RULES & REGULATIONS
1. CONTEST.
The Sponsor of the $5K in 5 Days Contest (the “Contest”) will give away $1,000 (the “Grand Prize”) each week for 5 consecutive weeks according to the terms and conditions of these rules. The Contest will run from June 29, 2020 to August 1, 2020. Radio broadcast stations KONY, KPLD, KZHK, KCLS, JUAN are owned by Canyon Media and are referred to in these rules as the “Station”.
2. SPONSOR.
The Contest is sponsored by Stephen Wade Auto Center and Canyon Media (the “Sponsor”).
3. ELIGIBILITY.
Except as set forth below, all individuals that are, as of June 29, 2020, residents of the State of Utah, Arizona or Nevada over the age of 18, and have a valid Utah, Arizona or Nevada driver’s license and social security number, are eligible to participate in the Contest. Identification cards or ITIN numbers will not be accepted, only a current, valid driver’s license and social security number will be allowed. The Sponsor, and its respective affiliates, subsidiaries, agencies and divisions, participating promotional partners, and each of their respective employees and immediate family members are ineligible to participate in the Contest. The Contest is void where prohibited by law. Each individual that participates in the Contest agrees to be subject to and abide by these rules. Any deviation from these rules on the part of any participant will render that contestant ineligible. All decisions of the Sponsor are final.
4. NO PURCHASE IS NECESSARY TO ENTER OR WIN; VOID WHERE PROHIBITED BY LAW.
5. HOW TO ENTER.
Only eligible individuals that qualify for a chance to win will have a chance to participate in the Grand Prize Drawing and win. To qualify for a chance to win, an eligible individual must do one of the following:
1. Listen to KONY, KPLD, KZHK, KCLS, JUAN daily and complete the task assigned which may consist of a phone call, Facebook participation, website participation, etc.
OR
2. Take a selfie at any of the selfie stations positioned at Washington City Community Center, Sand Hollow Aquatic Center, Red Cliffs Mall, or any of the Stephen Wade dealerships and post it to your social media with #WadeRedTag (post or profile must be public. Visit waderedtag.com for details.)
OR
3. Complete a registration form provided by Stephen Wade Auto Center at any of the Stephen Wade Auto dealerships. Note: No purchase is necessary, however if you purchase a vehicle from any Stephen Wade Dealership during the month of July 2020, you may choose to enter and will be bonused an additional entry into the drawing to be qualified to be a finalist at one of the Grand Prize give-aways.
Listeners of the radio stations may enter-to-qualify at each of the radio station websites. 2 individuals who have entered on the website will be chosen at random each Friday by each radio station. (2 individuals from each station + 5 stations = 10 total qualifiers) Those individuals chosen from the radio stations will be qualified to participate in the Grand Prize Drawing (herein so called). Such individual is referred to as a “Qualified Individual”. A total of 10 individuals will be qualified each week from the radio stations website starting June 29th and running until July 31st. Those 10 will be able to participate at the event on the Saturday in the week in which they are selected.
Also, each Friday an employee or agent of the participating Station will randomly draw from the completed registrations properly submitted at the dealerships, from the social media posts with #WadeRedTag and from the purchased car entries.
A total of 50 individuals will be qualified each Friday including July 3rd, July 10th and July 17th, July 24th and July 31st . These individuals drawn will be identified as “Qualified Individuals.” There will not be more than 50 Qualified Individuals selected to participate in the Grand Prize Drawing each week.
On July 4, 11, 18, 25 and August 1, 2020, on or about 10:00 am, at Stephen Wade Auto Center, 250 Hilton Drive, St George, Utah 84770, the Grand Prize Drawings will be held. Each Qualified Individual who wants to participate in the Grand Prize Drawing must arrive and check in with the Sponsor no later than 9:45 a.m. with his or her current Utah, Arizona or Nevada drivers license (each Qualified Individual that has properly signed in at the Grand Prize Drawings is referred to as a “Final Contestant”).
A qualified individual who is not able to attend may substitute another person by e-mailing brent@canyonmedia.net before 9:00 am on the day of the give-away. Any Qualified Individual who fails to check in by 9:45 a.m., or any Qualified Individual deemed ineligible, will be disqualified and not allowed to participate in the Grand Prize Drawing. At time of check in, the Qualified Individual will receive a number. That number will also be put into a drawing box and will be used to identify the winner of the contest.
At 10:00 a.m. the drawing will commence in a reverse –drawing format. The first number that is picked will be identified and the person with that number will be eliminated from the contest. The drawing will continue in the same format until the last number in the box is left. The grand prize (not cash prize) will be given to the second-to-last number drawn. When the last number is drawn, the person with that number will be considered the winner of the cash prize and will be awarded $1,000. Smaller secondary prizes may be given away during the reverse drawing, at random. (Example: the next number pulled from the box will win a prize).
If the winner is later disqualified for any reason, the Sponsor will randomly draw a new winner from the other Final Contestants and such new winner will be notified in writing.
6. PRIZE INFORMATION.
Only one Grand Prize per week will be awarded. The Grand Prize is $1,000. The Grand Prize must be claimed no later than Sept 1, 2020. If the Grand Prize is not claimed by September 1, 2020, the winner will be disqualified. The odds of winning depend on the number of participants. The Sponsor reserves the right to substitute any prize for cash or other similarly-valued consideration.
7. PRIZE RESTRICTIONS/CONDITIONS.
The winner is solely responsible for any income taxes associated with the Grand Prize and will receive a 1099 form from Stephen Wade Auto Center. Any Contest prize is non-transferable and not assignable. By entering the Contest, each participant consents without limitation and without receiving additional compensation, to the use of his or her name, voice, photograph, and/or likeness by Sponsor and its respective affiliates and promotional partners for advertising and promotional purposes, including, without limitation, on radio broadcast stations or on the internet. Failure to make promotional appearances requested by Sponsor or grant such rights as reasonably requested by Sponsor may result in disqualification.
8. RULES; WINNERS LIST.
Copies of these rules and identification of the winner are available between 9:00 a.m. and 5:00 p.m., local time, at 3143 S. 840 E. Suite 100, St George, UT 84790 or Stephen Wade Auto Center 150 West Hilton Drive, St George, UT 84770 or will be provided to you if you send a stamped, self-addressed envelope, that identifies the Contest, to the same address. The winner will be identified on the Station after the winner has been awarded the Grand Prize.
9. GENERAL CONDITIONS.
Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest, to be acting in violation of these rules, or to be acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person, or for any other reason deemed reasonable by Sponsor. If after the Contest has begun changes or updates in these rules are deemed necessary by Sponsor, all changes will be announced on the Station on the day that the change takes effect. Sponsor reserves the right to change these rules at any time as it determines necessary in its sole discretion. Sponsor reserves the right to terminate the Contest if fraud, misconduct or technical failures destroy the integrity of the Contest, or for any other reason deemed reasonable by Sponsor.
10.LIMITATIONS OF LIABILITY.
All participants agree to release and hold harmless Sponsor and all of its respective affiliated companies and all of their respective directors, officers, employees, agents, legal counsel, and/or participating promotional partners from all losses, damages, penalties, claims, actions, suits, costs, and expenses of any kind whatsoever and any property damage, personal injury, or death to any participant or third person caused by or arising out of or in connection with participation in the Contest or with the use of any prize awarded. Sponsor is not responsible for any incorrect or inaccurate information and assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to the Contest or the equipment used in its administration.
11.DISPUTES.
As a condition to participating in the Contest, participants agree that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Contest, shall be resolved individually, without resort to any form of class action, exclusively, before a court located in Salt Lake City, Utah having competent jurisdiction, which Court shall apply the laws of the State of Utah without regard for the doctrines of Conflict of Law. Further, in any such dispute, under no circumstances will participants be permitted to obtain awards for, and each hereby waives all rights to claim punitive, incidental or consequential damages, or attorneys’ fees.
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCE OF WINNING. VOID WHERE PROHIBITED.
Unless otherwise specified by Radio Station KONY COUNTRY (KONY FM), The Planet (KPLD FM), or The Hawk (KZHK FM) (the “Station”), these rules cover routine contests and promotions conducted by the Station. These rules may be amended by separate specific rules for major contests or promotions conducted by the Station or its sponsors.
The contest or promotion (the “Promotion”) will take place during the dates and times specified in the official rules of the Promotion (the “Promotion Period”) or as announced on-air. The Station may change the dates and/or terms of the Promotion without prior notice. Any material changes will be broadcast on the Station and, if applicable, posted on its website located at (KONY) http://www.999konycountry.com, (The Planet) http://www.planet941.com, (The Hawk) http://www.959thehawk.com , (KZNU FOX NEWS) www.foxnews1450.com, (KCLS) http://www1015kcls.com.
Promotions conducted on-air that require telephone responses to “cues to call” are only official when heard on-air via radio. Due to delays with the Station’s online streaming of its broadcast signal, listeners to the online stream may not be able to participate in or be disadvantaged in participating in certain Promotions.
To be eligible to enter or participate in the Promotion, listeners must follow the instructions set forth in the official rules of the Promotion or as announced on-air and must fulfill all of the eligibility requirements of the Promotion. Unless otherwise specified, the Promotion is open to all listeners of the Station who are legal U.S. residents, 18 years of age or older and who live within the Southern Utah or surrounding areas. Employees of the Station, its licensee, the licensee’s parent, subsidiary and affiliated entities, Station’s advertising and promotional agencies, it’s participating sponsors, other radio stations in the Southern Utah or surrounding area and the members of their immediate families and/or households are ineligible to participate or win. Listeners are eligible to win a prize in a Promotion conducted by the Station only once every six (6) months if the prize is valued over $600. Only one winner per household is permitted in any Station-conducted Promotion. For on-air Promotions, there is no limit to the number of times a listener may attempt to call-in or text; however a listener may only qualify once. Listeners can only win a prize valued at $50 or more or event tickets valued at $100 or more (per ticket) from the Station once every 30 days but remain eligible to win prizes of $500 or greater, which can be won only once every three (3) months.
Entrants are required to provide truthful information and the Station will reject and delete any entry that it discovers to be false or fraudulent. The Station will disqualify any entry from individuals who do not meet the eligibility requirements, and the Station will also delete any online entry knowingly received from persons under the age of 13 in compliance with the Children’s Online Privacy Protection Act.
Promotion prizes and their values will be indicated when the Station announces the Promotion. Unless otherwise announced, all prizes or prize certificates must be picked up at the offices of the Station, 619 S. Bluff St. Tower 1 STE 300, St. George, UT 84770. Prizes may be claimed during regular business hours (between 8:30am and 5:00pm, Monday through Friday). Offices are closed for all major holidays. Promotion winner(s) will be required to present valid government-issued photo identification and provide their complete address, date of birth and phone number to claim a prize. Unless otherwise permitted by the Station, winner(s) must claim his or her prize in person, and a prize cannot be claimed by third parties on behalf of the winner. If a Promotion is open to entrants under the age of 18 and a winner is under the age of 18, a parent or legal guardian must claim the prize. Failure to comply with these requirements will result in the forfeiture of the prize. A winner will forfeit any prize or prize certificate not claimed within thirty (30) days (or sooner for time sensitive prizes) of winning. Unless otherwise specified or required by law, if a prize is not claimed no alternate winner will be selected and the prize will become the property of the Station. The Station, solely at its discretion and only with the consent of the winner, may opt to deliver the prize to the winner by mail or overnight courier. In such event, the winner assumes the risk of the prize’s loss and the Station will not be responsible for the safe arrival of the prize or prize certificate. There is no substitution, transfer or cash equivalent for prizes, except that the Station may, at its sole discretion, substitute prizes of comparable value or cash. Each prize is expressly limited to the item(s) announced by the Station and does not include taxes, gratuities or any other expenses. Other restrictions may apply.
Decisions of the Station’s management with respect to the Promotion are final.
Potential winner(s) will be selected and notified of their prize in the manner announced by the Station. Promotion winner(s) must execute and return any required Affidavit of Eligibility and/or Release of Liability Prize Acceptance Form within thirty (30) days of winning or being notified of winning (or sooner for time sensitive prizes) or prize will be forfeited and an alternate winner may be selected. If a potential winner cannot be contacted, fails to sign and return the required affidavit of eligibility and/or liability/publicity release within the required time period, or if a prize or prize notification is returned as undeliverable, the potential winner forfeits the prize.
By participating in the Promotion, the winner(s) agree to have his or her name, voice and likeness used in any advertising or broadcasting material related to such Promotion, without further compensation, and (where permitted by law) to sign a publicity release confirming such consent prior to acceptance of the prize.
Prior to awarding any prize or prize certificate, the Station in its sole discretion may require the winner of such prize (and his or her travel companion(s), if any) to sign a liability release, which holds harmless the Station, its licensee, its parent, subsidiary, and affiliated entities, their respective officers, shareholders, directors, employees, agents and representatives and all of their successors and assigns against any and all claims or liability arising directly or indirectly from the prize or participation in the Promotion. The Station is not responsible for (i) lost, stolen, mangled, misdirected, postage due, illegible, incomplete or late entries; (ii) telephone or mobile service outages, delays, busy signals, facsimile transmission errors, equipment malfunctions and any other technological difficulties that may prevent an individual from completing his/her telephone call or from sending a text message (if applicable, standard text messaging fees may apply, and the Station is not responsible for any fees incurred by an entrant for this method of entry); or (iii) entries not received due to difficulty accessing the internet, service outage or delays, computer difficulties or other technical difficulties.
Station reserves the right to cancel, terminate or modify the Promotion if it is not capable of completion as planned, including, without limitation, as a result of infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort. The Station reserves the right to make changes in the rules of the Promotion, including, without limitation, the substitution of a prize or equivalent value, which will become effective upon announcement. If due to circumstances beyond the control of the Station, any event related to the Promotion or prize is delayed, rescheduled, postponed, cancelled or has a change of venue, the Station reserves the right, but is not obligated, to cancel or modify the Promotion and shall not be required to award a substitute prize. The Station is not responsible for typographical or other errors in the printing, the offering or the administration of the Promotion, or in the announcement of a prize.
The Station, in its sole discretion, reserves the right to disqualify any person tampering with the entry process or the operation of the Station’s website. Failure to comply with the rules of the Promotion may result in a contestant’s disqualification and/or forfeiture of any prize or prizes. If the Station makes a good faith determination that an entrant has cheated or committed fraudulent activity in connection with a Promotion, the Station reserves the right to disqualify that entrant from entering and/or winning future Promotions.
For the official rules of a Promotion, send a self-addressed stamped envelope for receipt by the end of the Promotion Period to Canyon Media Broadcasting, 619 S. Bluff St. Tower 1 STE 300 St. George, UT 84770, Attn: Promotions Department Promotion Rules. For the names of the prize winners send a self-addressed stamped envelope for receipt within 60 days following the end of the Promotion Period to the attention of Promotion Winner Lists at the above address. In either case please be sure to specify the name of the Promotion for which you are requesting the rules or winners list.
