as to which Entries are eligible to take part in the Contest. Uploading an Entry on the Website is not verification that the Entry is a qualifying entry. By submitting an Entry, each entrant (i) warrants that the Entry is original and created by the entrant, non-confidential and legally created, does not violate any third-party rights including third-party intellectual property rights, and (ii) grants Sponsor, its affiliates, licensees and assignees, the perpetual, unlimited and irrevocable right to post, publish, adapt, edit, make derivative works and/or otherwise use the essay  and/or description of the Story in any manner, including copyright, and in any media now known or hereafter developed. All Entries become Sponsor’s property and will not be returned. Anyone found to use multiple email addresses to participate will be ineligible for this Contest and will not be eligible for the Grand Prize (as defined in Section 10 of these Official Rules).

 

If you enter the Contest by accessing the Website using your mobile phone, please note that standard data rates may be charged to your wireless bill or be deducted from your prepaid balance according to the terms of service with your carrier. Contact your wireless carrier for more information on data rates that apply to your service plan. 

 

5. JUDGING CRITERIA/ DETERMINATION OF GRAND PRIZE WINNER: This is not a game of chance. Odds of winning depend on the number and quality of Entries received. On or about September 15, 2022, the judges will select one (1) Grand Prize winner from among all eligible Entries submitted during the Contest Period. Grand Prize winner will be subject to verification and validation. 

 

Entries will be judged, evaluated and scored based on the following criteria:

 

 

All Entries will be judged as they are received by FleishmanHillard, an independent judging organization, and the Sponsor. If an Entry is disqualified due to violating the restrictions and limitations of Entry content outlined in Section 4 of these Official Rules, the Entry will be void and eliminated from the judging process. Specific reason for disqualification will not be provided. 

 

One (1) Grand Prize winner will be determined based on the Entry that received the highest score. In the event of a tie in scores, the Entries involved in such tie will be re-judged by an additional judge designated by the Sponsor using the same judging criteria, who will select a winner that best reflects all criteria. 

 

6. NOTIFICATION OF GRAND PRIZE WINNER: The potential Grand Prize winner will be notified by phone, email, or express mail on or about September 15, 2022. The potential Grand Prize winner must complete, sign, and return to Sponsor’s designee within 7 days after receipt of the first notice of award (or such other date/time indicated in the first notice of award)all of the following as requested by Sponsor: (1) Assignment of Rights; (2) a publicity release; (3) an affidavit of eligibility (including proof of eligibility upon request) and liability release; (4) a background check authorization/consent document; and (5) the appropriate tax documents, including without limitation, IRS W-9 form (all collectively referred to as the “Documents”), or the Grand Prize will be forfeited in its entirety. The potential Grand Prize winner may need to pass a background check, at the sole discretion of the Sponsor, prior to being confirmed as the winner, or the Grand Prize will be forfeited in its entirety.

 

In addition, the potential Grand Prize winner’s Significant Other must complete, sign, and return the presented affidavit of eligibility and liability release, publicity release and a background investigation authorization/consent form within 7 days after receipt of the first notice of award (or such other date/time indicated in the first notice of award). and the potential Grand Prize winner’s Significant Other may need to pass a background check, at the discretion of the Sponsor, or the Grand Prize may be forfeited in its entirety. 

 

Background Checks: Sponsor reserves the right to conduct background checks on the potential Grand Prize winner and their Significant Other and reserves the right in its sole discretion to disqualify a potential Grand Prize winner based on the results of such background checks, if the Sponsor determines in its sole discretion that awarding the Grand Prize to such potential Grand Prize winner might reflect negatively on Sponsor. 

 

If any attempted winner notification or Grand Prize is returned as undeliverable, if any required Documents are not returned within the required time frame, if any potential Grand Prize winner cannot be verified or found, or if any Grand Prize winner is otherwise unable to accept the Grand Prize as stated, Sponsor will declare the Grand Prize forfeited, and no compensation will be given upon forfeiture.  If a potential winner forfeits the Grand Prize or is otherwise disqualified, Sponsor will select an alternate winner based on the judging process  described in Section 5 above, and the Entrant with the next highest score may be deemed an alternate potential Grand Prize winner. Sponsor will make reasonable efforts to award the full Grand Prize, but may elect to not do so if it is not able to timely confirm a Grand Prize winner. Notification and document completion timelines for any alternate potential Grand Prize winner may be adjusted by Sponsor in its sole discretion.

 

In addition, Sponsor reserves the right, in its sole discretion, to disqualify a potential winner for any of the following reasons: (a) non-compliance with these Official Rules; (b) a potential Grand Prize winner is ineligible or rejects the Grand Prize (c) Sponsor becomes aware of information showing that the Entry was defective or failed to comply with these Official Rules. 

 

Sponsor is not responsible for suspended or discontinued wireless or online service, non-functional or full voice mail, change in any entrant’s mailing address, email address, or daytime phone number which may result in a potential Grand Prize winner not receiving a Grand Prize notification. 

 

7)   PUBLICITY RELEASE: The Grand Prize winner and their Significant Other grant to Sponsor and its designees, the right to the use of Grand Prize winner’s and Significant Other’s names, pictures, images, likenesses, voices, videos, biographical information, statements or any other identifiable characteristics or information, either in whole or in part and in any and every form, style, size, or color, at any time or times, for advertising, trade, promotion, publicity, business, trade or art purpose, either here contemplated or to be contemplated in the future or for any other reason Sponsor sees fit, without limitation, in all media now known or hereafter discovered, worldwide, in perpetuity, and on the Internet and World Wide Web, without additional notice, consent, review or approval, and without additional compensation or attribution to winner or Significant Other, unless prohibited by law.

 

8)   USE OF GRAND PRIZE WINNER’S ENTRY/SPONSOR-CAPTURED CONTENT AND ASSIGNMENT OF RIGHTS: Grand Prize winner and their Significant Other, (collectively, the “Couple”) grant to Sponsor and Sponsor’s designees, an irrevocable, worldwide, royalty-free, sub-licensable, transferable and perpetual right and license to exploit the copyright in the Grand Prize winner’s Entry and all content captured during the selection and delivery of the Grand Prize merchandise, and, if the Couple chooses, their wedding ceremony if performed at a Helzberg retail location (see Section 10), (all collectively, the “Content”) and any ancillary and subsidiary rights therein, in any medium through the world in perpetuity for editorial, promotional, publicity, or advertising purposes, including without limitation the right to edit, publish, use, adapt, exploit, modify, copy, disseminate, or dispose of the Content without further compensation, attribution, or notification of any kind except as prohibited by law. The Couple explicitly acknowledges and agrees that Sponsor and their designees reserve the right to publish any or all content of the Entry, with or without first and last name credit to the Couple; and entries that attempt to restrict this right will be disqualified from the Contest. The Couple agrees to execute at Sponsor’s request such documents as may be necessary to confirm or enact any assignment of rights or other documentation that may be required for the Sponsor and their designees to make sure of the rights set forth in these Official Rules. The Couple understands they will not receive any compensation or credit for use of the Content, other than what is described in these Official Rules.

 

Please note that following the end of this Contest the Content may be posted on a website selected by the Sponsor and their designees for viewing by visitors to that website. The Sponsor and their designees are not responsible for any unauthorized use of the Content by visitors to this website. While the Sponsor and their designees reserve these rights, the Sponsor and their designees are not obligated to use the Content for any purpose.

 

9)   ENTRANT ASSIGNMENT OF RIGHTS: By submitting your Entry, you, on behalf of yourself and your Significant Other:

a. are granting the Released Parties an irrevocable, worldwide, royalty-free, perpetual right and license for the duration of the protection of the copyrights to: (i) reproduce, copy, modify or alter your Entry with all known or later developed means in connection with the promotion of this Contest in all media (now known or later developed); (ii) use, review, assess, test and otherwise analyze your Entry and all its content in connection with this Contest; and (ii) feature your Entry and all its content in connection with the promotion of this Contest in all media (now known or later developed);

b. except where prohibited by applicable law, hereby irrevocably and unconditionally waive in perpetuity any and all so-called “moral rights” or any similar right that you may have or hereinafter acquire in the Entry and all its content, and to the extent that you cannot, you hereby consent to us doing or omitting to do any act that would otherwise infringe such “moral rights” or any such similar rights;

c. understand and acknowledge that the Sponsor and their designees and other entrants may have developed or commissioned materials similar or identical to your Entry and you waive any claims you may have resulting from any similarities to your Entry;

d. understand that the Sponsor and their designees cannot control the incoming information you will disclose to the Sponsor’s and their designees’ representatives in the course of entering, or what the Sponsor’s and their designees’ representatives will remember about your Entry. You also understand that the Sponsor and their designees will not restrict work assignments of representatives who have had access to your Entry. By entering this Contest, you agree that use of information in the Sponsor and their designees’ representatives’ unaided memories in the development or deployment of the Released Parties’ products or services does not create liability for the Sponsor and their designees under this agreement or copyright or trade secret law;

3. agree that you have no right to use the copyrights, trademarks, or other intellectual property relating to the Content outside the Contest.

 

If you do not want to grant the Sponsor and their designees these rights to the Content, please do not enter this Contest.

 

10. PRIZE AND APPROXIMATE RETAIL VALUE (“ARV”):

 

One (1) Grand Prize* (the “Grand Prize”): one (1) $19,000 corporate check payable to the confirmed Grand Prize winner (The check will be presented to the Grand Prize winner after the confirmed winner meets with Helzberg and selects the Rings (as defined below).); two (2) Helzberg wedding bands (the “Rings”) valued up to $2,000 in the aggregate (The Grand Prize winner may select the Rings from available inventory; does not include sizing or engraving. The Rings must be selected by the winner within sixty (60) calendar days of the date of winner confirmation or the winner will forfeit the Grand Prize.). The ARV of the Grand Prize is: $21,000.

 

*The Couple may choose to get hitched at Helzberg, with the services being provided by an ordained Helzberg associate to perform the Couple’s wedding ceremony at a Helzberg Diamonds store (the “Wedding”). To get married at Helzberg, the Couple must comply with the requirements available at https://www.helzberg.com/hitched.

 

Sponsor at its discretion may film and produce materials in connection with the Ring selection, check presentation, Wedding, or any other brand engagement, which will be the sole property of the Sponsor for use in any way the Sponsor sees fit. Entrants and their Significant Others agree not to make claims of ownership and to grant to Sponsor all rights to the materials produced in connection with the Wedding. Entrants and their Significant Others may be required to execute and sign additional documents on site at the Wedding.

 

These are estimated values only. The actual value of the Grand Prize is expected to vary, based on the wedding band pricing. If the actual value of the wedding band portion of the Grand Prize is less than stated, difference will not be awarded in cash, and no such claim will be honored. 

 

The Grand Prize is not redeemable for cash. No substitution, transfer, or assignment of the Grand Prize is permitted, except that Sponsor reserves the right to substitute a Grand Prize of equal or greater value. Any and all federal, state, and local taxes related to acceptance or use of the Grand Prize are solely the responsibility of the Grand Prize winner and Sponsor will comply with all tax reporting requirements. All other expenses not specified as part of the Grand Prize in these Official Rules and all other non-specified expenses incurred by accepting the Grand Prize are solely the Grand Prize winner’s responsibility.

 

Sponsor is not responsible for any problems related to the shipping of any Grand Prize, including, but not limited to, theft, delay, damage, or destruction/accidental loss by the shipping carrier.  

11. ADDITIONAL TERMS: By entering, entrant agrees to accept and abide by the Official Rules of this Contest and agrees that any dispute with regard to the conduct of this Contest, rule interpretation, or award of the Grand Prize, shall be resolved by Sponsor in its sole discretion , whose decision shall be binding and final. This Contest is governed by the laws of the State of Missouri, and entrant consents to the exclusive jurisdiction and venue of the Courts of the State of Missouri for any disputes arising out of this Contest. All federal, state, and local laws and regulations apply. By entering, entrant agrees to be notified by the method of entry or using the contact information provided in the Online Entry Form provided during the entry process by the Sponsor and/or GMR for the purposes of the administration of this Contest. By participating, entrant agrees to release and hold harmless the Released Parties from any injury, loss or damage to person, including death or property damage due in-whole or in-part, directly or indirectly to the acceptance, use, or misuse of the Grand Prize, participation in any Contest-related activity, or participation in the Contest. Sponsor and the other Released Parties are not responsible for any typographical or other error in the printing of this offer, administration of the Contest or in the announcement of the Grand Prize, including such error as may give an erroneous indication that the Grand Prize has been won. In the event the Sponsor is prevented from continuing with this Contest, or the integrity and/or feasibility of the Contest is undermined by any event including but not limited to fire, flood, epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, war (declared or undeclared), terrorist threat or activity, or any federal, state, or local government law, order or regulation, order of any court or jurisdiction, or other cause not reasonably within the Sponsor’s control (each a “Force Majeure” event), the Sponsor shall have the right, in its sole discretion, to abbreviate, modify, suspend, cancel, or terminate the Contest without notice or further obligation. If the Sponsor, in their discretion, elect to abbreviate the Contest as a result of a Force Majeure event, the Sponsor reserve the right, but shall have no obligation, to select the winner(s) from among all valid and eligible Entries received up to the time of such Force Majeure event. 

12. INTERNET: If for any reason the Internet portion of this Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, Sponsor reserve the right, at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify, or suspend this Contest. In any such event, the Sponsor, at its sole discretion, may randomly select the winner(s) from eligible, non-suspect entries received prior to the event requiring such termination, suspension or cancellation. The Released Parties and any promotion/prizing partners assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Released Parties and any promotion/prizing partners are not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, mobile or tablet devices, software, failure of any email or Entry to be received by Helzberg on account of technical problems or traffic congestion on the Internet or at any Web site, or any combination thereof, including any injury or damage to participant’s or any other person’s computer related to or resulting from participation or downloading any materials in this Contest. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW. Entries made by Internet will be declared made by the authorized account holder of the email address submitted at time of entry. “Authorized account holder” is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.

 

13. WINNER LIST: For the name of the Grand Prize winner, send a self-addressed stamped envelope to: Get Hitched at Helzberg Contest Winner List, Attn: Promotions Department, 5000 South Towne Drive, New Berlin, WI 53151 postmarked by December 31, 2022.

 

14. SPONSOR: This Contest is sponsored by Helzberg’s Diamond Shops, LLC, 1825 Swift Avenue, North Kansas City, MO 64116.

 

15. ADMINISTRATOR: This Contest is administered by GMR Marketing LLC, 5000 South Towne Drive, New Berlin, WI 53151.
