The Canadian Cherry Month Contest (the “Contest”) begins on July 19, 2023, at 12:00 a.m. Pacific Time (“PT”) and ends on August 31, 2023 at 11:59 p.m. PT (the “Contest Period”).
The Contest is open only to residents of Canada who have reached the legal age of majority in their province/territory of residence at the time of entry, except employees, representatives and agents (and those with whom such persons are living, whether related or not) of BC Cherry Association (the “Sponsor”) its parent companies, subsidiaries, affiliates, prize suppliers, advertising/promotion agencies and any other individual(s), entity or entities involved in the development, production, implementation, administration or fulfilment of the Contest (collectively, the “Contest Parties”).
By participating in this Contest, you are signifying your agreement that you have read and agree to be legally bound by these Official Rules and Regulations (the “Rules”).
The Contest is in no way sponsored, endorsed or administered by, or associated with Facebook, YouTube or Instagram (each, a “Social Platform”). Each Social Platform is hereby completely released of all liability by each entrant in this Contest. Any questions, comments or complaints regarding the Contest must be directed to the Sponsor and not to a Social Platform.

To enter, visit ttps://woobox.com/hg2mre (the “Website”). Upon visiting the Website, follow the on-screen instructions to: (i) fully complete the Contest multiple choice survey (the “Survey”); and, (ii) fully complete the official Contest entry form (the “Entry Form”) with all required information, which may include a requirement to enter your first and last name, valid email address, city/town and province/territory of residence, postal code, and birth year. Once you have fully completed the Survey and Entry Form with all required information, follow the on-screen instructions to submit your completed Survey and Entry Form (the “Entry”).
At the time of entering the Contest, each participant will also have the opportunity to: (i) opt-in to receive promotional communications from the Sponsor; and (ii) become a “follower” of the Sponsor on the Social Platform(s). NOTE: opting-in to receive promotional communications from the Sponsor and/or becoming a “follower” of the Sponsor on the Social Platform(s) will not in any way whatsoever increase or otherwise impact the chances of winning in this Contest. A participant can opt-out of receiving promotional communications from the Sponsor and un-follow the Sponsor on the Social Platform(s) at any time without impacting their chances of winning in this Contest.
To be eligible, your Entry must be submitted and received in accordance with these Rules during the Contest Period (as determined by the Sponsor in its sole and absolute discretion). All eligible Entries submitted and received in accordance with these Rules during the Contest Period will be entered into the random prize draw. Standard data rates apply to participants who choose to participate in the Contest via a mobile device. Please contact your service provider for pricing and service plan information and rates before mobile device participation.
There is a limit of one (1) Entry per person and per email address. If it is discovered by the Sponsor (using any evidence or other information made available to or otherwise discovered by the Sponsor) that any person has attempted to: (i) exceed any of the limits stated in these Rules; (ii) use multiple names, identities, e-mail addresses and/or use any automated, macro, script, robotic or other system(s) or program(s) to enter or otherwise participate in or to disrupt the Contest; and/or (iii) disrupt or participate in the Contest in any other fraudulent or misleading way, then he/she may be disqualified from the Contest in the sole and absolute discretion of the Sponsor. The Contest Parties, Meta Platforms, Inc., Google LLC and each of their respective agents, employees, directors, officers, successors, and assigns (collectively, the “Released Parties”) are not responsible for, and accept no liability whatsoever in relation to, any late, lost, misdirected, delayed, incomplete or incompatible Surveys, Entry Forms, Entries and/or any other Contest-related information (collectively, “Contest-Related Information”), all of which are void.
An Entry may be rejected if, in the sole and absolute discretion of the Sponsor: (i) the Entry is not submitted and received in accordance with these Rules during the Contest Period; and/or (ii) the Entry is not in compliance with these Rules (including, but not limited to, the specific Participation Requirements listed below), all as determined by the Sponsor in its sole and absolute discretion.
All Contest-Related Information and entrants are subject to verification at any time and for any reason. The Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor – including, without limitation, government issued photo identification): (i) for the purposes of verifying an entrant’s eligibility to participate in this Contest; (ii) for the purposes of verifying the eligibility and/or legitimacy of any Contest-Related Information and/or other information entered (or purportedly entered) for the purposes of this Contest; and/or (iii) for any other reason the Sponsor deems necessary, in its sole and absolute discretion, for the purposes of administering this Contest in accordance with the letter and spirit of these Rules. Failure to provide such proof to the complete satisfaction of the Sponsor within the timeline specified by the Sponsor may result in disqualification in the sole and absolute discretion of the Sponsor. The sole determinant of the time for the purposes of the Contest will be the official time-keeping device(s) used by the Sponsor.
BY PARTICIPATING IN THIS CONTEST, YOU AGREE TO RELEASE THE RELEASED PARTIES FROM ANY AND ALL LIABILITY IN CONNECTION WITH THE CONTEST AND YOUR PARTICIPATION THEREIN AND TO INDEMNIFY THE RELEASED PARTIES AGAINST ANY AND ALL CLAIMS, DAMAGES, LIABILITIES, COSTS, AND EXPENSES ARISING FROM YOUR PARTICIPATION IN THE CONTEST. BY PARTICIPATING IN THIS CONTEST, YOU ALSO AGREE THAT YOUR ENTRY (AND EACH INDIVIDUAL COMPONENT THEREOF) COMPLIES WITH ALL CONDITIONS STATED IN THESE RULES. THE RELEASED PARTIES WILL BEAR NO LIABILITY WHATSOEVER REGARDING: (I) THE USE OF YOUR ENTRY (OR ANY COMPONENT THEREOF); (II) PARTICIPATION IN ANY CONTEST-RELATED ACTIVITIES; (III) ANY USE, COLLECTION, STORAGE AND DISCLOSURE OF ANY PERSONAL INFORMATION; AND/OR (IV) IF DECLARED A WINNER, THE PRIZE (INCLUDING ANY USE OR MISUSE OF THE PRIZE). THE RELEASED PARTIES SHALL BE HELD HARMLESS BY YOU IN THE EVENT IT IS DISCOVERED THAT YOU HAVE DEPARTED FROM OR NOT OTHERWISE FULLY COMPLIED WITH ANY OF THESE RULES. THIS RELEASE AND INDEMNITY SHALL CONTINUE IN FORCE FOLLOWING THE TERMINATION OF THE CONTEST AND/OR AWARDING OF ANY PRIZE.
By participating in the Contest, each entrant hereby warrants and represents that any Contest-related Information he/she submits does not contain any reference to any identifiable third parties, unless consent has been obtained from all such individuals and their parent/legal guardian if they are under the age of majority in their jurisdiction of residence, and will not give rise to any claims whatsoever, including, without limitation, claims of infringement, invasion of privacy or publicity, or infringe on any rights and/or interests of any third party.
There is one (1) prize available to be won in the Contest, consisting of a $250 CAD prepaid credit card (the “Prize”) to use towards completing a purchase at the confirmed winner’s favourite grocer.
The following general conditions apply to the Prize: (i) Prize must be accepted as awarded and is not transferable, assignable or convertible to cash (except as may be specifically permitted by the Sponsor in its sole and absolute discretion); (ii) no substitutions are permitted, except at the Sponsor’s option; (iii) the Sponsor reserves the right to substitute the Prize in whole or in part in the event that all or any component of such Prize is unavailable with a prize or prize component(s) of equal or greater retail value, including, without limitation, but solely at the Sponsor’s sole discretion, a cash award; (iv) all characteristics and features of the Prize, except as otherwise explicitly stated above, are at the Sponsor’s sole and absolute discretion; (v) Prize winner is solely responsible for all costs not expressly described herein; and (vi) the prepaid card is subject to all of the terms and conditions as stated by the applicable card issuer.
None of the Released Parties makes any representation or offers any warranty, express or implied, as to the quality or fitness of any Prize awarded in connection with the Contest. To the fullest extent permitted by applicable law, each confirmed winner understands and acknowledges that he or she may not seek reimbursement or pursue any legal or equitable remedy from either the Sponsor or any of the other Released Parties should his/her Prize fail to be fit for its purpose or is in any way unsatisfactory. For greater certainty and the avoidance of any doubt, by accepting a Prize, a confirmed winner agrees to waive all recourse against the Sponsor and all of the other Released Parties if the Prize or a component thereof does not prove satisfactory, either in whole or in part.
On September 1, 2023 (the “Selection Date”) in Kelowna, BC at 12:00 p.m. PT, the Sponsor or its designated representative will perform a random draw from among all eligible Entries submitted and received in accordance with these Rules during the Contest Period to select the potential Prize winner. The odds of winning depend on the number of eligible Entries submitted and received in accordance with these Rules during the Contest Period.
The Sponsor or its designated representative will make a minimum of two (2) attempts to contact the potential winner within three (3) business days of the Selection Date via email. A potential winner must respond to such notification (by the specified deadline indicated in the notification) and is solely responsible for ensuring they are able to receive such notification messages, monitoring for such notification messages and following all instructions contained in such notification messages, failing which, they may be disqualified (as determined by the Sponsor at its sole discretion).
NO ONE IS A WINNER UNLESS AND UNTIL THE SPONSOR OFFICIALLY CONFIRMS THEM AS A WINNER IN ACCORDANCE WITH THESE RULES. Before being declared A CONFIRMED PRIZE winner, the potential winner will be required to: (a) correctly answer a mathematical skill-testing question without mechanical or other aid (which may, in the sole and absolute discretion of the Sponsor, be administered online, by email or other electronic means, by telephone, or in the Sponsor’s form of declaration and release); and (b) sign and return within five (5) business days of notification the Sponsor’s declaration and release form, which (among other things): (i) confirms compliance with these Rules; (ii) acknowledges acceptance of the Prize (as awarded); (iii) releases the Released Parties from any and all liability in connection with this Contest, his/her participation therein and/or the awarding and use/misuse of the Prize or any portion thereof; (iv) agrees to indemnify the Released Parties against any and all claims, damages, liabilities, costs, and expenses arising from use of his/her Contest-Related Information or any portion(s) thereof; and (v) agrees to the publication, reproduction and/or other use of his/her name, address, voice, statements about the Contest and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by or on behalf of the Sponsor in perpetuity throughout the world in any manner or medium whatsoever, including print, broadcast or the internet.
If the potential winner: (a) cannot be contacted as set out set out above, or if there is a return of a notification as undeliverable; (b) fails to correctly answer the skill-testing question; (c) fails to return the properly executed Contest documents within the specified time; (d) cannot accept (or is unwilling to accept) a Prize (as awarded) for any reason; and/or (e) is determined to be in violation of these Rules (all as determined by the Sponsor in its sole and absolute discretion); then he/she will be disqualified (and will forfeit all rights to the Prize) and the Sponsor reserves the right, in its sole and absolute discretion and time permitting, to select an alternate potential winner in accordance with the procedure outlined above, with the necessary amendments (in which case the foregoing provisions of this section shall apply to such newly selected potential winner).
This Contest is subject to all applicable federal, provincial/territorial and municipal laws. The decisions of the Sponsor with respect to all aspects of this Contest, including without limitation the eligibility of entrants or any Contest-Related Information, are final and binding on all entrants without right of appeal.
ANYONE DEEMED BY THE SPONSOR TO BE IN VIOLATION OF THE SPONSOR’S INTERPRETATION OF THE LETTER AND/OR SPIRIT OF THESE RULES FOR ANY REASON IS SUBJECT TO DISQUALIFICATION IN THE SOLE AND ABSOLUTE DISCRETION OF THE SPONSOR AT ANY TIME.
All Contest-Related Information becomes the property of the Sponsor. The Released Parties will not be liable for: (i) any failure of the Website or any other any website or platform during the Contest; (ii) any technical malfunction or other problems of any nature whatsoever, including, without limitation, those relating to the telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software; (iii) the failure of any Contest-Related Information, winner notification message and/or other information to be received, captured or recorded for any reason whatsoever, including, but not limited to, technical problems or traffic congestion on the Internet or at any website; (iv) any injury or damage to an entrant’s or any other person’s computer or other device related to or resulting from participating in the Contest; (v) anyone being incorrectly and/or mistakenly identified as a winner or eligible winner; and/or (vi) any combination of the above.
The Sponsor reserves the right, subject only to the approval of the Régie des alcools, des courses et des jeux (the “Régie”) in Québec, to withdraw, amend or suspend the Contest (or to amend these Rules) in any way, in the event of any cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of the Contest as contemplated by these Rules, including, without limitation, any error, problem, computer virus, bugs, tampering, unauthorized intervention, fraud or failure of any kind whatsoever. Any attempt to undermine the legitimate operation of the Contest in any way (as determined by Sponsor in its sole and absolute discretion) may be a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law. The Sponsor reserves the right, subject only to the approval of the Régie in Québec, to cancel, amend or suspend the Contest, or to amend these Rules, in any way without prior notice or obligation, in the event of any accident, printing, administrative, or other error of any kind, or for any other reason whatsoever. The Sponsor reserves the right, in its sole and absolute discretion, to administer an alternate test of skill as it deems appropriate based on the circumstances and/or to comply with applicable law.
The Sponsor reserves the right, subject only to the approval of the Régie in Québec, to adjust any of the dates, timeframes and/or other Contest mechanics stipulated in these Rules, to the extent deemed necessary by the Sponsor, for purposes of verifying compliance of any entrants, Contest-Related Information and/or other information with these Rules, or as a result of any technical or other problems, or in light of any other circumstances which, in the opinion of the Sponsor, in its sole and absolute discretion, affect the proper administration of the Contest as contemplated in these Rules, or for any other reason.
FOR RESIDENTS OF QUÉBEC ONLY: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the board only for the purpose of helping the parties reach a settlement.
By entering this Contest, each entrant expressly consents to the Sponsor, its agents and/or representatives, storing, sharing and using the personal information submitted only for the purpose of administering the Contest and in accordance with the Sponsor’s privacy policy (available at: https://www.bccherry.com/new-canadian-cherry-month-campaign/).This section does not limit any other consent(s) that an individual may provide the Sponsor or others in relation to the collection, use and/or disclosure of their personal information.
In the event of any discrepancy or inconsistency between the terms and conditions of these English Rules and disclosures or other statements contained in any Contest-related materials, including, but not limited to, the French version of these Rules, point of sale, television, print or online advertising and/or any instructions or interpretations of these Rules given by any representative of the Sponsor, the terms and conditions of these English Rules shall prevail, govern and control to the fullest extent permitted by law.
The invalidity or unenforceability of any provision of these Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Rules shall otherwise remain in effect and shall be construed in accordance with the terms as if the invalid or illegal provision were not contained herein.
To the fullest extent permitted by applicable law, all issues and questions concerning the construction, validity, interpretation and enforceability of these Rules or the rights and obligations of participants, the Sponsor or any of the other the Released Parties in connection with the Contest will be governed by and construed in accordance with the domestic laws of the Province of British Columbia and the federal laws of Canada applicable therein, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction’s laws. The parties hereby consent to the exclusive jurisdiction and venue of the courts located in British Columbia in any action to enforce (or otherwise relating to) these Rules or relating to the Contest.

RÈGLEMENT OFFICIEL DU CONCOURS
Le concours Le mois des cerises du Canada (le « concours ») commence le 19 juillet 2023 à 00h00, heure du Pacifique (« HNP ») et prend fin le 31 août 2023 à 23h 59mHNP (la « période du concours »).
Le concours est ouvert uniquement aux résidents du Canada qui ont atteint l’âge légal de la majorité dans leur province ou leur territoire de résidence au moment de la participation au concours, à l’exception des employés, représentants et mandataires (et les personnes qui vivent sous le même toit que ces derniers, qu’il y ait lien de parenté ou non) de BC Cherry Association (le « commanditaire ») et ses sociétés mères, filiales, sociétés affiliées, fournisseurs de prix, agences de publicité et de promotion et toute autre personne ou entité qui participe à l’élaboration, à la production, à la mise en œuvre, à l’administration ou à l’exécution du concours (appelés collectivement les « entités du concours »).
En participant à ce concours, vous attestez avoir lu et accepté les contraintes légales imposées par le présent règlement officiel (le « règlement »).
Ce concours n'est d'aucune façon commandité, endossé ou administré par ou lié à Facebook, YouTube ou Instagram (chacune, une « plateforme sociale »). Chaque plateforme sociale est par les présentes complètement exonérée de toute responsabilité par chaque participant au présent concours. Toute question, commentaire ou plainte concernant le concours doit être adressé au commanditaire et non pas à une plateforme sociale.

Pour participer au concours, visiter le site Web https://woobox.com/hg2mre (le « site Web »). Une fois sur le site Web, suivez les instructions à l'écran pour : (i) compléter entièrement le sondage à choix multiples du concours (le « sondage »); et (ii) compléter entièrement le bulletin de participation officiel du concours (le « bulletin de participation ») avec toutes les informations requises, ce qui pourrait inclure une exigence de saisir votre nom et prénom, une adresse courriel valide, ville et province/territoire de résidence, code postal et année de naissance. Une fois que vous avez rempli le sondage et le bulletin de participation avec toutes les informations requises, suivez les instructions à l’écran pour soumettre le sondage et le bulletin de participation complété (une « participation »).
Au moment de la participation au concours, chaque participant aura également la possibilité de choisir de : (i) recevoir des communications promotionnelles du commanditaire; et (ii) devenir un « abonné » du commanditaire sur la ou les plateformes sociales. NOTE : le fait de choisir de recevoir des communications promotionnelles du commanditaire et/ou de devenir un « abonné » du commanditaire sur la ou les plateformes sociales n'augmentera ni n'influencera en aucune façon les chances de gagner dans ce concours. Un participant peut choisir d’arrêter de recevoir de communications promotionnelles du commanditaire et de suivre le commanditaire sur la ou les plateformes sociales à tout moment sans que cela n'ait d'incidence sur ses chances de gagner dans ce concours.
Pour être admissible, votre participation doit être soumise et reçue conformément au présent règlement pendant la période du concours (tel que déterminé par le commanditaire à sa seule et entière discrétion). Toutes les participations admissibles soumises et reçues conformément au présent règlement pendant la période du concours seront incluses dans le tirage au sort du prix. Les entités du concours, Meta Platforms, Inc., Google LLC et chacun de leurs mandataires, employés, administrateurs, dirigeants, successeurs et ayants droit respectifs (appelés collectivement les « parties exonérées ») ne sont pas responsables et n’acceptent aucune responsabilité de quelque nature que ce soit pour les sondages, bulletins de participation, participations et/ou toute autre information liée au concours (collectivement, l’ « information liée au concours ») en retard, perdues, mal acheminées, retardées, incomplètes ou incompatibles, toutes étant nulles.
Une participation peut être rejetée si, à la discrétion exclusive et absolue du commanditaire : (i) la participation n’est pas soumise et reçue conformément au présent règlement durant la période du concours; et/ou (ii) la participation n'est pas conforme au présent règlement (y compris, les conditions de participation spécifiques énumérées ci-dessous), tel que déterminé par le commanditaire à sa seule et entière discrétion.
L’ensemble de l’informations liée au concours et tous les participants peuvent faire l’objet d’une vérification en tout temps et pour quelque motif que ce soit. Le commanditaire se réserve le droit, à sa discrétion exclusive et absolue, d’exiger une preuve d’identité et/ou d’admissibilité (sous une forme que le commanditaire juge acceptable, y compris, mais sans s’y limiter, une pièce d’identité avec photo délivrée par le gouvernement) : (i) aux fins de vérification de l’admissibilité d’un participant à participer à ce concours; (ii) aux fins de vérification de l’admissibilité et/ou de la légitimité de l’information liée au concours et/ou de toute autre information inscrite (ou prétendument inscrite) aux fins de ce concours; et/ou (iii) pour toute autre raison que le commanditaire juge nécessaire, à sa discrétion exclusive et absolue, aux fins d’administration de ce concours conformément à la lettre et de l’esprit de ce règlement. Le fait de ne pas fournir une telle preuve à l’entière satisfaction du commanditaire dans le délai fixé par celui-ci peut entraîner l’exclusion du participant, à la discrétion exclusive et absolue du commanditaire. Seuls les dispositifs de chronométrage officiels du commanditaire seront utilisés pour déterminer l’heure aux fins du concours.

En participant au concours, chaque participant garantit et déclare par les présentes que toute information liée au concours soumise ne contient pas de référence à quelconque tiers identifiable, sauf si le consentement de tels individus a été obtenu, ou le consentement de leur parent/tuteur a été obtenu si les individus n’ont pas encore atteint l’âge de la majorité dans leur juridiction de résidence et ne donnera pas lieu à quelconque réclamation, y compris, mais sans s’y limiter, de violation, de non-respect du droit à la vie privée ou de publicité, ou de non-respect de quelconques droits ou intérêts de n’importe quel tiers.
Il y a un (1) prix disponible à gagner dans le concours, consistant en une carte de crédit prépayée de 250$ CA (le « prix ») à utiliser pour effectuer un achat chez l'épicier préféré du gagnant confirmé.
Les conditions générales suivantes s’applique au prix : (i) le prix doit être accepté tel que remis et ne peut être transféré, cédé ou converti en argent comptant (sauf si le commanditaire le permet expressément, à sa seule et entière discrétion); (ii) aucune substitution n’est permise, sauf à la discrétion du commanditaire; (iii) le commanditaire se réserve le droit de remplacer le prix en tout ou en partie dans le cas où tout ou partie d’un élément d’un tel prix est indisponible soit par un prix ou un élément de prix de valeur identique ou plus importante, y compris, sans s’y limiter, mais à la discrétion exclusive et absolue du commanditaire, un prix en argent comptant; (iv) toutes les caractéristiques et spécificités du prix, sauf tel que décrit expressément ci-dessus sont à la seule et entière discrétion du commanditaire; (v) le gagnant d’un prix est seul responsable de tous les coûts non expressément décrits dans le présent document; et (vi) la carte prépayée est soumise à toutes les conditions générales énoncées par l'émetteur de la carte concernée.
Aucune des parties exonérées ne font aucune représentation et n’offrent aucune garantie, expresse ou implicite, concernant la qualité marchande ou l’adaptation à un usage particulier de tout prix attribué dans le cadre du concours. Dans toute la mesure permise par la loi, chaque gagnant confirmé comprend et reconnaît qu’il ne peut pas demander de remboursement ni se prévaloir d’aucun recours juridique ou équitable auprès du commanditaire ou des parties exonérées au cas où un prix ne conviendrait pas à l’usage prévu ou serait insatisfaisant de quelque manière que ce soit. À titre de précision et afin de dissiper tout doute, en acceptant un prix, un gagnant confirmé accepte de renoncer à tout recours contre les parties exonérées si le prix ou un élément de celui-ci se révélait insatisfaisant, en tout ou en partie.
À 12h HNP le 1er septembre 2023, à Kelowna en Colombie-Britannique (la « date de sélection »), le commanditaire ou son représentant désigné effectuera un tirage au sort parmi toutes les participations admissibles soumises et reçues en conformité au présent règlement durant la période de concours pour sélectionner le gagnant potentiel du prix. Les chances de gagner dépendent du nombre de participations admissibles soumises et reçues conformément au présent règlement pendant la période du concours.
Le commanditaire ou son représentant désigné fera au moins deux (2) tentatives pour communiquer avec le gagnant potentiel dans les trois (3) jours ouvrables suivant la date de sélection par courriel électronique. Un gagnant potentiel, doit répondre à cette notification (avant la date limite indiquée dans la notification) et est seul responsable de s'assurer qu'il est en mesure de recevoir ces messages de notification, de surveiller ces messages de notification et de suivre toutes les instructions contenues dans ces messages, faute de quoi il pourra être disqualifié (tel que déterminé par le commanditaire à sa seule et entière discrétion).
PERSONNE N’EST UN GAGNANT TANT QUE LE COMMANDITAIRE NE L’A PAS CONFIRMÉ OFFICIELLEMENT, CONFORMÉMENT À CE RÈGLEMENT. Avant d’être déclaré UN GAGNANT CONFIRMÉ DU PRIX, le gagnant potentiel devra : (a) répondre correctement, sans aide mécanique ni autre, à une question réglementaire d’arithmétique (laquelle peut, à la discrétion exclusive et absolue du commanditaire, être posée en ligne, par courriel ou par tout autre moyen électronique, par téléphone, ou dans le formulaire de déclaration et de renonciation de responsabilité du commanditaire); et (b) signer et retourner dans les cinq (5) jours ouvrables de la notification le formulaire de déclaration et de décharge du commanditaire, lequel (entre autres) : (i) confirme le respect de ce règlement; (ii) reconnait l’acceptation du prix (tel qu’il est attribué); (iii) dégage les parties exonérées de toute responsabilité relativement à ce concours, sa participation à celui-ci, et/ou à l’attribution et à la bonne ou à la mauvaise utilisation du prix ou de toute partie de celui-ci; et (iv) convient d’indemniser les parties exonérées contre les réclamations, les dommages, les responsabilités, les coûts et les dépenses découlant de l’utilisation de l’information liée au concours ou toute(s) partie(s) de celle-ci; et (v) accepte la publication, la reproduction et/ou l'utilisation de son nom, de son adresse, de sa voix, de ses déclarations sur le concours et/ou de sa photographie ou de toute autre image, sans autre avis ni compensation, dans toute publicité ou annonce effectuée par ou au nom du commanditaire dans le monde entier et à perpétuité, de quelque manière que ce soit ou sur quelque support que ce soit, y compris par écrit, dans les médias diffusés ou sur internet.
Si le gagnant potentiel : (a) ne peut être contacté comme indiqué ci-dessus, ou si une notification est renvoyée comme étant non distribuable; (b) ne peut pas répondre correctement à la question réglementaire; (c) ne retourne pas les documents du concours dûment remplis et signés dans le délai prescrit; (d) ne peut accepter (ou refuse d’accepter) un prix (tel qu’il est attribué) pour quelque raison que ce soit; et/ou (e) est considéré comme n’ayant pas respecté ce règlement (selon ce que détermine le commanditaire, à sa seule et entière discrétion); il sera alors exclu du concours (et renoncera à tous ses droits à l’égard du prix) et le commanditaire se réserve le droit, à sa seule et entière discrétion et si le temps le permet, de sélectionner un autre gagnant potentiel conformément aux procédures indiquées ci-dessus avec les amendements nécessaires (auquel cas les dispositions de cette section s’appliqueront au nouveau gagnant potentiel sélectionné).
Ce concours est assujetti à toutes les lois fédérales, provinciales/territoriales et municipales applicables. Les décisions du commanditaire quant à tout aspect de ce concours, y compris sans limitation, l'admissibilité des participants ou toute information liée au concours, sont finales et exécutoires, et tous les participants sont tenus de les respecter sans droit d’appel.
TOUTE PERSONNE RÉPUTÉE PAR LE COMMANDITAIRE COMME CONTREVENANT À L’INTERPRÉTATION DU COMMANDITAIRE DE LA LETTRE ET/OU L’ESPRIT DE CE RÈGLEMENT, POUR QUELQUE RAISON QUE CE SOIT, EST SUSCEPTIBLE D’ÊTRE EXCLUE, À LA DISCRÉTION EXCLUSIVE ET ABSOLUE DU COMMANDITAIRE, ET CE, EN TOUT TEMPS.
Toutes les informations liées au concours deviennent la propriété du commanditaire. Les parties exonérées n’assumeront aucune responsabilité quant à ce qui suit : (i) toute défaillance du site Web ou de tout autre site Web ou plateforme pendant la période du concours; (ii) toute défectuosité technique ou tout autre problème de quelque nature que ce soit, y compris, mais sans s’y limiter, le réseau ou les lignes téléphoniques, les systèmes informatiques en ligne, les serveurs, les fournisseurs d’accès, le matériel informatique ou les logiciels; (iii) toute information liée au concours, message de notification du gagnant et/ou information qui n’est pas reçue, saisie ou consignée, pour quelque raison que ce soit, y compris, mais sans s’y limiter, les problèmes techniques ou la congestion sur Internet ou sur tout autre site Web; (iv) tout préjudice ou dommage causé à un ordinateur ou à un appareil du participant ou d’une autre personne lié à la participation au concours ou découlant de cette participation; (v) toute personne étant identifiée incorrectement et/ou par erreur comme étant un gagnant ou un gagnant admissible; et/ou (vi) toute combinaison des éléments mentionnés précédemment.
Le commanditaire se réserve le droit, sous seule réserve de l’approbation de la Régie des alcools, des courses et des jeux au Québec (la « Régie »), de modifier ou de suspendre le concours (ou de modifier ce règlement) de quelque façon que ce soit, y compris, mais sans s’y limiter, en cas d’erreur, de problème technique, de virus informatique, de bogue, de falsification, d’intervention non autorisée, de fraude, de panne technique ou de toute autre cause indépendante de la volonté du commanditaire qui nuit au bon déroulement du concours, conformément à ce règlement. Toute tentative d’entraver le déroulement légitime du concours de quelque façon que ce soit (selon ce que détermine le commanditaire, à sa discrétion exclusive et absolue) peut constituer une violation des lois criminelles et civiles et, advenant une telle tentative, le commanditaire se réserve le droit de réclamer une réparation et des dommages-intérêts dans toute la mesure permise par la loi. Le commanditaire se réserve le droit, sous seule réserve de l’approbation de la Régie, d’annuler, de modifier ou de suspendre le concours, ou de modifier ce règlement, de quelque manière que ce soit et sans préavis ni obligation, dans l’éventualité d’un accident, d’une erreur d’impression, d’une erreur administrative ou de toute autre erreur, ou pour tout autre motif, quel qu’il soit. Le commanditaire se réserve le droit, à sa discrétion exclusive et absolue, de faire subir un test d’habileté différent, selon ce qu’il juge approprié en fonction des circonstances et/ou pour se conformer à la loi applicable.
Le commanditaire se réserve le droit, sous seule réserve de l’approbation de la Régie au Québec, de modifier les dates, les délais prescrits et/ou les autres mécanismes du concours prévus dans ce règlement, dans la mesure jugée nécessaire par le commanditaire, afin de vérifier si les participants, l’information liée au concours et/ou toute autre information respectent ce règlement, ou à la suite de problèmes techniques ou autres, ou encore à la lumière d’autres circonstances qui, de l’avis du commanditaire, à sa discrétion exclusive et absolue, nuisent à la bonne administration du concours, tel que le prévoit ce règlement ou pour tout autre motif.
POUR LES RÉSIDENTS DU QUÉBEC SEULEMENT : Tout litige concernant le déroulement ou l’organisation d’un concours publicitaire peut être soumis à la Régie des alcools, des courses et des jeux aux fins de règlement. De la même façon, tout litige concernant l’attribution d’un prix peut être adressé à la Régie dans le but d’en arriver à un règlement à l’amiable entre les parties.
En prenant part à ce concours, chaque participant consent expressément à la conservation, le partage et l’utilisation des renseignements personnels soumis, par le commanditaire, ses mandataires et/ou représentants, seulement aux fins de l’administration du concours et conformément à la politique de confidentialité du commanditaire (disponible sur le site : https://www.bccherry.com/new-canadian-cherry-month-campaign/). Cette section ne limite pas tout autre consentement que pourrait fournir une personne au commanditaire ou à d’autres quant à la collecte, l’utilisation et/ou la divulgation de ses renseignements personnels.
En cas de divergence ou d’incompatibilité entre les modalités et conditions de la version anglaise de ce règlement et les divulgations ou autres déclarations contenues dans le matériel relatif au concours, y compris, mais sans s’y limiter, la version française de ce règlement, la publicité dans les points de vente, à la télévision, dans la presse écrite ou en ligne et/ou les directives ou interprétations de ce règlement données par tout représentant du commanditaire, les modalités et conditions de la version anglaise de ce règlement prévaudront, et elles régiront et contrôleront ce concours dans toute la mesure permise par la loi.
L’invalidité ou le caractère non exécutoire de toute disposition de ce règlement ne doit pas porter atteinte à la validité ou au caractère exécutoire de toute autre disposition. Dans le cas où une disposition est considérée invalide, non exécutoire ou illégale, ce règlement doit demeurer en vigueur et être interprété conformément aux modalités comme si la disposition invalide ou illégale n’était pas contenue aux présentes.
Dans toute la mesure permise par la loi applicable, toute préoccupation ou question concernant l’élaboration, la validité, l’interprétation et le caractère exécutoire de ce règlement ou les droits et obligations des participants, du commanditaire ou de toute autre partie exonérée relativement au concours sera régie et interprétée conformément aux lois internes de la province de la Colombie-Britannique et aux lois fédérales canadiennes applicables, et ce, sans égard aux règles ou aux dispositions en matière de compétence législative ou de conflit de lois qui entraîneraient l’application des lois de toute autre compétence. Les parties acceptent par les présentes de se soumettre à l’exclusivité de compétence et de lieu des tribunaux situés en Colombie-Britannique lors de toute action intentée pour faire respecter ce règlement ou ayant trait au concours (ou autrement liée à ceux-ci).
