These Official Rules apply for “RED TITAN DRL GIVEAWAY” (“Sweepstakes”) conducted by PocketWatch, Inc. 8500 Steller Drive, Building #7, Culver City, CA 90232 (“Sponsor”) and promoted at https://ryansworldshop.com/drl (“Website”). The Sweepstakes will start at 9:00:00 AM Pacific Standard Time (“PST”) on November 21, 2022, and will end at 11:59:59 PM PST on December 5, 2022 (“Sweepstakes Period”). By entering this Sweepstakes, you agree to the Terms in these Official Rules.
SWEEPSTAKES ENTRANTS AND PRIZE RECIPIENTS MUST BE (A) LEGAL RESIDENTS OF THE FIFTY (50) UNITED STATES AND THE DISTRICT OF COLUMBIA, AND (B) AT LEAST 18 YEARS OF AGE AT THE TIME OF ENTRY. VOID OUTSIDE THE UNITED STATES, DISTRICT OF COLUMBIA AND WHERE PROHIBITED BY LAW. SWEEPSTAKES SUBJECT TO ALL APPLICABLE FEDERAL, STATE AND LOCAL LAWS AND REGULATIONS. Officers, directors and employees of Sponsor and its respective parent companies, subsidiaries, affiliates, divisions, advertising and promotion, fulfillment and/or judging agencies (all such individuals and entities collectively referred to herein as, the “Related Entities”), and their immediate family members (mother, father, brothers, sisters, sons, daughters, spouse, step-parents, step-children and step-siblings regardless of where they reside) and/or those living in the same household of any such individual, whether or not related, are not eligible to enter this Sweepstakes or win a prize.
HOW TO ENTER: During the Sweepstakes Period, (i) go to the Website: https://ryansworldshop.com/drl and (ii) complete the Online Entry Form as directed by submitting your First name and first initial of your Last name, a valid e-mail address and your zip code (i and ii, individually defined as an “Entry” and collectively defined as “Entries”). By submitting an Entry, each entrant consents to receive from the Sponsor an e-mail notifying such entrant that he/she is a potential Prize Winner. Each entrant is limited to one (1) Entry per e-mail address during the Sweepstakes Period. Duplicate Entries or multiple Entries made by an entrant in excess of the number allowed will be disqualified.
Your Entry constitutes your consent to participate in this Sweepstakes and your consent for Sponsor to obtain and deliver your name, address and other information to the Sweepstakes Administrator for the purpose of administering this Sweepstakes and for future marketing purposes. All Entries become the property of the Sponsor upon submission and will not be acknowledged or returned and the Sponsor has the right to dispose of the Entries at Sponsor’s discretion.
BY ENTERING THIS SWEEPSTAKES AND SUBMITTING AN ENTRY, YOUR ENTRY MATERIALS, AS DEFINED HEREIN, MAY BE INCLUDED IN SPONSOR’S COMMERCIAL MATERIAL, AS WELL AS AT SPONSOR’S WEBSITE OR SOCIAL MEDIA PLATFORMS, INCLUDING BUT NOT LIMITED TO INSTAGRAM AND FACEBOOK.
Use of a mobile device to participate in this Sweepstakes is not required. If you use a mobile device to enter via the Website, message and data rates may apply, and entrants will be solely responsible for any and all applicable charges. Please consult your wireless-service provider regarding its pricing plans. By submitting an Entry, each entrant agrees to abide by the terms of these Official Rules, the decisions of the Sponsor and Related Entities, the Sponsor’s Privacy Policy available at https://ryansworldshop.com/pages/privacy-policy.
RANDOM DRAWING/WINNER SELECTION: One (1) Random Drawing will be conducted from among all Entries received during the Sweepstakes Period and one (1) Grand Prize Winner and three (3) Runner-Up Prize Winners will be selected. The Random Drawing will be conducted on or about December 7, 2022. Odds of winning a prize will depend upon the number of eligible Entries received. The Random Drawing will be conducted by PCG365, LLC, (“Sweepstakes Administrator”) whose decisions regarding the selection of winners are final and binding. In the event an insufficient number of eligible Entries are received (as determined by the Sponsor in its sole discretion), all prizes may not be awarded in this Sweepstakes.
FOUR (4) PRIZES AND THEIR APPROXIMATE RETAIL VALUES (“ARV”): ONE (1) GRAND PRIZE: One (1) Grand Prize Winner will receive (i) one (1) Drone Racing League Red Titan Racing Drone designated by Sponsor; (ii) four (4) VIP tickets to the Drone Racing League Event at loanDepot park in Miami, Florida scheduled on Saturday, February 25, 2023; and (iii) one (1) one thousand dollars ($1,000) American Express Gift Card to be used towards payment of air or ground transportation and lodging in Miami, FL (i, ii and iii, “Grand Prize”). The ARV of Grand Prize: $4,425; and THREE (3) RUNNER-UP PRIZES: Three (3) winners will each receive one (1) Ryan’s World Titan Universe Package and one (1) fifty dollars ($50) Promo Code redeemable at TheDroneRacingLeague.com. ARV of each Runner-Up Prize: $185. TOTAL ARV OF ALL PRIZES: $4,980. In the event the Grand Prize Winner does not wish to attend the Drone Racing League Event at loanDepot park in Miami, FL on Saturday, February 25, 2023, Grand Prize Winner forfeits that portion of the Grand Prize, and no substitution or compensation will be provided in lieu of the forfeited portion of the Grand Prize. Sponsor will not replace any lost or stolen tickets, or gift cards once delivered to the Grand Prize Winner. In the event the Drone Racing League Event at loanDepot park in Miami, FL scheduled on Saturday, February 25, 2023 is cancelled, that portion of the Grand Prize will not be awarded; and no compensation will be provided in lieu of the canceled portion of the Grand Prize. American Express Gift Card is subject to terms and conditions thereon. Each Promo Code must be redeemed at DroneRacingLeague.com. Any difference between the stated ARV of any Prize and the actual value of that Prize will not be awarded. No cash substitution, assignment, or transfer of any Prize permitted. In the event a Prize item is unavailable, Sponsor reserves the right to substitute a Prize of equal or greater value. Winners are solely responsible for any and all applicable taxes and all other costs on the prize. Limit one (1) Prize per household. Sponsor will have no further obligation to any winner who forfeited his/her prize and will not replace any forfeited prize. Grand Prize Winner will be required to supply Sponsor and Sweepstakes Administrator with his/her social security number. Any Prize Winner who receives a prize valued at six hundred dollars ($600) or more will be issued a FORM 1099-MISC for tax purposes as required by law.
If the Grand Prize Winner travels to Miami, FL, Grand Prize Winner is solely responsible for any and all expenses and incidental travel costs not expressly stated in the Grand Prize description herein, including but not limited to, air and ground transportation between winner’s residence and Miami, FL, lodging, any and all meals and beverages and ground transportation in Miami, FL, in-room hotel charges (e.g., mini-bar, room service, telephone, movies, etc.), gratuities, souvenirs, insurance, travel upgrades, baggage fees, and personal incidentals. Grand Prize Winner is responsible for any air travel taxes and/or expenses, including applicable departure taxes or fees, and security charges. Grand Prize Winner and his/her Guests must have a valid U.S. Government issued Identification in order to travel. All travel is subject to any and all restrictions instituted by the Department of Defense and/or Department of Homeland Security, The Centers for Disease Control and federal, state and local health departments, as required and if borders are closed due to COVID/any pandemic, Sponsor is not responsible. All travelers must agree to abide by the latest travel guidelines/requirements at time of travel. All travelers must also pass any required medical testing (at their own expense) and comply with any additional requirements, at any time, that may be required or recommended by any government agency, airline, or Sponsor, including without limitation, passing one or more COVID-19 antigen and screening tests, and testing negative for COVID-19 or having been vaccinated against COVID-19. Travelers may also be required to execute any assumption of risk and/or other documents relating to COVID-19 or he/she may not be permitted to travel. Sponsor, Administrator and the Related Entities are not responsible for any theft, personal injury, illness and/or death that could take place during the Grand Prize Trip, including but not limited to exposure to viruses associated with the COVID-19 pandemic and other communicable diseases as required. Grand Prize Winner and his/her Guests are responsible for obtaining their own medical and life insurance and the associated costs. During the Drone Racing League Event at loanDepot park in Miami, FL on February 25, 2023, if the Grand Prize Winner and/or any Guest engages or has engaged in behavior that is obnoxious, threatening, disruptive, inappropriate, illegal, or acts with the intent to annoy, abuse, threaten, or harass any other person, as determined by the Event venue’s personnel, in its sole discretion, the venue’s personnel reserves the right to remove the Grand Prize Winner and his/her Guests from the Event venue and to immediately terminate any outstanding portion of the Grand Prize without further compensation.
By entering this Sweepstakes, all entrants agree to release, hold harmless and indemnify the Sponsor, the Sweepstakes Administrator and the Related Entities and each of their respective shareholders, directors, officers, employees or representatives from and against any and all liability whatsoever for any injuries, losses, harm, damage (including but not limited to property damage, personal injury and/or death), claims, actions, costs and expenses (including without limitation, all attorneys’ fees and court costs) arising directly or indirectly from or in connection with any Prize or resulting from participation in this Sweepstakes or from acceptance, possession or use/misuse of any Prize or participation in any Prize-related activity or use by Sponsor of the Entry in any manner. Sponsor does not make, nor in any manner is responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to any Prize including but not limited to its quality, fitness for purpose or mechanical condition. Prizes are subject to the Sweepstakes and all applicable federal, state and local laws.
CLAIMING PRIZE/RELEASE: Eligibility, age and claims made by a potential Prize Winner are subject to verification. Receiving a prize is contingent upon compliance with these Official Rules. Each selected Prize Winner will be required to sign and return a Declaration of Compliance or similar documentation and where permitted, a Publicity Release, which must be received by Administrator within five (5) days of notification in order to claim the prize. Non-compliance with any of these Official Rules may result in disqualification. A Prize Winner may be disqualified if (i) a prize winner notification is returned as undeliverable; (ii) a signed Declaration of Compliance is not received by Sponsor in a timely manner; (iii) a Prize Winner is ineligible; or (iv) a Prize Winner declines his/her prize. If a Prize Winner is disqualified, that prize will be awarded to alternate winner selected in a random drawing from among all remaining eligible Entries received. Each Prize Winner agrees that the Related Entities may irrevocably use the Prize Winner’s name, voice, city/state of residence, photograph and/or other visual likeness for advertising and/or trade purposes and/or for any other purpose in any media or format including but not limited to Sponsor’s websites, social media platforms and any all media now or hereafter known without further compensation (financial or otherwise), permission or notification, and agrees to participate in any and all publicity and promotional activities as designated by Sponsor (except where prohibited by law) in connection with this Sweepstakes. Sponsor or Sweepstakes Administrator are not obligated to leave voice mail, answering machine or e-mail message. Sponsor and Sweepstakes Administrator are not responsible for fraudulent calls or e-mails to entrants that were not made by the Sponsor or Sweepstakes Administrator.
INTERNET: If for any reason this Sweepstakes is not capable of running as planned due to an infection by a computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor or the Related Entities which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, the Sponsor reserves the right at its sole discretion, to disqualify any individual who tampers with the Entry process, to cancel, terminate, modify or suspend the Sweepstakes. Neither the Sponsor nor the Related Entities assume any responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, Entries. Neither the Sponsor nor the Related Entities are responsible for any problems or technical malfunctions of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or Entry to be received by the Sponsor or the Related Entities due to technical problems, human error or traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to entrant’s or any other person’s computer relating to or resulting from participating in this Sweepstakes. NEITHER SPONSOR NOR THE RELATED ENTITIES ARE RESPONSIBLE FOR INCOMPATIBILITY OF ENTRANT’S HARDWARE, SOFTWARE OR BROWSER TECHNOLOGY WITH SPONSOR’S OR THE RELATED ENTITIES’ HARDWARE, SOFTWARE OR BROWSER TECHNOLOGY. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR OR RELATED ENTITIES THAT ARE AFFECTED RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES TO THE FULLEST EXTENT PERMITTED BY LAW FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT. In the event of a dispute as to the identity or eligibility of a Prize Winner based on a Social Media Platform handle or e-mail address, the winning Entry will be declared made by the “Authorized Account Holder” of the e-mail address associated with the Social Media Platform handle at time of Entry or the e-mail address submitted at the time of Entry. An “Authorized Account Holder” is defined as the natural person 18 years of age or older who is assigned to an e-mail address by an Internet access provider, on-line service provider, or other organization (e.g., business, education institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Sponsor may ask any entrant or the potential Prize Winner to provide Sponsor with proof that such person is the authorized account holder of the e-mail address associated with the Entry.
GENERAL: By entering this Sweepstakes, entrants and Winners: (1) agree to be bound by these Official Rules; (2) agree to release Sponsor and the Related Entities from any and all liability for any loss, harm, damages, costs or expenses, including without limitation property damages, personal injury and/or death, due in whole or in part, directly or indirectly, to participation in this Sweepstakes or any Sweepstakes-related activity, or the acceptance, possession, use or misuse of any Prize and claims based on publicity rights, defamation or invasion of privacy and/or merchandise delivery; and (3) consent to the use of his/her name, voice, picture, and likeness for advertising and Sweepstakes purposes (where permitted) in any medium throughout the world, whether now known or hereafter devised, in perpetuity without additional compensation unless prohibited by law. Sponsor, at its sole discretion, may discontinue this Sweepstakes at any time. Sponsor, at its sole discretion may terminate the Sweepstakes or decide to modify the Sweepstakes in any manner that it deems fair and equitable to entrants if it becomes aware of any occurrence that would materially affect the Sweepstakes’ security and fairness. Sponsor, at its sole discretion may prohibit individuals from participating in the Sweepstakes and disqualify Entries if they: (1) attempt to enter the Sweepstakes through any means other than as described in these Official Rules; (2) attempt to disrupt the Sweepstakes or circumvent the terms and conditions of these Official Rules in any way; or (3) repeatedly show a disregard for the Sweepstakes Official Rules or act (a) in an unsportsmanlike manner, or (b) with an intent to annoy, abuse, threaten or harass any other entrant, Sponsor, or the Related Entities. Sponsor’s decisions with respect to the Sweepstakes are final.
LIABILITY & RELEASE: By participating in this Sweepstakes, entrants agree to release and hold harmless Sponsor, the Sweepstakes Administrator and the Related Entities from and against any claim or cause of action arising out of participation in the Sweepstakes or receipt or use of any Prize hereunder, including, but not limited to: (a) unauthorized human intervention in the Sweepstakes; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing errors; (d) errors in the administration of the Sweepstakes or the processing of Entries or Claims; or (e) injury or death to a person(s) or damage to property which may be result, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or entrants’ receipt, acceptance, use and/or enjoyment of any Prize. In no event shall Sponsor, Sweepstakes Administrator or the Related Entities be liable for attorney’s fees. Each entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. Sponsor, Sweepstakes Administrator and the Related Entities reserve the right to correct typographic, clerical or printing errors in any Sweepstakes materials. Sponsor, Sweepstakes Administrator and the Related Entities are not responsible for any typographical or other error in the printing of this Sweepstakes, the administration of the Sweepstakes or in the announcement of any Winner, including such error as may give an erroneous indication that a Prize has been won. In the event the Sponsor, Sweepstakes Administrator or the Related Entities are prevented from continuing with this Sweepstakes, or the integrity and/or feasibility of the Sweepstakes is undermined by any event including but not limited to fire, flood, epidemic, pandemic, earthquake, explosion, labor dispute, or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, war (declared or undeclared), terrorist threat or activity, or any federal, state, or local government law, order of regulation, order of any court or jurisdiction, or other cause not reasonably within the Sponsor’s, Sweepstakes Administrator’s or the Related Entities’ control (each a “Force Majeure” event) the Sponsor, Sweepstakes Administrator and the Related Entities shall have the right, in their sole discretion, to abbreviate, modify, suspend, cancel or terminate the Sweepstakes without notice or further obligation. If the Sponsor, Sweepstakes Administrator or the Related Entities, in their discretion, elect to abbreviate, cancel or terminate the Sweepstakes as a result of a Force Majeure event, the Sponsor, Sweepstakes Administrator and the Related Entities reserve the right, but shall have no obligation, to award the Weekly Prizes and Grand Prize from among all valid and eligible Entries received up to the time of such Force Majeure event.
USE OF INFORMATION: The information that you provide in connection with the Sweepstakes may be used for Sponsor's internal purposes and to send you information about Sponsor’s products and special promotions but will not be provided to other third parties, except as necessary for the administration of the Sweepstakes or as required by law or legal process. Entrants grant the Sponsor and the Related Entities’ permission to post Winners’ names on Sponsor’s commercial material, Sponsor’s websites, the Website or any of its social media platforms and to use Winners’ names, hometown and/or likenesses for purposes of advertising without further compensation unless prohibited by law. If you do not wish to receive information from Sponsor in the future, please make sure to uncheck the appropriate box on the Sweepstakes Entry Form. Sponsor uses commercially reasonable efforts to comply with CAN-SPAM and you may opt out of any commercial e-mail message by following the instructions contained in the communication.
