ATHLINKS® PARTNERSHIP BEAUTYREST®MATTRESS GIVEAWAY OFFICIAL RULES (“Official Rules”)
1.Entry. NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING. The Athlinks® Partnership Beautyrest® Mattress Giveaway (“Giveaway”) begins at 12:00:01 a.m. CST on July 12, 2021 and ends at 11:59:59 p.m. CST on August 12, 2021. You may enter the Giveaway in one of two ways: (a) by visiting the Athlinks® Giveaway online form via the link, https://woobox.com/umcbj9, or (b) by hand, printing your name, address, telephone number on a 3X5 card and mailing it in a stamped envelope to: Life Time®, Attn:Athlinks® Partnership Giveaway, 2902 Corporate Place, Chanhassen, MN 55317 (“Entry’). Limit one (1) Entry per person. All online Entries must be received and all mail-in Entries postmarked by August 12, 2021, 11:59:59 p.m. PST. The date and time your Entry is uploaded to and registered by the link provided above or the date postmarked on the mailed Entry constitutes the official time of your Entry for purposes of the Giveaway. Any Entry that is not posted, filled out or submitted correctly and completely may be disqualified. Any Entry which, in the sole opinion of Athlinks®, is deemed fraudulent in any way or otherwise attempts to circumvent an Entry submission (e.g., use of multiple different email addresses, identities, and/or devices), violates the terms of these Official Rules in any way, may be rejected and result in disqualification. An Entry will only be accepted as noted above. Each Entry becomes the property of Athlinks® and will not be acknowledged or returned. Athlinks® has the right, but not the duty, to disqualify any Entry submitted in connection with this Giveaway that violates any terms herein in Athlinks’® sole discretion. Athlinks® may terminate the Giveaway at any time and without notice.
2.Eligibility. You must be a legal resident of the United States and at least 18 years of age to enter and win. The Giveaway is void in Puerto Rico and the U.S. Virgin Islands. Officers, agents, employees and representatives of Athlinks®, Simmons Bedding Company, LLC and Life Time® and their immediate family members are not eligible for Entry. The Giveaway is void where prohibited or restricted by law, and is subject to applicable federal, state, provincial and local laws and regulations. Entrants are limited to one (1) Entry by one of the means listed in Sections 1(a) or 1(b) above. Mechanically altered or reproduced Entries are not eligible.
3.Requirements of Entries. By submitting an Entry, you warrant and represent that you consent to the submission and use of the Entry in the Giveaway and to its use for the purposes set forth herein. In addition, you agree that you have read these Official Rules and will abide by and be bound by the terms and conditions herein. Furthermore, by submitting an Entry in the Giveaway, you consent to being notified through your provided information in order to fulfill your Prize and otherwise communicate with you in connection with your participation as otherwise described and permitted in these Official Rules. By Entering, you understand and agree you will be sharing personal information with Athlinks®, subject to all applicable Athlinks® policies, terms of use, and terms of service.
4.Drawing. One (1) winning Entry will be randomly drawn on or about August 27, 2021. Subject to the eligibility requirements of these Official Rules, the person(s) whose name is drawn will be awarded the prize. Participants need not be present to win. By entering the Giveaway, you consent to being notified publicly through email to the account used to Enter or by mail to the address provided on the 3X5mail Entry. You also agree to provide your mailing address and home address to Athlinks® in order to fulfill your prize. If any winner fails to respond to notification within five (5) business days of the random drawing date, the prize will be forfeited and another winner will be randomly selected. Athlinks® and Simmons Bedding Company, LLC are not liable if winner fails to receive notices due to spam, junk e-mail or other security settings or for winner’s provision of incorrect or otherwise non-functioning contact information.
5.Winner Affidavit of Eligibility & Release. Potential winners may be required to show proof of being the named winning holder of the selected Entry. In addition, before receiving the prize and as a condition of receiving the prize, winner may be required sign an Affidavit of Eligibility & Release supplied by Athlinks® which, among other disclaimers: (a) releases Athlinks®, Life Time® and Simmons Bedding Company, LLC and their respective subsidiaries, agents, agencies, affiliates, promoters, officers, directors, employees and related persons from any and all liability related to this Giveaway and the receipt and use of the prize; and (b) grants Athlinks®, Life Time® and Simmons Bedding Company, LLC the right to publish the winner’s name, city/state, photograph, voice, testimonial, approved biographical information, or other likeness and/or prize information or personal exposition, and or any edited portion thereof, for promotional, advertising and/or publicity purposes in any media, now and hereafter known throughout the world in perpetuity, without compensation or notice to, or further consent of, the winner to the extent permitted by law. Winner must complete, sign and return the notarized affidavit of eligibility and release to Athlinks® before taking delivery of prize. Failure to do so will result in disqualification, forfeiture of the prize and selection of an alternate winner. Any information provided under these Official Rules, including, without limitation, any information provided in connection with an Entry or participating in the Giveaway, shall be subject to the Athlinks® terms of use/service and privacy policy/notice posted on the applicable website (athlinks.com).
6.Odds. The odds of winning depend upon the number of Entries received.
7.Prizes. The Giveaway prize (“Prize”) is: One (1) Beautyrest Harmony Lux Hybrid Mattress (ARV $2100). Actual/appraised value may differ at time of Prize award. Prize must be redeemed within 30 days of winner’s acknowledgement of their winning Entry. Prize is non-refundable, non-transferable, and subject to all other terms and conditions of Athlinks®. Winner shall be responsible for all other fees, taxes, surcharges, or any other incidental costs.
8.Release. By entering the Giveaway, each participant agrees to follow these Official Rules and to release, discharge, and hold harmless Athlinks®, Life Time® and Simmons Bedding Company, LLC, their respective affiliates, subsidiaries, agents, together with the present and future officers, directors, agents, employees and representatives of each of them, from any and all responsibility or liability whatsoever for any property loss, damage, personal injury, or death, in connection with the awarding, receipt, acceptance, use and/or misuse of any prize provided pursuant to the Giveaway and/or any person’s participation in the Giveaway, technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; the unavailability or inaccessibility of any transmissions, telephone, or Internet service; unauthorized human intervention in any part of the entry process or the Giveaway; electronic or human error in the administration of the Giveaway or the processing of entries. If contest requires a submission of original work by entrant, entrant represents and warrants that their Entry is an original work of authorship, and does not violate any third party’s proprietary or intellectual property rights. If your Entry infringes upon the intellectual property right of another, entrant will be disqualified at the sole discretion of Athlinks®. If the content of your Entry is claimed to constitute infringement of any proprietary or intellectual proprietary rights of any third party, you shall, at your sole expense, defend or settle against such claims. You shall indemnify, defend, and hold harmless Athlinks®, Life Time® and/or Simmons Bedding Company, LLC from and against any suit, proceeding, claims, liability, loss, damage, costs or expense, which Athlinks® Life Time® and/or Simmons Bedding Company, LLC may incur, suffer, or be required to pay arising out of such infringement or suspected infringement of any third party’s right.
9.General. All interpretations of these Official Rules shall be made by Athlinks®, whose decisions and interpretations shall be final and binding. Athlinks® reserves the right to cancel, terminate or suspend this Giveaway or any part of this Giveaway for any reason. Athlinks® reserves the right, at its sole discretion, to disqualify any individual it reasonably suspects or believes to be acting in violation of these rules. Athlinks® shall not be responsible for lost, incomplete, misdirected, misdelivered, misplaced, stolen, illegible, mutilated or defaced entries or for entries that are not received by Athlinks® for any reason. Except where prohibited, all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant(s) or Athlinks® in connection with the Giveaway, shall be governed by, and construed in accordance with, the laws of the State of Minnesota, without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than the State of Minnesota. In addition, any dispute relating to the Giveaway (including these Official Rules) shall be brought in the appropriate state or federal court having jurisdiction over the subject matter located in Hennepin County, State of Minnesota. Entrants hereby irrevocably consent to the personal jurisdiction of said courts and waive any claim of forum non conveniens or lack of personal jurisdiction that they may have.
10.Winner List. For notification of the winners submit your request in writing by May 31, 2021, to Life Time® c/o Athlinks® - Partnership Giveaway, 2902 Corporate Place, Chanhassen, MN 55317.
