1. ELIGIBILITY. To be eligible to enter, you must be a legal resident of the United States and be 18 years of age or older at the time of entry. Only individuals may enter; no entry from any corporation or other entity shall be accepted. Employees of the prize sponsor as well as employees and other representatives of the Metropolitan Knoxville Airport Authority and its tenants, (and the immediate family members of each of them and others living in the same household) are not eligible to win prizes. All applicable federal, state and local laws and regulations of the United States apply. This Sweepstakes is VOID where prohibited or otherwise restricted by law. The Metropolitan Knoxville Airport Authority will only accept entries that are completed and submitted in the format designated below.
By participating in this Sweepstakes, each participant (a) accepts the terms and conditions stated in these official rules, (b) agrees to be bound by these official rules and by the decisions of Metropolitan Knoxville Airport Authority, which are final and binding in all respects, and (c) warrants that he/she is eligible to participate in this Sweepstakes.
2. ENTRY PERIOD. The Sweepstakes entry period begins at 9:00 AM EST on January 2, 2018, and will end at 4:00 PM EST on January 31, 2018. All entries to this Sweepstakes must be received during that period to be eligible to win.
3. HOW TO ENTER. The Sweepstakes can be found on the McGhee Tyson Airport Facebook page at www.facebook.com/FlyKnoxville/. To enter, the participant must 1) click on the sweepstakes tab, 2) upload a photo that contains the hashtag #TYSturns80 (in or on the photo), 3) fill out their name and email address, and 4) agree to these terms and conditions. All uploaded photos will be manually reviewed by staff of the Metropolitan Knoxville Airport Authority for vulgarity or inappropriateness. If the staff of the Metropolitan Knoxville Airport Authority deems a photo to be vulgar or inappropriate, the Metropolitan Knoxville Airport Authority has the ultimate and binding discretion to disqualify that entry. Photos that are approved by Metropolitan Knoxville Airport Authority staff will be entered into the sweepstakes. Only one entry per email address will be permitted.
In the event of a dispute regarding the identity of a participant, the entry will be deemed submitted by the natural person who is the registered holder of the email account, at the time of entry, used to enter the sweepstakes. Each potential winner may be required, at the Metropolitan Knoxville Airport Authority’s sole discretion, to show proof of being the registered holder of a particular email as a condition to receiving the prize award.
Neither the Metropolitan Knoxville Airport Authority, its tenants, or advertising or promotion agencies are responsible for any (i) incorrect or inaccurate transcriptions of entry information, (ii) lost, delayed or corrupted data transmissions or telephone, electronic, hardware, software, network, Internet, or other computer or communications related malfunctions, (iii) other errors, failures or malfunctions, (iv) late, lost, illegible or misdirected entries, or (v) any damage to an entrant's system occasioned by participating in the Giveaway or downloading any Giveaway information or forms from http://www.flyknoxville.com. This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants are providing information to the Metropolitan Knoxville Airport Authority and not to Facebook. By participating in this promotion entrants agree to a complete release of Facebook from any claims.
4. PRIZES/ODDS. The odds of winning will depend upon the number of eligible entries received. A purchase will not improve your chances of winning. The prizes are not transferable, and no substitutions or cash exchanges are permissible, except that the Metropolitan Knoxville Airport Authority reserves the right to substitute a prize of equal or greater value. The prizes will be awarded "AS IS" and without warranty of any kind, express or implied, including, without limitation, any implied warranty of merchantability or fitness for a particular purpose. All federal, state and local taxes associated with the receipt of any prizes are the sole responsibility of the winner.
5. DISCLAIMERS AND RELEASE OF LIABILITY. The Metropolitan Knoxville Airport Authority, and their directors, officers, employees, representatives and agents disclaim any and all liability whatsoever for any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Sweepstakes or with the acceptance, possession or use of any prize (including, without limitation, claims, costs, injuries and losses related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light). Except where prohibited by law, by accepting a prize, the winner releases the Metropolitan Knoxville Airport Authority, its directors, officers, employees, representatives and agents from any and all such liability.
6. DRAWING. The prize winner will be chosen at random by Woobox, the sweepstakes third-party software company, from all entries received and verified by the Metropolitan Knoxville Airport Authority. The winner will be chosen on January 31, 2018, at 4:30 PM EST. Winners will be notified in a manner as defined below and will have seven (7) business days after notification in which to accept the prize and confirm their full compliance with the contest rules and regulations. If the notified winner fails to respond with acceptance of the prize, compliance with the contest rules and regulations, or if the winner fails to meet the contest eligibility requirements, the notified winner shall forfeit his/her prize in full, and an alternate winner will be selected in the manner described above.
Notwithstanding the foregoing, at its sole discretion, the Metropolitan Knoxville Airport Authority may require the winner to complete an Affidavit of Eligibility before awarding the prize. If required, the winner, as instructed in the notification, will have (10) business days from the date of notification to sign and return the Affidavit of Eligibility to the Metropolitan Knoxville Airport Authority. If the winner fails to return the Affidavit of Eligibility, then the winner shall forfeit his/her prize in full, and an alternate winner will be selected.
8. NOTIFICATION. The winner will be notified via email address within seven (7) business days of the drawing. The email address used to enter the sweepstakes ("Notification") will be the sole means of Notification for all winning entries received. If an email address is returned as "undeliverable", an alternate winner will be selected in the manner as defined above. Neither the Metropolitan Knoxville Airport Authority nor its advertising or promotion agencies are responsible for any (i) lost, delayed or corrupted data transmissions or other communication related errors with relation to telephone, electronic, hardware, software, network, or Internet malfunctions (ii) other errors, failures or malfunctions, resulting in late, lost, or misdirected Notifications or (iii) any damage to an entrant's system occasioned by receipt of the Notification.
The eligible winner will receive their prize within two (2) weeks of prize acceptance in accordance with the Notification. No refund, substitutions or credit for unused services or items are offered in the package.
9. USE OF WINNER'S NAME, LIKENESS, ETC. Except where prohibited by law, entry into the Sweepstakes constitutes permission to use winners' name and uploaded photo, likeness and/or prize information, without limitation, for promotional purposes without further permission or compensation. Except where prohibited by law, as a further condition of being awarded any prize, winners may be required to execute a consent to the use of their name, likeness and/or prize information, without limitation, for promotional purposes without further permission or compensation.
10. WINNERS LIST AND OFFICIAL RULES. The names of all winners may be posted on www.facebook.com/FlyKnoxville/ after eligibility is confirmed. 11. MISCELLANEOUS. The Sweepstakes and all accompanying materials are Copyright 2018 by the Metropolitan Knoxville Airport Authority and will be governed, construed and interpreted under the laws of the State of Tennessee and the United States. Any action you, any third party or the Metropolitan Knoxville Airport Authority brings to enforce these Official Rules shall be brought in either the state or federal courts located in Knoxville, Tennessee, and you expressly consent to the jurisdiction of such courts. Any and all lawsuits or other disputes that arise relating to the Sweepstakes must be filed within one (1) year from the date that the winner is drawn. If any provision of these Official Rules shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Official Rules and shall not affect the validity and enforceability of any remaining provisions. Entrants agree to be bound by these Official Rules and by the decisions of the Metropolitan Knoxville Airport Authority, which are final and binding in all respects. To the maximum extent permitted by applicable law, the Metropolitan Knoxville Airport Authority reserves the right to change these Official Rules or cancel or suspend the Giveaway at any time, in its sole discretion. Entrants who violate these Official Rules, tamper with the operation of the Sweepstakes or engage in any conduct that is detrimental or unfair to the Metropolitan Knoxville Airport Authority, the Sweepstakes other entrant (in each case as determined by the Metropolitan Knoxville Airport Authority at its sole discretion) are subject to disqualification from entry into the Sweepstakes. The Metropolitan Knoxville Airport Authority reserves the right to prohibit participation in the Sweepstakes of persons whose eligibility is in question or who have been disqualified or are otherwise ineligible to enter the Sweepstakes. Entries will not be returned and will become the exclusive property of the Metropolitan Knoxville Airport Authority. Blackout dates apply. All requested flight dates and times are subject to availability and must be booked at least four weeks prior to departure. The prize will be honored for up to one year from date of sweepstakes. If the airline ticket is for seasonal service, no other airlines will be substituted. No refund, substitutions or credit for unused services or items offered in the package.
All taxes, meals, tips, incidental expenses, travel to and from the Airport and/or other expenses and costs associated with receipt of the Prize is the sole responsibility of the winner.
12. PRIZE PACKAGE - Airline Ticket Giveaway: Four round-trip tickets from McGhee Tyson Airport (TYS) to any of the nonstop Florida destinations that serve TYS on the date the trip is booked. A list of the current nonstop destinations can be found here: http://flyknoxville.com/non-stop-destinations/. Travel complete one year from date of award, unless it is seasonal service – then no other airline will be substituted. Not transferrable. Cannot be bartered or sold. The retail value of this prize is approximately $2,000.
