Official Rules

The following Contest is intended for participants in the United States and Canada (excluding residents of Quebec) only and shall be construed and evaluated according to the laws of the United States.  

NO PURCHASE NECESSARY TO ENTER OR WIN. PURCHASE WILL NOT   INCREASE YOUR CHANCES OF WINNING. YOU HAVE NOT YET WON. You understand that you are providing your information to Instituto Costarricense de Turismo (ICT) ("Sponsor"). Contest Sponsor will be collecting personal data about entrants online, in accordance with its privacy policy. This is a perfect time of the year to think about Who’s Essential to you and being thankful for what you have. The Who's Essential To You contest serves as a Contest for individuals to recognize and show appreciation for those whom they consider essential

1. Eligibility:

No purchase necessary. Open to legal residents of the 50 United States and the District of Columbia,(“U.S.”) and Canada (excluding residents of Quebec), who are at least 18 years of age or older (OR THE AGE OF MAJORITY IN YOUR STATE OF RESIDENCE, WHICHEVER IS OLDER) at the time of entry. The Who’s Essential To You Contest (the "Contest") is governed by US law and is subject to all applicable federal, and state laws and regulations. Employees, officers and directors of Instituto Costarricense de Turismo (ICT), Apartado Postal 777-1000 San Jose, Costa Rica (“Sponsor”), Cohen-Friedberg Associates, LLC (“Administrator”), MMGY Global (“Judge”) and their respective parents, affiliates, subsidiaries, advertising, promotion and fulfillment agencies (collectively, the “Promotion Entities”) and members of the immediate family or household of each are not eligible to participate. Immediate family member is defined as a parent, sibling or any person residing in same household as employee of the Promotion Entities. 

This Contest is void where prohibited by law or regulation. 

2. Agreement to Official Rules: 

Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s, Administrator’s, and Judge’s decisions, which are final and legally binding in all respects. 

3. Timing: 

Contest entry begins Thursday, November 26, 2020 at 12:00:00 p.m. Eastern Time (“ET”) and ends Sunday, January 31, 2021 at 11:59:59 p.m. ET ("Contest Period"). The Contest will consist of one (1) judging period to select Three (3) winning entries (see below for prizes Rule #5). Each eligible entry will be judged by the Judge based on predefined judging criteria, as later defined in these Official Rules, to determine the winning entries. The Judge’s designated computer server is the official time-keeping device for the Contest.  Winning entries will be notified the week of February 8, 2021.

4. Winner Section & Notification: 

Potential winners will be notified by email or phone within three (3) business days of the applicable winner selection date (“Prize Notification”) and will be required to respond and provide all required information in order to receive their prize. Potential winner must reply within forty-eight (48) hours of first notification. Sponsor, Administrator or Judge, shall have no liability for any notification that is lost, intercepted or not received for any reason. If, despite reasonable efforts, any potential winner does not respond within forty-eight (48) hours of the first notification attempt, or if prize notification is returned as unclaimed or undeliverable, such potential winner will forfeit prize and at Sponsor’s discretion, an alternate potential winner may be selected. If any potential winner is found to be ineligible or if the potential winner has not complied with these Official Rules or declines a prize for any reason, such potential winner will be disqualified and at Sponsor’s discretion, an alternate potential winner may be selected. The alternate winner will be defined as the entry with the next highest Judge’s score (“Alternate Winner”).

5. Prizes: There will be a total of fifteen (15) Prizes:

Grand Prize: Winning Nominator and Nominee will jointly* travel to Costa Rica.  Prize includes the following:
 

            Approximate retail value of this prize package is $5,200.

*If the Nominee is unable to travel on the date selected, the Nominator may select an alternate travel companion. All changes must be made prior to booking the vacation

Prizes are non-transferable, non-refundable, and no substitutions will be made except as provided herein, in the Sponsor’s sole discretion. Prize is not redeemable for cash, unless otherwise specified herein. Sponsor reserves the right to substitute a particular prize for one of comparable or greater value. Winner is responsible for any and all applicable local, state, and/or federal taxes and fees. Prize details are at Sponsor’s sole discretion.

Prizes for Contest include only those items expressly listed above in the applicable description of the prize. Any costs associated with the use or ownership of any prize is the sole responsibility of the Winner. Prize is awarded "as is" with no warranty or guarantee express or implied by Sponsor and/or Administrator. Sponsor and/or Administrator disclaims all and any liability for the actual provision, quality or nature of any third-party product or services accepted by the winner. The awarding of any prize is contingent upon full compliance with these Official Rules. Entrants agree to be bound by Official Rules and agree that if winner fails to provide proof of identity, refuses to provide required signed documents listed below in section 6 “Winner Requirements”, is found to have violated the Official Rules or otherwise does not meet eligibility criteria, prize will be forfeited and awarded to an Alternate Winner. Entrants understand that neither Sponsor nor Administrator is liable for injuries, losses or damages of any kind arising from participation in this promotion and acceptance, possession and use of prize. Neither Sponsor and/or Administrator is responsible for any typographical or other error in the printing of the offer, administration of the Contest or in the announcement of the prize. Decisions of Sponsor and/or Administrator are final and binding in all respects. No substitution of prizes is allowed. Sponsor and/or Administrator will not ship any prize to addresses outside of the fifty (50) United States or District of Columbia.

6. How to Enter: 

1. You (the “Nominator”) must Nominate a person (the “Nominee”) “Who’s Essential To You” along with a brief short essay not to exceed (200) words sharing the reason that person is “essential to you” (“Eligible Entry”). You may not nominate yourself.

           

2. Your Eligible Entry must comply with these Official Rules and may not contain any of the Prohibited Content set forth below. 

3. Limit: You may enter a unique entry as often as you like during the Contest Period.

VIA MICROSITE:  Visit https://woobox.com/w9syp4 and complete all the required information fields on the entry form including entering an Eligible Entry along with the nominated person’s name and email address. Once you complete and submit the registration, your entry will be reviewed for compliance and if approved your Eligible Entry will be included in the judging process.  

Proof of delivery or receipt of entry will not be deemed by the Sponsor as proof of entry into the Contest.  All entries become the sole property of Sponsor.  Entries will not be acknowledged or returned.  All entries are subject to verification and approval by the Sponsor. Entries that do not meet the requirements for the entry specified below or otherwise do not comply with the Official Rules herein will be disqualified. Any attempted form of entry other than as described herein is void. Sponsor will determine in its sole discretion, what constitutes a valid entry. All materials submitted become the property of the Sponsor and will not be returned or acknowledged.  

Entry submissions may not contain, as determined by the Sponsor or Judge, at their sole discretion, any 

a) sexually explicit or suggestive; violent or derogatory of any ethnic, racial, gender, religious, professional or age group; profane or pornographic; contains nudity; 

b) promotes alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing); promotes any activities that may appear unsafe or dangerous; promotes any particular political agenda or message; 

c) is obscene or offensive; endorses any form of hate or hate group; 

d) defames, misrepresents or contains disparaging remarks about other people, companies, or travel destinations;  

e) contains any personal identification, such as personal names, photos or e-mail addresses; 

f) communicates messages or images inconsistent with the positive images and/or good will to which the Sponsor wishes to associate; 

g) infringes the rights of any third party; and/or

h) violates any law. 

By entering, entrant affirms that he/she has the consent of all parties mentioned in the entry essay to upload/enter such essay and enter it into the Contest, and unconditionally assigns and transfers to Sponsor all rights, title, interest and claim, which it now has or may in the future have to his/her essay entry and any element(s) embodied therein. Sponsor and its designees shall have the right to edit, publish, use, adapt, reproduce, exploit, modify or dispose of any entry and all elements of such entry, online, in print, film, television, or in any other media now or hereafter known throughout the world. 

Limit: You may enter a unique essay entry as often as you like. Entries generated by script, macro or other automated means or any means that subvert, or are likely to subvert, the entry process will be void.  LIMIT: One (1) prize per person. 

7. Judging:

Each Eligible Entry will be judged based on the following judging criteria:

In case of a tie, a third-party Judge will be selected by the Sponsor and at its sole discretion, to judge the tied entries to determine the winner. 

 

Requirements: Acceptance of prize shall constitute winner’s agreement and consent to Sponsor’s and its designees’ use of any winner’s name, city, state, likeness, photo and/or prize information in connection with this Contest for promotional, advertising or other purposes, in any manner, worldwide, in any and all media now known or hereafter devised, including the Internet, without limitation and without further payment, notification, permission or other consideration, except where prohibited by law.  If a selected Winner cannot be contacted, fails to claim their prize, fails to comply with all rules, is unable to or fails to respond to the winner notification within two (2) calendar days of notification, the Winner is disqualified and the prize is forfeited. If forfeited, an Alternate Winner will be selected.

8. Release: 

By entering, you agree to release and hold harmless Released Parties (as defined below) from and against any and all liability, claim or cause of action, including, but not limited to, injuries, death, loss or damage of any kind arising from or in connection with this Contest or receipt or use or misuse of any prize. 

Any winner of a prize valued at $600 or more will be required to complete and return an Affidavit of Eligibility, provide identification, Release of Liability and Publicity Release (where permitted by law) (collectively, the “Affidavit” or “Declaration” in Canada) within seven (7) calendar days of the first prize notification. In the event: (a) potential winner cannot be reached for whatever reason after a reasonable effort has been exerted or the potential winner notification or Affidavit is returned as undeliverable; (b) potential winner declines or cannot accept, receive or use the prize for any reason; (c) of noncompliance with the above or within any of the aforesaid time periods; (d) potential winner is found to be ineligible to enter the Contest; (e) potential winner cannot or does not comply with the Official Rules; or (f) potential winner fails to fulfill the Affidavit-related obligations, the potential winner shall be disqualified, and the next entry with the highest Judge’s score will be selected. 

9. General Conditions: 

Sponsor reserves the right to cancel, suspend, and/or modify this Contest, or any part of it, if any fraud, technical failures or any other factor impairs the integrity or proper functioning of this Contest, as determined by Sponsor in its sole discretion.  If terminated, Sponsor may, in its sole discretion, determine winner from among all non-suspect, eligible entries received up to time of such action or as otherwise deemed fair and appropriate by Sponsor. The Judge, in its sole discretion, reserves the right to disqualify any individual it finds to be tampering, or attempting to tamper, with the entry process or the operation of this Contest or to be acting in violation of the Official Rules of this or any other promotion or in an unsportsmanlike or disruptive manner, and to void all associated entries.  

10. Limitations of Liability: 

Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrant, printing, typographical or other errors or by any of the equipment or programming associated with or utilized in this Contest; (2) technical failures of any kind, including, but not limited to, malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or this Contest; (4) printing, typographical, technical, computer, network or human error which may occur in the administration of this Contest, the uploading, the processing or judging selection of entries, the announcement of the prize or in any Contest-related materials; (5) late, lost, garbled, misdirected, inaccurate, incorrect, undeliverable, damaged or stolen entries or mail; (6) costs associated with claiming or redeeming the prizes; nor (7) loss or damages resulting from an entrant’s connection to the internet via any of the websites contained herein.  Released Parties are not responsible for any incorrect, mistranscribed, misdirected or undeliverable entries, E-mail transmissions, incorrect announcements of any kind, or for any technical problems of any kind, malfunctions of computer systems, servers, providers, hardware/software, lost or unavailable network connections or failed, incomplete, garbled or delayed computer transmission or any combination thereof.  Sponsor assumes no responsibility for late, lost, incomplete, inaccurate or damaged entries, or undeliverable E-mails resulting from any form of active or passive E-mail filtering by a user's Internet service provider and/or E-mail client or for insufficient space in user's E-mail account to receive E-mail.  Sponsor does not accept responsibility for any damage (whether material or non-material) caused to entrants, to their computer equipment or to data which is stored on them, or to their personal, professional or commercial activities. Proof of submitting entries will not be deemed to be proof of receipt by Sponsor, Judge or Administrator. In the event of a dispute regarding the identity of the person submitting an online entry, the entry will be deemed submitted by the person whose name the corresponding account is registered to. All decisions regarding the identity of the authorized registrant shall be made by Sponsor and Administrator in its/their sole discretion.

11. GOVERNING LAW/JURISDICTION: 

The Contest is governed by, and will be construed in accordance with, the laws of the State of CALIFORNIA, and, except where prohibited, each entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in CALIFORNIA if the controversy or claim is not otherwise resolved through direct discussions or mediation, it shall THEN be resolved by FINAL AND binding arbitration administered by JUDICIAL ARBITRATION AND MEDIATION SERVICES, INC., in accordance with its Streamlined Arbitration Rules and Procedures or subsequent versions thereof (“JAMS Rules”).  The JAMS Rules for selection of an arbitrator shall be followed, except that the arbitrator shall be experienced and licensed to practice law in CALIFORNIA. All proceedings brought pursuant to this paragraph will be conducted in the STATE OF CALIFORNIA.  THE REMEDY FOR ANY CLAIM SHALL BE LIMITED TO ACTUAL DAMAGES, AND IN NO EVENT SHALL ANY PARTY BE ENTITLED TO RECOVER PUNITIVE, EXEMPLARY, CONSEQUENTIAL, OR INCIDENTAL DAMAGES, INCLUDING ATTORNEYS’ FEES OR OTHER SUCH RELATED COSTS OF BRINGING A CLAIM, OR TO RESCIND THIS AGREEMENT OR SEEK INJUNCTIVE OR ANY OTHER EQUITABLE RELIEF.

 12.   ARBITRATION PROVISION

By participating in this Contest, each entrant agrees that any and all disputes the entrant may have with, or claims entrant may have against, the Released Parties relating to, arising out of or connected in any way with (i) the Contest, (ii) the awarding or redemption of any prize, and/or (iii) the determination of the scope or applicability of this agreement, will be resolved individually and exclusively in the courts of CALIFORNIA. 

13. By participating and winning a prize, entrants and Winners agree to release and hold harmless Sponsor, Judge, Administrator, and each of their respective parents, affiliates, subsidiaries and agents, and their respective officers, directors, employees and agents ("Released Parties") from and against any claim or cause of action arising out of participation in the Contest or receipt or use of the prize, including any travel or activity related thereto including, but not limited to: (a) any technical errors associated with the Contest, including lost, interrupted or unavailable Internet Service Provider (ISP), network, server, wireless service provider, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone, cellular tower or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failure or difficulties; (b) unauthorized human intervention in the Contest; (c) mechanical, network, electronic, computer, human, printing or typographical errors; (d) lost, late, incomplete, garbled, illegible, undelivered, stolen, damaged, delayed, application downloads; (e) any other errors or problems in connection with the Contest, including without limitation, errors that may occur in the administration of the Contest, the announcement of Winners, the cancellation or postponement of the event; (f) injury, death, losses or damages of any kind to persons or property which may be caused directly or indirectly, in whole or in part, from entrants or Winner's participation in the Contest or acceptance, receipt or use/misuse of the prize (including any travel or activity related thereto). Entrant and/or Winners further agree that in any cause of action, the Released Parties liability will be limited to the cost of entering and participating in the Contest, and in no event shall the entrant or Winner's be entitled to receive attorneys fees. Released Parties are not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Contest. Entrants and/or Winner's waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.

14. If any provision of this document is deemed to be invalid, it shall be considered deleted herefrom and shall not invalidate the remaining provisions.

16. If you choose to participate in this Contest, we will request certain personally identifiable information from you including but not limited to name, address, daytime phone number, age and e-mail address. Participation in these activities is entirely voluntary. IF YOU DO NOT WISH TO SHARE YOUR PERSONALLY IDENTIFIABLE INFORMATION, PLEASE DO NOT ENTER THIS CONTEST. We use this information to notify Contest winners and award prizes.

Sarchí is also home to national coffee and sugar cane production farms where travelers can learn about two of Costa Rica’s most important exports. CENTRAL VALLEY

NORTH PACIFIC

With more than 400 miles of coast line, the Guanacaste tourism area comprises the Pacific Coast area from the border of Nicaragua to the Bongo River estuary in the Nicoya Peninsula. This tourism area is home to a very important section of Costa Rica’s cultural and natural heritage. This area boasts a significant number of protected areas including water, land, mountain, and coastal ecosystems that are teaming with life. The incomparable beauty of its landscapes, which ranges from tropical dry forests to lowland mountain forests, its warm climate, as well as its flourishing nature have made Guanacaste one of the most heavily visited areas by locals as well as international tourists and is one of the most developed areas because of its high level of investment in the hotel industry that is in high demand. All along the Guanacaste coastline are a number of beaches where you can swim in their warm Pacific Ocean waters. Guanacaste receives very little rain and consistent heat from November to April, which makes for optimal swimming weather year-round. There are two commercial centers located in the northern area: Liberia and Santa Cruz, which, in turn, are linked with five important tourism development centers: Papagayo, El Coco, Flamingo, Conchal, and Tamarindo. In the southern area, the commercial center is Nicoya with Samara being the development center. Guanacaste is also home to the town of Nicoya, one of the nine Blue Zones in the world, a geographic region of the world where people live the longest.

CENTRAL PACIFIC

This region of the country stretches from the city of Puntarenas to the mouth of the Río Barú in the area known as Dominical de Osa. It has three cities attractive to tourists and well developed for tourism: Jacó, Puntarenas and Quepos. The region also comprises the islands in the Gulf of Nicoya, as these are mainly accessed from Puntarenas. The Puntarenas touristic area is one of the most important tourism regions in Costa Rica, and is a primary access point for lodging, distribution, port of call, and excursions. The Nicoya Peninsula has very important touristic areas, including, Tambor, Santa Teresa, and Montezuma, all with very beautiful natural and beach areas. Visitors can also find the Cabo Blanco Absolute Nature Reserve, San Lucas, Chira, Tortuga, and Coco Islands. The Monteverde area, located just north of Puntarenas, has both national and international significance because of its conservation efforts and lifestyle centered around nature. Santa Elena is the hub for commercial services and tourism-based businesses. Near Quepos, the small mountain towns of Santa Juana and Coopesilencio offer rural tourism.

SOUTH PACIFIC

At the entrance of the South Pacific is the city of Pérez Zeledón, which is home to popular tourism attractions, such as the Nauyaca Waterfalls, the town of Platanillo and the Barú River. This coastal area is also home to beaches and marine attractions, such as whale and dolphin watching, mangroves, sport fishing, surfing and professional diving. Named after the humpback whales that migrate to the park in mid-July and October, and again in December through March, Marino Ballena National Park is one of the country’s newest national parks and is committed to the conservation of the rich marine ecosystems found within its boundaries. In fact, the park contains some of the largest coral formations on the Pacific side of Central America. Ecotourism is what draws many visitors to this part of the country, which features many protected areas, botanical gardens and impressive waterfalls. Two important protected areas are the Corcovado National Park, which National Geographic defines as “the planet’s biologically richest place,” and the Humanity Biosphere Preserve, declared as Humanity Patrimony and part of the Amistad International Park. The beaches of Platanares, Zancudo and Pavones are popular among the locals and tourists for their surf, and the Cordillera de Talamanca’s Mountain subunit is an important mountain access center to Chirripó National Park and the Friendship World Patrimony site.

CARIBBEAN COAST

The Costa Rican Caribbean extends from the San Juan River to the Sixaola River along the Panamanian border. It is home to the Bribri, the largest first nation population in Costa Rica, who influenced the region’s rich culture and traditions. The city of Limón is located in the center of the tourist sector with a port and many tourism areas. In the northern sector, the main attractions involve the green tortoises nesting grounds along the beaches of the Tortuguero National Park and the Barra del Colorado National Wildlife Refuge. This area is known for sport fishing of sea bass, shad, and other species. The Barra del Colorado National Wildlife Refuge is complemented by a river system that joins the port of Moín with Barra del Colorado, which is both an attraction, as well as the only means of transportation. The refuge is known worldwide for its bird and turtle observing activities. The Limón province also exhibits a unique mix of beach, natural resources and Afro-Caribbean culture in the surrounding areas like Cahuita, Puerto Viejo, and Gandoca-Manzanillo, which are located in the southern sector of the tourism area. Here there are beautiful beaches where travelers can experience a mix of adventure and natural history. The area is also known for its coral reefs, multi-colored sand beaches (black, yellow, and grey), coastal vegetation and medium-high forests.
