The Entenmann’s® 120th Birthday Celebration Sweepstakes (the “Sweepstakes”) starts on January 8, 2018 at 12:00 a.m. Eastern Time (“ET”) and ends on March 30, 2018 at 11:59 p.m. ET (“Sweepstakes Period”).
ELIGIBILITY: Sweepstakes is open to legal residents of the fifty (50) United States and the District of Columbia, 21 years of age or older as of date of entry. Employees of Bimbo Bakeries USA, Inc. (“Sponsor”), Harlem Globetrotters International, Inc., Macy's Inc. (“Prize Provider”), and their respective parents, subsidiaries, distributors, affiliates, promotion and advertising agencies, and members of their immediate family (spouse and parent, children and siblings and their respective spouses, regardless of where they reside) and persons living in the same household, whether or not related, of such employees, are not eligible to enter or win. If you have received a prize from Sponsor within the past six (6) months in connection with another Sponsor promotion, you are not eligible to participate in this Sweepstakes or receive a prize. Void where prohibited by law. Sweepstakes is subject to all applicable federal, state and local laws.
HOW TO ENTER: During the Sweepstakes Period, visit www.entenmanns120birthday.com and follow the directions provided to complete and submit the registration form to receive one (1) entry in the Sweepstakes (each, an “Entry”). Entries must be received by March 30, 2018 at 11:59 p.m. ET to be eligible. Entries generated by script, macro or other automated means and Entries by any means which subvert the entry process are void. Limit one (1) Entry per person using only one (1) e-mail address per day for the duration of the Sweepstakes Period. You may only use one (1) e-mail address to enter the Sweepstakes. Entries received from any person or e-mail address in excess of the limitation stated above will be void. All Entries become the sole property of the Sponsor and will not be returned.
Bonus Entry: There are three (3) ways to obtain one (1) bonus Entry in the Sweepstakes; 1) Birthday Video: Visit the Entenmann’s Facebook page at www.facebook.com/entenmanns and upload a video to the page of yourself singing happy birthday to Entenmann’s, holding your favorite Entenmann’s product and include the hashtags #Entenmanns120 and #promotion in your post to receive one (1) bonus Entry. All posts must be public to count as entry. OR 2) post a video on your public Instagram or Twitter account of yourself singing happy birthday to Entenmann’s, holding your favorite Entenmann’s product and include the hashtags #Entenmanns120 and #promotion in your post OR 3) Mail-in: To receive one (1) bonus Entry without creating or uploading a video, on a 3” x 5” piece of paper, hand-print your name, complete address, telephone number (including area code), date of birth and email address and mail in an envelope with proper postage affixed to: Entenmann’s® 120th Birthday Celebration Sweepstakes, 15820 Euclid Avenue Chino, CA 91708. All mail-in requests must be postmarked by March 30, 2018 received by April 2, 2018 to be considered. Entries generated by script, macro or other automated means or by any means which subvert the entry process are void. Limit one (1) bonus Entry per person using only one (1) e-mail address for the duration of the Sweepstakes Period, regardless of method of entry. Entries received from any person or email address or household in excess of the limitation will be void.
This Sweepstakes is not sponsored, endorsed, administered by or associated with Facebook. By entering, you are providing the information to Sponsor, and not to Facebook. If you have any questions regarding the Sweepstakes direct them to the Sponsor and not to Facebook.
For each eligible bonus Entry received throughout the Sweepstakes Period, Sponsor will donate $1.00 to Give a Note Foundation, up to $10,000 total. Information concerning Give a Note Foundation, including financial, licensing or charitable purpose may be obtained at giveanote.org.
PLEASE NOTE: Entrants must adjust their Facebook account settings to allow for receipt of messages from Sponsor. For this purpose, Entrants will have to set Facebook account settings to ‘Public’, and take any further necessary steps to ensure receipt of any communication from Sponsor. It is solely Entrant’s burden to take any steps necessary to adjust his/her Facebook account settings so that messages can be sent by Sponsor. An Entrant’s non-receipt of a message from Sponsor for any reason, including for failure on behalf of Entrant to adjust Facebook account settings, shall be Entrant’s, and not Sponsor’s fault. Similarly, Sponsor shall not be held liable if they are not able to view an Entrant’s entry for any reason, including the failure on behalf of Entrant to adjust his/her Facebook account settings accordingly. By entering this Sweepstakes, each Entrant agrees that the Sponsor has the right to contact the Entrant by Facebook Messenger to administer and fulfill this Sweepstakes.
REQUIREMENTS OF VIDEOS: Video must include entrant singing the entire Happy Birthday Song to Entenmann’s and holding an Entenmann’s product.
Videos may not contain, as determined by the Sponsor, in its sole discretion, any content that:
· is sexually explicit or suggestive; unnecessarily violent or derogatory of any ethnic, racial, gender, religious, professional or age group; profane or pornographic; contains nudity;
· promotes alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing); promotes any activities that may appear unsafe or dangerous; promotes any particular political agenda or message;
· is obscene or offensive; endorses any form of hate or hate group;
· defames, misrepresents or contains disparaging remarks about other people or companies;
· contains trademarks, logos, or trade dress (such as distinctive packaging or building exteriors/interiors) owned by others, without permission; contains any personal identification, such as license plate numbers, personal names, e-mail addresses or street addresses;
· contains copyrighted materials owned by others (including photographs, sculptures, paintings, and other works of art or images published on or in websites, television, movies or other media), without permission;
· contains materials embodying the names, likenesses, voices, or other indicia identifying any person, including, without limitation, celebrities and/or other public or private figures, living or dead, without permission;
· contains look-alikes of celebrities or other public or private figures, living or dead;
· communicates messages or images inconsistent with the positive images and/or good will to which we wish to associate; and/or
· violates any law.
Videos must be the original work of the entrant, may not have been previously published, may not have won previous awards, and must not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity. If a video contains any material or elements that are not owned by the entrant, and/or which are subject to the rights of third parties, the entrant is responsible for obtaining, prior to submission of the video, any and all releases and consents necessary to permit the use and exhibition of the video by Sponsor in the manner set forth in these Official Rules, including, without limitation, name and likeness permissions from any person who appears in or is identifiable in the video. Sponsor reserves the right to request proof of these permissions in a form acceptable to Sponsor from any entrant at any time. Failure to provide such proof may, if requested, render video (and corresponding bonus Entry) null and void. By submitting a video, entrant warrants and represents that he/she and any persons appearing or who are identifiable in the video consent to the submission and use of the video in the Sweepstakes and to its use as otherwise set forth herein.
RANDOM DRAWING: Two (2) potential Grand Prize winners, one hundred and twenty (120) potential First Prize winners, and three thousand (3,000) potential Second Prize winners will be selected in a random drawing on or about April 3, 2018 from all eligible entries received throughout the Sweepstakes Period. Odds of winning a prize depend on the number of eligible entries received throughout the Sweepstakes Period.
WINNER NOTIFICATION: Sponsor’s decisions are final and binding on all matters relating to this Sweepstakes. Potential winners will be notified by mail, phone, and/or e-mail and potential Grand Prize winners will, and potential First Prize winners may be required to execute and return an affidavit of eligibility, a liability release and, where lawful, a publicity release within five (5) days of date of issuance. If such documents are not returned within the specified time period, prize notification is returned as undeliverable, Sponsor is unable to contact a potential winner or a potential winner is not in compliance with these Official Rules, prize will be forfeited and, at Sponsor’s discretion, an alternate winner may be selected.
FIRST GRAND PRIZE (1): A trip for winner and up to three (3) guests (one (1) adult guest and two (2) minor guests who must be twelve (12) years of age or younger) to New York, NY from November 20-24, 2018. Trip consists of roundtrip, coach class air transportation from a major U.S. gateway airport nearest winner’s residence to New York, NY, four (4) days and three (3) nights hotel accommodations in New York, NY (one room, quad occupancy), and four (4) VIP passes to the 2018 Macys Thanksgiving Day Parade. If winner resides within a 100-mile radius of New York, NY, ground transportation will be provided in lieu of air transportation and no compensation or substitution will be provided in lieu thereof. Approximate Retail Value (“ARV”) of First Grand Prize: $6,000. Actual value may vary based on point of departure and number of guests on trip. In the event winner elects not to travel with an adult guest or elects to travel with less than two (2) minor guests no compensation or substitution will be provided in lieu thereof. Any difference between stated value and actual value will not be awarded. Trip must be taken from November 20-24, 2018 or prize will be forfeited and Sponsor will have no further obligation to such winner. Sponsor reserves right to change dates. Winner and guest(s) must travel together on the same itinerary. Adult guest must be of legal age of majority in his/her jurisdiction of residence (and at least 18) and must sign a liability/publicity release prior to issuance of travel documents. Minor guest(s) must be a child or legal ward of winner or guest and winner or guest must sign and return release on behalf of such child or legal ward. Travel must be made through Sponsor’s agent, on a carrier of Sponsor’s choice.
SECOND GRAND PRIZE (1): A Harlem Globetrotters party for winner which includes a two (2) hour event with player performances, Globie (mascot) appearance, and food and beverages for winner and up to twenty four (24) guests at the winners home. ARV of Second Grand Prize: $16,000. Exact date and time of Harlem Globetrotters party to be determined by Sponsor, in its sole discretion. Date of Harlem Globetrotters party subject to change. Failure of winner to accept the date, time, and location of party will result in forfeiture of award. Sponsor reserves the right to host party at a location other than winner’s residence for any reason. In the event the Harlem Globetrotters and/or Globie is unable to attend the party, no compensation or substitution will be provided in lieu thereof; however, remainder of prize will be provided and Sponsor will have no further obligation to winner.
FIRST PRIZES (120): Each winner will receive Entenmann’s product for a year, awarded in the form of a $364 gift card. ARV of each First Prize: $364. Gift cards are subject to certain terms and conditions specified by issuer.
SECOND PRIZES (3,000): Each winner will receive one (1) coupon redeemable for an Entenmann’s product up to $7.00 in value. ARV of each First Prize: $7. Coupons are subject to certain terms and conditions specified by Sponsor. The total value of a coupon must be redeemed at one (1) transaction. Any unused balance will not be awarded. Coupons must be surrendered at time of redemption. Coupons expire on date specified on each coupon. Coupons may not be used online or in conjunction with any other offer or discount. Valid only in the U.S.A. and are void where prohibited.
GENERAL PRIZE CONDITIONS: All federal, state and local taxes and all other costs associated with prize acceptance and use not specified herein as being provided, including if a Grand Prize winner but not limited to any/all ground transportation, parking fees, luggage fees, meals, souvenirs and gratuities are the sole responsibility of the winners. Prizes awarded “as is” with no warranty or guarantee, either express or implied by Sponsor. Winners may not substitute, assign or transfer prize or redeem prize for cash, but Sponsor reserves the right, at its sole discretion, to substitute a prize (or portion thereof) with one of comparable or greater value. All prize details are at Sponsor’s sole discretion. Total ARV of all prizes: $86,680.
GRAND PRIZE FOOTAGE: Grand Prize winner and his/her guests on the trip and at the Harlem Globetrotters party may be photographed, videotaped and otherwise recorded by Sponsor during the party (collectively, "Footage"). Footage will be owned by Sponsor who has the right to use, edit, adapt, post, stream, copy and exploit such Footage and all elements embodied therein, including any names and likenesses embodied therein, on social media and in any and all media now known or hereafter devised throughout the world, in perpetuity, for advertising, promotional, trade and other purposes. By accepting the prize, winner agrees that his/her name and likeness and those of any other individuals present may be included in the Footage, in Sponsor’s sole discretion. Winner agrees to help Sponsor retain necessary releases (as applicable) if requested by Sponsor to do so.
GENERAL CONDITIONS: By participating, each entrant agrees: (a) to abide by these Official Rules and decisions of Sponsor, which shall be final and binding in all respects relating to this Sweepstakes; (b) to release, discharge and hold harmless Sponsor, Prize Provider, and their respective parents, affiliates, subsidiaries, distributors, and advertising and promotion agencies, and the respective officers, directors, shareholders, employees, agents and representatives of the forgoing (collectively, “Released Parties”) from any and all injuries, liability, losses and damages of any kind to persons, including death, or property resulting, in whole or in part, directly or indirectly, from entrant’s participation in the Sweepstakes or any Sweepstakes-related activity or the acceptance, possession, use or misuse of any prize (including any travel/activity related thereto); and (c) to the use of his/her name, voice, performance, photograph, caption, entry, and/or likeness for programming, advertising, publicity and promotional purposes in any and all media, now or hereafter known, worldwide and on the Internet, and in perpetuity by Sponsor and its designees, without compensation (unless prohibited by law) or additional consents from entrant or any third party and without prior notice, approval or inspection, and to execute specific consent to such use. By participating, entrant also agrees not to release any publicity or other materials on their own or through someone else regarding their participation in the Sweepstakes without the prior consent of the Sponsor, which it may withhold in its sole discretion.
When entering the Sweepstakes, we collect personally identifying information about you, including your name and email address. The information that you provide will be added to a centralized Sponsor database. By entering and providing the required entry information, you acknowledge that Sponsor may email you information, promotional discounts or special offers it believes may be of interest to you. Your information will not be sold or rented to third parties. If you would like your information removed from this database you can do so at any time by following the opt-out instructions at the bottom of any email correspondence received from Sponsor. LICENSE/USE OF VIDEOS: By submitting a video, and to the extent allowed by law, you grant the Released Parties a perpetual, worldwide, royalty-free, non-exclusive, sub licensable, unconditional and transferable license to edit, modify, cut, rearrange, add to, delete from, reproduce, encode, store, modify, copy, transmit, publish, post, broadcast, display, adapt, exhibit and/or otherwise use or reuse your video, name, photo, and biographical material including, but not limited to, all materials submitted in connection with the Sweepstakes in any and all media, throughout the world, and in any manner, for trade, advertising, promotional, commercial, or any other purposes without further review, notice, approval, consideration, or compensation to entrant or any third party.
MISCELLANEOUS: Released Parties are not responsible for lost, late, incomplete, damaged, inaccurate, stolen, delayed, misdirected, undelivered, or garbled Entries or videos, or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Sweepstakes, including, without limitation, errors or difficulties which may occur in connection with the administration of the Sweepstakes, the cancellation or postponement of any trip, party or show, the processing of Entries or videos, the announcement of the prizes, or in any Sweepstakes-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Sweepstakes. Released Parties are not responsible for injury or damage to any person's computer related to or resulting from participating in this Sweepstakes or downloading materials from or use of the website. Persons who tamper with or abuse any aspect of the Sweepstakes or website, who act in an unsportsmanlike or disruptive manner or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated entries will be void. Should any portion of the Sweepstakes be, in Sponsor’s sole opinion, compromised for any reason, including virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of Entries, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Sweepstakes (or portion thereof) and, if terminated, at its discretion, select the potential winners from among all non-suspect, eligible Entries received prior to action taken. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK ANY AND ALL REMEDIES AVAILABLE FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
ARBITRATION: Except where prohibited by law, as a condition of participating in this Sweepstakes, participant agrees that (1) any and all disputes and causes of action arising out of or connected with this Sweepstakes, or any prize awarded, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association and held at the AAA regional office nearest the participant; (2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys' fees, other than participant's actual out-of-pocket expenses (i.e., costs associated with participating in this Sweepstakes), and participant further waives all rights to have damages multiplied or increased.
CHOICE OF LAW: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of participant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the substantive laws of the Commonwealth of Pennsylvania, USA.
