OFFICIAL RULES

1. KEY DATES:

The National California Date Month Promotion (the “Promotion) begins on September 10,

2024, at 9:00 a.m. Pacific Time (“PT”) and ends on October 31, 2024, at 11:59 p.m. PT (the

“Promotion End Date”), such period referred to herein as the “Promotion Period”. The

Promotion is sponsored by the California Date Commission, or CDC (the “Promotion

Sponsor”).

2. FACEBOOK, YOUTUBE, INSTAGRAM AND TWITTER NOT INVOLVED

The Promotion is in no way sponsored, endorsed or administered by, or associated with

Facebook, YouTube, Instagram, or Twitter (each, a “Social Platform”). Each Social Platform

is hereby completely released of all liability by each entrant in this Promotion. Any questions,

comments, or complaints regarding the Promotion must be directed to the Promotion

Sponsor and not to any Social Platform.

3. HOW TO ENTER:

NO PURCHASE NECESSARY TO ENTER OT WIN. A PURCHASE WILL

NOT INCREASE YOUR CHANCES OF WINNING. ALL FEDERAL,STATE,

LOCAL, AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID

WHERE PROHIBITED.

To enter the Promotion:

Step 1: Visit the online California Dates Recipe Center on CaliforniaDates.com website and

choose your favorite recipe.

Step 2: Visit the Promotion landing page at https://woobox.com/mheo5s (the “Promotion

Website”).

Step 3: Upon visiting the Promotion Website, follow the on-screen instructions to

(i) fully complete the official Promotion entry form (the “Entry Form”) with all required

information, which may include a requirement to enter your first and last name, valid

email address, city/town and state of residence, Zip code, and date of birth;

(ii)Fill in the name of your favorite recipe or link found on the California Dates Recipe

Center.

Step 4: Once you have fully completed the Entry Form with all required information, follow

the on-screen instructions to submit your Entry Form (the “Entry”).

At the time of entering the Promotion, each participant will also have the opportunity to (i)

opt-in to receive promotional communications from the Promotion Sponsor and (ii) become a

“follower” of the Promotion Sponsor on their Social Platform(s). NOTE: opting-in to receive

promotional communications from the Promotion Sponsor and/or becoming a “follower” of

the Promotion Sponsor on their Social Platform(s) will not in any way whatsoever increase or

otherwise impact the chances of winning in this Promotion. A participant can opt out of

receiving promotional communications from the Promotion Sponsor and un-follow the

Promotion Sponsor on the Social Platform(s) at any time without impacting their chances of

winning in this Promotion.

To be eligible, your Entry must be submitted and received in accordance with these Rules

during the Promotion Period (as determined by the Promotion Sponsor in its sole and

absolute discretion). All eligible Entries submitted and received in accordance with these

Rules during the Promotion Period will be entered into the random prize draw for a chance to

win. Standard data rates apply to participants who choose to participate in the Promotion via

a mobile device. Please contact your service provider for pricing and service plan

information and rates before mobile device participation.

4. ENTRY LIMIT AND CONDITIONS:

There is a limit of one (1) Entry per person and per email address. Participation is voluntary

and does not require you to purchase anything from the Promotion Sponsor. No illegible,

incomplete, forged, incorrect, or altered entries will be accepted. All entries become the

property of the Promotion Sponsor and will not be returned. All entrants must be legal

residents of the United States. If it is discovered by the Sponsor (using any evidence or other

information made available to or otherwise discovered by the Promotion Sponsor) that any

person has attempted to: (i) exceed any of the limits or conditions stated in these Rules; (ii)

use multiple names, identities, e-mail addresses and/or use any automated, macro, script,

robotic or other system(s) or program(s) to enter or otherwise participate in or to disrupt the

Promotion; and/or (iii) disrupt or participate in the Promotion in any other fraudulent or

misleading way, then he/she may be disqualified from the Promotion in the sole and

absolute discretion of the Promotion Sponsor. The Promotion Parties, Promotion Partners,

Meta Platforms, Inc., Google LLC and each of their respective agents, employees, directors,

officers, successors, and assigns (collectively, the “Released Parties”) are not responsible

for and accept no liability whatsoever in relation to, any late, lost, misdirected, delayed,

incomplete or incompatible Surveys, Entry Forms, Entries and/or any other Promotion-

related information (collectively, “Promotion-Related Information”), all of which are void.

An Entry may be rejected if, in the sole and absolute discretion of the Promotion Sponsor: (i)

the Entry is not submitted and received in accordance with these Rules during the Promotion

Period; and/or (ii) the Entry is not in compliance with these Rules (including, but not limited

to, the specific Participation Requirements listed below), all as determined by the Promotion

Sponsor in its sole and absolute discretion.

5. PRIZES:

There are multiple prizes available to be won in the Promotion. All potential winners will be

chosen by random draw. .

● Five (5) winners will receive a 2 lb box of California Dates and a $100 gift card

Estimated prize value: $120.00

● Three (3) winners will be invited to participate in a private online cooking class

hosted by California Dates Ambassador, Chef Aarti Sequeira. Each winner can

invite up to 3 friends to join them, with a maximum of 4 total participants.

Winners will be given a selection of calendar dates to choose from and will

indicate their availability through a group poll. One date will be chosen for all

winners based on the most common availability. The prize includes the

cooking class only. An ingredient list will be provided to the winners; however,

the sponsor will not provide the ingredients. Data rates for the Zoom class

may apply and are the sole responsibility of the participants. Estimated Prize

Value $500.

● One (1) Grand prize winner will receive a California Dates VIP Experience at

the Palm Desert Food & Wine Festival (March 2025). The prize includes a 3-

night stay at an area hotel, complimentary tickets to the Celebrity Chef Farm

Tour & Luncheon, and the Saturday Grand Tasting Event. Travel expenses to

and from Palm Desert, as well as any expenses incurred during the stay, are

not included and are the sole responsibility of the winner. Estimated Prize

Value: $1200. ).

6. PRIZE DETAILS, CONDITIONS AND WINNER REQUIREMENTS:

● The estimated retail value of each prize is approximate and may vary.

● Prize Substitution: In the event that a winner is unable to attend or participate in any

prize-related event, the Sponsor reserves the right, in its sole discretion, to substitute

a prize with one of equal or greater value. No cash or cash equivalent prizes will be

awarded as substitute prizes.

● Allow 3-4 weeks after validation of arrangement for receipt of physical prizes (in the

case of date boxes and gift cards, confirmation of dates for the cooking class, or final

details regarding the California Dates VIP Experience. There is no cash equivalent or

transfer of prizes allowed. The Promotion Sponsor reserves the right to substitute

prizes of equal or greater value. No other substitution or transfer of prizes is

permitted. Winner(s) will be solely responsible for all other expenses not specifically

set forth herein. The Promotion Sponsor is responsible only for prize delivery; not

responsible for prize utility, quality, or otherwise.

● In order to receive a prize, winner(s) may be required to provide proof of

identification, have filled out all fields, meet all criteria, and answer all questions

correctly.

● Prize winner(s) is solely responsible for all costs not expressly described herein. All

prizes may be subject to taxes, which are the sole responsibility of the winner. The

prepaid gift card is subject to all of the terms and conditions as stated by the

applicable card issuer.

None of the Released Parties makes any representation or offers any warranty, express or

implied, as to the quality or fitness of any Prize awarded in connection with the Promotion.

To the fullest extent permitted by applicable law, each confirmed winner understands and

acknowledges that he or she may not seek reimbursement or pursue any legal or equitable

remedy from either the Promotion Sponsor or any of the other Released Parties should

his/her Prize fail to be fit for its purpose or is in any way unsatisfactory. For greater certainty

and the avoidance of any doubt, by accepting a Prize, a confirmed winner agrees to waive

all recourse against the Promotion Sponsor and all of the other Released Parties if the Prize

or a component thereof does not prove satisfactory, either in whole or in part.

7. ELIGIBILITY TO ENTER:

The Promotion is only open to people who are at least 21 years old at the time of entry, legal

residents of the United States, and who are otherwise eligible to use CaliforniaDates.com.

Entries are limited to individuals only; commercial enterprises and business entities are not

eligible. By participating in the Promotion, each entrant accepts the conditions stated in

these Official Rules, agrees to be bound by the decisions of the Promotion Sponsor, and

warrants that s/he is eligible to participate in the Promotion. Employees, independent

contractors, officers, and directors of the Promotion Sponsor, affiliates, subsidiaries,

advertising, promotion, and fulfilment agencies, and legal advisors, and their immediate

family members and persons living in the same household, are not eligible to participate in

the Promotion. PROMOTION IS VOID WHERE PROHIBITED OR RESTRICTED BY LAW

and is subject to applicable federal, state, and local laws and regulations.

Entries that are submitted in connection with the Promotion will only be eligible if such

entries do not contain content that is unlawful, hateful or obscene, in the Promotion

Sponsor’s sole discretion, and do not include any other identifiable individual other than the

individual participant unless prior express consent is obtained from such individual. The

Promotion Sponsor will allow only those entries that have been filled out in full (i.e. all

questions answered and all form fields filled) that meet all of these criteria, in the sole

discretion of the Promotion Sponsor, to be posted.

8. SELECTION OF WINNERS

Within thirty (30) days of the Promotion End Date, the Promotion Sponsor will notify the

winner(s) via email. Winners will be prompted to email the Promotion Sponsor in order to

receive the prize of a $100 prepaid credit card and 2lb box of California Dates; to confirm

availability dates for the cooking class from supplied options, or confirm availability to take

part in the . In the event a winner does not accept the prize, a winner is ineligible, or the

prize or prize notification is not deliverable, an alternate winner may be selected. The

Promotion Sponsor is not responsible for and shall not be liable for late, lost, misdirected or

unsuccessful efforts to notify the winners.

Winners agree to the publication, reproduction, and/or other use of his/her name, address,

voice, statements about the promotion, and/or photograph or other likeness, and/or prize

information for promotional purposes by the Promotion Sponsor and/or Promotion Partner in

any medium without further notice or compensation. This includes any publicity or

advertising carried out by or on behalf of the Promotion Sponsor and/or Promotion Partner in

perpetuity throughout the world in any manner or medium whatsoever, including print,

broadcast, or the internet, to the extent permitted by law. Where lawful, the winner may be

required to sign and return a Publicity Consent and Liability Release.

9. ELIGIBLE WINNER NOTIFICATION PROCESS:

The Promotion Sponsor or its designated representative will make a minimum of two (2)

attempts to contact the potential winner via email. A potential winner must respond to such

notification (by the specified deadline indicated in the notification) and is solely responsible

for ensuring they are able to receive such notification messages, monitoring for such

notification messages, and following all instructions contained in such notification messages,

failing which, they may be disqualified (as determined by the Promotion Sponsor at its sole

discretion).

9. VERIFICATION:

All Promotion-Related Information and entrants are subject to verification at any time and for

any reason. The Promotion Sponsor reserves the right, in its sole and absolute discretion, to

require proof of identity and/or eligibility (in a form acceptable to the Promotion Sponsor –

including, without limitation, government-issued photo identification): (i) for the purposes of

verifying an entrant’s eligibility to participate in this Promotion; (ii) for the purposes of

verifying the eligibility and/or legitimacy of any Promotion-Related Information and/or other

information entered (or purportedly entered) for the purposes of this Promotion; and/or (iii)

for any other reason the Promotion Sponsor deems necessary, in its sole and absolute

discretion, for the purposes of administering this Promotion in accordance with the letter and

spirit of these Rules. Failure to provide such proof to the complete satisfaction of the

Promotion Sponsor within the timeline specified by the Promotion Sponsor may result in

disqualification in the sole and absolute discretion of the Promotion Sponsor. The sole

determinant of the time for the purposes of the Promotion will be the official time-keeping

device(s) used by the Promotion Sponsor.

13. ELIGIBLE WINNER CONFIRMATION PROCESS

NO ONE IS A WINNER UNLESS AND UNTIL THE PROMOTION SPONSOR OFFICIALLY

CONFIRMS THEM AS A WINNER IN ACCORDANCE WITH THESE RULES. BEFORE

BEING DECLARED A CONFIRMED PRIZE WINNER, the potential winner may be required

to sign and return within five (5) business days of notification the Promotion Sponsor’s

declaration and release form, which (among other things): (i) confirms compliance with these

Rules; (ii) acknowledges acceptance of the Prize (as awarded); (iii) releases the Released

Parties from any and all liability in connection with this Promotion, his/her participation

therein and/or the awarding and use/misuse of the Prize or any portion thereof; (iv) agrees to

indemnify the Released Parties against any and all claims, damages, liabilities, costs, and

expenses arising from use of his/her Promotion-Related Information or any portion(s)

thereof; and (v) agrees to the publication, reproduction and/or other use of his/her name,

name of city and/or state, voice, statements about the promotion and/or photograph or other

likeness without further notice or compensation, in any publicity or advertising carried out by

or on behalf of the Promotion Sponsor in perpetuity throughout the world in any manner or

medium whatsoever, including print, broadcast or the internet.

If the potential winner: (a) cannot be contacted as set out set out above, or if there is a return

of a notification as undeliverable; (b) fails to return the properly executed Promotion

documents within the specified time; (c) cannot accept (or is unwilling to accept) a Prize (as

awarded) for any reason; and/or (d) is determined to be in violation of these Rules (all as

determined by the Sponsor in its sole and absolute discretion); then he/she will be

disqualified (and will forfeit all rights to the Prize) and the Sponsor reserves the right, in its

sole and absolute discretion and time permitting, to select an alternate potential winner in

accordance with the procedure outlined above, with the necessary amendments (in which

case the foregoing provisions of this section shall apply to such newly selected potential

winner).

10. CONDITIONS

The Promotion Sponsor and Social Platforms, and their respective agents, directors, officers,

shareholders, employees, insurers, servants, parents, subsidiaries, divisions, affiliates,

predecessors, successors, representatives, advertising, promotion, and fulfilment agencies,

and legal advisors (the “Released Entities”), are not responsible for, shall not be liable for,

and hereby disclaim all liability arising from or relating to: (i) late, lost, stolen, delayed,

damaged, misdirected, misaddressed, incomplete, unintelligible or postage-due entries; (ii)

telephone, electronic, hardware or software program, network, Internet, computer or other

malfunctions, failures, or difficulties of any kind, whether human or technical; (iii) failed,

incomplete, garbled, or delayed computer or e-mail transmissions; (iv) any condition caused

by events beyond the control of the Promotion Sponsor; (v) any injuries, losses, or damages

of any kind arising in connection with or as a result of the prize, or acceptance, possession,

or use of the prize, or from participation in the Promotion; or (vi) any printing or typographical

errors in any materials associated with the Promotion. The Promotion Sponsor reserves the

right, in its sole discretion, to suspend, modify or cancel the Promotion should any

unauthorised human intervention or other causes beyond the Promotion Sponsors’ control

corrupt or affect the administration, security, fairness or proper conduct of the Promotion. In

the event that proper administration of the Promotion is prevented by such causes as

contemplated above, the Promotion Sponsor will pick the winners from all eligible, non-

suspect entries received prior to such action. By participating in the Promotion, participants

and winners agree to release, discharge and hold harmless the Released Entities, and all

others associated with the development and execution of the Promotion, from any and all

losses, damages, rights, claims and actions of any kind arising out of or relating to the

Promotion, participation in the Promotion, the prize, and/or acceptance, possession, use or

misuse of the prize, including but not limited to statutory and common law claims for

misappropriation or participant’s right of publicity. This Promotion shall be governed by

California law

12. EMAIL OPT-IN:

By entering into this Promotion, all entrants provide expressed permission for the email

address provided to be used for promotional services by the California Date Commission.

These email addresses will not be shared with any other third party partners, and will be

used for internal marketing purposes only.

13. AGREEMENT TO BE LEGALLY BOUND BY RULES:

By participating in this Promotion, you are signifying your agreement that you have read and

agree to be legally bound by these Official Rules and Regulations (the “Rules”).

14. GENERAL PARTICIPATION REQUIREMENTS:

BY PARTICIPATING IN THIS PROMOTION, YOU AGREE TO RELEASE THE RELEASED

PARTIES FROM ANY AND ALL LIABILITY IN CONNECTION WITH THE PROMOTION

AND YOUR PARTICIPATION THEREIN AND TO INDEMNIFY THE RELEASED PARTIES

AGAINST ANY AND ALL CLAIMS, DAMAGES, LIABILITIES, COSTS, AND EXPENSES

ARISING FROM YOUR PARTICIPATION IN THE PROMOTION. BY PARTICIPATING IN

THIS PROMOTION YOU ALSO AGREE THAT YOUR ENTRY (AND EACH INDIVIDUAL

COMPONENT THEREOF) COMPLIES WITH ALL CONDITIONS STATED IN THESE

RULES. THE RELEASED PARTIES WILL BEAR NO LIABILITY WHATSOEVER

REGARDING: (I) THE USE OF YOUR ENTRY (OR ANY COMPONENT THEREOF); (II)

PARTICIPATION IN ANY PROMOTION-RELATED ACTIVITIES; (III) ANY USE,

COLLECTION, STORAGE AND DISCLOSURE OF ANY PERSONAL INFORMATION;

AND/OR (IV) IF DECLARED A WINNER, THE PRIZE (INCLUDING ANY USE OR MISUSE

OF THE PRIZE). THE RELEASED PARTIES SHALL BE HELD HARMLESS BY YOU IN

THE EVENT IT IS DISCOVERED THAT YOU HAVE DEPARTED FROM OR NOT

OTHERWISE FULLY COMPLIED WITH ANY OF THESE RULES. THIS RELEASE AND

INDEMNITY SHALL CONTINUE IN FORCE FOLLOWING THE TERMINATION OF THE

PROMOTION AND/OR AWARDING OF ANY PRIZE.

By participating in the Promotion, each entrant hereby warrants and represents that any

Promotion-related information he/she submits does not contain any reference to any

identifiable third parties, unless consent has been obtained from all such individuals and

their parent/legal guardian if they are under the age of majority in their jurisdiction of

residence, and will not give rise to any claims whatsoever, including, without limitation,

claims of infringement, invasion of privacy or publicity, or infringe on any rights and/or

interests of any third party.

15. GENERAL CONDITIONS:

This Promotion is subject to all applicable federal and state laws. The decisions of the

Program Sponsor with respect to all aspects of this Promotion, including without limitation

the eligibility of entrants or any Promotion-Related Information, are final and binding on all

entrants without right of appeal.

ANYONE DEEMED BY THE PROMOTION SPONSOR TO BE IN VIOLATION OF THE

PROMOTION SPONSOR’S INTERPRETATION OF THE LETTER AND/OR SPIRIT OF

THESE RULES FOR ANY REASON IS SUBJECT TO DISQUALIFICATION IN THE SOLE

AND ABSOLUTE DISCRETION OF THE PROMOTION SPONSOR AT ANY TIME.

All Promotion-Related Information becomes the property of the Promotion Sponsor. The

Released Parties will not be liable for: (i) any failure of the Website or any other any website

or platform during the Promotion; (ii) any technical malfunction or other problems of any

nature whatsoever, including, without limitation, those relating to the telephone network or

lines, computer on-line systems, servers, access providers, computer equipment or

software; (iii) the failure of any Promotion-Related Information, winner notification message

and/or other information to be received, captured or recorded for any reason whatsoever,

including, but not limited to, technical problems or traffic congestion on the Internet or at any

website; (iv) any injury or damage to an entrant’s or any other person’s computer or other

device related to or resulting from participating in the Promotion; (v) anyone being incorrectly

and/or mistakenly identified as a winner or eligible winner; and/or (vi) any combination of the

above.
