2016 ENTENMANN’S NATIONAL DONUT DAY SWEEPSTAKES

The 2016 Entenmann’s National Donut Day Sweepstakes (the “Sweepstakes”) starts at 12:00:01 a.m. Eastern Time (“ET”) on April 1, 2016 and ends at 11:59:59 p.m. ET on July 2, 2016 (The “Promotion Period”). The sponsor of this Sweepstakes is Bimbo Bakeries USA, Inc. d/b/a Entenmann's Bakery (“Sponsor”), with a principal place of business at 255 Business Center Drive, Horsham, Pennsylvania 19044. The Sweepstakes shall be subject to these Official Rules, and by entering, all participants agree to be bound by these Official Rules and the decisions of the Sponsor, which are binding and final on matters relating to this Sweepstakes. Certain restrictions may apply. This Sweepstakes is in no way sponsored, endorsed or administered by, or associated with, Facebook. You understand that you are providing your information to Sponsor and not to Facebook. The Promotion Period will be divided into two (2) entry periods (each, an “Entry Period”) as defined below.

Entry Period 1

Begins at 12:00 a.m. ET on: April 1, 2016

Ends 11:59 p.m. ET on: April 30, 2016

 

Entry Period 2

Begins at 12:00 a.m. ET on: May 1, 2016

Ends 11:59 p.m. ET on: July 2, 2016

ELIGIBILITY: This Sweepstakes is open only to legal residents of the fifty (50) United States and the District of Columbia who are at least 18 years of age as of date of entry. The parent, affiliates, subsidiaries, officers, trustees, distributors, advertising and promotion agencies, employees and agents of the Sponsor, and the immediate families (parent, child, spouse or sibling and their respective spouses regardless of where they reside) and those living in the same households, whether or not related, of any of the above are not eligible to enter or win. If you have received a prize from Sponsor within the past six (6) months in connection with another Sponsor promotion, you are not eligible to participate in this Promotion or receive a prize. All federal, state and local rules and regulations apply. Void where prohibited.

HOW TO ENTER: During Entry Period 1, visit www.facebook.com/Entenmanns and follow the instructions provided to complete and submit an official entry form to receive one (1) entry for the Entry Period 1 drawing and the Entry Period 2 grand prize drawing. During Entry Period 2, visit www.facebook.com/Entenmanns and follow the instructions provided to complete and submit an official entry form to receive one (1) entry for the Entry Period 2 grand prize drawing. For each Sweepstakes entry submitted throughout the Promotion Period, Sponsor will donate $1 to The Salvation Army, up to $35,000. Entries must be received by the end dates and times specified above to be eligible for an applicable Entry Period. Limit: Each entrant may enter only one (1) time per day during the Promotion Period. Any attempt by any entrant to obtain more than the stated daily number of entries by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that entrant's entries and that entrant may be disqualified. For the purpose of this Sweepstakes, a day is understood to begin at 12:00:01 am ET and end at 11:59:59 pm ET that same day.

RANDOM DRAWINGS: One hundred (100) potential winners will be selected for Entry Period 1 in a random drawing held on or about May 1, 2016 from all eligible entries received throughout Entry Period 1. Ten (10) potential grand prize winners will be selected in a random drawing from all eligible Entry Period 2 entries received and combined throughout the Promotion Period on or about July 3, 2016. Odds of winning an Entry Period 1 prize depend on the number of eligible entries received throughout Entry Period 1. Odds of winning an Entry Period 2 grand prize depend on the number of eligible Entry Period 2 entries received throughout the Promotion Period.

WINNER NOTIFICATION: Sponsor’s decisions are final and binding on all matters relating to this Sweepstakes. Potential winners will be notified by mail, phone, and/or e-mail and may be required to execute and return an affidavit of eligibility, a liability release and, where lawful, a publicity release within seven (7) days of date of issuance. If such documents are not returned within the specified time period, prize or prize notification is returned as undeliverable, Sponsor is unable to contact potential winner or potential winner is not in compliance with these Official Rules, prize will be forfeited and, at Sponsor’s discretion, an alternate winner may be selected.

PRIZES:

ENTRY PERIOD 1 PRIZES (100):  Each winner will receive a prize package consisting of four (4) Entenmann’s donut coupons (each coupon is for $7 and will cover the cost of a box of donuts), a $25 gift card, an Entenmann’s T-shirt, a set of Entenmann’s plates and napkins, and an Entenmann’s Mr. Rich Frosted Donut Party Hat Plush toy. Approximate Retail Value (“ARV”) of each prize package: $75.

ENTRY PERIOD 2 GRAND PRIZES (10): Each grand prize winner will receive Entenmann’s products for a year, awarded as fifty two (52) coupons, each redeemable for any Entenmann’s product up to $7.00 in value (excluding sales tax). ARV of each Grand Prize package is $364.

PRIZE CONDITIONS: Prizes are awarded “as is” with no warranty or guarantee, either express or implied by Sponsor. Coupons are subject to certain terms and conditions specified by Sponsor. Coupons expire on 6/30/17. Coupons may not be used online or in conjunction with any other offer or discount. Valid only in the U.S.A. Void where prohibited. Winners may not substitute, assign or transfer prize or redeem prize for cash, but Sponsor reserves the right, at its sole discretion, to substitute a prize with one of comparable or greater value. Winners are responsible for all applicable federal, state and local taxes, if any, as well as any other costs and expenses associated with prize acceptance and use not specified herein as being provided. All prize details are at Sponsor’s sole discretion. Total ARV of all prizes: $11,140.

GENERAL CONDITIONS: By participating, each entrant agrees: (a) to abide by these Official Rules and decisions of Sponsor, which shall be final and binding in all respects relating to this Sweepstakes; (b) to release, discharge and hold harmless Sponsor, Facebook, and their respective parents, affiliates, subsidiaries, and advertising and promotion agencies, and the respective officers, directors, shareholders, employees, agents and representatives of the forgoing (collectively, “Released Parties”) from any and all injuries, liability, losses and damages of any kind to persons, including death, or property resulting, in whole or in part, directly or indirectly, from entrant’s participation in the Sweepstakes or any Sweepstakes-related activity or the acceptance, possession, use or misuse of any prizes; and (c) to the use of his/her name, voice, Entry, and/or likeness for programming, advertising, publicity and promotional purposes in any and all media, now or hereafter known, worldwide and on the Internet, and in perpetuity by Sponsor and its designees, without compensation (unless prohibited by law) or additional consents from entrant or any third party and without prior notice, approval or inspection, and to execute specific consent to such use.

When entering the Sweepstakes, we collect personally identifying information about you, including your name and email address. The information that you provide will be added to a centralized Sponsor database. By entering and providing the required entry information, you acknowledge that Sponsor may email you information, promotional discounts or special offers it believes may be of interest to you.  Your information will not be sold or rented to third parties. If you would like your information removed from this database you can do so at any time by following the opt-out instructions at the bottom of any email correspondence received from Sponsor. MISCELLANEOUS: Released Parties are not responsible for lost, late, incomplete, damaged, inaccurate, stolen, delayed, misdirected, undelivered, or garbled entries, or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Sweepstakes, including, without limitation, errors or difficulties which may occur in connection with the administration of the Sweepstakes, the processing of entries, the announcement of the prizes, or in any Sweepstakes-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Sweepstakes.  Released Parties are not responsible for injury or damage to any person's computer related to or resulting from participating in this Sweepstakes or downloading materials from or use of the website. Persons who tamper with or abuse any aspect of the Sweepstakes or website, who act in an unsportsmanlike or disruptive manner or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated Entries will be void. Should any portion of the Sweepstakes be, in Sponsor’s sole opinion, compromised for any reason, including virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of Entries, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Sweepstakes (or portion thereof) and, if terminated, at its discretion, select the potential winners for the drawing(s) at issue from among all non-suspect, eligible entries received for the applicable drawing(s) prior to action taken. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK ANY AND ALL REMEDIES AVAILABLE FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.

ARBITRATION: Except where prohibited by law, as a condition of participating in this Sweepstakes, entrant agrees that (1) any and all disputes and causes of action arising out of or connected with this Sweepstakes, or prizes awarded, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association and held at the AAA regional office nearest the entrant; (2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys' fees, other than entrant's actual out-of-pocket expenses (i.e., costs associated with participating in this Sweepstakes), and entrant further waives all rights to have damages multiplied or increased.

CHOICE OF LAW: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the substantive laws of the Commonwealth of Pennsylvania, USA.

WINNERS’ LIST: For the names of the winners (available after July 13, 2016), send a self-addressed, stamped envelope to: 2016 Entenmann’s National Donut Day Sweepstakes Winner’s List, C/O Vision Marketing, 25 Sylvan Rd S. Ste F, Westport, CT 06880 for receipt no later than August 13, 2016.
