NO PURCHASE OR PAYMENT OF ANY KIND NECESSARY IS TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING. THIS GIVEAWAY (DEFINED BELOW) IS INTENDED FOR PLAY IN THE UNITED STATES ONLY AND WILL BE GOVERNED BY UNITED STATES LAW. DO NOT ENTER IF YOU ARE NOT ELIGIBLE AND LOCATED IN THE UNITED STATES AT THE TIME OF ENTRY. OPEN TO LEGAL RESIDENTS OF THE FIFTY (50) UNITED STATES OR THE DISTRICT OF COLUMBIA, EIGHTEEN (18) YEARS OF AGE OR OLDER, WHO ENTER FROM WITHIN THE FIFTY (50) UNITED STATES OR THE DISTRICT OF COLUMBIA. ELIGIBILITY: The OWYN x Josh Hart Giveaway (the “Giveaway”) is open to legal US residents only who are at least eighteen (18) years old and the age of majority in their jurisdictions of residence as of the date of entry. Void where prohibited. Employees of Only What You Need, Inc. (“Sponsor”), their parent companies, subsidiaries, affiliates, advertising agencies, public relations agencies, prize suppliers, including any vendors providing services in connection with this Giveaway (collectively, the “Sponsor Affiliates”), and employees, agents, directors, officers (including members of their immediate family – i.e., spouse, mother, father, in-laws, grandmother, grandfather, brother, sister, children, and grandchildren – or those living in the same household) of Sponsor or any Sponsor Affiliates are not eligible to participate in the Giveaway. The Giveaway is subject to all applicable federal, state, and local laws. No purchase or payment of any kind is necessary to enter or win the Giveaway. A purchase will not improve your chances of winning. This Giveaway is in no way sponsored, endorsed, or administered by, or associated with Instagram, Facebook, or Josh Hart. You are providing your information to Sponsor, and not to Instagram, Facebook, or Josh Hart. Any questions, comments, or complaints regarding this Giveaway shall be directed to Sponsor and not to Instagram, Facebook, and/or Josh Hart.
GIVEAWAY PERIOD: The Giveaway begins on October 19th, 2024 at 10:00 a.m. Eastern Standard Time (“EST”) and ends on October 22nd, 2024 at 11:59 p.m. EST (the “Giveaway Period”). The time shall be determined by Sponsor’s timekeeping systems, and Sponsor may also rely on the time processing functions of third parties. Sponsor shall have the sole discretion in determining the timeliness of any action or inaction related to this Giveaway.

Please Note: The content of your Instagram comment will not be judged and therefore will not increase or decrease your chances of winning the prize.
MAIL-IN ENTRY: To enter without following @liveowyn on Instagram/liking and commenting on an Instagram post, you may, on an index card, hand-write the title of the Giveaway, and your full name, complete address, and e-mail address in English, and mail the index card via first-class or priority mail in a properly stamped envelope to: OWYN x Josh Hart Giveaway, 33 Irving Plaza, New York, New York, 10003 (a “Mail-in Entry”). Mail-in Entries must be received at the above address by October 22nd, 2024 at 11:59 p.m. EST to be eligible. Limit one (1) entry per stamped outer envelope during the Giveaway. All Mail-in Entries must be mailed in separately. Sponsor is not responsible for late, lost, damaged, illegible, or postage-due mail. Only one (1) Mail-in Entry per person shall be valid during the Giveaway. Sending multiple Mail-in Entries will not increase your chances of winning.
DRAWING: On or around October 23rd, 2024, Sponsor will randomly select one (1) potential winner among all eligible entries received. Odds of winning a prize depend on the number of eligible entries received during the Giveaway Period. Sponsor’s decisions are final and binding in all aspects.
WINNER NOTIFICATION: Sponsor will notify each potential winner by sending the potential winner an email (at the email address provided to Sponsor) by October 23rd, 2024 at 12:00 p.m. EST. Such potential winner will be required to respond to such notification within twenty-four (24) hours via an email response. The potential winner is subject to verification of eligibility and compliance with these Terms & Conditions. The potential winner may be disqualified and the applicable prize may be forfeited in Sponsor’s sole discretion if: (a) a potential winner is found not to be eligible or not in compliance with these Terms & Conditions; (b) attempted notification or any prize is returned as undeliverable; (c) any required documents are not returned within the required number of days; (d) a potential winner cannot be verified; or (e) if a potential winner is otherwise unable or unwilling to accept and claim the prize as stated. In the event that a potential winner is disqualified for any reason, Sponsor reserves the right to award the prize to an alternate entrant who will also be selected randomly. Winners may be required to complete, sign, and return an Affidavit of Eligibility/Liability Release, and, where lawful, a Publicity Release, or the prize may be forfeited. Sponsor is not responsible for any change of email address, mailing address, and/or telephone number of entrants.
GRAND PRIZE: Two (2) tickets to the New York vs. Indiana basketball game on October 25th, 2024 at 7:30 p.m. (the “Prize”). Approximate Retail Value (“ARV”) of the Prize: $1,000. The difference between any stated value and actual value will not be awarded to the winner. The Prize is non-transferable and may not be substituted for cash or any other items will be made except as provided herein at Sponsor’s sole discretion. If the prize, or any portion thereof, cannot be awarded for any reason, Sponsor reserves the right to substitute the Prize with another prize of equal or greater value. Prize winners will be solely responsible for all federal, state, and/or local taxes, and for any other fees or costs associated with the Prize, regardless of whether it, in whole or in part, is used.
The Prize will be provided by Sponsor via Ticketmaster through email. The winner does not have to have a Ticketmaster account to redeem the Prize (i.e., the tickets). The winner is solely responsible for all expenses not expressly stated in the prize description, including but not limited to transportation, lodging, meals, and any other incidental costs. OWYN is only responsible for providing the two (2) tickets to the New York vs. Indiana basketball game on October 25th, 2024 at 7:30 p.m. All other costs associated with redeeming the Prize, including travel to and from the event, are the sole responsibility of the winner.
PRIVACY: By participating in the Giveaway, you agree to be bound by Sponsor’s Privacy Policy (located at the following link: https://liveowyn.com/privacy-policy/ [liveowyn.com]) and Sponsor’s Terms of Service (located at the following link: https://liveowyn.com/terms-of-service/ [liveowyn.com]), which are hereby incorporated by reference. By participating in the Giveaway, each entrant consents to the collection, use, and disclosure of their personal information as described in these Terms and Conditions. Sponsor will collect information from the entrants for the purposes of administering the Giveaway and communicating with the entrants regarding their entries. By entering, you automatically provide prior written consent to receive text message(s) and email(s) from Sponsor. Text message rates may apply. Entrants’ information may include, but is not limited to, their name, email address, and age.
GENERAL CONDITIONS: Sponsor is not responsible for lost, late, misdirected entries, or entries not received regardless of cause. In the event of a dispute over who submitted an entry, the entry will be deemed to have been directly submitted by the authorized account holder of the relevant account used to enter the Giveaway. Tickets cannot be transferred or sold to another party. The authorized account holder is deemed to be the natural person who is assigned to the account by the relevant entity responsible for assigning those accounts. By entering and/or participating, entrants agree to be bound by these Terms & Conditions (including Sponsor’s Privacy Policy and Sponsor’s Terms of Service). Furthermore, the Sponsor shall not be responsible for any entries that are lost, late, incomplete, or misdirected, or for any technical malfunctions of any kind, including, but not limited to, malfunctions of any network, hardware, or software, or for any failure of the Giveaway to be conducted as planned. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process, the website, or the operation of the Giveaway or to be acting in violation of the Terms & Conditions or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Giveaway may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Terms & Conditions shall not constitute a waiver of that provision.
PUBLICITY: Except where prohibited by law, each winner grants (and agrees to confirm this grant in writing, if requested) permission for Sponsor and those acting under its authority to use his/her name, photograph, and/or likeness, for advertising and/or publicity purposes in any and all media now known or hereinafter invented without territorial or time limitations and without compensation.
GOVERNING LAW & DISPUTE RESOLUTION: These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of New York, other than such laws, rules, regulations, and case law that would result in the application of the laws of a jurisdiction other than the State of New York. By participating in the Giveaway, entrants agree that any disputes arising out of or related to these Terms and Conditions or the Giveaway shall be resolved exclusively in the state or federal courts located in New York, and entrants hereby consent to the personal jurisdiction of such courts.
FORCE MAJEURE: Sponsor shall not be liable for any failure to perform its obligations under these Terms and Conditions if such failure is due to causes beyond its reasonable control, including but not limited to acts of God, war, terrorism, fire, flood, earthquake, labor disputes, government action, or any other event that may be classified as an event of force majeure (each, a “Force Majeure Event”). If a Force Majeure Event occurs, Sponsor reserves the right to cancel, suspend, or modify the Giveaway or these Terms and Conditions, as necessary, without prior notice to the entrants.
LIMITATION OF LIABILITY: To the fullest extent permitted by applicable law, Sponsor, its affiliates, employees, agents, and representatives shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the Giveaway, including, but not limited to, loss of profits, loss of data, or any other loss or damage, whether arising in tort (including negligence), contract, or otherwise, even if Sponsor has been advised of the possibility of such damages. By participating in the Giveaway, each entrant agrees that Sponsor’s liability is limited to the maximum extent permitted by law and that the only remedy available to any entrant shall be the right to withdraw from the Giveaway.
