DATES OF SWEEPSTAKES: The “Heart Set on Vegas” Sweepstakes (the “Sweepstakes”) will begin at 12:00 p.m. Eastern Time (“ET”) on January 20, 2020 and ends at 11:59 p.m. ET on February 16, 2020 (the “Sweepstakes Period”).
ELIGIBILITY: The Sweepstakes is open to legal permanent U.S. residents residing in the fifty (50) United States or the District of Columbia who are at least the age of majority in his/her state of residence (nineteen (19) in Alabama and Nebraska, twenty-one (21) in Mississippi and eighteen (18) in all other states) at the time of entry (the “Entrant”). Employees, officers and directors of Rogers Enterprises, Inc. (the “Sponsor”) and each of its subsidiaries and affiliates, distributors, vendors, advertising/promotion agencies, including, but not limited to, National Sweepstakes Company, LLC (the “Independent Administrator”) and any others engaged in the development, production, execution or distribution of the Sweepstakes (collectively referred to herein as “Sweepstakes Entities”) as well as their immediate family members (spouses, siblings, children and parents, regardless of where they live) or members of the same households (whether related or not) of such employees, officers and directors are not eligible to participate. All federal, state and local laws and regulations apply. Sweepstakes is void outside the fifty (50) United States, the District of Columbia and wherever else prohibited or restricted by law.
HOW TO ENTER: Visit www.fornowandforever.com/sweepstakes (the “Website”) during the Sweepstakes Period and complete the online entry form in its entirety, including full name, physical address, phone number and email address. Upon completing the online entry form and clicking the “Enter to Win” button, Entrant will receive one (1) entry into the Sweepstakes. All online entries must be submitted with all required fields completed by 11:59PM ET on February 16, 2020.
Limit of one (1) entry per Entrant during the Sweepstakes Period.
Any attempt by an Entrant to obtain more than the stated number of entries allowed by using multiple / different identities and/or any other methods will void that Entrant’s entry and that Entrant may be disqualified from the Sweepstakes. In the event of a dispute regarding the identity of an Entrant the entry will be assigned to the authorized account holder (Authorized Account Holder”) of the email address submitted at the time of entry. The Authorized Account Holder is defined as the natural person who is assigned to an email address by the email provider who is responsible for assigning email addresses.
In the event it is determined that an Entrant has provided an invalid email address at time of entry, the Entrant providing such invalid email address will not receive an entry into the Sweepstakes. Entries generated by a script, macro, or other automated means will be disqualified. Entries that are lost, late, misdirected, incomplete, garbled, corrupted, or unintelligible for any reason, including but not limited to, computer or network malfunction or congestion, are void and will not be accepted. Neither the Sponsor nor Sweepstakes Entities will verify receipt of entries for Entrants. All entries submitted become the sole property of Sponsor and will not be returned.
WINNING/ODDS: On or about February 19, 2020, two (2) potential grand prize winners (each a “Grand Prize Winner”) will be selected from among all eligible entries received during the Sweepstakes Period in a random drawing conducted by the Independent Administrator, an independent judging organization, whose decisions are based upon their sole discretion and interpretation of these Official Rules and are final and binding in all respects. Odds of winning are dependent upon the total number of entries received during the Sweepstakes Period.
PRIZES:
GRAND PRIZE: A 3 day/2 night trip to Las Vegas, NV for Grand Prize Winner and one (1) guest (the “Grand Prize”). The Grand Prize is inclusive of; i) roundtrip coach-class airfare to/from Grand Prize Winner’s legal residence and a major commercial airport in Las Vegas, NV for Grand Prize Winner and one (1) guest; ii) two night hotel accommodations (double occupancy/standard rooms, room and tax only), hotel to be determined at the sole discretion of the Sponsor, iii) dinner for Grand Prize Winner and one (1) guest for up to $200 at a local restaurant to be determined by the Sponsor; and iv) a $500 Rogers & Hollands® Jewelers OR Ashcroft & Oak® Jewelers gift certificate. Total approximate retail value (“ARV”) of each Grand Prize is $2,500.
Trip, travel and lodging elements selected by Sponsor may be subject to change due to impracticability or unavailability, or for any other reason as determined necessary by Sponsor or its designee. Gift cards, tickets, and certificates if any, are subject to the terms and conditions of issuer and will not be replaced by Sponsor if lost, stolen, misplaced, damaged or destroyed. Trip ARV may vary, depending on the point, date and time of departure. Grand Prize must be accepted as a whole, or will be forfeited in its entirety. Grand Prize Winner and guest must travel together on the same itinerary or Grand Prize will be forfeited in its entirety. All travel arrangements must be made through a travel agent or entity selected by Sponsor. Grand Prize Winner will be responsible for all meals, transportation, excursions, tips or gratuities, fuel, parking, beverages, telephone calls, overages, baggage fees, extras and any other incidental costs or expenses not specifically stated herein as being included. Specific air carrier(s) and other trip specifics are selected at the sole discretion of the Sponsor. All travel is subject to availability; blackout dates and other restrictions may apply. Travel must originate and end at the same major gateway airport. If the Grand Prize Winner and guest would like insurance (including health, liability and any other insurance), this will be at their own personal expense. Guest must be 18 years of age or older. Grand Prize Winner acknowledges and agrees that the Sweepstakes Entities are not providers/carriers of transportation or insurance providers. No changes will be made to travel details once any element(s) of the travel arrangements have been booked. No frequent flier miles will be earned on any element of prize travel. Grand Prize conditions may be added or modified by Sponsor or its designee. Sweepstakes Entities are not responsible for any changes of any element of the Grand Prize, nor are they liable for any expenses incurred as a consequence of flight/event changes, cancellation or delays. Travel is subject to capacity controls, availability, and certain other restrictions, which may include a Saturday night stay, all of which are subject to change. Any unclaimed and/or unused element of the Grand Prize, or any element thereof, will remain the property of Sponsor or its designee. The trip/prize restrictions/conditions stated herein are not all-inclusive and the described above may be subject to additional restrictions/conditions, which may be stated in the Affidavit (as defined herein), and/or other travel or release documents. A Grand Prize Winner later found ineligible or non-compliant will be immediately required to return and forfeit any prize awarded. In the event Grand Prize Winner and/or guest engage(s) in behavior that, as determined by Sponsor (or its designee) in their absolute discretion, is obnoxious or threatening, dangerous, illegal or that is intended to annoy, abuse, threaten or harass any other person, or may cause harm, property damage or any other loss, Sponsor reserves the right to terminate the trip early, in whole or in part, and to send the Grand Prize Winner (and guest) home with no further compensation.
Total value of all prizes to be awarded is $5,000.
PRIZE RESTRICTIONS: Limit of one (1) Grand Prize per person/household. Sponsor will determine all details of the Grand Prize in their sole discretion. No substitution or cash alternative offered, except at Sponsor’s sole discretion or as otherwise provided herein. Sponsor reserves the right to substitute a prize of equal or greater value if the Grand Prize becomes unavailable due to reasons beyond the control of the Sponsor; provided no such substitute prize shall be from Sponsor without its prior written consent. Grand Prizes are not transferable, except at Sponsor’s sole discretion. Any taxes imposed on the income of a Grand Prize Winner as a result of winning a Grand Prize and all other expenses not specifically mentioned herein as part of the Grand Prize are solely the responsibility of the Grand Prize Winner. No more than the number of Grand Prizes set forth in these Official Rules will be awarded. Sponsor does not make, nor is Sponsor in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to the Grand Prize.
Grand Prize Winners consent to Sponsor’s use of his/her name, likeness, biographical information, image, and/or voice and other indicia of persona for purposes of advertising, promotion, and publicity in any and all media now or hereafter known, throughout the world in perpetuity, without additional compensation, notification, permission or approval (TN residents will not be required to sign a publicity release as a condition of winning a Prize).
PRIZE NOTIFICATION/PRIZE CLAIM: Potential Grand Prize Winners will be notified by email or any other available contact source provided at the time of entry and must reply to the notification by the date indicated with the requested information indicated in the notification. In the event a potential Grand Prize Winner fails to return the requested information by the date indicated in the notification, or if a potential Grand Prize Winner is found to be ineligible, or if he/she does not comply with the Official Rules, then a potential Grand Prize Winner will be disqualified and an alternate potential Grand Prize Winner will be selected from the remaining eligible entries. If the notification is returned as undeliverable, this will result in disqualification and an alternate potential Grand Prize Winner will be selected.
Except where prohibited, potential Grand Prize Winners must sign and return within timeframe specified, an Affidavit of Eligibility/Liability/Publicity Release Form and an IRS Form W-9 (collectively, the “Paperwork”) in order to claim the Grand Prize. If potential Grand Prize Winner fails to return the Paperwork by the date indicated, then that Grand Prize Winner forfeits their right to the Grand Prize (without compensation of any kind) and an alternate potential Grand Prize Winner will be selected at random from among all remaining non-winning eligible entries received, at Sponsor’s sole discretion.
The value associated with the Grand Prize may be taxable as income and the Grand Prize Winner is solely responsible for any taxes, including, but not limited to all applicable federal, state and local taxes that become due with respect to the value of the Grand Prize. The Sponsor must report the value of the Grand Prize to the Internal Revenue Service in the year the Grand Prize is received by the Grand Prize Winner and will be reported to the Grand Prize Winner and the Internal Revenue Service in the form of a Form 1099. In the event it is deemed during the verification process that potential Grand Prize Winner does not have a unique, personal and valid social security number for Sponsor to report the tax liability associated with acceptance of the Grand Prize, he/she will be disqualified and an alternate potential Grand Prize Winner will be selected at random from among all remaining non-winning eligible entries received, at Sponsor’s sole discretion, time permitting. Valid social security numbers will be determined by IRS requirements.
GENERAL: By participating, Entrants agree for Entrant, executors and administrators: [a] to abide by and be bound by these Official Rules and to waive any right to claim any ambiguity or error therein or in the Sweepstakes itself, and to be bound by all decisions of Sponsor and Independent Administrator which shall be final and binding in all respects relating to the Sweepstakes, including without limitation the interpretation of these Official Rules; [b] to release, discharge and hold harmless Sponsor, its franchisees, licensees, subsidiaries, affiliates, advertising agencies, promotional agencies and suppliers and any other individual or company (including the Independent Administrator) involved in the development or execution of the Sweepstakes and each of their respective officers, directors, employees, agents, shareholders and representatives, (collectively, the “Released Parties”) from any and all injuries, liability, illness, losses, damages, rights, claims and actions of any kind including liability for personal injury or death that may occur, directly or indirectly, whether caused by negligence or not, from such Entrant’s participation in the Sweepstakes and/or his/her acceptance, receipt, possession, use or misuse of a Grand Prize or any portion thereof (including any travel related thereto); and [c] to indemnify the Released Parties from any and all liability resulting or arising from the Sweepstakes and to hereby acknowledge that Released Parties have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to the Grand Prize, including express warranties provided exclusively by prize supplier that are sent along with the Grand Prize (if applicable). Failures to comply with these conditions may result in disqualification from the Sweepstakes at Sponsor’s sole discretion. Entries which contain false information, are incomplete, inaccurate or are otherwise forged, defective, or made outside authorized channels, shall be void. Sponsor, its licensees, subsidiaries, affiliates, advertising agencies, promotional agencies and suppliers and any other individual or company involved in the development or execution of the Sweepstakes (including the Independent Administrator) and their respective directors, officers, shareholders, agents, representatives, and employees are not responsible and shall not be liable for; [a] electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction; [b] unauthorized access to or alterations of entry materials; [c] technical, network, telephone equipment, electronic, computer, hardware or software malfunctions; [d] late, lost, misdirected, mutilated, incomplete, or illegible entries; [e] limitations of any kind or inaccurate transmissions of or failure to receive information by Sponsor on account of technical problems or traffic congestion on the Internet or at any website or any combination thereof (if applicable); or [f] any condition caused by events beyond the control of the Sponsor that may cause the Sweepstakes to be disrupted or corrupted. Sponsor may prohibit an Entrant from participating in the Sweepstakes or winning a Prize if, in its sole discretion, it determines that said Entrant is attempting to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception, or other unfair playing practices or intending to annoy, abuse, threaten or harass any other Entrants, Sponsor or other Sweepstakes Entities. If for any reason this Sweepstakes is not able to be conducted as planned, including, but not limited to reason of infection by computer virus, technical failures, tampering, unauthorized intervention, fraud or any other causes beyond the control of Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes, then Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes and randomly draw the Grand Prize Winners from those eligible entries received up to the cancellation/suspension date. CAUTION: ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY’S FEES) FROM ANY SUCH PERSON TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION. SPONSOR'S FAILURE TO ENFORCE ANY TERM OF THESE OFFICIAL RULES SHALL NOT CONSTITUTE A WAIVER OF THESE PROVISIONS. Entry information becomes property of Sponsor. All federal, state and local regulations apply.
DISPUTES: Entrant agrees that: (a) any and all disputes, claims, and causes of action arising out of, or connected with, this Sweepstakes (including, without limitation, any alleged violation of these Official Rules, any controversy relating to the arbitrability of any dispute, or any claim that these Official Rules (or any part thereof) are invalid, illegal, or otherwise voidable (or void) shall be resolved individually, without resort to any form of class action, and any judicial proceeding shall take place in a federal or state court within the State of Illinois; (b) any and all claims, judgments, liabilities, and/or awards shall be limited to actual out-of-pocket costs incurred, including costs associated with Entrant’s participation in this Sweepstakes or otherwise accessing this Sweepstakes, and in no event will Entrant be entitled to receive attorneys’ fees or other legal costs; and (c) under no circumstances will you be permitted to obtain awards for, and Entrant hereby waives, all rights to claim, punitive, special, incidental, and/or consequential damages and any other damages, other than out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. In no event shall Entrant seek or be entitled to rescission, injunctive, or other equitable relief or to enjoin or restrain the operation of this Sweepstakes, exploitation of any advertising or other materials issued in connection therewith, or exploitation of this Sweepstakes or any content or other material used or displayed on this Sweepstakes. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the Entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Illinois, without giving effect to any choice of law or conflict of law rules (whether of the State of Illinois or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Illinois.
