MUST COMPLY WITH ALL RULES TO WIN AND RECEIVE A PRIZE.

Who’s sponsoring the Contest?
Our legal name is Ranch and Home Supply, LLC dba Murdoch's Ranch & Home Supply® (“Murdoch’s,” “we,” “us,” “our”). You can reach us at 2311 N. 7th Ave., Bozeman, MT 59715 and by email at social@murdochs.com.
When is the Contest?
The Contest runs November 4 through November 11, 2022.
Who’s eligible?
Any legal resident of the United States (except FL, NY, RI, HI, & CA) who is at least 18 years old may enter the Contest. Heads up, we may require you to verify your eligibility at any time to participate in the Contest, win, and/or receive a prize. These folks, however, are not eligible: Murdoch’s owners, officers, managers, employees, and agents, their immediate family members (including parents, grandparents, spouses, children, grandchildren, and siblings), and anyone domiciled with any of them.
How do I enter?
Follow the link on our website (murdochs.com) and our official Facebook page, upload your best Chicken Lady Photo (“Photo”), and you'll be entered in the Contest.
What is the prize?
The Contest winner will be eligible to receive a $50 eGift Card for Murdoch's. The prize is not redeemable for cash. Taxes are the sole responsibility of the winner. No cash equivalents, substitutions, or transfers. Murdoch’s may substitute a prize of equal or greater value at our sole discretion.
When and how will the winner be selected?
Visitors to our official Facebook page will be invited to vote for their favorite Photo based on originality and creativity. The Photo with the most votes on November 111, 2022, will be declared the Contest winner and be eligible to claim the Prize (see below). Murdoch’s decision regarding vote counting and winner selection are final.
How does the winner claim the prize?
We will notify the winner by the email address provided upon entry into the Contest using the link described above. Murdoch’s does not guarantee delivery of the Contest prize and is not responsible or liable for any failure of delivery not caused directly by us.
Where can I see who wins the Contest?
Murdoch's will announce the winner on our official Facebook page and will also reach out to the winner via email.
Are there conditions for an entry photo?
To qualify for consideration, you must have the right to use the photo as an entry into the Contest at the time you enter. By entering, you assure us that you have the copyright in the photo or a license to use the photo in the Contest, and that doing so does not violate anyone else’s rights in the photo (including copyrights, trademark rights, privacy rights, and all other personal and intellectual property rights). Also, your photo must not contain illegal, pornographic, offensive, or inappropriate content. Decisions regarding the qualification of photos for consideration in the Contest are made in Murdoch’s sole discretion and are final.
What about rights, privacy, and future contact?
By entering the Contest, you give us full “Permission” to use the photo(s) you enter, including use in our social media and other marketing, advertising, and communications. Now this is important, so slow down here. Entering the Contest and thereby giving us your Permission to use your photo(s) creates a legally binding license agreement. Specifically, entering the Contest grants Murdoch’s an unlimited, non-exclusive, assignable, sublicensable, perpetual, worldwide, and royalty-free right to publish, distribute, and otherwise use your entry photo(s). Let’s call it an “Unlimited Free License.” In short, your Permission allows us to use your entry photo(s) in our own content without any limitation on us or compensation to you.
By entering the Contest, you also warrant that:
You are at least 18 years of age;
You own all rights in and to your entry photo(s);
You have permission from all persons in your entry photo(s) to grant us an Unlimited Free License; and
Any and all use of your entry photo(s) by Murdoch’s does not infringe any third party’s rights or violate any law.
Finally, by entering the Contest, you agree that we can publish your social media username(s) and the caption(s) for your entry photo(s) whenever and wherever we use those photos.
Don’t get disqualified.
So you know, we may disqualify any person from participating in the Contest, winning, and/or receiving a prize for violating any of these Official Rules, failing to meet any of the requirements, gaining an unfair advantage, or using fraudulent means to participate, win, or receive a prize in the Contest. Decisions regarding disqualification are made in Murdoch's sole discretion and are final.
We may modify these Official Rules as needed.
We are solely responsible for interpreting these Official Rules and addressing any conflicts, ambiguities, or disputes. We may waive any requirements or otherwise modify these Official Rules as we deem appropriate. We may suspend or terminate the Contest at any time if affected by anything that undermines its purpose or fairness, including (without limitation) the following: human error; intentional interference; mechanical, electrical, communications, network, Internet, hardware, or software malfunction or failure; or any other event outside Murdoch’s control. Decisions regarding modification of these Official Rules and suspension or termination of the Contest are made in Murdoch’s sole discretion and are final.
We are not responsible for any losses.
BY ENTERING THE CONTEST, EACH PERSON THEREBY RELEASES, ACQUITS, AND FOREVER DISCHARGES MURDOCH’S AND ITS OWNERS, OFFICERS, MANAGERS, EMPLOYEES, AND AGENTS (“MURDOCHIANS”) FROM ANY AND ALL KINDS of loss, HARM, or injury related to or arising from the CONTEST, including (without limitation) loss associated with the following: lost, late, illegible, or degraded entries, winner notification, or delivery of prizes; transmission issues or errors resulting in omission, interruption, deletion, defect, or delay of entries or winner notification; theft, destruction, unauthorized access to, or alterations of entries (including personal information) or winner notification; mechanical, electrical, communications, network, Internet, hardware, or software malfunction or failure.
WITHOUT LIMITING THE FOREGOING, TO THE MAXIMUM EXTENT PERMITTED BY LAW, BY GIVING US YOUR “PERMISSION” (DEFINED ABOVE) TO USE YOUR ENTRY PHOTO(S), YOU THEREBY WAIVE ALL RIGHTS TO PRIVACY AND PUBLICITY IN THOSE PHOTOS, AND YOU AGREE THAT MURDOCHIANS SHALL NOT BE LIABLE IN ANY WAY FOR USING YOUR ENTRY PHOTO(S) UNDER THE “UNLIMITED FREE LICENSE” (DEFINED ABOVE). YOU ALSO AGREE THAT MURDOCHIANS WILL NEVER BE LIABLE (REGARDLESS OF LEGAL THEORY) FOR ANY INJURY, HARM, DAMAGE, EXPENSE, OR OTHER LOSS ARISING OUT OF OUR USE OF YOUR ENTRY PHOTO(S).
We are not liable for any damages.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MURDOCHIANS SHALL NOT BE LIABLE (STRICTLY, VICARIOUSLY, JOINTLY, SEVERALLY, OR OTHERWISE) FOR DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES RELATED TO OR ARISING FROM THE CONTEST. That limitation on liability applies regardless of whether we knew or should have known of any loss, harm, injury, or damages.
Any disputes must be arbitrated.
ALL CLAIMS OF EVERY KIND ARISING OUT OF OR RELATED TO THESE OFFICIAL RULES AND/OR THE CONTEST SHALL BE RESOLVED ON AN INDIVIDUAL BASIS (WITHOUT RESORT TO ANY FORM OF CLASS ACTION) BY BINDING ARBITRATION. The Commercial Arbitration Rules and Mediation Procedures of the American Arbitration Association shall govern any such proceeding. EACH PERSON ENTERING THE CONTEST KNOWINGLY, WILLFULLY, EXPRESSLY, AND IRREVOCABLY WAIVES THE RIGHT TO A JURY TRIAL FOR ANY KIND OF CLAIM OR DISPUTE RELATED TO OR ARISING OUT OF THESE OFFICIAL RULES AND/OR THE CONTEST.
Montana law governs these Official Rules.
Montana law governs all issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules and all aspects of the Contest.
Only these Official Rules apply.
These Official Rules constitute the entire agreement between Murdoch’s and each person entering the Contest concerning all aspects of the Contest. These Official Rules supersede and cancel any and all other statements, agreements, and/or understandings concerning any and all aspects of the Contest, except as Murdoch’s may modify these Official Rules in its sole discretion.
Murdoch’s use of the social media platforms owned and operated by Facebook (or any other social media platform) does not claim any association, affiliation, sponsorship, or endorsement by the platform or any interest in its registered trademarks.
